vanished. no chocolates or roses today for a grieving mom in southwest d.c. who is flooded with bad memories every valentine's day. >> they'll ma butler's daughter, pam, an analyst at the epa disappeared three years ago and is yet to be found. the investigation into pam butler's disappearance continues but there is still no real sense exactly what happened to her. >> valentine's day is a hard day for me thelma butler says valentine's day will never be the same and who could possibly blame her for feeling that way. >> i feel sad when the valentine's day comes. >> exactly three years ago, thelma was supposed to have valentine's day dinner with her 47 year old daughter pam. >> a very sharing and caring person. >> but pam never showed up prompting a search for answers that continues to this day. >> its been so hard, just very very hard. >> pam butler was last seen on february 12, 2009, a few days

before she was actually reported missing, heading home from work in northwest washington she picked up her mail and went inside her house and that was it. >> horrible, disaster. i can't think sometimes, i just break down and cry. >> surveillance cameras showed pam butler entering her house that night but she's never again seen leaving it though technically butler's disappearance is considered a missing persons case and d.c. police say they've long believed pap was probably murdered. according to cops, the prime suspect has long been pams ex- boyfriend, jose rodriguez, but there has never been enough evidence to charge him and he continues to insist that he had nothing to do with pam's disappearance. >> is she living? could she be somewhere held against her own will? >> pam's mother says even now, she often prays that her daughter will somehow be found one day, but with each passing year, each passing valentine's day, she's well aware that that

becomes an increasingly remote possibility. >> do you still hope that you'll see her again some day? >> oh, my god, yes, i do, but i feel like it's fading away. i really do. three years, i just feel like it's fading away. >> matt jablo, 9 news now. >> should you have any information about pam butler's disappearance, d.c. police would like to hear a call from you. 202-727-9099. blindsided and violently knocked to the ground causing a brain injury. a local man says that is the treatment he suffered at the hands of a lowden county sheriffs deputy and the whole thing is caught on tape. as our ken molestina reports, that man is now fighting back. >> reporter: take a good look at this police video posted on youtube. the man in the dark shirt in front of the officer with his hands up is carlos garcia. the lowden county deputy running into the shot is terry daniel. >> terry daniel runs up to carlos, never sees him coming,

has his back to him and pounds him on the head and drops carlos to the ground. >> victor glassberg is representing garcia. they claim deputy daniel abused his power back in november last year when he viciously knocked garcia to the ground leaving him with permanent injuries. garcia, his friends and family were leaving a bar in sterling getting into a cab when this all began. his defense team says there has yet to be any explanation as to why deputy daniel felt the need to do this. >> we do know that what happened that night did not justify his use of violence against mr. garcia. >> this side by side come par it son shows garcia before he was roughed up by the cops and shortly after when he was booked into jail. >> he has traumatic brain injury, severe intimate memory loss. glassberg insists there was no need to hit garcia. they say the video clearly shows he was not a threat, but lawyers say garcia was later charged for assaulting an

officer allegedly before deputy daniel arrived and knocked him out. >> if that had happened he would have been arrested immediately. he would have been cuffed and he would have been in a cruiser. >> i called the lowden county sheriffs office to ask for their version of the story but never heard back. we understand daniel is no longer employed by the sheriffs office and lives in another state. was it an unintended death or murder? forensics at the uva lacrosse murder trial testified today the injuries were caused by trauma and a sudden snapping of her head, not contributed to by cpr, as paramedics tried to revive her. we have all of the details from the courthouse. >> reporter: a late night at the courthouse as the prosecutor tries to wrap up his case. an expert testifies that george ugley had dna under his fingernails that was compatible with yardley love's dna and that yardley love had dna under

her fingernails that was compatible with george ugley. in fact, she said, it was hundreds of millions of times more likely that dna was a mixture of the two of them than a mixture of one of them and some other unknown subject. also testifying, a neuropathologist who described this snapping, rotational injury to yardley love's brainstem where you're breathing and your heart beat is controlled. the lead medical examiner testified that the cause of death was blunt force trauma to the head, those brain injuries. 9 news now. >> the bitter debate over extending payroll tax cuts have come to an end for now. it seems house and senate negotiators reached a tentative deal that delivers about $20 a week to the average worker. the two sides hope to send the legislation to president obama as early as this week. under this plan, the payroll tax cut would be extended through the end of this year.

