all lanes of 301 are shut down as of now. prince george's county fire officials say several other vehicles are also involved in the crash. >> the tanker is carrying 9,000 gallons of gas. we just learned the driver suffered minor injuries. no word yet if anybody else is hurt. we're going to bring you an update on this massive accident as soon as we know more. on to virginia now where an annual holiday tradition in leesburg is in full swing tonight, that is the annual debate over separation of church and state of religion versus freedom of speech. >> all about what holiday displays are allowed on the courthouse lawn. gary nurenberg is here to show us the latest on the controversy joining us live outside the courthouse. gary? >> reporter anita, these disputes often come down to christians versus atheists. today one deeply offended christian took matters into her own hands.

crucified santa on the courthouse lawn. >> atheist on religion. >> it's harmful in every aspect of our lives. >> reporter: the board chairman on the policy allowing nine displays, first come, first served. >> what is going on now is just absolutely out of hand and just getting absurd. >> a sheriff's deputy assigned to the courthouse made no effort to stop her from taking the display down, nor did he cite nor arrest her. he did, however, try to stop 9 news reporter peggy fox from capturing images on the courthouse grounds and forced her off the property. >> gary, thank you. there is another movement in d.c. growing in popularity and promising to make some noise. our d.c. is taking to the national mall demanding more jobs for the district's residents. ken explains how their efforts may be hindered in the public eye. >> reporter: that's because they've been lumped together with every other movement going on right now. the folks here with our d.c.

say they're separate and they're separate specifically from objection over at occupy d.c -- separate from folks over at occupy d.c. delegate kicked off the week-long demonstration on the national mall. this group, our d.c., unlike the occupy d.c. protesters, are specifically focused on bringing more jobs to d.c. residents. >> we're going to congress and we're going to capitol hill and it's called take back capitol hill. >> reporter: but those efforts may be tainted by public perception after the aggression seen on sunday. occupy d.c. protesters were arrested by police and thrown to the ground after they refused to dismantle a barn- like structure they were illegally building. it's this kind of activity our d.c. protesters don't want to be associated with. >> we're not about balance, you know. we're not about hurting anybody. >> reporter: the two movements are not one and the same according to the organizers. although they share common agendas, they have many

differences. for example, our d.c. is heavily funded by title sponsors like moveon.org and seiu to name a few. occupy d.c. isn't. >> you were seeing the people who got out of jail having reminders for yesterday's movements. >> reporter: he says he doesn't believe his camp's actions are to blame for any negative attention other groups are getting. he feels the arrests should be celebrated. >> it obstructed the town. it stopped business as usual. because of that people had to pay attention. >> reporter: back at the national mall, our d.c. has been permitted to keep their tents and stations up through friday. >> it shouldn't be so many people unemployed, underemployed and homeless. >> reporter: here's the irony in all of this. the our d.c. folks here at this site have invited the occupy d.c. protesters to participate with them tomorrow when they march up to the capitol demanding more jobs. we're live at the national

mall,ken molestina, 9 news now. will harry thomas take a hike? he may take a leave from the d.c. city council. the fbi and irs raided his home last friday. the councilman is accused of diverting to his personal use $300,000 in public money, money meant for a sports program for kids. thomas denies he did anything wrong, but just the same, he has agreed to pay back all that money. today, his council colleagues met to talk about the ongoing investigation and they instructed the council chairman to have a face-to-face with mr. thomas. >> and i look forward to having a conversation with council member thomas to discuss so he's clear on where his colleagues are and what they feel. we look forward to having the discussion shortly. >> thomas so far has not been charged with any kiln investigations. things going from bad to worse for the u.s. postal service. in an attempt to stave off bankruptcy, they announced they're going to make dramatic changes to its first class mail

service. the postmaster general wants to shut down almost half of the services big processing centers and cut 28,000 jobs. now, that would mean virtually all of those letters that used to arrive in one day will now take two days to get there, and the letters that used to take two days will now take three. >> our service commitment is causing this tremendous amount of excess capacity within our network. that's what we've got to deal with. we've got to do everything in order to save this postal service. >> all those changes are slated to take effect next march. they're on track to lose $14 billion this year as e-mail and electronic bill pay robs it of a lot of its core business. tonight a movement on capitol hill toward extending the payroll tax cut, the cut to let you take home a little more with each paycheck. it is set to disappear at the end of this month unless congress takes action. the republicans and democrats have been bickering over how to

offset the cost. do you cut spending or tax increase someplace else. leave it to some of the ladies to come up with a bipartisan plan. two say offset the cost of the tax with a 2% tax on surpass income over a million dollars a year. we'll keep you posted on whether this new proposal draws a crowd. getting caught driving drunk doesn't usually garner a lot of headlines unless you are the head of the federal aviation administration. randy bab bet is out of jail after police arrested him for a dui over the weekend. he was driving on the wrong side of the road, old lee highway, when they arrested him. he is due in court in february. the faa has placed him on leave. search teams plan to be back out on the water tomorrow morning looking for a missing employee of the washington suburban sanitary commission. chuck duckett vanished while on

the job friday. he had taken a boat on to the reservoir in montgomery county. crews have since found the boat and clothing. tests will show whether it belongs to duckett. caught on tape, a couple of crooks stealing from a busy shopper. the loudoun county sheriff's office says a woman loading items into her cart when she saw a small pickup drive by, knock the cart and the driver reached out and drive the victim's purse from that cart. investigators have released these surveillance photos of possible suspects. if you know any of these folks, call the loudoun county sheriff's office. it's just like october. almost september out here. you probably can't see this, but there are insects flying around. it's just not normal this time of the year. let's talk about the wakeup weather. grab your umbrella. going to be mild, 50s to start. 50s by 7:00 and 50s by 9:00. we will come back. let you know when the heavy rain is going to roll in and if that rain could end in snow on thursday. also still ahead, a man who says the name of accused penn

that contained real footage caught during a deadly car accident. the republican presidential field shrunk by one over the weekend but there are still those that believe herman cain got a raw deal from the news media. >> reporter: herman cain and every other candidate probably wishes today's news media were a lot more like the journalists back in 1960 who ignored the reports of john f. kennedy's poor health and womanizing, issues which would have certainly made him unelectable today. but the project for ethics in journalism said everything changed after water gated, not just because it whetted the appetite for scandal but made us realize that perhaps who these guys are when we're not watching them really does matter. for example, sure, you've got that 999 plan, but do you have character? do you have judgment? the allegations against cane were always a lot more than just he said, she said and his

turning to snow around detroit and even into northwestern sections of ohio. now, this is going to be sort of similar to what could happen here late wednesday night and on thursday. in the meantime, the front is entering pennsylvania and west virginia. believe it or not, the cold air is not going to get in here. this front won't go east of us until we get into late wednesday night and early on thursday. just a few sprinkles. everything will be light. you may have a wet commute if you're in the mountains. damp roads in the immediate metro area. nothing heavy. need an umbrella. showers but still mild. that's the silver lining for tomorrow. cooler and wetter on wednesday. and then rain to snow before ending, that is certainly possible. we'll talk more about that in just a second. overnight, mostly cloudy and mild. a sprinkle or shower possible. lows only around 50. 50 is our average high temperature. that's how topsy-turvy things are.
