>> as far as the accusations cause me to back off and maybe withdraw from this presidential primary race, ain't going to happen. >> sharon bialek was clinical in her allegation. >> and he put his hand on my leg under my skirt and reached for my genitals. he also grabbed my head and brought it towards his crotch. >> my first response in my mind and reaction was, i don't even know who this woman is. these unanimous allegations are false and now the democrat machine in america has brought forth a troubled woman to make false accusations. >> he also rejected the settled allegation of karen kraushaar. >> that is the one that i recall that file add complaint, but it was found to be baseless. >> he was accusing rick perry

now, he's accusing the democrat machine. he was willing to take a lie detector test, but it doesn't sound like he is willing to do it right now. he's not just facing these unanimous allegations anymore. karen kraushaar, the federal employee and registered republican from germantown tells the washington post that now that her name is out there in the public, she wants to hold a news conference with all the other women so that all the allegations against cain can be reviewed by the public as what she calls a collective body of evidence against him. >> and that would be a revelation, because as you know, it is rare that women step forward to make any kind of sexual harassment claim for the reasons that have been layed out for the other women remaining unanimous. that their lives would be torn apart. that their stories would be torn apart. so to hear of this particular accuser suggesting that all four of them come together, it sounds like this is not going

anywhere any time soon. >> sounds like it's drip, drip, drip, but lynwood who is the attorney for cain and the attorney for richard jewel, the olympic bomber, he held this against him. he says, you know, i wouldn't parade my clients out in front of them and that makes it sound like it's not true. we'll see. it's going to go on and on. >> bruce, thank you for that. anita. >> new at 6:00 tonight, an appeals court says president obama's healthcare plan is unconstitutional. the u.s. district court of appeals for the district of columbia upheld a lower court's ruling that congress did not overstep its authority by requiring americans to have health insurance or pay a penalty. that law is set to take effect in 2014. the supreme court could decide by thursday if it will take up the case. today the high court focused on another issue out of d.c. can police use a wireless gps to track a suspect without getting a court order first? bruce johnson is live in northwest with more on the

argument. >> this case is getting a lot of tang of attention from diverse groups. the fbi is standing on the corner. they're watching you. they can follow you without a court warrant, right? nothing wrong with that. what if they attach a gps device to your vehicle and don't tell you about it? is that going too far? that's exactly what the supreme court is being asked to decide right now. let's face it, local and federal police already able to watch mess of us on camera or on the public streets. but should police be allowed to track a suspect using a global positioning system that has been secretly placed on his car? that's what happened to antwon jones, a dc nightclub operator that led authorities to a stash of drugs and weapons. >> this is fundamental police work. >> these cars driving by us right now, they don't have an expectation of privacy. they are tracking them on public roads. >> the issue of privacy in

this 21st century was front and center. did police violate jones' constitutional gain constitutional guarantee against unreasonable search and seizure. >> the police without his knowledge and without his consent installed a device on his car, which would be a criminal trespass if any of his neighbors did it. >> he is still in prison. he served five of life sentence and he doesn't get out unless the supreme court rules against the government. >> justice soledo wanted to know what is the difference between following someone for 12 hours and monitoring someone using a gps for 12 hours? >> we aren't saying don't use a gps. if you are going to use it, get a warrant. >> chief justice roberts said how far police could go in such investigations. if authorities wanted to track the justices, if you put a gps on all our cars and monitored our movement for a month, would that be okay? justice department lawyers said yes. the fbi could put surveillance

on any individual. obviously an appeals court overturn thad conviction. that's how it got to the supreme court. now the attorneys for the government didn't come out for comment today. the supreme court could rule on this by spring, we're told. anita, back to you. >> interesting debate. bruce, thanks so much. a shocking new development in the penn state sex abuse scandal. the "new york times" is reporting that the university football coach, joe paterno may be out of a job. anny hong is live in the satellite center with details. what happened this afternoon? >> they are saying that he could potentially be out of a job very soon, days, perhaps within weeks according to that report from the "new york times," siting two people who had conversations with top university officials. now the report comes after the university canceled a weekly news conference with paterno shortly before it was scheduled to start earlier today. it was supposed to be the first chance for reporters to ask paterno about the sex abuse scandal involving his former

assistant coach, jerry sandusky. he has been charged with sexually abusing eight boys across a 15 year period. and paterno has been widely criticized for failing to involve the police when he learned in 2002 of an allegation of assault on the young boy. now meanwhile, scott paterno is telling reporters that his father had no talks with penn state officials or trustees about stepping down. he told reporters outside his father's home today that joe paterno plans to not only coach in this weekend's game, but is in it for the long haul. meanwhile, another potential victim has contacted authorities after seeing sandusky arrested recently. the board of trustees will have to detail the exact timing. talks how to manage the departure are apparently already underway. their next meeting is friday. derek. >> moving very, very quickly. tonight at 7:00 on 9news now, a

