happy vl valentine's day. the state joins new york, connecticut, massachusetts, new hampshire, very month, and washington, d.c. in allows gay kubels to wed. it is signing. with the sweep of the pen monday he signed the bill into law. they approved domestic poip law in 2007 and 2009 that stopped short of allowing same sex couples to marry. but now they say it's time to recognize equality. >> i'm proud that our same sex couples will no longer be treated as that. they'll be treated equal. >> gay and lesbian couples won't be able to walk down the aisle right away.

but hours after the signing opponents signed a reference dem to overturn the law. >> there are many relationships that are significant to individuals. they are entitled and encouraged to participate in them. >> republican presidential candidate rick santorum who opposes gay marriage was at the state capitol to encourage them to stop it but that's not discouraging some couples from planning their wedding. i e-mail delighted to take it to next step and mair the woman i want to spend the rest of my life with. >> legislation for and against same sex marriage is taking place in a number of states. >> governor chris christie is in fab of a ref rehn doesn't and will veto the measure.

amendments banning gay couples from marrying will be on ballots. now to the nation's capitol where a house votes on extending the payroll tax cut at the end of the year could come by the oenld f the week. it was an about-face for those who had previously demanded that they be cut. the house leaders said the democrats refwusal to agree to any spending cuts in the corn frens committee has made it necessary to protect small business job creators and assure taxes don't go up on middle class workers. without action by the end of the month, the payroll taxes will rise for 160 million americans but republicans still want to negotiate the fate of the long term unemployment benefits. >> and president obama's budget proposal for fiscal year 2013 is drawing fire. the record $3.8 trillion budget was unveiled yesterday. it includes tax increases on the

wealthy and cuts in military spending. the white house claims it will cut $4 trillion from the deficit over the next ten years but senate minority leader mitch mcconnell calls it, quote, a charade. >> the president's goal is not to solve them but ignore them for another year. >> it leaves medicare mostly untouched. republicans are voting for changes. the budget will be a key issue this year. the latest poll shows rick santorum has made up significant ground against mitt romney. in michigan, mitt romney's home state, a poll by the american research group shows santorum leading and a national poll of likely republican voters shoes them in a virtual tie. overseas anti-government in syria say they resumed attacks on the city of homs.

they said they would consider a plan for a peace keeping form. susan mcginnis has more on this. >> reporter: good morning, betty. with it looking more and more imminent, the u.s. said it is working with its allies but it's clear at this point that support only goes so far amateur video claims to show syrian troops launching new attacks on the city of homs. united nation's says the violence is escalated. >> as long as the international community fails to take action the population will suffer from countless atrocities committed against them. >> president bashir al assad's army is working to take down his regime. the u.n. estimates more than 5,400 people have died.

the pro-democracy uprising began almost a year ago. now the arab league is calling on the u.n. to form a joint pea peace-keeping force to end the violence. the white house says it supports it but admits that international intervention faces several obstacles. russia and china have already vetoed a resolution and syrian government has rejected any a s assistanasu assistan assistance. >> they are leading syria into the outcome that we all deplore. we do not want to see a civil war in syria. >> secretary of state hillary clinton says the united states will work to support the opposition and deliver humanitarian aid, but the u.s. has said military force is not an option. and later this month the u.s. will be with arab nations and european allies to work on the pressure. betty? >> thank you, susan.

whitney houston's body has arrived in new jersey where she grew up and where plans are being made for her funeral at the end of the week. it's still unclear why she died, but a few detail of her final hours are emerging. we have more. >> reporter: a hearse carries the body of whitney houston to a funeral home in her hometown of newark, new jersey. it's the same funeral home where her father was remembered after his death in 2003. houston's remains were flown where police are still investigating the death of the grammy-winning singer. >> i do not know the cause of death. we don't know the circumstances leading up to her death. >> reporter: beverly hills police say the 48-year-old houston was under water and unconscious when she was found in the bathtub. it will take weeks for toxicology reports to say whether they contributed to her death. >> what's in the system, we're not going to speculate.

