public transportation, no problems to report. trains are on time on metro, marc and vre. more on area roadways coming up at 5:10. u.s. park police are quietly enforcing a no camping rule at mcpherson square and freedom plaza. >> so far no arrests have taken place and police have not started any forced evictions so far. deal ya goncalves is live. >> reporter: it's quiet considering yesterday's deadline was looming. the deadline has come and gone and here we are still are. folks are still here and the tents are still here. but since the deadline, take a look at this massive tent that folks have erected, this blue tarp. it's over the statue of major general mcpherson. they have erected that we're told in peaceful protest. the tarp they're calling the tent of dreams. it was erected just after yesterday's noon deadline.

now, i've spent some time throughout my coverage of this story, nearly four months now, taking a close look at the park rules. i've learned that defacing the statue is also one of the prohibitions here at the park. so it is absolutely unclear just how long police will allow this activity to continue but protesters say they are here for the long run. >> we want to be able to sleep here so we can dream of a better world where everyone has access to health care, education, and housing. the purpose of this is to ensure if they a try to arrest one of us, they'll have to arrest awfully us or none of us. >> reporter: take a look live. we have some folks who are actually sitting down on the sidewalk here playing scrabble. we've been told they are allowed indeed to have a 24- hour vigil. they're not allowed to sleep so some folks, perhaps these folks are staging a 24-hour -- staging -- i'm sorry, sir --

live tv. absolutely. some people are staging a sleep strike. other people are sleeping elsewhere and will only come here during the night to keep a presence here at the park. we'll have another live report coming up in a half-hour. back to you. >> delia reporting live under live conditions. members of congress plan to rework the keystone pipeline proposal. the president obama rejected the extension earlier this month. it would have carried oil from canada to the gulf of mexico. supporters say the plan will help the u.s. gain energy independence. opponents are concerned about the potential environmental effects. the president said he only rejected the plan after congress gave him a two-month deadline to make a decision. he said the administration just needed more time. another after shock has jolted mineral, virginia. 3.2 magnitude quake hit around 6:40 last night. so far we haven't had any reports of any serious damage or injuries, but back in august

mineral was the center of that 5.8 rum letter that rum bammed up and down the east coast -- rumbled up and down the east coast causing significant damage to places like the washington monument. people in five counties and the city of fredricksburg who lost jobs as a result of that powerful earthquake last year face a deadline this week. they need to file by thursday for disaster unemployment assistance. that aid is intended for the unemployed people who live or work in the disaster area and are not covered by state unemployment insurance programs. in addition to fredricksburg, the disaster area includes culpeper, orange and spots vin ya counties. -- spotsylvania counties. governor martin o'malley is expected to testify in favor after bill to legalize same-sex marriage in the state. his testimony will come just hours after opponents of gay marriage rallied in front of the statehouse in annapolis. several speakers made reference to maryland's first lady katie

o'malley's comment that legalization of same-sex marriage failed last year because of cowards in the house of delegates. the first lady made the comment at an annual conference thursday. the very next day she said she regretted making these statements. the average price for a gallon of gas in maryland is about $3.51. but a new proposal from governor o'malley would tack on another 21 cents on top of that. o'malley says he supports applying the 6% sales tax to gasoline. right now gas purchases are exempt from sales tax in maryland. o'malley's proposal would leave the state's 23.5 cent gas tax in place. a state transportation commission estimates a 6% sales tax on gas would bring in $613 million. o'malley plans to introduce the measure after wednesday's state of the state address. just about 5:07. time for the latest your money report. >> jessica is here with the

headlines. good morning. good morning. busy day ahead for wall street. we're already seeing stocks jumpingover seas on new signs europe is continuing to get its debt crisis under control. and investors here at home are looking ahead to new reports on home prices, consumer confidence and of course earnings season is full steam ahead. as for stocks it was a pretty flat session by the close. checking the numbers. the dow stands this morning at 12,653. dropped almost 7 points in trading yesterday. nasdaq was off by about 4.5 and the s&p 500 was down 53. european leaders have agreed on a pact to move to a closer fiscal union. earlier this morning they signed off on details for a permanent bailout fund for the disiewr row zone. investors are still waiting for greece and its creditors to sign off on a debt reduction deal so it can secure a crucial investment of bailout money and avoid missing an upcoming bond payment. pep boys is going private. a private investment firm is buying the 90-year-old auto parts chain of the the price?

