grandmother vandalized and dismantelled it yesterday. >> peggy fox joins us live where supervisors try to get rid of this today. it keeps going. >> it certainly does. the supervisors took up a proposal that would have kept skeleton santa from coming back to the lawn and gotten rid of all the public displays. that would have included the nativity. >> four members of the loudoun county board of supervisors wanted to suspend the rules that allow public holidays like this. a skeleton santa on a cross. this grandmother found so offensive she took it down. >> it was predictable. it was easy to see coming. the ku klux klan put up things and i shutter to think we might get to that point. >> steven miller wanted this and all the displays banned and have only a christmas tree on

all, i'll start with you. three years and counting you had disputes. your reaction to the days vote which keeps the whole thing going. >> i was hoping that the board would actually take up consideration just to allow a christmas tree. but unfortunately, they chose not to do that. and discovered that they had an opportunity three years ago to have all displays of the holiday season and not any public displays of the atheist kind. if the government had done something and they chose not do that. it's a shame. >> do you feel like that one viewer who said she is embarrassed and humiliated by the fact that you are a spectacle this time of year? >> i believe the atheist groups cross the line with a display which even though it is intent by the young man to deal with an issue of commercialism, clearly be outrage to very young children and our holiday and christmas parade this saturday. i would also like to say the

town of leesburg and town council does not have any decision making in this manner. so the town should not have to be punished for the decision of the board of supervisors. >> what would you have wanted the board of supervisors to do? >> i would like to remove all the displays in the courthouse lawn. >> how come? >> the religious displays are unconstitutional and we are only there so they can continue to allow the religious displays. >> your display is a banner that says happy holidays. the skeleton santa is not yours. it's a fella that says he is a christian but has a commentary. what is your reaction to the woman who tore it down? >> i'm offended by that. she took it upon herself to decide what was acceptable free speech and wasn't. she disrespected this young man's free speech and vandalized his display on the courthouse lawn in front of a sheriff. >> the christmas spirit is big for a whole lot of folks and christians like this holiday.

what would be acceptable on the front of the courthouse from your perspective? >> a secular christmas tree would be fine with us. i want to point out that many atheists celebrate christmas. this was never an attack on christmas or anyone's religion. it was purely the constitutionality of the religious displays on the lawn. >> so in other words, it's the nativity scene that you don't want. >> would you be happier if there was just a christmas tree and maybe a happy holidays banner? would that work for you and most of the folks down in leesburg? >> well, that's what i wanted temporarily for this holiday season. but the board of supervisors chose not to do this. what i find interesting is that he is saying he would accept a christmas tree. it's interesting he wants to use the holiday season as an opportunity to promote free speech and that's fine. but you know, why don't we do something that is uplifting for the community? i find it interesting that his attacks are on the cresh, none of the build boards have

attacked my religion, judaism or islam. i would like to know why they don't do that? they went across the line with the santa clause crucifixion. they were hurting young children. >> let him respond to that. he says that a, you're now okay with the christmas tree, but you weren't before. and secondly, what about the issue of islam, judaism, and the other religions? >> fist of all, i never taken a position at all about a christmas tree. the displays are there just to allow the christian displays to be there. it was there with privileged access for decades. and it's only in the last three years they allowed any there. >> this is not a debate we will solve tonight. we appreciate your time. we are out of time. we have to go back to you, lesli. >> thank you, derek. protesters from around the country take over capitol hill

candidate's town to make his point today. danielle nottingham reports, he is pushing congress to act now on a proposal to extend a very popular tax cut. >> this is a make or break moment for the middle class. >> the president channeled one of his predecessors to argue that all americans deserve a fair shot at financial security. republican president theodore roosevelt delivered a similar plea more than a century ago. president obama argued that fair shot includes extending the payroll tax break set to expire at the end of the month. >> if we don't do that, 160 million americans, including most of the people here, will see their taxes go up by an average of $1,000. >> both parties want an extension, but lawmakers are at odds over how to pay for it. in an effort to bridge the gap, two senators offered a

bipartisan proposal tuesday. our thanks to danielle nottingham. that plan would cover the payroll tax extension with a 2% tax on millionaires only and provide an exception for small business owners. still many republicans insist any tax hikes would damage the flow. >> the hotly debeated abortion issue is off the table. today, the county council killed the legislation. lawmakers voted 6-3 to postpone debate on the bill indefinitely. county executive had proposed the idea after several late night incidents earlier this year involving teens. but some council members call the plan unfair by most law- abiding young people. back open again in bowie after a nasty accident. sky 9 out over the scene last night just after a passenger car, a box truck, and an 18 wheeler carrying gasoline collided. more than 80 firefighters had to respond to the scene. the driver of the tanker truck was taken to the hospital with

breaking news coming into our newsroom right now. federal aviation administration chief, randy babbitt says he will resign. babbitt was arrested saturday night after a fairfax city police officer pulled him over after spotting him allegedly driving on the wrong side of the road. babbitt said in a statement today that he did not want anything to cast a shadow on the work done by his colleagues at the faa. the 65-year-old was half way through his term at the faa. two suicide bombings in afghanistan killed dozens and injured even more. the first blast hit during religious ceremonies near a

mosque in cobble. several more afghans died when a bomb strapped to a bicycle exploded near a mosque in the northern city. the attacks happened on the holy day. they are the worse since the fall a decade ago. the taliban denied responsibility and condemning the violence. afghanistan has a history of violence, but attacks on religious days are rare. a historic settlement stemming from one of the worst coal mining disasters. agreed to pay nearly $210 million. 29 miners were killed during a blast in that mine in 2010. the settlement comes the same day a final federal report on the explosion details, 369 safety violations at the mine, including 12 that contributed

hormone has a greater risk of creating blood clots. doctors need to be clear on the findings. young lives lost without warning and what can be done to save more in the future. brought together doctors, coaches, trainers and parents. some of whose children died suddenly. concussion, heatstroke, asthma, sudden cardiac arrest. the national athletic trainers association is putting out a position statement on what should be done step by step to manage these and other potentially life threatening conditions. >> how they can take extra precaution in insuring that a concussion doesn't result in a more catastrophic event or a brain hemorrhage and how to manage that not only on the field, but also in the athletic training room. >> some 40 young athletes have lost their lives on the playing field so far this year.

derek. all eight alleged victims are expected to face jerry sandusky across the courtroom sometime next week. abc news reporteds the eight young men plan to testify against the defensive coordinator during a preliminary hearing next tuesday. sandusky's lawyer says he is looking forward to questioning any alleged victims. sandusky faces 40 counts of child sex abuse. inappropriate contact with the eight boys over a 15 year period. imagine, you wake up one day to imagine you have the same name as jerry sandusky. >> that's what happened recently to a maryland sports caster who is spending a lot of time trying to distant himself from his name. >> the long time sports director of wbal television in baltimore has always been proud of his name. >> i have a good name. >> first because of his father, a former profootball player and coach.

caught on tape, a california restaurant accidentally becomes a drive
