has donated. >> reporter: some reports say the school president will also be forced to resign or at least to take a demotion. two penn state officials, the ones the coach reported to, have already been charged in the alleged cover-up. that threat speak director and a vice president have already resigned from office. derek? >> thank you, bruce. protests already underway in hawaii after a virginia man who is also a state department special agent is released from jail. he is accused of shooting and killing a man over the weekend. the 27-year-old was released monday after posting $270,000 $270,000 in bail. he was in hawaii to provide protection for dignitaries at a conference. late tuesday, nearly 70 people marched in honolulu holding signs remembering elvis. he was 23 years old shot to death inside this mcdonald's in waikiki early sunday morning.

>> it was just like my god. >> reporter: police said four men were involved in some sort of argument at that mcdonald's when the shooting occurred. the next court appearance november 17th. the state department saying he is on paid administrative leave. tonight republican presidential candidates will again take the stage. they have got yet another debate and this time it is in michigan. and they will be talking about the economy. however, herman cain likely could face more questions about the claims that he sexually harassed four women while he ran the national restaurant association. and a new poll out there tonight showing all those accusations have hurt his campaign. according to ras a poll 37% support cain. that would be a flip from last month because in the same poll in october cain actually led the president by 2 points. right now we are still waiting to hear if there will be a recount in virginia's 17th

district. just 86 votes separate republican bryce reeves and the democratic incumbent in the race. republicans will gain control of the state senate if reeves is declared the winner. each party would hold 20 seats and then the republican lieutenant-governor would be a tie breaker on votes. now, assuming reeves does hold on to win, republicans would then have complete control of the leverage of power in virginia state. marjorities in both houses of the general assembly the republican in the governor's mansion. democrats did pick up a couple of wins yesterday in kentucky and ohio. we need to figure out what it all means for next year's congressional elections. we are joined by a columnist and paid political consultant for the republicans and in virginia you could argue that holding all the leverage of power could be a two-edged sword because now you've got to produce. >> exactly. that's what the american people are saying. tired of the partisanship and bickering. dealing with the deficit and

budget. i think it will be interesting if virginia is flipped to the republicans. >> let's talk about president obama in virginia. he won that state for the first time since johnson won it in 1968. the fact that republicans are doing so well there, does that bode ill for him in 2012? >> i think it does because obama had the convergence of a perfect storm last time in '08. i don't think he will be able to replicate it with the health care issue going through the supreme court, with the economy being what it is, with the heavy military population throughout virginia. i don't think obama is going to take virginia. but also, i think virginia is indicative of what happened in north carolina where he won last time as well because the states are similar. >> let's go to ohio where governor john casey could put together a very strong bill. it was overturned very strongly in a referendum yesterday. could that be a harbinger in state of ohio for president obama? >> i disagree with that.

the governor of ohio, he lost the vote on the amendment or the bill. but i think the conversations with the unions have totally shifted from when the union goes to negotiate with the governor it is not what are you going to give us, governor, but how much are we going to give back now? so the dynamic has changed in wisconsin and in ohio. >> the fact is 60 some odd% of the voters said we don't want this bill, and he even said when the voters speak i have to listen. >> no question about it. he has deposit a black eye it. no question about it. i think it weakened the leverage going forward. >> let's talk about herman cain a little bit. you have written you think he got a raw deal from the media. do you still leave that now that four women are coming out saying he did something wrong? >> they are alleging he did something wrong. i have not seen any facts to verify that he did something wrong. and that's the issue i have. if the women have e-mail traffic, if they have written

documentation, if they have a video. show me proof that you were upgraded by herman cain. then we can have that conversation. >> what about the payoff the two of the women that work for restaurant association, doesn't at least say there is smoke in the room if not fire? >> well, it is common in business to do what we call a nuisance settlement. sincere much cheaper to pay these women off. >> we appreciate your time. we will see how it turns out tonight in that republican debate. will the case of herman cain be discussed even further? we appreciate your time. let's move on to prince george's county where the decision to relax a grading policy for high school students who play sports is catching some in the community by surprise and they are angry about it. now, we first told you about this last night and now the school system is trying to explain why they did if and how it can help students. >> i'm andrea mccarren in prince george's county where high school athletes with a 2.0 grade point average will soon

be able to fail a class and still play sports. >> when i went to school if i didn't have a good gpa he wasn't playing. they sat me down. >> reporter: starting november 15th prince george's county student athletes will be allowed to fail one class. and still stay on their sports team. as long as they maintain a 2.0 grade point average. >> i don't think their schoolwork and their education should suffer for the sake of being on a sports team. >> i have a grandson and he loves to play sports but i'm always telling him you need to study because you are going to need your education in case something goes wrong. >> reporter: not everyone agrees. >> well, education is not just in the classroom. it is also out here on the athletic field. self-esteem. discipline. time management. >> reporter: kicking an athlete off a team has not worked as an academic incentive. >> the state of maryland only requires the students make progress towards graduation to be able to play sports.

