this morning rescue crews blue up part of coast ta concordia's deck to reach a part of the ship. it was suspended yesterday when the ship started to shift in rough seas. the italian coast forward now says 29 are missing. at least six are known to have died. two missing are an american couple from minnesota. the company that owns this ship says the captain intentionally navigated off course to impress people on shore. >> there's been a human error here. the captain did not follow the authorized route. >> the captain faces manslaughter charges. after the accident passengers describe a scene of chaos with little help from the ship's crew. >> we were panicking and yelling and pushing. they wanted to be the first on the life boats. we were up close. we didn't get on the first lifeboat. they were gone and there we

santorum and newt gingrich. >> i would go out and say stop it. >> but romney insists he has no control over those groups. >> now, i can't call these people and direct them to do that as you know because that would violate federal law. >> he apparently has no influence which makes you wonder how much influence he would have if he were president. >> the fireworks aren't expected to die down any time soon. the gop contenders face off again on thursday. by romney releasing his tax records we get a look maybe at the tax rate that he pays. again, though, he said he no be doing that possibly until april and by then, betty, this race for the gop nomination may be well over. >> good point. terrell brown in washington for us. thank you, terrell. a just-released cnn poll finds that if the general election were held today, president obama would be in a statistical tie with two republican candidates. 48% of the registered voters say they would vote for mitt romney

if he were the gop candidate. 47% for the president. the president would beat ron paul, 48% to 46%. and mr. obama would defeat rick santorum, 51% to 45%. the house returns from its winter break with the tax break at the top of the agenda. demonstrators are unhappy with how lawmakers are working and they plan to occupy congress in rallies there. well, the online ensi encyclopedia wikipedia plans to protest, in fact, one of its own, one of the english versions tomorrow. it's protesting a stop online piracy act in congress. the proposed law would harm the free internet and bring about tools of censureship in the u.s. walker pushed through a law last year that stripped most

collective bargaining rights for public workers. now, even if democrats are successful in getting a recall, a recall election would not be held until june or later and democrats don't have a candidate to run against walker. on the "cbs moneywatch," a mini cooper malfunction prompts a recall and the shoe website zappos is hit by hackers. ashley morrison is here with more. good morning, ashley. good morning. big gains overseas added 1% on news of better than expected economic data from china, while hong kong's hang seng jumped more than 3%. trading on wall street took a break monday in observance of martin luther king jr. day. today investors will keep an eye on earnings reports from two big banks. citibank and wells fargo will make their announcements be before the opening bell. standard & poor's is

downgrading the euro rating fund. it was cut to a aa plus. if other credit rating agencies cut the fund's credit rating it could deepen the european debt crisis. on friday the s&p downgraded the rating to nine european countries. bmw of north america is issuing a recall affecting nearly 89,000 mini coopers. the company says a water pump malfunction in the cars could cause a fire. the recall was issued voluntarily. no accidents or injuries have been reported. bmw will replace the pumps for free. online shoe sellers zapp zappos.com is the last company to have birthday hacked. it's affected 40 million companies. that includes names, phone numbers, addresses and e-mails. zappos says credit card and other information was not stolen. and you can now name o.j.

getting fuel. a russian tanger which got within a half mile of the iced in city has begun pumping 1.3 million gallons of fuel in gas. the coast guard is keeping a close eye to make sure nothing goes wrong. >> people falling through the ice. you know, we're taking every effort possible to drill the ice before anybody goes on it to test it. you have a potentialle for a fuel spill. we've got everything in place to assist if something goes wrong. >> if all goes well, the job could be done in about a day and a half, but it could also take up to five days. this is the first fuel delivery to nome since the massive storm hit two months ago. the peace corps has pulled out all volunteers from honduras. it's said to have the highest murder rate in the world. the piece corpse has also stopped training volunteers in el salvador and guatemala. those three countries are

plagued by drug trafficking and gang violence. the cdc is expected to release its latest findings on obesity later today. over 200,000 choose to have weight loss reduction surgery every year. one appears to be more effective than the erie. >> lynnette trotman decided to haveweight loss surgery after being diagnosed with blood pressure. >> i was so happy when i went to the doctor. >> she chose a procedure called gastric banding. doctors put an adjustable band around a apartment of the stomach. trotman thought banding was the safest option but three years later after complaining to her doctor, she had the band removed. >> i told her what is going on, you know. i'm not losing any weight, i'm gaining weight still. >> trotmap's experience is not unusual. more than half who chose gastric

