back. susan mcginnis, cbs news, washington. metro transit may soon admit to some liability. in the 2009 reds line crash -- red line crash at fort totten station. >> metro along with three equipment manufacturing companies filed documents in d.c. district court saying they're prepared to admit some liability at the four remaining trials. the filing is an effort to avoid the cost and exposure of a lengthy trial. the crash in june 2009 killed nine people and injured dozens more. seven of the nine death cases along with several injury cases related to the crash have already been settled. the former loudoun county sheriff's deputy is refusing to comment about an alleged attack against a sterling man which was caught on video. a camera on the deputy's cruiser recorded the confrontation it carlos garcia and terry daniel in 2009.

garcia is now suing that deputy. he claims the deputy hit him so hard, he ended up with a brain injury. garcia says he had his hands in the air at time of the connation in 2009 of november. a d.n.a. expert took the stand in the george huguely trial tomorrow. the former uva lacrosse player is charged in his ex-girlfriend yeardley love's death. she testified yeardley's d.n.a. was found under huguely's fingernails and the damage to the brain was consistent with a severe blow to the head. now to the deadly police involved shooting in virginia. a culpeper police officer shot and killed 54-year-old patricia cook in a catholic school parking lot. officers say the cop's arm was caught in the front window of cook's jeep and he was shooting in self-defense as she attempted to drive away but a culpeper town spokesperson says the officer didn't have his

blue lights on. if the lights had been on, it would be a sign he was detaining the person. otherwise the driver would be free to leave after being stopped. >> what is he investigating? if it's just what we call a suspicious person, then he doesn't have justification to use force to maintain the contact. so if a person wants to roll the window up, they can. he can't be sticking his hand in the window. he can't try to pull somebody out of the car. he can't open a door. >> an eyewitness has told 9news the officer's arm was not caught in the window. patricia cook's husband believes excessive force may have been used and is looking into hiring an attorney. the officer was responding to a suspicious person call at the time of the incident. a georgetown man accused of straggling his 91-year-old wife is headed to a d.c. psychiatric hospital now. a judge says 47-year-old man is not mentally fit to stand

trial. the judge plans to revisit that decision after the doctor's evaluate him. police say he killed his wife last august inside their home and doctors say he offers from hallucinations. he claims that angel gabriel told him to deny himself all food while in jail. the democratic national committee is expected to announce that los angeles mayor has been selected as the chair of the democratic national convention this summer in charlotte, north carolina. the move is seen by some political analyst as an effort by the democratic party to try and gain latino support for president obama's reelection bill. he has been serving as los angeles mayor since 2005. he's currently in his second term in office. the montgomery county school board has approved the superintendent's $2.13 billion budget request. it allows the school system to keep up with growing enrollment while meeting the minimum requirement to fund student education at the same level

mission road. coming up in my next report, more on maryland roadways at 4:47. it is time for the first your money segment of the morning. >> that's why jessica doyle is here. >> good morning. we're seeing green arrows around the world this morning. that's because of new developments at greece moves closer to aid for its economic problems. wall street stocks were higher sort of despite a disappointing retail sales report. the dow stands this morning at 12,878. nasdaq was pretty much flat. s&p 500 was down by about a point. 17 million americans are unbanked. that means they do not have a checking or savings account. that population is feeding into the popularity of prepaid debit cards. you can load them with money without having to have a bank account. customers put $409 billion on prepaid cards in 2011 and the industry is expected to grow

35% a year but fees vary and can add up to even more than having a regular bank account so consumers need to read the fine print. montgomery county spent 20% more on county health department salaries in neighbors counties but residents are not nearly as healthy as some neighbors areas. the washington examiner reports the average health and human services salary in montgomery county is $71,000. that's compared to 58,000 in fairfax county and 55,000 in howard county. at the same time montgomery fared worst in both fairfax and howard like premature births, low birth rates and high blood pressure. the newest version of the ipad may soon hit stores of the "the wall street journal" reports apple is ready to announce the debut of the ipad 3 the first week of march. sources say tractor-trailer and verizon -- say teat and vary rye -- at&t and vary ryion will sell the -- vary ryion will --

