mcpherson square. bruce leshan is at the site with an update. there was a rumor that swept through this encampment that the park police were going to move in right now at this hour and clear out that tent. they call it the tent of dreams that is up there. that did not happen. but just a couple of minutes ago, an individual apparently an opponent, pulled on the tent hard and there was a loud ripping sound and mcferson popped out of the tent. and down there there are several park police officers who in the midst of the crowd talking to individuals there. at least one law enforcement source tells me there is not any intention today and perhaps for some period of time to do any kind of dramatic enforcement. park police officers are going through trying to convince

people to comply with the court order about no camping here in mcpherson square or at freedom plaza. simultaneously, a hearing is going on in federal court. we can look at the video of the officers coming through the encampment. and we are hearing in federal court several of the protestors are asking a district court judge to impose a temporary restraining order to allow them to continue the "occupy" protests here at mcpherson square and at freedom plaza. we have not heard the results of that hearing. we understood it started about 10:00 a.m. this morning but we haven't heard what the judge has decided on that. we'll let you know just as soon as we find out. jc. >> thank you, very much. bruce leshan reporting live. police are looking for a motive in the murder of lenny harris. his body was recovered if from -- from a well on saturday in

ft. washington, maryland. a autopsy revealed harris was shot to death. he was last seen in september at an alexandria recreation center and friends say harris dedicated his life to helping others. >> lenny always preached that somebody out there does care, come and talk to me. we've been through it and we can help you through it. he was a pretty good guy. >> a camera captured someone using harris' bank card at an atm after his disappearance. but despite that footage and a $38,000 reward, police still do not have a suspect. a chase involving officers in anne arundel and baltimore counties ended with police killing the suspect. it started at a traffic stop on 695 around 2:00 this morning. but during the stop, the suspect stole the officer's cruiser. the man was finally stopped at a shopping center on annapolis

road and he was shot at least once. the suspect was taken to shock trauma in baltimore where he was pronounced dead. an investigation is underway. campaign 2012, it is decision day in florida. republican voters are heading to the polls for the state's critical presidential primary. the race is shaping up as a two- man contest with the winner taking all 50 of florida's delegates. despite polls showing he trails mitt romney by double-digit, newt gingrich said he will stay in the campaign. >> we are going to go all of the way to the convention and we are going to win in tampa and we are going to be the nominee with your help and the republican party. >> usually that is an indication that you are going to lose, when you say you are going on no matter what happens, that is not usually a good sign. >> the other two republican hopefuls, ron paul and rick santorum bailed out of florida

to focus on nevada and colorado. after today's vote, the next contest is on saturday. that is when nevada holds its caucus. a week from today, voters cast ballots in colorado, minnesota and missouri. and then it is three more weeks until the february 28th primaries in arizona and michigan. and super tuesday is five weeks away with contests in virginia and nine other state news today the white house is announcing its support of a measure to help small business owners. president obama is calling on congress to enactor expand tax breaks for small businesses and remove barriers to start-up companies. the move would tap existing bipartisan proposals. the legislative package would be part of the president's 2013 budget proposal later this month. this afternoon maryland's governor will testify in favor of legalizing same-sex marriage.

alley will appear before the state senate judicial proceedings committee and that will be in annapolis. last night, however, opponents of the plan rallied at the maryland state house. it was a coalition of religious and conservative leaders. governor o'malley wants to ensure churches do not have to recognize same-sex marriages if they don't want to. opponents say no deal. >> they have not been to our churches, they don't know our doctrines and they don't know our god. >> right now maryland gives limited rights to same sex partners and it recognizes same- sex marriages performed in other state. another plan by the governor would hike the gas tax in maryland. right now the gasoline tax is 23.5 cents per galon. if the governor's plan passes that would go up 6 cents next year and another 6 cents the

following year. and the third 6 cents hike would be in the third year. maryland's gas tax hasn't been raised actually in 20 years. the governor said each hike will bring in an extra $200 million. a transit center scheduled to open this june could be delayed for another four years. when it is complete, the $101 million paul baines silver spring transit center will serve as a central location for taxis, metro and ride-on buses and the marc train. but they announced the massive delay yesterday as reported in the silver spring patch. it turns out half of the concrete on the second floor isn't the correct thickness and that could make the structure weaken quickly. but the good news is taxpayers won't have to pay for the error because of how the construction contract is worded.

a major metro station entrance in northwest washington will be closed for nine months while officials replace escalators. it is the south entrance of the dupont circle station on the red line. this entrance will close tonight and remain shut through october. the dupont escalators were originally installed in 1997 and are some of the least reliable of the metro's 600 escalators. still ahead at noon, the kennedy center asks airy young people for their take on a classic marvin gay song. plus the university of maryland finds a buyer for its energy official home which won the solar decathon.