as you can see here in springfield, this is pretty much what it looks like across the occoquan river. all lanes open to 495. more on virginia roadways coming up again at 5:18. back to you, andrea. here's a look at the headlines. a team of united nations monitors is inspecting iran's nuclear facilities. there are concerns the iranians are developing nuclear weapons. both the united states and several of its european allies have enacted sanctions to punish iran for its nuclear ambitions. the iranian foreign minister told the u.n. inspectors they can stay for as long as they like. investigators are trying to find out why interstate 57 in florida was reopened after being closed due to heavy smoke and fog. 15 minutes after cars were allowed back on the road, chain reaction crashes littered the highway. ten people were killed. 16 more injured. the florida highway patrol defended its decision to reopen the road saying the visibility was clear whether they did but

it deteriorated quickly again. the historical kennedy home in hyannisport, massachusetts has been donated to the kennedy institute. it fulfills a promise made by the late senator to his mother rose that the home would be preserved for charitable use. the institute is working with historians to determine the best way to preserve the home. it will eventually be open to the public. it is primary day in florida, but two of the republican presidential hopefuls have already left and went to colorado. >> we'll have more on that plus your weather first in less than three minutes. you're watching 9news now.

good morning. welcome back to 9news now. before we begin with howard's weather first, i want to say good morning to the students and faculty at the apostle school in camp springs, maryland. i was there with some of the kids there. it's catholic schools week nationwide so they invited me to come and speak to the students, as a product of catholic schools in new orleans. i got a great gift basket. i was going to bring it in but it was too heavy. inside the basket is my lovely little mug which says welcome to me on the sign which i knew where i was going. i also received a mug and it says andrea roane, st. philips

planner. you're going to like it. a good deal of sunshine. by noon we're in the mid-50s. 3:00 low 60s. we're going to top off maybe 63 at reagan national. then for 6:00 p.m. we're still in the 50s under mostly clear skies. just a partly cloudy expected overnight. we've got readings in the 30s and 40s. the cold spots being in the mid- 30s. up in cumberland, if you were with us last hour, they were 30 degrees. winds kicked up. we go from 30 to 43. there's a lot of warm air just off to the southwest like in lurray at 48 where locally we're looking at readings still 30s and 40s. these are the wind chills. just a little bit after windchill so it feels like it's in the 30s to around 40 at pacs river. our weather camera, nice and clear. very good looking morning out there. 41 degrees with clear skies. southwesterly winds at 7 giving us the windchill at 36. the dew points in the teens yesterday are now in the mid- 20s. the air still nice and dry with

53% humidity. national temperatures really tell a story. you can see the green sunning up here, this warmer tongue of air from chicago southward, kansas city, little rock, all in the 50s. dallas 61 at this hour. there's a front that's going to be coming across the midwest bringing up the warmth to us the next couple of days and also some moisture out of the gulf of mexico. today other than a passing cloud or two, i think we're going to be really mostly sunny and rather mild throughout much of the afternoon. as we head toward tonight and tomorrow, a little moisture increases with clouds and maybe just a stray sprinkle overnight. tomorrow we'll start off perhaps with a few clouds and maybe an isolated sprinkle or two. a lot more showers by wednesday afternoon in pennsylvania and west virginia. we'll just have to see how much of it can hold together in the afternoon and come across the region. as we head into thursday, looks like the better chance for any showers on thursday will be south as opposed to north of d.c. but certainly cooler as the chillier air starts to work in. but nothing horribly cold is

you have a point. >> temperatures in the 30s and 40s to start. you'll need a jacket. grab the sunglasses because we're going to be in a nice place this afternoon whether or not we're eating lunch outside. temperatures in the mid-50s in d.c. by noon. some areas south and west of town could be in the upper 50s by then with highs today between 60 and 65. your drive home temperature still a very comfortable 59 degrees. right now we're 41. and we are looking at some 30s in just a few spots. clouds to our north last night. they're gone. another batch of clouds coming in right now. so we'll have a few clouds for a few hours. look at the big difference in temperatures depending on winds and clear skies like 34 in leesburg but 55 in peters bug, west virginia. -- petersburg, west virginia. 39 gaithersburg. we are at 41. monika, how is it looking this tuesday morning on the roads? it is looking just final. thank you for asking, howard. things are great if you're heading out the door at 5:32 in the morning.

