d.c. council session today. council member says it's a tragedy that could have been prevented. we have done some checking. the city does have a safe haven law, but it wasn't until thanksgiving that signs let mothers know that if you can't take care of that child, you can drop that baby off at any hospital without penalty. >> this is a desperate move by someone who is facing some real issues. >> this is an example of a law. people just don't know it exists. >> jim graham, chairman of the council says the safe haven law would have prevented such a tragedy. >> it takes a horrendous tragedy like this to get the job done. i think now you're going to see a lot of broadcasts. a lot of information about this law's intentions and prospects. >> chief lanier says she has taken this personally, as are the men and women investigating this case. i got a couple numbers. you can text unanimously any information you might have.

before driving. that's like drinking ten glasses of wine. >> maria is the grandmother of 8-year-old brian hernandez chavez who was killed on sunday afternoon. his mother was severely injured when a drunk driver jumped a curb and barreled into them. they were walking to the mall along duke street just past the i-395 overpass. >> i can't believe he's gone. he was like a little brother to me. >> brian's uncle says he watched his nephew after school. >> he likes sponge bob and soccer mostly. >> the family's grief is drenched in anger at 22-year- old victor aldona who had a blood alcohol content of .15. he is charged with dui manslaughter, dui maiming, wreckless driving and no

operator's license. >> he is stupid for not turning and he hit my nephew and my sister-in-law. >> not only do they live in the same apartment complex, but she says she spoke to him at the place where he used to work and the place where he has been working. the kfc. the manager and coworker says he was a good guy and hard worker. they never saw him drunk. >> when he's here, he worked hard. he looks out for people. he takes care of business. >> you're very surprised to hear what happened in. >> definitely. i was. >> no one is more shocked than brian's family. >> he was here on saturday. she took care of him on saturday and there's a candle right there where he was sitting. >> brian hernandez chavez was his mother's only child. she is in fairfax hospital with two broken legs and a broken pelvis. as well as other injuries.

her family says that all she remembers is being hit. she remembers nothing after that and her family says that doctors have told them not to talk about her son. so it's really unclear how much she knows about what happened. horrible. >> this is really, really sad. thank you, peggy. back to you. >> one awful story to another. sighting a horrendous criminal record, a maryland judge ordered kevin ray to be held without bond for the home invasions in wheaten, temple hill. he confessed and said he went on the spree after his partner was killed while they were holding up drug dealers in d.c. bruce leshan brings us the story from rockville. >> yeah lesli, we just heard a couple of things from kevin ray in the courtroom right behind me. we heard him say yes, okay, how do i see -- >> kevin ray used crutches and spent most of the hearing

hunched over, growning like he was in a great deal of pain. authorities say he was injured, when he ran from police and resisted arrest. >> i'm not going to speculate whether or not he's in real pain. >> they don't have to speculate about the crimes. he has confessed. in a wheaten garage, he pointed a gun at a woman and threatened to kill her and her baby if she failed to hand over her money and her credit cards. in bethesda, they say he forced a 14-year-old boy to tie up his own mother. sexually assaulted the housekeeper, and forced her to shower because he knew his dna was in the sex offender registry. in temple hills, he threatened to kill a baby. bound six people with zip ties and rape add young mother. >> there were children involved in each incident. there were threats to kill not only the women in these cases, but also to kill their children. >> and ray allegedly told

police that all this started after his partner was killed. they have been holding up drug dealers in d.c. the ultimate acts in a criminal career that had already seen him charged with first-degree murder and first-degree rape. >> the defendant has prior convictions for manslaughter, armed robbery, and use of a handgun in the commission of a crime of violence. >> that was bruce leshan reporting. police tell them they are still looking for a second man who was at the scene in bethesda. we'll have more on that coming up at 6:00. >> well lesli, rainy, mild, great looking day today. getting ready to get chilly and colder. topper is on the terrace with that forecast. >> no jacket required, at least right now. temperatures in the upper 50s. we'll start with temperatures because it is extremely mild. we talked about salvaging a nice afternoon. 55 in gaithersburg. mid 50s in frederick. 61 in fredericksburg down 95

>> we hope in this way we can reach all the places that haven't been inspected yet. >> they are looking in the murky water for anyone who may be alive. search crews found more victims tuesday. captain frank chess koa francesco schettino is in a lifeboat during the evacuation. the coast guard official yelled. telling schettino, get on board. you are aware it is dark and we can't see anything. the official says get on the ship and tell me what can be done. video shows some of the passengers have to climb down the side of the ship using rope ladders. now there's a new problem. the wrecked ship contains