you christmas tree lovers out there can breathe a sigh of relief. the obama administration delaying a proposed 15 cents fee on all fresh christmas trees. word of the so-called christmas tree tax came out this morning. the department of agriculture proposed the idea and planned to use the money brought in to launch a promotional campaign to improve the perception of christmas trees. kind of like that got milk campaign. now that's been put on the shelf. the agricultural department will revisit the fee later on. no fee for now. no extra costs for your tree but what do you think about the

all right. two weeks to go and by then the full length of the icc will be open in the state of maryland connecting gaithersburg over to laurel. first part opened pack in january. today we got a sneak peek at the rest of it. i'm scott broom in montgomery county taking a look at the always controversial icc highway about to open november 22nd. the project director for construction is conducting a bus tour of the latest 10.3- mile section of the road the critical link that will connect gaithersburg. >> you have to have an easy

pass to ride the highway. >> reporter: the executive secretary of the maryland transportation authority is reminding everyone this is maryland's first all electronic cash free toll road. >> the time savings will be very significant. cutting the travel time, for example, from gaithersburg to vwu airport from 71 minutes to 37 minutes. >> reporter: end-to-end during peak hours one way the toll will be $4. in montgomery county, scott broom, 9news now. a bicycle traveling 57 miles per hour unless it is on a really, really steep downhill. that sounds pretty much impossible. the town administrator says one of the city's speed cameras caught that happening this summer. it was in a letter he sent to the company that runs or used to run the speed camera program. complaining about the accuracy of the cameras. that letter and others like it were obtained by the washington times this week. they are standing by its

cameras and the errors happened because town personnel did not understand the equipment. the company still provides speed cameras for prince george's county and 12 other municipalities. this video likely brings back some really bad memories for all of us. the january 26th ice storm caused massive gridlock, hundreds of abandoned cars out on the road, the rest of everybody else just sitting in traffic dying to get home. well, now regional leaders have come up with a plan to help ease that congestion and hopefully make for a smoother way even if we get another afternoon storm. the first major change is over at the office of personnel management. they are got a new dismissal policy for federal workers. >> now we add an end time to that. leave two ours earlier but no later than, for instance, 3 p.m. and if you don't leave by 3 p.m. be prepared to stay a few extra hours. >> okay, so you'll have to stay until the plows clear the roads. there is also a plan nor backup generators for traffic lights because you remember how many

lights were out. first responders are working on an emergency app for smartphones and a new regional website is in the works to help get information out to the public a little bit faster. i don't know how much all of that is going to help. we can hope. >> here is the thing. i just tweeted about this. i have done talks about this. you can't make policy overcome human nature and the human nature was, even though we said you'll have a hull in the storm they waited until the snow started flying and by that time it was too late. >> we didn't really believe it was coming. >> believe it or pay the price. >> because you guys are right 100% of the time. >> we were today. sunny and 64. we were today. let's look at the satellite picture and radar combined. we will zoom into the great lakes and it has got a cold front and it will roll through tomorrow. we talked about this earlier. monday and tuesday this was a massive cold front producing severe weather out in the plains. it keeps getting weaker and weaker as it moves eastward so we are going to see a skinny

line of showers going through tomorrow and they will be light an kind of few and far between. certainly nothing after the evening commute. i think the evening commute will be dry. clouds on the way in now. showers may creep into the mountains before midnight. that's about it. temperatures very nice. we are still looking at 53 in bethesda. 55 arlington. unlike the past few months when temperatures have fallen like a stone. temps not so bad tonight. 56 in rockville. 48 up in gaithersburg. and 51 in laytonsville. cool tonight. a few showers on thursday. the best chance going to be a little window between 10 a.m. and 2 p.m. ry for veteran's day. that will be the significant of this front not so much how much shower activity we get but the winds on friday and much colder air on friday. so by midnight tonight, some clouds roll in. all the showers back in the mountains. and then we get into the 7 p.m. hour. some showers south and east of town. you might have have a wet commute if you're coming up 3 or 5 from southern maryland but

then we see this skinny line of showers develop right around 1:15. it is all green so it is all light. nothing really heavy but it may impact your plans for lunch. and then the clouds kind of linger but the showers race out of here. look what happens. rain showers turn to snow west of the divide. late tomorrow, tomorrow night. and they continue into early on friday monk. so for tonight, increasing cloudiness, just cool. low temps in the 40s. winds south-southwest at 10. by afternoon partly sunny, breezy, cool. a few showers in the morning. primarily late morning. 40s an 50s. winds become northwest at 10 to 15. by afternoon showers ending pretty early. highs 55 to 59. a little bit deceiving though because these northwest winds of 10 to 15 will cause the temperatures to fall a little bit in the mid to late afternoon hours. so we will break it down for you. 40s to start. some showers. 54 to 59 by noon some showers. most of the showers gone by 5 p.m. 50 to about 55. the next three days here is

that blustery day on friday. only 50. that might be generous actually. back up to 59 milder on saturday. another nice november weekend. by sunday we are back in the 60s. couple of showers possible next monday and maybe even a thunderstorm next tuesday. temperatures remaining warm. in fact, we are flirting with 70 on tuesday and hanging around 60 on wednesday. >> can you keep it going through thanksgiving? we will be back.

in the mail bag tonight. prince george's county to allow public school kids to play sports if they fail a class. previously one failed class meant you couldn't play and one person from prince george says what are they thinking? this has to be the dumbest thing i have heard. they have already lowered the gpa to 2.5. my son played football for four years and from day 1 i told him he will not be a dumb jock. i guess prince george's county does not have the same morals. i am so disgusted by this. but linda says she begs to differ. not every student can excel at class work but they can excel at sports. anything that helps them have self-esteem and a sense of self-worth is good and keeps them on the field instead of

getting into trouble with idol time. prince george's county had some of the toughest standards in the state. this change merely brings them in line with a lot of other jurisdictions including i should note montgomery county. plus, a story that has a still a lot of you fired. the penn state sex abuse scandal. joe paterno we learned today has volunteered to resign after the season is done. ron from maryland says that is not soon enough. joe paterno's focus forever has been football, football, football and winning, winning winning. john from green belt doesn't understand all the focus on joe paterno? it is not as if joe was an eyewitness. he had hearsay evidence and may not have believe ited. however he did follow policy and passed it on to his superiors. if they didn't act then they are wrong, not joe. maybe the higher ups are using
