step down from office. that stunning revelation just into our news room tonight. >> this may be the end of the line for the city council member harry thomas jr.. bruce johnson joins us now with the story that you'll see only here. >> reporter: this is going to come as a shock to the people following this story but a lot didn't think it would come to this. harry thomas is telling close associates is telling 9 news now the councilman will agree to resign from office as part of a plea agreement with federal prosecutors. this all started with allegations thomas stole some $300,000 from youth baseball and used that money for personal trips, golf outings and expensive items like an audi, suv, and motorcycle. his associates say councilman thomas will plead to a felony and he expects to go to prison. >> last year when d.c. councilman harry thomas was accused in a civil suit of saling some $300,000 from youth baseball programs he denied any

wrong doing. >> i think the body of work that my life represents will defend that. >> but the d.c. councilman, without admitting guilt did eventually agree to repay the money, $50,000 at a time. despite calls for his resignation from some of his council colleagues, thomas continued to show up for work while refusing to talk with reporters. >> anything you can tell us? we haven't heard from you. >> you know my lawyers will give you a comment. >> just before the d.c. council recessed for the holidays, the ward 5 democrat appeared and voted for a new ethics bill for city employees. late last year, the fbi and irs agents raided thomas' home in northeast and took off items reportedly bought with missappropriated funds and sources tell 9 news now harry thomas is phoning his closest colleagues to say he will enter into a plea agreement with prosecutors perhaps before the week is out.

the agreement as thomas explains to friends will force him to resign from office and admit to more than one felony charge and thomas said you just couldn't beat the tax charges. he told friends he's looking at a two to three year prison sentence. >> we couldn't reach him or his attorneys tonight. our information is a final meeting with prosecutors could come in a day or two with an official announcement before the week is out. the d.c. council tomorrow will stake steps to speed up the enactment of that ethics bill. it's unclear if harry thomas jr. will cast a vote. it could very well be his last vote could you reach any of his colleagues for reaction? >> to be honest haven't had time to reach his colleagues except for one who didn't know that this was about to take place. there have been rumors and what's going to happen, the council members who said before it's about three of them who said he should resign, they are going to go back and say i told you so. the other council members who refused to call for his resignation will continue to say we didn't have the

authority to force him out of his office. >> bruce johnson, thank you. anita? now to politicians who don't want to step down but who want to step up to the presidency. the iowa caucases are wrapping up with early results showing ron paul, rick santorum and mit romney in a dead heat. we'll be watching this throughout the newscast but gary is here with what we know so far. gary? >> reporter: anita this thing is changing and man is it close, with 88% of the precincts now in, rick santorum and mit romney tied at 25% each and santorum has a 19 vote lead with ron paul in third place at 21% and newt gingrich in fourth place but as i said this is about to change. >> real voters casting real votes in the iowa caucases after literal last minute appeals from candidates like ron paul who worked the waiting lines and then stood by in a caucas waiting his turn to make a last pitch. >> conservative to me means

small government and following the constitution. i think that would solve our problems a whole lot. >> michelle bachmann, just as the caucas began. >> we are unwilling to allow barack obama to implement socialism in the united states of america. >> newt gingrich touting his experience. >> this is not a time for another amateur. we've had three years of an amateur. >> more than 1700 caucases and 809 locations meant surrogates were necessary. rick perry's son. >> he is running for president of the united states, because he wants to serve his country. >> electability has been a key romney's selling point. >> i'm hoping that the undecided will take a look at who they think can be barack obama. >> and there were lots of undecided waiting to be convinced at the last minute. >> there's still time for that to happen. >> the plea of former senator rick santorum. >> you need to focus in on who was that candidate who has the vision for america. >> they've been counting the

votes, sanotrum, romney and paul winning the most in incomplete returns. >> the winner of the 2012 precinct presidential poll is congressman ron paul. >> [applause]. >> well, that was precinct that looks like paul is coming in third. right now he's speaking to supporters in iowa. we'll copy that for you, listen to it carefully and turn it around and have it for you later in the newscast but now a squeeker between romney and santorum in first. back to you. >> thank you, gary. all eyes on iowa and joining me tonight is kathy taylor editor for human events.com, the oldest conservative weekly and kathy, three minutes atop, the rest of iowa not sure who they like republican wise. >> reporter: it's not a surprise. the polling last three days showed a dead heat and that is what we have tonight and you see this with the field in general. you see that ron paul and rick