500,000 gallons of fuel. >> dutch engineers are here waiting for the go ahead to start the delicate process of extracting the fuel. that could begin as early as wednesday. the water around the island is a protected marine life sanctuary. crews have already placed boons around in case of a spill. but as rough seas move the ship, officials say the risk of a leak increases. anna, cbs news, italy. and it is estimated the process to extract that fuel from the costa concordia could take four weeks. lesli. >> more fallout from the corruption scandal involving harry thomas, jr. 55-year-old james garvin was formally accused of helping to funnel $300,000 to the fund. to the ward 5 democrats. garvin, a golf pro, is the third person charged in the alleged scheme. he is expected to plead guilty tomorrow in u.s. district court. congress was back in

session today and occupy protesters were there to meet them. demonstrators gathered today on capitol hill for what they hope would become the largest gathering of occupy activists from around the country. lindsey joins us live. we understand there were some arrests. >> well you know what? there were some arrests. this is an event going on all day. this began at 9:00 a.m. it's supposed to last until 11:00 tonight. the protesters started on the west lawn and now they are marching throughout the city. they already marched in front of the house and now they are on their way down constitution avenue. this is a day that is historic and some confrontations. >> people from across the country came here to make a point about congress. >> all of them have bought into the appropriate scheme. the wall street revolving doors. there's not a single representative that is not

taking corporate money. if you are in congress right now, taking the corporate money and part of the system that is corrupted our democracy. >> they are occupying the line. the capital police are keeping the sidewalk off limits. a few protesters taunted police and crossed through. some of their efforts resulted in arrests. >> first of all, they have to stop me. what's going on here? and obviously they want to make sure i was not armed. >> this man is a retired police captain from philly here to prove that the occupy movement represents everyone in america. >> when they see me, mainstream america sees me, they might pay more attention to what's being said, because corporate media cannot marginalize me. >> it's been a historic day. >> coming here to congress wasn't because we have our demands and we have our goals and we want congress to listen. >> of course, protesters are coming up the street. the police are escorting them to make sure that nothing else

only on 9, a frayed and tattered american flag flying at francis scott park. it's a story you first saw on 9 last summer and the national park service replaced it the next day. last week we got an e-mail from a viewer that said it was again in very bad condition. so we sent our kristin fisher down to that georgetown park to investigate. four days before the fourth of july, this frayed flag was flying above the very monument to the man who wrote the star spangled banner. >> the ends are frayed and the individual stripes are starting to tear from each other a bit. >> national park service admitted it was their fault. one day after the story aired, a new flag was gallantly

streaming. six months later, we got an e- mail from a viewer. an army captain that wants to remain unanimous. once again, the flag at francis key park is frayed on the top edge and flying in a disrespectful manner. >> it's important to show respect with a new flag, not an old tattered flag. i have never noticed a problem with the flag. i see it every day. at the same time, if there is a problem with the flag, this is certainly one that got great symbolic importance. >> this flag is not your average american flag with 50 stars. this flag only has 15 stars. just like the flag that inspired francis scott to write our national anthem. not only are they harder to come by, but this flag is constantly exposed to the wind. the national park service says the staff of rock creek park deeply regret the condition of the flag and will recommit our efforts to regularly monitor it. sure enough, just 24 hours after we notified the park service, the flag was replaced.

we begin this half hour with an ambitious new plan to treat and prevent alzheimer's. >> the obama administration told scientists they want treatment options that work and they want them by the year 2025. here is terrell brown.

>> russell patterson knows all about the devastation of alzheimer's. his mother struggled with it for seven years. he encouraged to hear the government is finally taking it on. >> like cancer, something we need to find out more about, if anything. that's a great move on obama's part. >> the administration is developing the first national plan for tackling alzheimer's. the goal is to develop prevention and treatment by the year 2025. the alzheimer's association says the goal is realistic if the commitment is there. >> we are going to see whether this is a plan that will remain an aspiration or whether it's a battle plan that is back by the resources needed to really end this disease. >> president obama signed off on the project last year and a committee of his experts is under a deadline. >> the group is in a two-day meeting to hammer out its game plan. over 5 million americans suffer from alzheimer's. thinking and behaving, but it's the only disease among the top

killers for which there is no prevention or cure. >> someone has taken the initiative is a good thing for me. >> doctors expect alzheimer's to grow. the government is hoping it can stop that trend before it happens. terrell brown, cbs news, washington. >> and the alzheimer's association says it expects to see a final plan this spring. >> americans are not putting a dent in the country's obesity problem. a new study out from the center of disease control and prevention shows 1/3 of adults almost, almost 17% of kids were obese from 2009 to 2010. that's exactly the same from 2003. researchers say although there hasn't been an increase, the fact it stayed the same is worrysome. mainly because type 2 diabetes is linked to obesity and it gets worse as you get older. tonight, animal control

officials in howard county are investigating a case in which 40 dead pets were found in the columbia home. now it happened yesterday afternoon when a property manager smelled odors coming from that townhouse. they were not pleasant. 19 dead animals were found in the freezer, including birds, rabbits, even a hermet crab. 20 others were found in cadges or loose running around the house. investigators believe she may have been involved with a nonprofit animal rescue group. lesli. more trouble for metro. this time a man is suing the tran agency. delia has details. >> lawrence miller is suing metro saying his first amendment rights were violated back in may in an incident right here outside of the u

