>> in fact, people have gotten sicker and some have died. this is a 5th in a series of unilateral executive orders the president signed since he has been in office. the verdict is guilty for a man that killed a nonin a drunk driving crash. >> this is a case that has a lot of people angry and upset. it lead to an investigation at the department of homeland security. >> reporter: the issue is not that carlos montano is an illegal immigrant. he is 24 and lived in the country since he was 8. his defense attorney says he has a legal work permit but he was going through deportation. the issue is that he was a drunk driver that didn't learn from his mistakes. >> mr. carlos montano. >> reporter: a father of two small children pled guilty to five counts in the drunk driving crash that killed sister jeannette mosier. >> reporter: the two nuns in

the front seat were severely injured and left with life long complications. they hug a marine reservist that happened upon the scene and gave them first aid. >> had him sit in jail and think about what he has done. >> reporter: montano had a blood alcohol content of point 2 more than twice the legal limit when he struck a guardrail and smashed head on into the nun's vehicle. he pled not guilty to felony murder. his phone is arguing that he didn't mean to kill anyone. >> what he is not guilty of is felony murder. >> reporter: but because he had been convicted of twice before of dui, malice and intent were there. >> in taking an innocent life of a person applies to the felony murder rule, this is it. >> reporter: the judge agreed. >> i deny the motion to strike and find the guilty -- defendant guilty of felony murder.

>> reporter: montano's uncle says the family feels guilty they didn't take the alcoholism serious enough and force him into rehabilitation. his sentencing will be in february and the prosecutor will ask for a lengthy sentence of at least 25 years. >> everybody is taking it seriously now, peggy. thank you. to another trial in rockville. this is the brittany norwood trial where the jury heard painstaking details of evidence collection today including dna and blood splatter analysis. it's what the jury is not hearing that has so many people upset. andrea mccarron joins us live to explain. >> the jury will not hear about jayna murray's calls to a coworker and manager to discuss brittney norwood's theft from the lululemon store. the jury did hear plenty of shocking new details. late this afternoon, a montgomery county police

detective testified that on the night of the murder, apple store surveillance video showed two men, all dressed in black, wearing mask. that lead credibility to norwood's story. they through norwood on her body and told her it was all her fault. also revealed the most gruesome photo of the day, significantly more subdued in this sketch showing jayna murray's head completely unrecognizable. we learned that despite norwood telling police from her hospital bed she had not had sex recently, see man was found inside her body. the prosecution implied that norwood was so cunning, that may have been part of the plan lending greater credence to her tail of two masked intruders. a dna analyst testified that murray's finger nail clippings revealed only her own dna, evidence that what transpired between norwood and murray was

not a mutual fight. from the beginning, the defense strategy has been to say brittney norwood killed jayna murray but didn't mean to. her defense lawyer says in the heat of an argument she simply lost it. to talk about that, i'm joined by our legal analyst. you called it brilliant. why? >> it's -- it stunned everyone of us. the overwhelming evidence is that the murder was committed by brittany norwood what we don't know is that the jury will be tasked with reading her mind. what was she thinking. did she plan to do this. clearly this is not a murder for hire. will we see -- where we see premeditation. all the cover up activity, that is post meditation which is not the same thing. >> reporter: is the defense trying to he volk sim pay through for brittney norwood. today on cross-examination, the

an iconic washington tour operator called it quits after 42 years. tour mobile that operated the buses on the mall seized operations due to financial issues according to a u.s. parks service spokesman. as many as 200 employees are out of work. >> i never thought this day would come but it's quite a auspicious day for those of us who joined the company in its infancy to be here on its last day of operation. >> you can see why he is the narrator. the park service hopes to have a replacement service operating within weeks. visitors to arlington's expansive 640 acres will have to watch. coming up on 9news now,

the big night arrived. anny hong is live on connecticut avenue. you had quite a crowd out there. >> it has been that a little bit. it's winding down. we found great trick or treaters out here, a pizza slice and elvis out here for several years every halloween. earlier we had hundreds of trick or treaters of all sizes including little dogs. great homemade costumes, one including a starbucks latte cup and a family that dressed up as characters from madagascar. businesses have been donating candy. elvis has been here eight years, every year standing in
