now tmz is reporting an apparent rift in whitney houston's family on where she aught to be layed to rest. houston's cousin and her mom both want the burial to take place in atlanta, but the rest of the family wants her buried in newark. lesli. from accidental death to an alleged murder. forensic experts testified that the snapping of her head, not cpr. bruce leshan has been listening to this case all along. bruce, tell us about what happened today. >> yeah, lesli, the lead medical examiner just got off the stand a couple minutes ago and he told the jurors that yeardley love died from brunt force trauma to the head. yeardley love's mother got up and walked out at one point, but the prosecutors are trying to prove that george huguely

killed yeardley love and they want to show jurors just exactly how he did it. a bad day for huguely's defense as two neuropathologists agree on the subtle brain injuries that killed yeardley love. both describe small bruises and bleeding all over the uva lacrosse player's brain. christine fuller said there were bruises in the middle cranium, near the young woman's temples on both sides of her head. she said they were consistent with either a fall from a height or a punch to the head. particularly if the punch was into a wall or the floor. but she said those injuries were too minor to kill her. instead, both pathologists describe bruising and bleeding they found in love's brain stem. the area of the brain that controls your breathing and your heartbeat. they said they were caused by a sudden snapping of her head. a twisting motion with sudden

acceleration and deceleration. huguely's lawyer forced the pathologist to admit they had no idea what caused that or how much force would be required. but investigators believe huguely slammed love's head against the floor or the wall of her bedroom. doctor beatrice testified that a chemical stain showed the injury to love's brain was inflicted at least two hours before she died alone in her room with no one to help her. the pathologist also cut a big hole in one of the defense theories here, that the injuries to yeardley love's brain might have been caused by cpr. they said they saw no sign of what they say are clear indications usually of what is called reprofusion. that is the sudden rush of blood back into oxygen starved

brain cells. they say they saw no sign of that and when the lead medical examiner was done with the prosecutor, the defense declined to even ask him any questions. lesli. >> another day of testify testimony there, bruce leshan, thank you. a former loudoun county sheriff deputy is refusing to comment about an alleged attack against a sterling man that was caught on tape. now take a look at this one. a camera on the deputy's cruiser recorded the confrontation between carlos garcia. this happened back in november of '09. garcia is now suing this deputy. he claims the deputy hit him so hard, he had a brain injury. garcia said he had his hand in the air at the time of the alleged attack. like i said, of 2009. >> police are investigating three more street robberies in upper northwest. all of them taking place yesterday and two of them at gunpoint. the robberies happened at river road and 46th street. the 5,000 block of wisconsin avenue and friendship rights and the 3800 block of warren

13 would have to ride in the back with exceptions if the seat wasn't available due to a full vehicle or car pool. >> we are trying to keep it simple. trying to cover the majority. >> emily from montgomery county explains the current maryland child safety law is based on height and weight and age and doesn't address graduating to the front seat. >> the back is the safest for children. children are 40% less likely to be killed or injuried in the backseat. if you have a backseat available, you want the children in the back. >> largely related to air bag safety. >> one big issue here is front seat air bags and testimony from doctors today that even a sturdy 12-year-old could be hurt. >> kids and adults are not the same in their architecture. >> keeping kids up to age 13 in the backseat is a long standing recommendation of both federal experts and the american academy of pediatrics.

in los angeles, a surprise attack caught on tape. a large man over 2 feet and 200 pounds breaks into a cashier's cage in a gas station, over powers the female clerk and chokes her, grabs the cash. that's what you see him doing there and flees. surveillance video shows him driving away in a late model dark sedan. the syrian government forces went on the attack today and what's being called the heaviest shelling in days. assad attacks opponents of the president and sties across the country and at least six people were killed. meanwhile, arab officials confirm, regional governments are ready to arm the resistance if the violence continues. at the same time -- the

sing. >> you want to hit a whitney houston tune for us? >> you know what? i know my limitations. i'm going to send it back into the newsroom. >> thanks, lesli. we continue to investigate a police involved shooting that is getting a will the lot of questions from a will the of you. a culpeper town police officer shot and killed a 54-year-old woman in a catholic school parking lot. the police tell us the officer's arm was caught in the front window of the woman's jeep and he was shooting her in self-defense because she was trying to drag him or drive away. an eyewitness tells a different story, contradicting what the police said. more than 200,000 of you watched this story on wusa9.com with hundreds of you asking us to follow up. tonight, 9 wants to know where this investigation is headed. we sent our own peggy fox back to culpeper to get the real deal. >> this is where patricia cook was shot and killed by a police officer thursday morning. it was in this parking lot.