all lanes are open on the west side of town. no problems to report on the dulles toll road or 66. we'll head over to the north side. if you're planning to head on the outer loop, it's 64 miles an hour at georgia avenue. that's good news for you. in fact, let's go outside live right now. if you're planning to head over to that area, no problems to report. this is 270 at falls road coming down to frederick. you can see the volume building but no big delays to report as you head for urban that and germantown. back over to the map, this time we'll head a little further east. bw parkway and route 50 coming in from annapolis, you're fine. bw parkway from baltimore no reports to -- no problems to report. no problems in from annapolis past this point to the beltway. more on area roadways once again at 5:41. >> thank you, monika. u.s. park police have quietly begun enforcing a no camping rule at mcpherson square and freedom plaza. the site of the occupy d.c. encampment. >> so far there have been no arrests and no forced evicts,

but some protesters say they are prepared for any possible confrontations with police. delia goncalves joins us with a look at how things are going on there. there's a big tarp there. >> reporter: it's a huge tarp. according to the rules i looked up t is against the rules here at the park to deface that statue. so it's unclear as to how long park police are going to let this activity continuing, but i should tell you since our last report which was interrupted a bit by an occupier who was pretty vocal, police have actually responded here. several park police officers are patrolling the area here around mcpherson square. apparently another news organization is here and had called the police after some unruly protesters but i can tell you i've done plenty of stories on these folks and most of them outside of some bad apples are staging peaceful demonstrations this evening and this early morning i should say. just after yesterday's noon no

camping deadline, the protesters erected that blue tarp called the tent of dreams over the statue of major general mcpherson. many say they are staging a sleep strike or simply sleeping elsewhere during the day so they can maintain a presence here at night. they all tell me they are prepared for arrests. >> i hope that no one gets abused in this process, even though we're all kind of reacting to systemic abuse being here. i think there's always going to be an energy here. it's also expanding beyond the park. the okay pietion is more than just -- the pock participation is more than just what happens in tents. >> reporter: coming up in my next live report, we'll have a live interview with one of those peaceful demonstrators, someone here who is among the leaders of the occupy d.c. movement. back to you. >> thank you. days after marching outside pepco offices downtown, customers delivered another message to the utility company.

the group hour d.c. took their fight to a hearing at the d.c. public service commission. they're outraged over the proposed $42 million rate increase for d.c. customers. that translates to a 5% increase for a typical resident or slightly more than $5 per month. >> we want pepco to pay their fair share in taxes and to create jobs by using their tax refunds which is $800 million, to use that money to create jobs. >> in a company statement pepco says the request to raise rates will allow them to continue improving service and upgrades to its infrastructure. the public service commission is expected to make a final decision in late april. until then the record is open for comments till mid march. seems d.c. is doing pretty well financially. mayor vincent gray announced the city has a $240 million surplus from fiscal year 2011. gray says the hiring and spending freeze and underspending by city agencies

are part of the reasons for that surplus. the city plans to keep it as part of the rainy day fund. 5:37. time for another your money report. >> jessica is back with a troubling development for homeowners. >> that's right. it turns out one mortgage giant may not be working in the best interest of homeowners. in fact, could be quite the opposite. according to an investigation by npr, freddie mac has reportedly spent dl billions of dollars -- spent billions of dollars betting homeowners with high rate mortgages won't be able to refinance. they were profiting from homeowners with high rate mortgages and freddie mac was allegedly making it more difficult for those locked in with high interest rate mortgages to refinance to a lower rate. this is all according to their investigation. freddie mac and its cousin fannie mae imposed new rules and regulations and have introduced new fees effectively narrowing the number of borrowers who could qualify for freddie insured mortgage. the white house is now saying

it's going to look into this matter. we can hate companies for a lot of reasons. some because of the business they're in or their policies. wall street decided to review a long list of companies and surveys to figure out what it thinks of the most eighthed companies in america. -- hated companies in america. one on the list facebook. 800 million users later facebook has the lowest customer satisfaction score from the american customer satisfaction index for its type of business. it gets dinged on its personal privacy policy as well as its customer service. another on the list, american airlines. parent company amr filed for chapter 11 bankruptcy back in november. in a "wall street journal" study, american was picked as the worst airline for customer service. that takes into account on time performance, mishandled bags, bumped passengers, canceled flights and of course customer complaints. other companies on the list of the top ten most hated, at&t, nokia, goldman saks, best buy, bank of america, johnson&johnson, sears and

95 heading on to 395. more on that situation and other area roadways at 5:50. back to you. here's a look at some other things making news now. the government has approved a new drug to treat an advanced form of skin cancer. the drug will treat people with basil cell carcinoma. it's approved for patients who can't be treated with surgery or radiation. it can also be used in cases where the disease has spread to other parts of the body. new evidence heart disease can lead to memory problems. a study from australia people who have a heart condition tend to see a decline in the long- term memory. researchers say they're planning some follow-up studies to figure out why this happens. the relationship with your mom may affect the size of your brain. a study found that children who grow up with a sense of support from their mother are more likely to have a bigger hipocampus, the part of the brain responsible for emotion and repg lating stress. researchers says it highlights