shows clear skies over most of the southwest. there are patchy clouds from georgia up to maine, and it's overcast from the pacific northwest to the great lakes region. in sports the lakers take it down to the wire against the mavs. with less than ten on the clock, the mavs jason terry hits the pull-up jumper to even the score at 70. then fisher goes down down to put the lakers up by three. vince carter could win it at the buzzer, but it bounces off the rim. lakers edge the mavs, 783-70. in boston the thunder roll over the slumping celtics. kevin durant drives the force to put a big jam in under five but russell had the hot hand scoring 26, including the long-distance shot sealing the win. oklahoma stops celtics, 97-88. boston has not lost five straight games. in college ball, the syracuse orange put the crush on

while applause broke out last night when they entered the kennedy center, they entered a tribute for the slain civil rights leader called "let freedom ring." in south carolina hundreds gathered on martin luther king day to protest the state's voter identification law. the law requires voters to show a photo i.d. before they vote. opponents say the vote is meant to suppress black voter turnout. supporters say it's necessary to prevent voter fraud. well, a lot of folks think the civil rights movement got its start in the south. but jim axelrod reports on a trailblazing protest in the nation's heartland. >> reporter: if the sculptures are designed to design a certain pioneering experience, then look no further than this bronze soda fountain. were you thinking to yourself, hey, we're going to make history here? >> no, we were thinking we were going to sit until we were

momentarily. anny hong is in for howard. >> good morning, guys. you'll want your umbrellas. we're seeing light rain come through the area. the roads are wet. temperatures though not as cold compared to yesterday's teens and tos. right now, live doppler 9000 hd, we've got some showers and light rain out there. around the d.c. area and points south right now. another wave of showers coming through. day planner for the rest of today. we're expecting showers through this morning and some rain. temperatures will be in the 40s for much of the morning then into the 50s by this afternoon and we'll be breezy at times with winds out of the south 10 to 15. 20 miles per hour. by 3:00, we'll start clear out a little bit. partly sunny conditions. it will still be breezy. right now, temperatures in the 40s. 45 in downtown. 43 in gaithersburg. annapolis around 44. so, not cold enough to make any snow in the area. here's a look at your 7-day

forecast. breezy through the next couple of days but colder tomorrow in the low 40s. thursday in the mid-30s. a chance for light rain and some snow for the weekend. here's a look at your traffic with monika. good morning. >> good morning, anny. good morning, everybody. the beltway is looking fine although some wet road conditions and some icing in fact, i believe a weather- related accident happened an hour ago. on the westbound side of route 50 at route 424. davidsonville road. the road is still blocked there. you'll have to follow police direction to get around that. that's westbound route 50 right here at route 4. i'll keep you posted on that situation. live look at the beltway. around that area. not too far away here at route 4 near andrews air force base. the roads are wet and some volume already building with traffic headed southbound toward oxon hill. we'll take you back over to the maps. another accident. this one just cleared on the southbound side of i-95. after the franconia,

springfield parkway. at one point, only the left side was getting by. all lanes are open right now. with the yellow, that's indicating there is a bit of slow traffic through that area as well. let's take you over to maryland. no problems to report here on 270 southbound at route 28 in rockville. down to the point where the lanes divide. more on the situation out at route 50 at 4:59. this is a follow-up to a story reported last may when laurence miller was arrested after he questioned the actions of police officers beating another man in a wheelchair. >> miller was since filed a lawsuit against the metro transit police claiming they violated his first amendment rights to free expression. gary nurenberg has the story. >> reporter: this is how he fell out of his wheelchair. metro said he was arrested for resisting arrest and assaulting a police officer arrive being accused of drinking in public and failing to move on. police told witnesses to move on. but onlookers questioned police

behavior. one onlooker in particular. >> i simply said something. what are you doing to this man? he's bleeding. help him. and i was so -- i was told to leave. if i don't leave, i would be arrested. i threw my hands up in this motion and i turned my back and i walked away. at that point, i was arrested. >> what were you charged with? >> i was charged with inciting violence, assaulting a police officer, disturbing the peace and all of the charges were dropped. >> reporter: the charges against the man in the wheelchair, dwight harris were dropped as well. metro conducted an internal investigation of the two officers who were involved in the incident here but when the u.s. attorney declined to prosecute, those officers were returned to full duty. >> mr. miller is innocent of any criminal activity and he was arrested falsely by police. we think it was because he spoke up. first amendment of the coti
