fight against a complicated legal system. a 19-year-old from mineral, virginia has been on the commonwealth's sex offender registry for nearly five years even though everyone acknowledges he's not one. matt has details. it >> reporter: 20-year-old edgar is an inspiring rap musician who writes his own songs, one of which is entitled "the truth shall set you free." it's an auto bye biography. when edgar was 15 he was accused of raping a 14-year-old girl. he and his mother say based on the advice of their lawyer edgar pleaded guilty to avoid a lengthy prison sentence. >> i know we had bad counsel. >> i was scared. >> reporter: a year and a half later after his accuser

admitted that she made up the whole story he was released from custody. >> a relief. >> reporter: but that's not where the story ends. that's just the beginning. despite the fact that his name was cleared in court that same name, for technical legal reasons is still listed in the sex offender registry, making it extremely difficult for edward to get on with his life. he says he was recently arrested for being around minors at a high school football game because of his legal status as a sex offender. so with the help of the innocence project of the university of virginia edgar and his mother have gone down several legal avenues trying to get his name off the registry. so far nothing has worked, but edgar says he's certain he won't be on the list forever, and that the truth will ultimately set him free entirely. >> when you get in trouble, it's hard to get out, basically. >> reporter: edgar's next legal appeal will be argued at the virginia supreme court january 13th. >> it's hard to fathom that this keeps going on and he

can't clear his name. why? >> two things. both technicalities. first of all, for sex offenders to get their names off the list in virginia they have to have the convictions vacated. in juvenile court technically defendants are not convicted. also, the fact that he did plead guilty in the first place is making things very complicated, even though everyone now acknowledges he's innocent. >> as his mom said, they got some bad advice and they're now paying fort. we saw some snow right here around the station in northwest. is there more on the way? topper joins me now with the answer to the question. >> a little bit, south and east of town. if you are west of 95, it is over. we'll start with live doppler 9000. it will lay down a dusting. right now the line of snow is essential eastern prince george's county, anne arundel county, and also back into southern maryland. again, i don't think we'll see any problems at all for tomorrow morning, but we are

500. this just in. d.c. police have released a sketch of a sex assault. take a look. police believe a man who looks like this is responsible for kidnapping a woman and then attacking her right in front of her child. the attack happened back on december 29th. a woman was stopped in traffic a block from the verizon center when a man jumped into her car. she says he then sexually assaulted her at gunpoint all while her one-year-old child sat in the backseat. the man eventually let them both go. if you have any information about what happened call d.c. police. 24 hours ago we knew the iowa caucuses were close but we didn't know they would provide the closest election there in history, with mitt romney winning by only eight votes of more than 122,000 cast. the political road show has moved full force now into new hampshire but as gary nurenberg reports, with one less candidate than last night. >> reporter: 6th place finisher

michele bachmann is out. >> i have decided to stand aside. winner mitt romney flew to new hampshire and picked up the endorsement of 2008's nominee john mccain. one poll shows romney with a commanding lead in new hampshire, 43% to ron paul's 14%, but that was extra santorum's impressive showing in iowa. he reminded doubters wednesday night. >> they forget this is now my 31st trip into if you hampshire that we've done well over 100 of these town hall meetings. >> reporter: newt gingrich offered an interesting perspective on why the seemingly endless campaign is worth it. he talked about iowa. >> here's this very intense breathing after the caucus, and, bye-bye, and you go to the next place to get immersed, and you do this over and he over. and good candidates, they're not just going from staged

the director of a new financial borrow. >> the financial firms have armies of lobbyists looking out for their interests. you need someone looking out for your interest and fighting for you, and that's richard. his job will be to protect families like yours from the abuses of the financial industry. >> he was first appointed last summer. it touched off a month-long battle with republicans who said the new office had too much power and no oversight. the nomination was blocked by the g. o. p. just lant month, but with congress in a pro forma session the president used a recess appointment to give him the job for at least two years without congressional okay. it is a move republicans now call arrogant. they warn the president will face a court fight over his decision to do. so tomorrow perhaps a critical day for d.c. councilman harry thomas junior. his attorneys plan to meet with prosecutors. as we first reported on 9 news last night sources say thomas is telling close associates as part of a plea deal he would resign from office and plead guilty to tax evasion with a

sentence of perhaps two to three years in prison. the justice system has been given an opportunity to work, and i think that's the fairway to do this, and if council member thomas chooses to resign, he is then taking that action, and would we hope is to be able to make sure the residents of ward 5 are well represented. >> the fbi and irs raided thomas' home last month, part of an investigation into allegation he stole public dollars from a baseball program for kids using about 300 grand on an suv, a motorcycle, and other personal goods. publiclily, at least, thomas continues to deny those allegations. don't play with fire. a four-year-old boy in waldorf learned this lesson the hard way. after investigators say he is the reason a home went up in flames. investigators say the child was playing with a lighter when he lit a mattress on fire tuesday. those flames spread from the bedroom, causing major damage to this duplex no. one was seriously hurt. the fire spread to the home

next-door when neighbors say they barely got out. >> there was a lot of smoke, and it was hard to breathe, and i was trying to run. we have five animals. i was trying to run and get the animals out, so that they wouldn't get hurt. it was pretty scary. and you don't leave lighters and matches and that sort of thing out to where a child can get them. >> the house where the fire started will be torn down. the neighboring home can be repaired. among some woods in fort washington, maryland, police badges and bulldozers. officers were looking for the body of a woman murdered back in 1996. her boyfriend eventually confessed to killing her and burying her, but police were not able to find the remains. no word yet on what led to this renewed search today. bell's family says they would like to find her body so they can give her a proper burial. 25 years ago today an amtrak train slammed into a set of freight locomotives in

northeastern baltimore county. 16 people died in the violent accident. the engineer of those locomotives ended up serving four years in prison for beg under the influence of pot. that led to mandatory drug testing for people in safety- sensitive job. for montgomery county public schools the math doesn't add up. the county has just asked the state of maryland for $184 million to help upgrade and renovate aging school buildings but the state says we only have 24 million to give you. >> we have about 2500 more kids every year coming in, and it's important that we have the facilities that we need to meet that growth. >> the county plans to keep asking the state for cash. meanwhile, there is good news to report. today the county cut the ribbon on three renovated schools. garret park, seven locks, and canon road elementary. coming up, it seems like the district could be one of the best places to find a date.

tonight a virginia mother wants answers after her seven- year-old daughter died at school from a well-known severe peanut allergy. this all happened at hopkins elementary school in chesterfield county on monday. police say the seven-year-old died after she suffered an allergic reaction to some kind of peanut product. the girl's mother says the school knew about the allergy and her little girl should be alive today. >> she has an allergy action plan at the school. if she breaks out into hives, the first thing you do is give her benadryl. they didn't give her anything. i've heard two different stories. one was that it was unsupervised, and a kid gave it to her, and the other was that -- something else.

>> the school will not comment other than to say they're looking into exactly how the little girl got the peanut product. the medical examiner will determine the exact cause of death. in tonight's health alert, the american cancer society says cancer rates and deaths keep going down for yet another year. the biggest progress has been against breast, prostate, lung, and colon cancer. but less common ma leg nancys of the pancreas, throat, and thyroid are still going up. overall, doctors say obesity, lack of exercise, and high- calorie intake are raising our risks. there is still encouraging news on the screening and treatment fronts. >> we're catching it earlier so we're not -- we're catching the abnormal tissue earlier so that they don't turn into cancer. >> advances in screening and better, more targeted therapies have saved more than a million lives in the last 20 years. if you're watching us while laying in bed, first, behave yourself because we can see