we're going to be in the 60s this afternoon. 6 on 0 to -- 60 to 65. by #k we're at 52 degrees -- by 8:00 we're at a 52 degrees. a fairly mild night for january. right now it's made out there. we've got 30s in places like culpeper and gaithersburg and easton is at 39. but 50 now. cumberland was 30 when we came on the air at 4:25. now they're 50 degrees. it's in the mid-30s in leesburg and lovettsville 34. haymarket, you're one of the cold spots. you're 32. look to our east. upper marlboro 45. we've got warmer air there as well with upper 30s in montgomery county and also mid- 30s across much of fairfax county. outside clear skies. good visibility. a good looking morning here in washington with a temperature of 41. got a dew point of 25. so the humidity is 53% and a

little bit of a windchill making it feel like it's 36 out there. a couple of clippers that have been moving across the northern part of the country. snow across parts of new york state and new england. this clipper brings very light wintry mix. but this one is going to help draw up some warmer air for us as it passes to our north. but as it draws up the warmer air, it will likely draw up a little bit of moisture as well. east texas coming through louisiana and mississippi right now. this will flow toward the northeast. with the moisture returning, we have that threat of showers which will return. even overnight tonight there's a slight chance after shower but it really looks like tomorrow a couple of showers will be possible. here's our future cast. we're not talking about a lot of rain. today good deal of sunshine. very mild this afternoon. 60 to 65. tonight we'll see a few more clouds and just a slim, slim chance we'll see a sprinkle overnight with lows in the 40s. tomorrow the front is lined up back here across ohio, northwest pennsylvania. out ahead of it look at the

moisture from west virginia, texas. some of those showers may come through. depends how organized things can get. but crossing the mountains with moisture can be a difficult thing. doesn't look like there's much -- a great chance for that tomorrow. a couple of showers will be possible. then as we head into thursday, looks like the moisture is going to really concentrate maybe from i-64 south could get toward southern maryland and fredericksburg. we'll see. better chance thursday south of town for showers than north of town. today a warm one for january. average highs 44. we'll be 63. tonight 40 to 45. tomorrow 65, chance for a couple of showers. cooler thursday. we'll be on the north side of the cold front. so 50 degrees. again a couple of showers with more clouds. as we head toward friday, 52. saturday and sunday upper 40s. sunday into monday may just see a couple of showers. doesn't look like any big storm will be headed this way this weekend. if we do get something, it certainly won't be wintry. it's 5:50. good morning, monika.

>> good morning. at least we can enjoy dark right, howard? you can go for a walk during lunch, al frescoe dining all sounds great to me. if you're planning to head on the northbound side of 395 generally speaking it's been great with the exception of one spot on the northbound side of 395 right here in the hov lanes north of edsall road. there had been a disabled vehicle. let's take a look outside live. it slowed things down for a bit but it was just cleared. that means traffic is moving at a normal place in the main and hov lanes north of edsall road. we'll take you further south into springfield on the northbound side of 95. here the brake lights generally begin in newington up toward springfield and then the pace improves on to 395 as you just saw. we'll go over 2066 on the inbound side. -- over to 66 on the inbound side. no problems to report. heading for the beltway, we'll take a live look further out west where you've got a bit of a slowdown leaving manassas into centerfield and then the pace improves into -- centreville and then the pace

improves in. there's rampant fraud and wrongdoing in a district program designed to provide housing for at risk youth. ward one council member jim graham who initiated a probe says millions of dollars were spent with little to no accountability. that report show as lot of the questionable funding went to a group called peaceaholics. it's received $4.6 million from the d.c. department of housing and community development, even though it has never bought or repaired a building. the head of that agency released a response to the report. he said he's asking the inspector general and the d.c. attorney general to investigate the matter further. we have new information into metro's investigation of a brake system failure on a metro train back in december. the washington examiner is reporting metro has determined premature wear is what caused the friction ring to fall off an orange line train near l'enfant plaza. the transit's is replacing part of the brake system on much of

the rail car fleet. officials are still looking into what caused another friction ring to fall off this one on january 9. the report on that incident is due out next month. well, another cracked rail led to some delays on metro, this time it was yesterday. it happened on the blue and orange lines near rosslyn station. you may recall the problems last thursday when a rail cracked on the red line at the height of the morning rush hour. luckily for metro the delays were not as bad as they were last thursday. 5:53. we want to take another look at the question of the day. 20% of married people spend money on this without telling their spouses. a, lottery tickets, b, eating out, or c, clothes? >> one of the responses from our facebook fan page michele wrote, i'm saying a, lottery tickets only because my spouse always seem to have some in his pocket. we never discuss playing the lottery at any time. i don't mind because if he hits, it's ours. >> you've got it. log on to the wusa9 facebook