jobless benefits for the long term unemployed would be renewed and doctors would be saved from a big cut in their medicare reimbursements. now to the latest on the deadly police involved shooting out of virginia. last week, a culpeper police officer shot and killed 54 year old patricia kukin a catholic school parking lot. officers say the cops arm was caught in the front window of cook's jeep and he was shooting in self-defense as she attempted to drive away, but a culpeper town spokesperson says the officer did not have his blue lights on. former fairfax county police officer ted siebert says if the lights had been on it would be a sign he was detaining the person. otherwise that driver would be free to leave after being stopped. >> what is he investigating? if it's just what we call a suspicious person, then he doesn't have justification to use force to maintain the contact. so if a person wants to roll the window up, they can. he can't be sticking his hand in the window.

he can't try to pull somebody out of the car. he can't open a door. >> an eye witness tells 9 news the officers arm was not caught in the window. patricia cook's husband says he believes some kind of excessive force may have been used and he's looking to hire an attorney. the officer was responding to a sus push us person call at the time of this incident. a georgetown man accused of stranging his 91 year old wife is headed from jail to d.c.'s psychiatric hospital. a judge says the man is not mentally fit to stand trial. the judge plans to revisit that decision after doctors give this man another evaluation. he is 47 year old albrecht mooth. police say he killed his wife last august inside their home and doctors say he suffers from ha loose nations and he claims the angel gabrielle told him to deny himself food while in jail. well the governor of new jersey has ordered state flags to fly at half staff saturday when family and friends pay their final respects to whitney houston. the singers family is planning

a private funeral and burial in newark where houston grew up and at this point, there are no plans for a public memorial. whitney houston died last weekend in her room at the beverly hilton hotel in california. the coroner expects it will take eight weeks to get the results from the toxicology tests. until then, no ruling on exactly what killed houston; however the coroner has ruled out foul play. 9 wants you to know that fairfax police charged five juveniles with public drunkenness. this happened last friday night following a basketball game. four of the kids were arrested after mcclain high school. >> the other at a nearby fast food restaurant. we tried to contact the principals of both schools to see if any disciplinary was being taken against those students but we were unable to reach them; however we did some digging and according to the student rights and responsibilities booklet for fairfax county, any student on campus or at a school sponsored event does face some consequences regarding alcohol.

minimally, a first time violation for possessing or being under the influence shall "result in suspension from school for a minimum of five days and a maximum of 10 days and suspension for 30 calendar days from all student activities." well it is just this kind of behavior that police are seeing as a disturbing trend. they call it pre-gaming, or teen tailgating. >> come on over here a minute. >> montgomery county police officer bill morrison has a factor spotting pre-gamers. teenagers and young adults who get intoxicated or high before high school sporting events or on this night before a concert at a popular local venue. >> we don't want you to do that. >> no. you didn't ask me to sign anything. >> young lady, relax. >> i'd just like the cameras on please. >> well here is the problem you have. you're out in public.

>> cruising through public parking lots, we quickly come upon a car that's idling, inside, four young adults drinking alcohol and allegedly smoking marijuana. >> everyone in the vehicle has drug paraphernalia because they all had pipes and marijuana. >> the charge is $500 and you get something in the mail. >> two of the women have children at home, under the age of three. most aren't upset about being caught. only that their arrest might make them late to the show. >> the arrest didn't bother them other than the fact it would interfere with them going to the concert. >> their main concern was getting at the concert on time. >> one of the women urinated outside the car in a public place. >> this is a ticket. >> and that's not uncommon, but it is behavior that can earn them a citation, $1000 fine, and a seven year spot on maryland's sex offender registry for exposure. after the concert, we watch as officer morrison issues another young woman a citation for
