and so far it appears most of those protestors are standing their ground. they refuse to leave. and officers have not moved in. at least not just yet. matt jablow is has down there all night long. he joins us now with details on the showdown that just hasn't been a showdown so far. matt. >> reporter: derek, almost exactly four months after they began camping out here, occupy protestors are still here, but their lengthy stay could be about to end. about 11 hours when campers were told to stop camping out, all was quiet. though many don't expect it to stay quiet. >> i hope no one gets abused in this process. >> reporter: occupiers are fearing a repeat of yesterday when police shot a protestor with a taser gun when they said he aggressively confronted officers about flyers they were handing out about the camping

band at mcphearson square. earlier today, u.s. park police officers walked through mcphearson presumably looking for violations but so far nobody has been arrested today. >> we would like to start your dreams. >> reporter: meanwhile, a few protestors could be seen rolling up their sleeping bags and blankets, though it doesn't look like many tents have been taken down. in fact, they put down a large blue tarp, what they call a tent of dreams, over james mcphearson, a civil war hero whose last name is now synonymous with dc's so far peaceful occupy movement. >> we want to be able to sleep here so we can dream of a better world where everyone has access to health care, education and housing. the tact full purpose of this is to ensure if they arrest one of us, they'll have to arrest all of us or none of us. >> reporter: so far the national park service has given absolutely no indication as to exactly when they'll begin enforcing the ban on camping here at mcphearson square and at

injuries. however, neta marco lives 10 miles outside of mineral, and she says her dog knew it was coming. >> she started barking like something was out there. and then about 20 seconds later, it hit and shook the whole house. and by then, she's really barking and getting upset and me along with her. but i'm not barking, of course, but i was upset. i thought it was the big one again. i mean, we all think that around here when these aftershocks hit. >> and you can't blame them for being nervous because back in august you remember mineral was the center of the 5.8 tremor that rumbled up the east coast and caused significant damage to the cathedral and washington monument. so, top, another look at a quake in our neighborhood. >> yes. there are fault lines in virginia. we talked about this over and overment they run back into tennessee and southwestern virginia. let's start with where it is. we'll start wide. we'll show you where the metro area is. and the quake down to the south

and west of us. and you can see that it is in the same spot. north of 64 and we're looking at not too far from charlottesville. it's west of 95. here is fredericksburg and just west of 64. not too far from charlottesville. exactly where it hits, 2.1 miles north of yanycville. if you were driving your car, there was a lot of comments on facebook, you didn't feel it. but if your dogs were barking, you did feel it. what about the wakeup weather? we're looking at temperatures tomorrow generally in the -- well, generally in the range of temperatures in the 30s to start. and then we're looking at temperatures warming up. i'll get to the wakeup weather in a minute. i promise you it's going to come up in a minute. temperatures generally back into the 30s. and then back into the 60s. in fact, we are looking at temperatures -- okay. i won't -- i give up.

we are looking at temperatures bouncing -- here we go. bouncing back up to the 50s. now, it's going to be cold to start so grab a coat. and then 45-50 by 9:00. we're going to end january on a very april-like note. >> that quakes make it tough on everybody. >> it does. a new washington post poll finds the largest majority yet supporting gay marriage in maryland. but the numbers are hardly overwhelming. opponents of the bill to legalize gay bill rallied to keep together the coalition to stop the measurement last year with just a handful of votes short. lawmakers from prince george's county are the ones holding the crucial votes. >> marriage should be defined between what? >> one man. >> and what. >> one woman. >> there you go. democratic african-american church goers and a latino minister putting it into words. >> a cross denomination al racial denying. tonight we are one. >> reporter: tonight's rally against gay marriage comes as a new poll finds the largest number of marylanders yet 50% in favor of gay marriage with 44% opposed. senator richard matalino raising two children with the same sex partner is not surprised. >> people are becoming more used to it because it's not a mystery. >> you can't stop us from loving each other. >> reporter: gay marriage passed the senate last year but it fell short in the house of delegates. as representative after representative switched sides during the final floor debate under pressure from powerful church leaders. >> this was rolled out with compromise assurances that no church would be forced to perform or recognize same sex