talk about an unbelievable shot. that was not trick photography, folks. a seventh grader in ohio actually makes a full court shot after the other team misses a free throw last week. you can hear the buzzer go off just at it hits the backboards, and to make it even sweeter, his team was down by one point, so that miracle toss actually won the game. congratulations. on the "cbs moneywatch" apple shares hit a new high, and for the first time you can hit the slopes and get your starbucks at the same time. ashley morrison is here in new york with more on that. overseas marktds kale out slightly aad. tokyo's nikkei gained half a percent while hong kong's hang seng gain as fraction after a volatile day. it was a positive start. the nasdaq gained 27. china's vice president meets with president obama in washington today. the president will once again ask china to lower trade barriers and reform its currency

policies. his visit to the united states may hold some clues about china's economic stances. he is widely viewed as the successor to current president hu jintao. regulators in the u.s. and europe have approved google'sed by to buy motorola. google is going to pay $12.5 billion for the mobile phone maker. it will give them the ability to manufacture its own phones and devices for the first time. google has some catching up to do with apple. monday they closed at $500 for the first time ever and apple will begin allowing independent inspectors to begin inspecting in china where ipads and iphones are made. starbucks has now opened its first ski-through coffee shop at squaw valley in california. skiers can pull up, place an

cloudy in seattle, 48. here's another look at this morning's top stories. same-sex marriage is now legal in washington. it becomes the seventh state to allow gay couples to wed. opponents say they won't fight the law in court. and whitney houston's body arrives at a funeral home in new jersey, not far from where she grew up. her family is planning a funeral for later this week ja a group of doctors is urging the makers of a common childhood cancer drug to increase production. they say that the supply could run out in weeks, costing patients their lives. we spoke with one family whose daughter desperately needs the drug. >> reporter: in december, 8-month-old elena was diagnosed with leukemia. her parjts were devastated but hopeful. mark is elena's father. >> the fact of the matter is it's terrible. in regard to leukemia, we're

lucky in a weird way that it's cure about and they have a track record of curing it. >> reporter: but the cure depending on a cocktail of drugs. and it's running out. >> if we lose the drug, we will open up a very unknown future, and children will die. >> reporter: dr. maris's hospital has only a two-month supply of medication which children usually take for three years. but the shortage doesn't stop there. 28 cancer drugs taken by more than half a million patients are in short supply. there are several reasons. one problem, a smaller profit margin because many of these drugs have become generic. there are now fewer suppliers. the largest manufacturer of methatrexate shut down last fact. >> this is a real, real crisis.

unless something dramatic changes in the next few weeks, myself and other physicians and nurses on this very unit are going to need to look them in the eye and say we don't have it. >> reporter: a year ago three bills were introduced to give the fda more power to deal with the drug shortage crisis, but so far neither the house nor the senate has brought a bill to the floor. dr. jon lapook, cbs news, no. steven brewer was a victim of a vicious robbery. the 73-year-old, his wife, and guest were confronted by a machete-wielding intruder last week at brewer's home. the suspect took about a thousand dollars in cash. no one is hurt. coming up after the news on "cbs this morning" john miller takes a look at the security of supreme court justices. plus, why it pays to be married. i'm betty nguyen with your "cbs morning news."

good morning. it's chilly out there. i'm going to show you radar but don't be alarmed by it. it's so dry nothing is reaching the ground. we've got temperatures this morning in the upper 30s. mid-40s by noon. by 5:00 49. there could be an isolated shower or two this afternoon. but most of the time today it's just going to be dry with mostly cloudy skies and highs from the upper 40s to the low 50s. so rather comfortable. here's a look at the regional dopplers. you see some snow up north and what looks like a lot of rain here but none of this seems to be reaching the ground. even live doppler 9 hd, you think it would be snow in hagerstown. not getting any reports yet there. may be a couple of flurries out there but not getting any reports of anything reaching the ground due to the dryness of the air. temperatures down to 30 in frederick. 34 in winchester. cumberland is 32.

off in the east in annapolis it's 40. fredricksburg 38. a bunch of 30s from manassas, la plata and over to andrews. we'll stay in the 40s up north. 52 for d.c. maybe even as warm as 55 down at the tappahannock airport. let's go to monica samtani with time saver traffic. that's exactly what it is. all the icons you see here behind me, that's an indication of all that overnight construction. i'll start off with the west side of town. mainly what i want to tell you is on the inner loop at 123 and that ramp to route 123, also the inner loop at route 7, quite a few lanes blocked. so watch out. basically through the tysons area and over at i-66 for your construction spots. again by about 5:00 this morning, everything does clear out for the day. we're going to take a live look right now at 95 northbound in lorton. no problems to report here as you head for springfield and on

attention to the debate over same-sex marriage. gary nurenberg has more. >> reporter: corinne and barb have been together for more than 26 years, met while they both served in the navy. >> we served under don't ask don't tell. that was a very unusual experience because we could not acknowledge each other as part of our family and we are a family. i think that's the reason why we want a license, a marriage license to express that to everybody. but we want people to know that we are a family and we're like them. we're good citizens, good neighbors. we're good members of a congregation and we'd like to be like they are. >> reporter: but they know they'll be denied that license and plan to leave the courthouse and walk into a demonstration of supporters who plan a candlelight vigil there tuesday afternn.
