florida, arizona, nevada, ohio. all hot spots on the foreclosure map and they account for 80 of the 270 electoral votes needed to win the presidency. so big question is how will voters struggling through the housing crisis ebb press themselves on -- express themselves on election day? today is the last day for virginia residents to apply for a mail-in ab sen see ballot. you need to get the request in by 5:00 tonight but if you want to vote absentee in person, you have until saturday to do so. d. c. police had a busy night last night responding to five shootings. >> the first happened in the 100 block of m. street northeast. the victim was conscious and breathing when police arrived. he's now at a local hospital. the second at georgia avenue in decatur street northwest. two people have serious injuries. around 10:12. a third shooting came in? northwest. a fourth was reported sometime later in the 2800 block of m.

and georgetown. the other juvenile male was shot and this time was in the head. a fifth person being shot in the leg. 1300 block of south southern avenue in southeast. one person is in custody in connection with the georgetown shooting. there's no word what their role may or may not have been. 4:32 now. a man already convicted twice for drunk driving has now been convicted a third time. a judge found 23-year-old carlos montano guilty of felony murder in the august 2010 crash which killed a nun and injured two more nuns. police say he had a blood alcohol level of more than twice the legal limit when he hit a guardrail and then smashed into a toyota corolla. sister jeanette mosier died in that crash. montano in the country illegally was awaiting deportation. we are now in the second week of the lululemon murder trial. >> both shocked and surprised us with the allegations and the revelations as it continues to

move forward. andrea mccarren with the latest. >> reporter: a significant defeat for the prosecution when judge robert greenberg ruled that evidence pointing to norwood's possible motive for the attack would be inadmissible. jayna murray allegedly called her manager who said norwood would be fired the next day but the jury will not hear any of that said state's attorney john mccarthy. referring to murray's call with her manager, the judge responded that's rank hearsay. also today blood splatter analyst testified the greatest volume of blood flew off murray's body on to the floor. the doctor testified murray wasn't in a standing position for long. because the bottom of her

tennis shoes had little blood on them indicating she didn't walk around the bloody floor. the defense, you would call it a quick timeline. doctor, yes? that was significant because the prosecution has been trying to prove that the 20 to 30 minute attack pointed to premeditation. andrea mccarren, 9news now. at 4:34. here's a look at other things making news now. across the northeast many residents are facing another day without electricity or heat. millions are still without power following this weekend's snowstorm. forecasters do expect temperatures to rise melting the snow and helping clean up efforts. the snowfall is also blamed for at least 21 deaths including one in canada. at the height of the storm more three million people were without power. five people are dead after two attacks near a united nations in kandahar. first an inurgent drove a pickup truck loaded with

explosives through a check point and then they touched off a gun battle with afghan and nato fors. that losted -- forces. that lasted more than two hours before they were killed. on saturday a suicide car bomber killed 17 people in kabul including a dozen americans. secretary of state hillary clinton canceled a trip to london and turkey because her mother is ill. she was scheduled to depart monday for a conference. a state department official says she will remain in washington. the specific cause of her mother's illness is being kept private. 4:35 now. coming up, bank of america reconsiders the fees it charges its customers. at 4:48. holes in our region are going to cause some of you a little more money beginning today. before that we're back with your weather first in two minutes.

starting today to discuss the direction of interest rates. ben bernanke will hold his news conference at the stop of the meeting and most believe the fed will leave rates unchanged but wall street wants to know if they have any more plans to buy u.s. bonds to prop up the u.s. economy. he is also expected to comment on the recently announced deal to contain europe's debt crisis. on wall street yesterday. john core sine's firm filed for bankruptcy protection after leaving the new jersey governor's office the former head of goldman sachs took over. last week the company's debt was downgraded to junk status. bank stocks fell on news of the bankruptcy and that dragged the broader market lower. checking the ugly numbers from wall street yesterday, the dow standing this morning 11,955. that's after it dropped 276 points. the nasdaq tailed off 52

points. the s&p 500 was down 31. still though, wall street wrapped up one of its best months in 20 years. now to bank of america. reportedly considering dropping the $5 monthly charge for customers who make purchases with their debit cards. last week jp morgan chase and citigroup announced they would not charge customers a fee for using their debit cards. honda says parts from shortages from flooding in thailand have forced it to cut car and truck production by 50% in the u.s. and canada until early november. it could also delay the december sale date for a crossover vehicle. macy's opening at midnight on thanksgiving joining target for holiday shoppers who want get a jump-start. many are announcing extended hours during the most important shopping season of the year for the retailers. who's going to be there at midnight? >> no. >> we know some people will be. >> we know.

daylight saving time kicking in. by noon weaver in the mid 50s and sunshine and northerly winds all day. 5 to 10 miles an hour. 3:00, 58 and by 6:00 at 56. we're expecting highs today anywhere between 57 and 61. overnight we watched storm system just clip us to the south and east. had some clouds here in town. we did have some showers especially east of us and this morning we're still looking at a few showers off to the east places like davidsonville and bowie, calvert county. down across the eastern shore especially welt this morning with temperatures -- wet this morning with temperatures with the clouds and showers in the mid 40s at easton. 48 in town but look to the west, skies have cleared and temperatures have dropped big time. luray winchester in the mid 30s. in gaithersburg right now, we sit at a chilly 40. at reagan national, clouds, 48. north winds at 6 and the dew point at 43 and a windchill, little bit of a windchill this morning feeling like 45. nationally the country's pretty quiet.