marriage. >> we don't want their protection. >> reporter: that did not go over well tonight. >> they have not been to our churches. they don't know our doct rins and they don't know our god. [ cheers and applause ] >> reporter: at the state house in annapolis, scott broom, 9news now. >> and maryland first lady katie o'malley apologized over the weekend for calling opponents of gay marriage cowards. an ironic and heart-breaking murder mystery. friends and family of lenny harris say he spent his life trying to head off violence and tonight police are looking for whoever killed him. he disappeared from an alexandria rec center last september. within hours cameras captured somebody trying to use his bank card. but it was not until late last week that a unanimous caller said they would find his body in the bottom of a well in washington. >> this guy's life is gone. his daughter don't have a father

no more. his wife doesn't have a husband anymore. it's just bad. it's real bad. >> police spent nearly three days excavating his body from 23 feet down to the bottom of the well. finally they got his remains out on saturday night. officers are still unsure if harris had been targeted or if he was just a victim of random violence. halt service. >> just days after this protest in dc, frustrated customers sent another message to pepco. they took their fight to the dc public commission. they are outraged over the $42 million raise increase for dc customers. that translates to 5% increase for a typical resident or just over $5 a month. >> we want them to fairly pay their fair share in taxes and

create jobs by using their tax refund which is $800 million. use that money to create jobs. >> pepco says the request to raise their rates will allow them to continue improving service. the public service commission is expected to make a final service sometime in late april. until then, the record is still open for comments, at least until mid march. well, dc mayor vince gray has responded to an effort to recall him from office. he calls the move ill advised. leading the effort is a political activist called frederick butler and he'll have 180 days to collect more than 45,000 signatures. for the record, nearly every single mayor of dc has been the target of a recall, and none of those tries has ever succeeded. and there is a good news for the mayor today. the district may be in the best fiscal of any major sicz. dc has a -- city.

dc has a $240 surplus but taxpayers will not be seeing a dime of that. instead not while the district's long time cfo wants to keep the surplus as part of a rainy day fund and the mayor says, yes, that's a good idea. >> this is one time money. the surplus represents money that we will get every year going forward. >> people are tired of being nickelled and dimed to death and we take every option to see if there is some relief. >> they point to higher fees and fines, a tax increase on businesses and a high end earner income tax. well, now to the latest from campaign 2012 and the race for president. in the morning, voters will head off to the polls in the florida primary. mitt romney has a double digit lead over his closest competitor newt gingrich.

tonight romney is using the polls to sock it to gingrich but newt refuses to say uncle. >> i know the speaker is not real happy. speaker gingrich. >> we nominated a moderate in 1996 and he lost. we moderated in 2008 and he lost. mitt romney is more liberal than either of those candidates. >> ron paul and rick santorum fell far behind and both candidates have already moved on to other states to campaign there. the end of the world. that's how one witness described the massive pileup along a florida interstate that killed 10 people and injured at least 30 others. now the 911 calls from yesterday more than's crash are out. >> is there anybody in there that you can see? >> there's a lot of people it looks like. >> you see a lot of people. are they lying down?

moisture has come back in in part thanks to the southwest wind. that will keep us out of the 20s tonight. so here is the deal. a light jacket today for tomorrow. that's probably about all you're going to need really. and then more like april. not like january. temperatures around 60 as late march, early april. locate your umbrella for wednesday. it's still going to be warm on wednesday. and then the evening commute may be wet wednesday. in fact, parts of the morning commute may be wet as well. the next system is not a huge rain maker, but enough to wet the roads and cause minor problems. overnight clear skies, cold. lows 28-36. these winds southwest 10-15 will keep us out of the 20s because air mass is still fairly dry. tomorrow morning, mostly sunny, breezy and chilly. jacket and sunglasses. you're going to need the jacket in the morning with 30s and 40s. by afternoon, kind of like a spring day. you'll end up carrying it over your shoulder. mostly sunny, breezy and warmer. the southwest winds will drive