street metro station. standing with his attorney outside federal court, lawrence miller says he is fighting metro. back in may, miller witnessed his friend being thrown from his wheelchair and slammed to the ground by two metro police officers outside a ustreet metro station. metro said his friend was drunk, resisted arrest, and fell out of his chair. miller says when he spoke up against the treatment, he was arrested for it. >> any time you stand up to something, there's consequences. you know, for anything. for every action, there's a reaction. and at that time, i wasn't even thinking about the reaction. i was just acting. >> aclu stands for the first amendment. the right of free speech. and the officers need to know that it applies to their work as much as it does to anyone. >> the two officers were returned to full duty after an internal investigation by metro. it is metro's policy not to comment on pending litigation. on u street, delia goncalves.

secretary of state, hillary clinton, could be questioned in the wikileaks case. that's if the attorney for bradley manning gets his way. manning, a 24-year-old intelligence analyst is accused of causing the biggest leak of classified information in u.s. history. the army still trying to decide whether or not he aught to stand trial. meantime, manning's attorney accuses clinton of over stating the harm that the release of those documents has done. >> some of the internet's biggest websites will go dark tomorrow. protesting an antipiracy bill, critics say will end the internet as we know it. the blog, and cheese burger, comedy network, all planning to shut down. protests their response to the online piracy act. that bill aims to crack down on copy write infringement. if sopa passes, copy write holders would be able to

complain and get websites shut down. opponents say that could lead to americans losing access to sites all across the web. and a group of shareholders claim the company gave false statements about its business practices and contract. once the alleged fraud became apparent to the market, netflicks suffered a nose dive. so far, the company is not commenting. the competition is on at george washington university. student organizations are competing to see who can collect the most phones. the winning organization will get $3,000 from the university. second place gets $2,000. and third place gets $1,000. the phones will all be recycled and the proceeds will go to fund technology projects in the democratic republic of congo and nepal. a homeless teenage science whiz has been invited to watch president obama's state of the

46-year-old was killed when his pickup was hit by a tractor trailer on maryland route 75. that's south of jones road. the crash closed the roadway for four hours this morning. maryland state police say charges against the driver of that tractor trailer are pending. >> general service's administration is refusing to budge. at least when it comes to the mileage reimbursement for federal workers. the rate will remain at 51 cents per mile. the workers using their cars for federal business. the standard rate is higher. 55 1/2 cents per mile. it decided to stick with the lower rate after an independent analysis. if you have a clunger in your garage, you have plenty of company. a new report finds americans are hanging on. the average age of a car is now almost 11 years. the research firm says that's a record. the average age per truck is 10.4 years. the report says drivers are putting off on buying cars and

in tonight's consumer alert, apple's decision to pull the ice from its flag ship store has fueled an explosion of counterfeit ipods, ipads, and computers. and they are being sold inside

a fake apple stores. this highly organized black market is very profitable for the thieves. the markup on many of the knockoffs is about $100 more than the official apple price. and steve jobs may have been an i con to many, but one chinese manufacture will not be moving ahead to produce an action figure of the late apple founder. his family pressured the toy maker to stop the project. that $99 would have featured jobs trademark glasses, black turtle neck, jeans, and sneakers. along with a spike in the use of devices like ipods, the number of injuries to pedestrians wearing headphones has also spiked in recent years. and that's according to a university of maryland study. researchers found those injuries have tripled nationwide since 2004 and 7 out of 10 are fatal. the author of the study blames distraction in sensory dep vision for the accident.

glimmers of hope for the job market for the latest economic figures. so will 2012 be the year things turn around? jessica doyle spoke with a local economist. >> you may be asking yourself, when is this economy ever going to get better? believe it or not, we have already experienced ten quarters in a row of recovery. the economy is better, but just a little bit. >> it is the norm. it's only slow when you are used to driving 60 miles an hour. >> the doctor steven fuller runs it at george mason university and last week presented his expectations for local economic growth before a group of over 600 bankers. the good news, our local job market is growing, just not as fast as anyone would like.

>> we climbed out of the hole and almost to the lift of the hole we dug. it was a very deep hole. >> this time last year, the dc region enjoyed the fastest job growth in the country. now, we have the slowest employment market among major metro areas. >> the economy changed dramatically. and it's gone through wrenching shifts and they aren't over yet as federal government begins to cut back and contribute less of the economy. >> the local employment news isn't all bad. new jobs are being created this year and the future looks a lot brighter. this year, the local economy is expected to pick up 23,000 new jobs. in 2013, that number jumps to 29,000. 35,000 new jobs are expected to be added in 2014 and 2015 could be the best year in a really long time with 41,000 new jobs coming to the washington area.
