fatally beating murray inside the lululemon shop in bethesda. our andrea mccarren joins us now from rockville with more information. andrea? >> j.c., right now, the jury is looking at some of those gruesome color autopsy photographs depicting the 331 injuries suffered by victim jayna murray. the medical examiner testified that jayna murray was alive for all of those injuries. her heart was beating. she had a pulse. blood was flowing to her wound. it was a stunning decision, j.c. by the judge this morning, despite defense objections to allow the jury to see any of those autopsy photographs. ultimately, he had decided that the jury would see nine of the 37 that the medical examiner took during the autopsy. joining me now is our legal analyst jeanie cho with more on

that. the extreme impact, i'm sure. >> andrea, my nearly 20 years as a prosecutor and defense attorney, i've never seen photographs that were that savage, that were that evil. >> i must say as well that the murray family, for the first time since this trial began, actually left the room. the norwood family, it was brittany norwood's -- both of her parents as well as one sister in the courtroom, both her mother and her sister left the room. >> the jury noticed that. there's no question. two rows deep and they were all gone when they came back. it would be incredibly difficult for the jury to ignore or forget those pictures and think about the catastrophic injuries that were caused by the metal rot that caused injuries, deep, deep inside her brain. >> reporter: in addition to the fact that the medical examiner has said in the past that there were more defensive injuries meaning holding up her hands and arms than she has ever

seen. 105. >> extraordinary testimony. it tells you that somewhere between any one of those blows, she formed the intent to kill. >> we'll see jeanie cho, what this means, in terms of the prosecution trying to prove premeditation. we'll have more on that. thank you so much, coming up tonight at 5:00. live if rockville, andrea mccarren, 9news now. >> thank you very much, andrea. murder suspect curtis lopez is reportedly heading back to montgomery county to face murder charges. he has been locked up in north carolina following the murders of his estranged wife and his stepson. jane mcquain was found murdered in her germantown, maryland, apartment last month and the body of william mcquain was found days later in a wooded area in clarksburg. police in prince george's county are looking for a killer. they would like to find the man who killed one person and wounded another. the shootings happened last

night after 8:00 at the penn forest shopping center at pennsylvania avenue and walters lane in forestville. police found 27-year-old anthony washington shot dead. witnesses say that he actually lived in that area, a woman was also shot. she is expected to survive. police do not know what prompted the shooting. montgomery county leaders held a hearing on whether to make big box stores like walmart and costco adhere to special guidelines. one county proposal would dictate a store's size, its design, hours of operation and local hiring practices. opponents fear that too many restrictions could drive away developers. however, supporters say big box stores should not destroy a neighborhood's character. >> to give a voice to those communities and neighborhoods that will be potentially impacted by large, big, megabig

box businesses coming into their communities. the county proposal would apply to stores that are at least 75,000 square feet larger than a football field. >> president obama is pressing lawmakers to act now. the part of his jobs plan designed to repair aging roads, rails and bridges. he's urging congress to pass his american jobs act. danielle nottingham has more on the president's plan to repair aging infrastructure like the key bridge. >> reporter: president obama's pushing congress to sign off on part of his jobs plan pay for repairs to the rails, roads and bridges. >> right now, what we have to do is put people back to work. >> the president insists the bill's $60 billion price tag is money well spent. it upgrades the nation's infrastructure and could put hundreds of thousands of people back to work.

the white house wants to pay for the plan with a new tax on individuals and couples making more than a million dollars a year. that idea is not sitting well with some lawmakers who say the president is more focused on winning votes than creating jobs. the good news, actually, come to washington and be focused on trying to help pass bills that would create a better environment for job creation and help put the american people back to work. >> it is not just republicans standing in the way of getting the bill passed. the white house will have to win over some democrats who share those concerns about new taxes. in recent weeks, the president has side stepped congress to put new economic proposals into action. but he'll need lawmakers' approval to get his infrastructure repair plan underway. danielle nottingham, cbs news, the white house. the senate's top democrat plans to bring the infrastructure plan up for a test vote later this week.

well, republican presidential candidate herman cain is campaigning in northern virginia. he spoke at the northern virginia technology council in alexandria. right now, he is fighting off sexual harassment claims after two women allege that they received financial payouts from the national restaurant association. cain has denied any sexual harassment took place. last week, the other republican front-runner former massachusetts governor mitt romney made a campaign stop in northern virginia and he was joined by governor bob mcdonnell. traffic relief could be coming to us because roads in fort belvoir in bethesda have increasingly gotten worse when the pentagon moved thousands of jobs to those spots. the department of defense has now given nearly $270 million to help keep us moving. surae chinn reports from bethesda. one of the routes is getting help. >> i can't get out of the

street. >> delores knows just how the base realignment project has changed people's lives, including hers. she lives across the street from the new walter reed national military medical center in bethesda. >> your habits have change and so has everybody else on the street. >> it is a lot different. it just sits and sits and sits. >> gridlock. gridlock between tree and sixth. >> but there is relief. tens of millions of dollars will improve the roads around these two top military hospitals. fort belvoir community hospital in fairfax county received $180 million to widen route one. walter reed gets $90 million, more than half of which will go toward improving four intersections. the rest will go into building a metro access tunnel under route 355. >> lovely. i really nice. i can approve of that. >> i'm an optimist. hopefully it will get better. >> i don't know in what way will it ease. i don't know how. i think it will only get worse. >> if there is light at the end

of the tunnel, wusm. if it were to get worse and stay that way, that would be really bad. >> reporter: unfortunately, some of the projects will take a few years to complete and some may not start construction for a couple of years. in bethesda, i'm surae chinn for 9news now. by the way, the bethesda metro tunnel construction will not begin until 2013. it is expected to take nearly two years to complete. still to come when the news continues, he was found shivering in the woods of virginia but today, 8-year-old robert wood jr. is fine. doctors will keep the little boy in the hospital a little while longer. we'll explain. rules on the extradition case of wikileaks founder julian assange. i'm rita nissan. the story is just ahead.

wikileaks founder julian assange lost his appeal against extradition to sweden to answer sex crime allegations. rita nissan reports that his attorneys are considering whether to take their fight to britain's highest court. julian assange walked out of britain's high court, calling the ruling against him merely technical. >> i have not been charged with any crime in any country. we will be considering our next step in the days ahead.

>> reporter: two judges ruled assange should be extradited to sweden where he's wanted for questioning in the alleged sexual attacks of two volunteers for his web site. the wikileaks founder says the encounters last year in stockholm were consensual. the 40-year-old created a firestorm in the u.s. when his whistle-blowing web site published thousands of secret diplomatic cables. the state department says americans were put at risk. he could face charges in the u.s. assange has 14 days to appeal to britain's supreme court. from the beginning, he has argued that his critics were behind the allegations. >> it is disappointing but in a sense, not surprising. julian has made some powerful enemies. >> he might end up in the united states. >> assange remains free on bail under virtual house arrest at a friend's country estate in southern england. rita nissan for cbs news, london. in addition to his legal problems, assange's wikileaks

>> 8-year-old robert wood jr. remains hospitalized from richmond. he's being treated for a hole in his esophagus. the child's grandmother believes the tear might have been from something that robert ate while he was in the woods. he wandered off from his family on october 23rd while on a walk at north battlefield park and he was found friday. for the next couple of weeks, you probably will notice