we've got one front stretched out here from salt lake city up to the northern plains there through bismarck and minneapolis and some showers. other than that, the only other thing we're watching again is a system just off to the east, there's not much weather that will be coming toward us. we'll get rid of this system and behind it look at this. the next couple of days look fine. it's going to be the front up in the northern plains which may give us a few showers as we head to friday. the futurecast, this morning the showers off to the east, parts of prince george's county, calvert, anne arundel, you can see that. and anyone east of the bay will be dealing with that. he had a couple of sprinkles on the windshield overnight. that's about it. here we are this morning, 11:45. lots of sunshine here. the showers are off to the east, a few clouds in the mountains this evening it's all quiet 6:00 p.m. you've got plans today or want to get rid of the snow in the yard? it will be melting pretty quickly. slight chance tomorrow morning

a few sprinkles or flurries actually up in the mountains well north and west of d. c. with a little bit of warmer air trying to move in but overall wednesday is another sunny and nice day. on thursday in the morning it will be approaching detroit and toledo. in fact i think thursday will be the warmest day of the week as temperatures shoot toward 65 perhaps. and by thursday afternoon, 4:45, some showers columbus up to pittsburgh. if this system holds together then thursday night into friday that's when we'll have a chance to get some showers around here. but nothing -- nothing terribly heavy at this time. temperatures this afternoon, we'll be around 59 at d. c. for the high. winchester 57 along with cumberland. and a couple of 60s in tappahannock and fredericksburg and even manassas and eastonment 61, maybe 62 degrees and then a chilly night tonight back in the 30s for most of us, today 59, tomorrow 60. thursday 65 and a couple of clouds late in the day.

the other corridors. a live look at the beltway in pennsylvania avenue. no problems here down to the wilson bridge and over into alexandria. well go into the district the next time around at 4:45. andrea and mike? maryland drivers it's going to cost you more to drive around. two stories that are going to give you examples why. first you will pay more at tolls across the state. cash tolls are now $1 to $4 at the chesapeake bay bridge on route 50. and the nice bridge on route 301. the cost is now $3 at the fort mchenry and harbor tunnel as well as the key bridge in baltimore. the good news is slight discount for drivers who use the maryland ez pass. here's another reason why. three months into the ticket amnesty program and the city's department of motor vehicles says more than 35,000 people have come to pay the outstanding tickets. that's brought in nearly $2 million in revenue. who paid the most?

you, maryland drivers. you owed the most followed by d. c. and virginia residents. new regulations could be coming down the line for informal curbside buses. >> we have more. >> reporter: she is still in mourning for her mother and father. >> they never come back. they'll never -- everything we touch we're thinking about them. >> reporter: her parents were among 15 passengers killed last march during a gruesome crash in new york. the bus rolled over after striking a barrier. a sign post tore off the roof. the bus was operated by one of an estimated 70 low cost carriers in the u.s. known as curbside buses which for a low fare pick up passengers on the street instead of designated bus terminals for travel to major cities. >> just a cheaper way to travel and usually you know they're all on time and get through safely. >> reporter: but in a new study

the national transportation safety board reveals concerns over the bus line safety records. according to the study bus carriers that pick up and drop off passengers are seven times more likely to be involved in fatal crash than those that use traditional bus terminals. >> these crashes waved a red flag about the curbside carriers. >> reporter: in the last six months 22 fatalities and 159 injuries happened with curbside buses according to the ntsb. the senator chuck schumer of new york wants them graded on a safety scale and posted on each bus. her parents only wanted a better life after moving from hong kong. >> we come here looking for happiness. futures and everything. >> reporter: but their lives were cut short on a bus side. bee gad sha ban, cbs news, new york. >> it agrees and strongly supports better oversight for curbside operators. company officials are hopeful the ntsb's report will help

jump-start bus safety legislation. today, students from st. mary's college are hoping to move into their new cruise ship dormitory. they were set to move in monday but the coast guard found a problem with the way the sea voyager is docked to the fear in st. mary a -- pier in st. mary's city. the clean-up of that could take months. the college decided rather than scatter the students in rented moe toles why not put them all aboard a rented ship? president obama is stepping in to help control the drug shortage crisis. >> yesterday, the president signed an executive order instructing the food and drug administration to take immediate action in three areas -- broaden its reporting of potential drug shortages, speed up reviews of applications to change production of drugs in trouble and report any possible price gouging. the fda reported 178 drug shortages last year and that number is continuing to increase this year.

some patients have died as a result of the shortage. a new study suggests children of military personnel may be more prone to violent behavior. a survey of teenagers in washington state found the kids whose parents have been deployed are more than twice as likely to carry a weapon or be in a gang or be involved in a fight. doctors think stress may be the reason. there's new evidence yoga can be effective for lower back pain. british researchers found patients showed both short-term and long-term improvement with back pain. they compared the results to patients receiving conventional medical treatment like painkillers. 4:54. before we head to break, time for a look at the question of the morning --