santorum, the results really overworking the state and you see the effect of romney having that sturdy base from 2008. >> let's talk about romney for a minute, the man who considers himself the most electable candidate. is he a conservative whose views just evolved since he was the moderate governor of massachusetts or a closet moderate just trying to get conservatives for both? i think iowaans aren't sure. >> could well be. i give him the benefit of the doubt that people can over time change their views but i think the thing to understand about mit romney is the distinction between a pro business republican and a free marketer which would be more the ron paul effect. a pro business republican is going to be okay with taxes, be okay with subsidies to business, a free marketer is really going to say pull government out of the equation. >> let's talk about rick santorum. he had been in the single digits until a couple weeks ago and now all of a sudden he's in the top tier. can he turn this into something

important in new hampshire and south carolina? >> well he doesn't have a strong organization but he appealed we believe to the blue collar, the kind of tim polente iowaans and he was sort of, they were the vote safe vote they could do that wasn't ron paul kind of pulling off that, so he will have to raise a lot of money before he goes to south carolina. you know the governor of south carolina, nikki hayley endorsed mit romney, so it makes south carolina that much more interesting. >> your conventional wisdom says there are three tickets out of iowa. is there a fourth ticket out and does somebody have to get out after tonight? >> well we spoke on a reporter in iowa, newt gingrich's campaign chair and they see him, if he takes two, three or four, they think he will still be alive and that he will go to

new hampshire and so they're optimistic on that. >> but as for somebody like michelle bachmann, is she done? >> michelle, i'm afraid she just did not become in the perception of iowa the hometown girl they thought she was. >> we will be watching closely. thank you very much for joining us tonight. back to you anita. and the wins we know are finally calming down a bit but the temperatures definitely still dropping. will it be this cold tomorrow and what about the morning commute? meterologist topper shutt has the break down for you right now. top? >> yeah, well i tell you what. what i would do is just allow maybe five extra minutes to warm the car tomorrow morning. look at the winds calming down a little bit, still gusting to 22 downtown, 29-mile per hour wind gusts in manassas and still a 26-mile per hour wind gust up toward hagerstown. these are the actual temperatures, 23 at national, teens already in leesburg, manassas, 12 up in hagerstown. we factor in the wind and it

feels like it's four above in gathersburg, 11 at national so we're talking single digit wind chills across the metro area and temperatures continue to tank tonight. our coldest night in fact of the season. here is your wake up weather. 15-25 to start. 14-24 by 7:00, and 18-26 by 9:00 and good news, not windy. bad news you still need a hat, scarf, and gloves. we'll come back and tell you when the arctic air leaves and explain why we put an extra no flake on the seven day. well new at 11, d.c. police tonight investigating the second homicide of 2012. it happened in the 1500 block of 45th street northeast just before 6:30. when officers got there they found a man with several gun shot wounds to his chest. they've not released his name or any other information on possible suspects. take a look at this guy. it looks like he may have gotten caught the front end of a freight train. covered in bandages, am and a sling, don't feel sorry for

him. this man walked into a cvs on christmas eve and he was all business. he threatened to pull out a gun and demanded not money but drugs. he got away with a load of oxycontin, a powerful painkiller. police released this surveillance video hoping to stirrup leads. the chair of the d.c. council wants every high school student to take a college entrance exam, even if it means forcing them to do so. brown is proposing each student be required to take the sat or act before they graduate and apply to at least one vocational school or college. >> we're going to do everything we can to insure that they have the option if they want to go to college. if they don't, we'll do everything we can to get them ready for employment. >> browns proposal would create a workshop of sorts to teach students how to apply to schools and get financial aid. his office says the cost of all this would be perhaps 300- $400,000. in his opinion, money well

spent on the future. mom, why am i fat? >> tonight a new ad campaign targeting the huge problem of childhood obesity in georgia is drawing criticism from around the nation. the ads show overweight kids talking about their bodies, confronting their parents and in one video an obese little girl talks about how she's bullied because of her weight and its hurt her feelings and she's pictured in a billboard that says that it's hard to be a little girl if you're not. >> they're trying to do a public good but what they're ultimately doing is shaming and blaming both kids and ultimately parents and shame and blame doesn't work. it just makes people feel bad. >> now that is dr. scott kahan, director of the weight and wellness center at johns hopkins. he says shame and blame as you heard do not work. what's needed to address the countries obesity epidemic is a multi-facetted campaign of education, marketing and price incentive such as taxing junk

food. speaking of shame and blame, actor alec baldwin's bad boy behavior cost him a job. he will no longer be the pitch man for wagman's grocery stores . well remember that little blow up that recently got baldwin kicked off a flight? that generated a lot of complaints from customers so it's cutting ties with baldwin. now a quick check in with gary following the latest on tonights iowa caucas. gary what do we have? well we don't have, we do have problems with gary's micro phone. >> reporter: yeah, well one of the things candidates learn how to do is turn on their microphone. you'd think i'd learn that lesson. you know how i told you a few minutes ago it was tied 25% to 25%, santorum with a 13 vote lead, it's tied 25%, 25% and romney with a 125 vote lead with 89% of the precincts in. ron paul is now addressing his