13th. five months after the big earthquake, another tremor shook mineral, virginia, last night. this one had a magnitude of 3.2. this afternoon louisa county school leaders will announce middle and high school students are returning to a normal five day a week schedule starting tomorrow. students have been alternating days at the middle school since the quake damaged the high school. now crews are finished installing mobile classrooms at the high school campus. the university of maryland team that won the solar decathalon has found a buyer for its green home. pepco. maryland steam displayed its home called water shed on the national mall last fall. the home includes water saving as well as energy-saving techniques. the university said pepco will install the home at one of the montgomery county facilities to help demonstrate clean energy options. there is no word on how much pepco is actually paying for

this home. well the district is doing well financially. they took in $240 million more than it projected last year. d.c. mayor gray tells bruce johnson he wants the city to keep it and create a rainy-day fund. >> and remember, bruce, this is one time-money, it isn't as if the surplus represents money that we'll get every year going forward. >> the mayor said the money came from spending cuts and the hiring freeze, along with higher city fees and an increase in business taxes. some lawmakers want those taxes and fees reevaluated to see if they should be lowered. do you try to buy more foods that are grown locally? coming up, we'll tell but a program to get more local produce and meat into the hospital. howard? >> jc, a chilly start has turned into a warm january afternoon. the records are still about 70 or so. i don't think we'll break any

planner for the afternoon. we have temperatures which are going to be climbing toward the 60 degrees mark in the next couple of hours in washington. by 3:00, 62. we may get 63 or 64 but not to 71. by 5:00 in the upper 50s to near 60 at national. winds south to southwest at 10- 15 miles per hour. this evening, again partly cloudy, becoming mostly cloudy overnight. we drop to the low 50s by 9:00 but with the win staying up and clouds moving in, temperatures tonight in the low to mid-40s which is about where we should be for the high this is time of year. check this out. we had some clear skies early but just enough moisture hitting the ridge tops, you can see it here around 219 in western maryland, west virginia, pennsylvania and here comes the clouds. but then they clear out. so we have a good deal of sunshine and we've warmed up from the lows in the 20s and 30s. petersberg is 46 and 30 in culpeper. we were 39. and look at it now. 57 degrees already. a little bit cooler on the bay

in annapolis thanks to the sea breeze coming in off the bay. but andrews is up to 60. it is 159 at pax river. and 61 in winchester. and dulles was 58, their record is 65 degrees. and you look outside on a michael and son weather camera, a lot of sunshine. high clouds with a halo around the sun earlier. temperatures running at 60. dew point is dry. dry air heats up quickly and cools down quickly and that is what we are looking at. so we have the clippers across the northern part of the country. this storm system across the u.p., this is drawing in the warmer air. but when you look down toward the gulf of mexico, we are seeing moisture on shore in texas and louisiana. making it into the tennessee valley. and it is not out of the question that some of these showers here get here by tomorrow morning. so we may get a couple of sprinkles overnight or early on

the day on wednesday. for the rest of the afternoon, i think we get a good deal of sunshine. clouds thicken up overnight and by tomorrow morning, notice a couple of showers around. they will scoot out of here and we may or may not get a couple more showers later on in the notice and into tomorrow night and thursday. but i don't think the rain chances will be all that high. but temperatures today and tomorrow will be high and then dropping off on thursday. to 63 today. some areas warmer than that. tomorrow 65 and chance for showers in the morning. thursday cooler and 54. and then temperatures in the 50s on friday and upper 40s on saturday and sunday and maybe a couple of showers on sunday and monday. stick around, 9 news now at noon will return right after this.

trying to get more healthy and natural fruits, vegetables and meats from local farmers. and i have to tell you, that i am a proponent of eating local food. i think it is important to support and promote our local farmers. so tell me how this came about. >> our program is called maryland hospitals for healthy environment and we provide technical assistance to hospitals for environmentally sustainable initiatives. and we have launching these initiatives throughout the country. and 350 hospitals have signed a pledge to provide healthier food and we're -- >> that's wonderful. what about here in the washington metropolitan area, are the hospitals on with this? are they signing on with this program and supporting it? >> they are. we have 40 hospitals purchasing fresh fruits and vegetables from the local farmer, either

from the distributor or farmers themselves. we have hospitalled purchasing organic food, foods without pesticides. nine hospitals in the region are muching meat and poultry produced without growth hormones and raised outside on pasture. >> and everybody should be -- all hospitals should be involved. look at some of the things you brought. let's talk about what you brought. this is a chicken. >> right. we have chicken that is raised outside on pasture and grown without the antibiotics. a local farmer that purchases -- that produces beef and the hospitals are purchasing that here in the region. and we have a lot of local vegetables in season right now, which is a low time for production of fruits and vegetables but in the summer it will ramp up significantly. >> well i would like to salute the university of maryland school of nursing and for this campaign that you are doing. and everyone, please, let's support our local farmers because the produce is so good and it is so healthy. and of course that you are