>> control of the state senate hangs in the balance. peggy fox is here with a closer look at the impact we could see from today's elections. that's up, too. >> you know, what's more important than the education of our children? control of the fairfax county school board could change hands. nine out of 12 seats are up for grabs. several of the challengers are parents who are angered by several recent controversial decisions, such as boundary changes, the discipline policy and elimination of honors courses. there's been controversy over how the school system spends taxpayer money and whether the school needs an increase or not. if you live in fairfax county, you can find interviews of school board candidates in all the races right on our website on the front page. >> let's talk about the virginia state senate race. how close are the republicans to gaining control? >> if the democrats lose just three seats, the gop will have the clear majority and will then control all the governing bodies in richmond.

here are a couple in our area where sparks have been flying. vying for the seat is republican businesswoman, karen merrick. a first time candidate and tea party favorite against democratic, barbra, who has been a member for 14 years. the 31st district comprises arlington and part of mcclane. now in the 39th district, it is republican miller baker challenging senator, george barker. if the senate flips to gop control, it could mean a turn to the political right on a number of social issues, such as abortions, same sex marriage. former congressman believes if republicans have total control in richmond, it will mean a strong it happens plan, because the party will be held accountable if it doesn't come through. >> let's say there is republican control. what does that mean for the governor? >> great news. bob mcdonald's final two years in office and his political legacy rests on the outcome of

this election. mcdonnell has been mentioned as a possible gop vice presidential candidate. his stock certainly rises if his party controls the entire state government. consider this, if republicans win complete control of the general assembly, it will be only the second time since the civil war that their party has simultaneously held the governor's mansion, house, and senate in virginia. pretty incredible stuff. >> we'll be looking at those races, lots to talk about and have the latest tonight at 11:00. >> thank you. okay, one of the key races in maryland is the city council contest in bowie. there's a council race in college park and in greenbelt. voters are deciding whether it's time for a new mayor. they are also voting in a city council race. lots to talk about. we'll have it through the evening. and watching two big votes in other parts of the country this election day. in ohio, voters are deciding the fate of a law that limits the ability of 350,000 unionized workers to engage in collective bargaining.

and many mississippi, they are weighing in on a constitutional amendment that declares that life begins when an egg is fertilized. if it passes, that could set up a new challenge to the roe versus wade supreme court decision on abortion. anita and topper. >> we're going to start weather with talking about a really, really big rock. >> a big rock, yes. it's going to miss us. we want to mike sure we are clear on that. you won't be able to see it with the naked eye. 6-inch telescope, you might be able to see it. it's going to be clear. the problem is, you are competing with the full moon. another ten minutes or so. but here's the deal. it is hurdling at 29,000 miles an hour. it's the size of an aircraft carrier. it's going to be closer to us than the moon. it's going to be about 200,000 miles away from the earth, which is sort of close in terms of space. but you are going to need at least a 6-inch telescope to get a picture. and it's moving so fast, the

hobble telescope won't be able to capture an image. >> good thing it's missing us. >> we'll have something for you tomorrow. let's start with the satellite picture combined. three things, first thing is this huge storm in the baring strait. perhaps hurricane forced winds, a tremendous amount of snow inland. not so much toward juno, but north of that a tremendous amount of snow and some winds at least 60 miles per hour, possibly gusty to 70. now this is the second thing we have to point out. this was producing severe weather this time last night, through oklahoma, into kansas. still packing a pretty good punch. some big thunderstorms in southeastern sections of missouri and northern arkansas. it looks impressive. that's the same front that will get here. it's not going to have much punch in terms of moisture. this is tropical storm shawn, which is in the atlantic. it will pass to the west of bermuda, but not affecting us.