she was exiting. now police say she rolled up the officer's arm in her window and got it caught and she was dragging him and he shot her because he feared for his life. a man who works in this house and says he saw the whole thing through this window says the officers arm was never caught and that he was never dragged. >> he had his left hand on the door handle and the right hand on the gun. >> state police say chris changed his story about what he saw thursday morning when a five year culpeper police officer shot and killed 54-year- old patricia cook. he told state police and reporters the same thing then and now. >> his left hand was on the door handle. it was real close together, you know. >> what's he doing with the gun? >> he's telling her to stop. i mean, he told her to stop or i'll shoot. >> to stop what? >> i'm aassuming to stop the vehicle. >> the officer fired and continued firing as cook drove

up the street. >> absolutely. there was traffic coming this way when she got to the side of the building, she was at a drift. you have traffic coming this way too. >> the culpeper town spokesperson says the officer's cruiser did have a video camera, but it was not working. he also said the officer did not turn on his blue lights. if he had, it would have been a sign that he was detaining the person, says attorney and former fairfax county police officer, ted sibert. if the person is not being detained, she should be free to go. >> what is he investigating? if it's suspicious person, then he doesn't have justification to use force to maintain the contact. so if a person wants to roll the window up, they can. he can't be sticking his hand in the window. he can't try to pull somebody out of the car. he can't open a door. those all need justification.

because of their children's excessive tardiness in getting to school in loudoun county. today, he and his wife filed a motion asking the court to dismiss this. we'll let you know what happens. >> some folks look into adopt children in virginia could soon face a new hurdle. governor bob mcdonnell indicated he will sign a bill that will allow child placement agencies to refuse placing children in certain homes if doing so will violate religious convictions. would that amount to dediscrimination or protecting the rights of private agencies and their religious beliefs? joining us to talk about that is the family research council and emily from the family equality council. let's start with you, is this about gays and lesbians? who else would there be a moral conviction against allowing them? >> well, this is an issue of religious liberty and it's for the faith based organization to decide what is the concern that

they may have. >> all right, now emily, basically he is saying that this will be okay if religious organizations say they don't want gay folks to adopt your view on that. >> well, what we're talking about here is the adoption rights of children in foster care in virginia. currently virginia is undergoing a foster care crisis. they have over 6,000 kids in the system. they rank second to last in the country in public placements. they also have the distinction of the highest rate of children who age out of the system every year without finding placements and this is because they don't have enough parents in virginia available to adopt these children. what this law does is further restrict the potential pool of parents that could come forward. >> i get this e-mail all the time from folks saying that exact argument. isn't it better for kids to be in a house with two mommies or two daddies or a house where they aren't loved or wanted? >> the problem is, these agencies are not going to compromise their conviction. they will go out of the adoption business rather than

do that. >> he says hey, it will be more difficult. >> we can't put the rights of religious organizations above the best interest of children. the reality of it is, in virginia, only 22% of the public adoptions are facilitated by public agencies. >> the red hairing, this is being presented as it keeps homosexuals from being able to adopt at all and because only a small percent age. they have a lot of other adoption agencies they can go to. not only the agencies, but birth mothers and adoptive parents may prefer to work with a faith based group. >> i got to bring this up. both of you have the name family in your title, but different idea of what that word means. isn't this really about a fight over whether or not gays and lesbians should have the right to adopt children? >> well, no it's not.

because gays and lesbians have the right to adopt children in virginia and this -- >> you don't think they aught to? >> it's always in the best interest for children to be placed with a married mother and father if at all possible. >> every established child welfare agency in this country, the american psychological association, the american academy of pediatrics, they all say the same thing. children raised by gay and lesbian parents do just as well as children raised in homes with a mother and a father. they all endorse the ability of gays and lesbians to raise children. several thousand are being raised in virginia. the issue of whether or not gay and lesbian parents provide good homes is a settled issue. >> i want it thank you both for joining us. >> thank you, derek. we are sounding like a broken record here. every time we think about what season it is and step outside
