paterno, law enforcement is investigating but says rockville lawyer wendy satin. >> he did not witness any of the alleged crimes. he went to his supervisor and reported what he had heard and that's what he should have done. moral wrong doing and ethical wrongdoing are different questions. but i don't believe that mr. paterno is at risk of any criminal prosecution. >> gary nurenberg, 9news now. >> paterno has reportedly contacted a criminal defense lawyer here in d.c. about the case. according to cbs news, paterno's son tweeted to be clear, no lawyer has been retained. not sure where that report originated. defense secretary leon panetta says he will consider harsher punishments for the three people who are being held responsible for mishandling soldiers remains. >> the air force says on two occasions back in 2009, the dover mortuary lost body parts of fallen soldiers to air force

also admitted between 2003 and 2008 some body parts of fallen soldiers were cremated then dumped them into a virginia landfill without the permission of the soldier's families. the commanding officer of the dover mortuary at the time of these incidents is now working at the pentagon. he was given a letter of reprimand. two of his top civilian deputies took pay cuts. venezuela's justice minister says washington nationals catcher wilson ramos is alive and he's vowing to catch his abductor. 24-year-old ramos was visiting with family when four armed men abducted him. bruce leshan spoke to a venezuelan newspaper columnist about the kidnapping. he said even though kidnappings are common in venezuela, most of them end peacefully. >> the fact that so many of these are about money and that maybe somebody will give these people enough money to release him. >> basically, that would be like our best hope because the statistics shows that 98% of

the kidnaps here in venezuela end up in a good way. the hostage being released and everything is ok at the end of the day. >> now, this is the first known kidnapping of a major league baseball player in venezuela. police say they have sketches of two of the four suspects suspected abductors. they also found a get away car but no clear leads at this point. the 20-year-old man responsible for a crash in olney last may which killed three people has pleaded guilty. kevin coffey pleaded guilty to three counts of vehicle manslaughter and one count of fleeing a scene of an accident involving death. haeley mcguire, 18-year-old spencer datt and johnny hoover were killed in the crash. their up as read broken bones, crushed skulls and severely damaged organs. when i got home today, johnny is not going to be there. i'm not going to be able to call spencer.

i'm not going to be able to see haley around. >> johnny was full of life. he was always smiling. you know, you can't find someone that did not like my little brother. >> he had been drinking at two parties before getting behind the wheel. he fled the crash scene on foot without calling for help. he will be sentenced on january 5th. he faces a maximum penalty of 40 years in jail. republicans now control the state senate in virginia. yesterday, seven turned democrat ed houck conceded to bryce reeves in virginia. houck finished just 222 votes behind reeves but he's decided not to request a recount. republicans and democrats now each hold 20 seats in virginia's senate. republican lieutenant-governor bill bolling would break any ties. allegations new congressional districts in maryland dilute the black vote. that's leading to nine people filing a federal lawsuit against the recently approved redistricting plan. the group is represented by

fannie lou. the second lawsuit filed against the plan in the last two weeks. here is a look at some of the other things making news now. the federal government is delaying plans for a controversial oil pipeline. thousands of people demonstrated last weekend here in d.c. against the project. the pipeline would carry oil from canada to refineries on the texas coast. now, the state department wants the developer to reroute the pipeline around environmentally sensitive portions of nebraska. rupert murdoch's son, james, grilled by lawmakers in britain this week, the news corps insisted he was not aware of widespread phone hacking at the now defunct news of the world tabloid. one compared murdoch to a mafia boss saying the company operated under a code of silence. the lawyer for the prime suspect in the disappearance of robin gardner has quit. mike bal lopez was representing gary giordano and jose baez.

casey anthony's lawyer has taken over the case. giordano still insists he's innocent. he claims robin gardner was swept out to sea while snorkeling. giordano in due back in court. >> president obama will mark veterans day with a wreath laying ceremony at arlington national cemetery and later, he and the first lady will travel to san diego where they'll attend the michigan state/unc basketball game aboard the u.s.s. carl vincent. metro has closed four stations along the green line. the waterfront, navy yard are all closed. they'll remain closed until the system opens monday morning. buses will replace trains between fleant plaza and southern avenue station so track work can be completed. coming up in about five minutes, new discount grocery store is opening today in the district. >> google as a medical tool? very well could happen. >> we're back your weather first. stay with us.

jessica, back to you. thank you, monika. i'm watching your money. wall street hoping to head into the weekend with gains but it will continue to keep a close eye on europe today for more signs of trouble in the region's debt crisis. checking the numbers, the dow starts this morning from 11,893, added 112 points in trading yesterday. meantime, the nasdaq was up by about three and a half and the s&p 500 was better by over 10 points. enjoying a turkey dinner this thanksgiving is going to take a bigger bite out of your wallet. the american farm bureau says on average, a turkey and all of the trimmings for ten people, getting hungry here will cost $49.20 this year. that is 13% or $5.73 more than the price tag last year. the biggest price hike is for the main course. the farm bureau says a 16 pound turkey will cost $21.57. that is 4% more than last thanksgiving. the nation's largest retailer will kick off the

biggest holiday shopping season of the year on thanksgiving day. walmart saying it will start its black friday sales at 10:00 p.m. on turkey day, two hours ahead of target and other competitors. the store is taking one step further so you won't have to wait until the shopping week to put your holiday plan together. walmart is giving everyone a sneak peek on its web site starting right now. a new discount grocery store opens today in northeast washington. it is aldie's first store in the district. the store is located at 901, 17th street in ward five. aldi held a ribbon cutting ceremony thursday. the store officially opens to the public today and the company says it is looking forward to providing the community with "fresh and affordable grocery options." back to turkey a second, mike. i was checking out the fresh birds. $100! >> really? >> for a 20 pound bird. thank you, i'll do frozen. >> i'm all set. >> turkey breast sandwich is just fine with me.

front pushing across maine. out to the west, the next big storm system is off the california coast. it is spinning here. look at the moisture. waves of it, one approaching the northern california coast. the subtropical jet bringing in moisture to southern california into the mountains there around yosemite. this is going to be quite a storm, i believe for the western u.s. for us, again with about 3,000 miles between storms, we should be in pretty good shape. we have a shot of cold air coming down right now. lake effect rain and snow showers from southwestern areas in new york and northwestern pa back to michigan and ohio. even some of the mountains off to our west. have seen some snow showers during the overnight period. that will be the case this morning. i doubt we'll see all that much in the way of accumulations because it is not the set-up for it. it is cold enough to see snow showers if you're travelling to western maryland or western pennsylvania. we'll see a good deal of sunshine although breezy. the winds will abate somewhat. tonight will be a chilly night for the friday night football game. then as we head into the

word beginning at 5:00 tonight, we'll be holding a live telethon to raise money for the troops and their families. >> most smokers in the u.s. want to quit but many aren't getting the help that they need. according to the centers for disease control, 70% of smokers would like to kick the habit. but less than half of them get counseling from a health professional and less than a third combine counselling counselling with medication. effective treatments can double or triple rates of successful quitting. >> new guidelines due out this weekend are expected to recommend that more children receive a screening test for high cholesterol before they reach puberty. more than 10% of children and teens have high cholesterol, half of those will go on to have it as an adults. >> should doctors be using google as a diagnostic tool? new york researchers about thought question to the test. they found beginner medical residents were able to identify diseases after reviewing google searches as accurately as attending physicians. the study's author says the