supporters in iowa saying that although he came in third, he is only one of two candidates who really has the finances and the organization to run a national campaign. clearly putting himself in the same basket as mit romney. rick santorum has not had a lot of money until he began raising it quickly over the weekend. going to be a tough week ahead for him in new hampshire particularly with paul saying he and romney are the only two who can compete. we've not heard from romney or santorum, but as the newscast progresses we'll watch and bring it to you when it happens about we'll turn the microphone on. >> thank you, gary. we'll have a lot more on the iowa caucas right after the break. the new year got off to an unpleasant start for the british royal family

so we'll check back in with him in news room, just a few dozen votes separating the top. >> 89% of the precincts in, romney has a 125 vote lead over rick santorum separated 25% each. ron paul came in third, he says he's the only viable candidate to continue, just finished his speech with supporters and talked to the supporters about why he thinks he did so well. >> the economy is in trouble. our civil liberties are being trashed. our foreign policy has been a mess and drains us both economically and our military forces but at the same time, people are coming together and we had the task which where we are very successful is re- introducing some ideas, republicans needed for a long time. >> and chief among those ideas he said is the idea of freedom. now just before we went to that bite from ron paul we told you romney had 125 vote lead. that's now changed. he's only ahead by 13%.

newt gingrich is at the podium preparing to speak. we'll listen to that and if he says anything interesting we'll bring it to you right away. >> thanks for keeping us up-to- date. britain's royal families country estate is a crime scene. police spent the day combing the property for evidence after a dog walker found a womans body on new years day. the remains were just three miles from queen elizabeth's retreat where the royals spent the holidays and held a new years celebration. authorities have not released details of how that victim died. if you think it's cold around here, think again. let's get to china where the temperature is so cold, they've actually frozen a giant water fall. take a look at this. you can see giant ice at the very top there and they're talking sub zero temperatures. so i guess we should feel lucky, right? >> yeah, exactly. >> it's amazing to see those formations. >> when you freeze running water it's cold. although that said our wind chills were in the single digits not far off from zero. >> oh, thank you. >> not a four blanket night tonight.

>> and the arctic air once we get through tomorrow we're in good shape. we'll gain about 10 degrees each day. let's start with the wind chills because these knock my socks off. four in gathers burg, six above in leesburg, nine in manassas, even at national, the wind chill is 11 and this is what you feel if you'll try to walk the dog one more time. bundle up. now you jump the divide and our friends in oakland, it feels like it's seven below zero, so winds are dying down but very very slowly. now, here is the deal. cold but not as windy tomorrow, so some good news there. kind of a silver lining. afternoon flurries are possible or snow showers possible late tomorrow and tomorrow evening much like we had today. now the good news, well you need your hat and gloves but it will not be windy. you'll have to fight a wind chill tomorrow but temperatures will be cold enough to require that and good news also, seasonable on thursday. we'll be back into the 40s, in fact maybe a little bit above average by the time we get into thursday so overnight partly cloudy and very cold. i'd say three to four blanket

night. 14-24 and i could widen the range to include places like smithburg. some areas get down to about nine or 10 but mainly in our area, 14-24 and winds come down northwesterly at about 10. now, tomorrow morning, partly cloudy and very cold. need a coat, sunglasses, teens and 20s and winds southwest at 10 because good news there, not very strong wind and also the winds from the southwest. it's a milder wind. by afternoon, partly cloudy and still cold. could see a flurry or snow shower, high temperatures around 35. winds pick up a tad but nothing crazy, southwesterly at about 10 to 15. so the zone forecast, we're looking at the snow shutting off in oakland, 28 and they've had 16 inches since monday. 32 in cumberland, above freezing but just barely in martinsburg, 36 in culpeper, 34 in warrenton, manassas about 34 as well. downtown we're looking at temperatures in the mid 30s, mid 30s in southern maryland,

maybe 36 over for annapolis. next seven days, look at this, 10 degrees almost every day. 35 tomorrow, 45 on thursday, 56 with sunshine on friday. that's the winter and then 52 as we get into saturday and we did add a flake since yesterday anyway for sunday and could see rain ending as snow on sunday, colder air moves in, 40s sunday and monday but look at that. we can't keep it back in the 50s tuesday. >> that will feel very nice after to
