single spending measure for 2012. and today the supreme court agreed to hear the concerns of 26 states regarding the president's healthcare plan and as danielle nottingham reports the central issue is whether or not the government has the right to force to you buy health insurance. >> in a statement, the white house communications director said quote we know the affordable care act is constitutional, and are confident the supreme court will agree. but republican leaders who fought against the law are happy the issue is in the hands of the nation's highest court. >> reporter: the supreme court will hear more than five hours of oral argument. the justices could leave the entire law in place, rule parts unconstitutional or throw out the whole thing. 26 states have challenged the law and several lower courts have come to different conclusions. legal experts expect the supreme court vote to be close. >> it is going to be hard for the court to avoid a controversial desixeth way. what they need to focus on is

oscar ortega has a criminal history in 23 states. he has distinctive tattoos, including the word israel on the left side of his neck. just hours before he allegedly fired shots near the white house, arlington police questioned him for suspicious behavior. on sunday morning after the shooting a neighbor saw a police officer with a gun pointed at a vacant house across the street. he said basically, police, put your hands up. >> us park police say or talladega talladega ga has a criminal record in idaho, utah and texas for drug and underage alcohol possession and assault. these assault charges also involve assaults on law enforcement officers. tonight for the first time, we are hearing exactly what was going on inside jack and leslie johnson's house. while the fbi waited at their door. scott is live at the federal courthouse in greenbelt, where wire tap recordings made during a raid on the couple's home a

new at 6:00. we are learning what parentally led up to a -- what apparently led up to a deadly shooting in the parking lot of a giant grocery store in harrison crossing. officers say a plan was in a car, waiting for his wife, while she returned a movie. children were also in the car. this man apparently reached to unbuckle his seat belt, but hit the trigger of a handgun. a bullet pierced the man's hip and he died at the hospital. a commuter alert tonight along the beltway in virginia. already a busy place. crews will be closing three lanes of the outer loop near tyson's corner tonight at 10:00 p.m. the stretch of highway will

stay closed until tomorrow morning at 5:00 a.m. all part of a building of a bring from metro's new silver line expansion that is ongoing. a local popular watering hole is getting a reprieve for now. ireland's four fields did not close last week as planned. instead, wt op, reports the restaurant and bar, formerly known as ireland's four ps, will be staying open until from april of next year. the owner had said the cleveland park mainstay would have to stay closed after the rent was raise. the weather may have been gorgeous today but these crews are focused on what the winter may bring and keeping the washington monument safe.

for local military families this thanksgiving. thanks to everybody who made a donation and you can still help. thanksgiving is literally just ten days away. this is a time when food banks across the country are stretched thin. >> one place in particular feeling the strain, kristen fisher reports the food bank is in danger of shutting down. >> we have a family of three. >> reporter: gabriella rosa and his family of three are on their twice a month shopping trip to the food bank. >> basically food, vegetables and produce. >> reporter: he has been unemployed for two years. so his family, including two-year-old isabella, has come to rely on the groceries had he get for free. >> the food bank is a big help. >> reporter: but the food bank's in trouble. >> our issues are money. >> reporter: last quarter,

their federal funding was cut 80%. >> we have utilities to pay. we have rents on this building to pay and we have salaries to pay. there could be a danger of us closing all together. if our funds aren't, if we don't raise the necessary funds. >> reporter: this may look like a lot of bread, and it is. but by the end of today, almost all of this bread will be gone. the food bank services between 40 and 60 families every day. last month alone they served 2,000 people and 800 of them are under the age of 18. >> a lot of people have come to depend on us to be open. >> it hurts tremendously, they cut down the food bank. it is not just going to impact my family. the food bank is asking for money as opposed to any donations of food and we are going to put that address on our website soon. it will be on wusa 9.com.

thousands of people would flock to the florida coast for space shuttle launches like that one. the ocean and the beach made for spectacular slideshow as the shuttle would go up but now a different scene is taking shape. this is what it looks like when they leave for the international space station. the rocket lived off from kazakhstan this morning in the snow. the russian space program is the main way of getting to and from the international space station these days. back here on earth, crews spent their day getting those cracks in the washington monument ready for whatever our winter brings. here along the national mall it is hard to miss the climbers scaling the washington monument. climbers are filling in the cracks caused by the earthquake. they are using a material that is similar to a swimming pool
