on the westbound side of route 50. you can see all of the red. that means as you come out of an annapolis and parole, expect this heading for the accident with one lane getting by to the left. i'll keep you posted on that. another accident closer into town on route 410 just west of the bw parkway out in the cheverly area. be aware of that as well. we'll take a live picture of 270 on the southbound side. here at father hurley, it is doing fine be. east of frederick and liberty town, we're getting word of a serious accident on route 75 at jones road. i'll keep you posted on that one as well. more on area road conditions at 6:12. back to you guys. thank you, monika. at the top of the hour, let's get a check on some of the stories happening today. congress returns to town and the occupy protestors will meet them on the hill. starting at 9:00 this morning, protestors will rally on the west side of the capitol with an effort of engaging the lawmakers. they'll hold a vigil for d.c.

voting rights. that's later this evening. a debate tonight in loudoun county over whether to bring full day kindergarten to schools there is part of a public hearing on the county's 2013 schools budget. the open forum begins at 6:30 at the school administration building in ashburn. president obama will welcome the st. louis cardinals to the white house today. they beat the texas rangers last fall to win their 11th world series title. they last visited the white house in 2006 when they won the world series back then. >> more bad news for metro this morning. >> it is the subject of a high profile lawsuit. the suit involves the aclu and a man who says metro police violated his first amendment rights. >> delia gonsalves is live at the u street station to tell us exactly what's behind this lawsuit. good morning, delia. >> reporter: good morning, andrea. this stems back to an arrest of a man in a wheelchair. this -- in this very area, back in may. let's take a close look at the video. you can see for yourself what we're talking about. two metro police officers

appear to be body slamming that man, taking him out of his chair and slamming him on to the ground after claiming he was drunk and resisting arrest at the time of the incident, metro said he simply fell out of his chair. well, when his friend, lawrence miller saw this happening, he questioned those police officers. >> what are you doing to this man? he's bleeding, help him. i was so -- i was told to leave. if i don't leave, i will be arrested. i threw my hands up in this motion, threw my hands up and i turned my back and i walked away. at that point, i was arrested. >> mr. miller is innocent of any criminal activity. he was arrested falsely by police. we think it was because he spoke up. >> reporter: so, what's the current status now? the man in the wheelchair is a regular here in the u street corridor. he's fine. he was treated at a local hospital for minor injuries. all charges against that man in a wheelchair and his friend

have been dropped. two officers were metro back on full duty after an internal investigation. we talked to metro this morning. they said they will not comment on pending litigation. andrea, back to you. >> delia gonsalves live at the u street metro station this morning. thank you. >> there will be a bond hearing this morning for the man accused in the deadly crash that left an 8-year-old boy dead. that suspect is 22-year-old victor aldana of fairfax county facing manslaughter and drunk driving charges. police say he was driving sunday near the landmark mall in alexandria. he swerved off the road, hitting an 8-year-old boy and his mother. the child died. the mother is recovering. aldana is being held at the alexandria jail. flags will fly at half staff across maryland today honor matthew seidler. the 24-year-old was from westminster and an airman first class. he died january 5th in the roadside bombing in virginia. new at 6:00 a.m., the

number of children living in poverty in virginia is now at its highest rate since 1998. the group voices for virginia children file its annual report today to state lawmakers. they hope legislators will up the money spent to help the children. it finds 265,000 children in virginia, 14% live below the poverty line. that line is a family of four earning $22,000 a year or less. the number of children living in poverty has increased since the economy began going south back in 2007. so, have you noticed gas prices are creeping up? aaa predicts we'll get back to $4 a gallon by the spring. this morning, regular gas is about $3.40 a gallon, up 3 cents from last week. aaa mid-atlantic says this is the highest prices have ever been at the start of the year. >> unfortunately, it looks like it will be this way for awhile. usually, what we see is that prices are low at the beginning of the year and inch up during the spring.

with them starting off high at the beginning of the year, they'll continue to inch up during the spring. >> aaa says the price of crude oil hasn't helped. that's up $24 a barrel, just since october. and the experts say that has increased global demand and optimism about the u.s. economic recovery are among the reasons. jessica doyle is here with her latest get hired report. >> local jobs spect what she's talking about. >> the latest economic figures are showing some glimmers of hope when you talk about the job market. so, is this the year things are finally going to improve? a local economist is reading the tea leaves. you may be asking yourself when is this economy ever going to get better? believe it or not, we've already experienced ten quarters in a row of recovery. the economy is better but just a little bit. >> it is the norm. it is only slow when you're used to driving 60 miles per hour. >> dr. steven fuller runs the center for regional an appear

sis at george mason university and last week prepbged his expectations for local economic growth before a group of over 600 bankers. the good news, the local job market is growing, just not as fast as anyone would like. >> we climbed out of the hole. we're almost to the lip of the hole we dug during the recession. it was a very deep hole. >> reporter: this time last year, the d.c. regent joyed the fastest job growth in the country. now, we have the slowest employment market among major metro areas. >> the economy has changed dramatically. and it has gone through some wrenching shifts. and they're not over yet as federal government begins to cut back and contribute less to the economy. >> but the local employment news isn't all bad. new jobs are being created this year and the future looks a lot brighter. this year, the local economy is expected to pick up 23,000 new jobs. in 2013, that number jumps to

29,000. 35,000 new jobs are expected to be added in 2014 and 2015 could be the best year in a long time with 41,000 new jobs coming to the washington area. >> altogether, 14 and 15 should be a really strong performance. >> strong compared to the last few years. >> now, we are further along in our jobs recovery than the rest of the country. almost back to where we started before the recession. fuller expects that the nation as a whole won't be able to recover all of the jobs it lost during the recession until 2019. that is a remarkable stretch of joblessness. >> that's incredible because you're adding new people all of those same years as well looking for jobs. >> we need to maintain 300,000 job creation numbers per month to even bring down the unemployment rate 1% by the end of the year and it will be a long time before the economy is

families who are -- who would love a child. any child and it is just heartbreaking. i don't know. we're pretty torn up about it. >> police have not made any arrests in the case and they're hoping to identify the baby's parents. the man charged with a string of home invasions in montgomery and prince george's county goes to court today. 33-year-old kevin darnell ray has a bail review hearing in rockville. in temple hill friday, police say ray bound six victims including a child and sexually assaulted one person. police say he also tied up a family in bethesda and sexually assaulting the cleaning lady days earlier. officers found and arrested ray in north carolina over the weekend. >> both police departments understood the threat and also the terror that was caused in the community and we worked around the clock to make sure that we could put an end to this and we have. >> ray is no stranger to police. he served 18 years in prison for manslaughter.

and is on the maryland sex offender registry. coming up today, the aclu is going to announce a major lawsuit against metro. it involves a man who says he was just trying to stop police from assaulting a man who was in a wheelchair. delia gonsalves is live outside the u street metro station with the story and that's where that alleged assault or help, however you define it took place. >> it is a complicated story but really, i think the emotion lies in the video. lawrence miller is the friend of the man in the wheelchair. it all happened right around here back in may. he says on this very sidewalk, his first amendment rights were violated. let's take a look at the video i mentioned. miller witnessed his friend being thrown from his wheelchair, slammed to the ground by two metro police officers. at the time, metro said the man was drunk, resisted arrest and fell out of his chair. miller tells us when he spoke up against the treatment, he was arrested for it. we spoke to his attorney who

says they are fighting for his first amendment rights. the right is well- established. it just has to be re-emphasized over and over every year and every decade. >> i believe that anybody and everyone has the right to question the police about what they're doing. everyone has the right to ask what are you doing? why are you doing this? >> reporter: now, the man in the wheelchair is ok. he was treat and released from a local hospital for minor injuries. both charges against both men were eventually dropped. the two officers with metro were placed on leave pending an internal investigation. now, they're back on full duty. we contacted metro this morning. they told us it is their policy not to comment on pending litigation. mike, back to you. >> thank you, delia gonsalves live at u street metro station this morning. as many as 15 new security cameras will be going up in georgetown. they'll be able to see activity up to 200 feet away, record license plates, even zoom in on

the laws are supposed to crack down on sales of prioritied u.s. products overseas. unintended consequences would hamp irtheir ability to put up content in general. "the washington examiner" reports that governor martin o'malley is feeling pressure from union members to raise tax on the rich to close a gap of $1 billion. o'malley initiated a millionaire's tax raising the rate another 14%. that went away in 2010. maryland has the highest share of millionaires in the nation. more than 7% of households. some republicans and economists say a year after the millionaire's tax was implemented, the number of millionaires filing tax returns in maryland plunged leading to the conclusion they simply moved out of state. if you are craving burger king but you just don't feel like leaving the house, there may be a solution.

ashburn. it has been there for 20 years but the district and prince george's county are exploring options to build facilities within their borders. than $25 million in aid to virginnians reports from last year's earthquake. most of the money comes as low interest loans. luis is a county was hardest hit with just the schools there suffering $80 million in damage. maryland state police make six arrests at an occupy baltimore protest. "the baltimore sun" reports they tried to set up a structure of some kind on a site proposed for juvenile detention centers. the group says it wanted to have a five-day campout at the site. despite the cold, a good showing for yesterday's martin luther king jr. parade in southeast washington. it has been put on hiatus since 2004 but community organizers brought it back. we'll let you check it out. one more look at traffic and weather is next here on 9news now.