good morning. welcome back to 9news now. howard has your weather first. yesterday turned out to be a lovely valentine's day. >> just a tad more sunshine the middle of the day and that was enough to boost temperatures from the low 50s up to about 56. >> we were hit by rain in the afternoon. >> we were expecting a couple of showers here and there so a

bit of everything. today lots of sunshine. back in the mid-50s. tomorrow some rain. sunday is really the day we're questioning right now. we have a storm system we expect to develop somewhere in the southern southeastern u.s. will that slide to the south or come up the coast and make things a little more interesting? andrea is keep it away. >> keep it away. >> a lot of folks are saying we want the snow. right now the jury is still out. yes, there's a possibility but it's nothing etched in stone. temps in the mid-30s to mid- 40s. we'll get the degree sign on the right side there in a moment. plenty of sunshine. by noon 50. a little breezy, especially this morning through midday. northwest winds at 10 to 15 miles an hour. by 4:00 53. a northwest wind at 11. nice afternoon. highs around 55 with an 8:00 p.m. temperature back down to 45. we'll turn cloudy overnight.

looks like rain moves in tomorrow but after the morning rush hour, might even happen toil in -- till midday on thursday. rain and snow up north well away from us. we still have some cloudiness around here. that's tending to keep temperatures from falling all that much. a few spots have dipped in the 30s like gaithersburg and culpeper. fredricksburg also down to 48 degrees. 45 already at this hour or still at this hour pax river. 41 winchester. here in washington we have pretty good temps. college park, though, you dip down to 36 with andrews at 44. up to the north some upper 30s and sterling and vienna also the upper 30s with ma fast a sas -- manassas down to 37. generally clear skies. not too many lights on at the white house this morning. mostly cloudy skies being reported and a windchill of 38 out at reagan national. across the country another storm system coming on shore. california with some rain and snow. storm system moving in to

texas. this is the one we're going to watch. they have a decent amount of rain in texas. remember the bad drought they had last summer? that's been helped a lot over the last couple of months. this rain you see in missouri and arkansas, back in oklahoma and texas, that's thursday afternoon, thursday evening's rain maker. it will be a pretty quick move. we'll be back in the sunshine by friday. looking at the future cast, lots of sunshine today through noon through the afternoon and evening hours. if you have outdoor plans, going to be a good day to get that afternoon run in. walk the dog this evening. clouds roll in tonight. by tomorrow morning we start cloudy. i think the thursday morning rush hour probably going to be dry because it looks like the showers are going to hold off till the afternoon and evening hours on thursday. a couple of hefty showers too, late. this gets out of here so by friday we're back in sunshine and of course we're going to watch the weekend and see what happens sunday. 55 degrees, breezy today. tonight we're back in the 30s

parkway route 50 as you head through sheverly in through the northeast corridor. the anacostia river crossings are running incident free. we'll take a look at route a outside the beltway. no problems to report coming in from annapolis this morning. coming up in my next report we'll go to virginia at 4:55. charles schumer is renewing his push to get passenger advocates at every airport security check point. it comes after a series of incidents uncovered by the cbs station in dallas in which women say they felt as if they were being targeted. here's a sampling of ginger allen's report. >> at one point the passenger was asked if she plays tennis because of her cute figure. >> you think there was a party going on back there? >> no doubt. no doubt. there was guys, plural. >> come on, guys, that's enough. >> reporter: they found a pattern, women saying i was targeted to go through the machine because i'm a

semiattractive female. i know he went to that room to see my naked body and passengers are unwilling victims of a peep show by tsa employees. >> new york senator schumer says this has to change. senator schumer's rights act would also allow passengers with medical conditions or disabilities to prearrange for screening before getting to the airport. the debate is raging in maryland now. the general assembly over some new proposals when it comes to child safety in cars. >> one idea would change the law so youngsters 12 and under would have to ride in the back. scoot broom covered hearings on the issue and has more. >> as we speak, there are lots of rules about child safety in cars in maryland. some of the rules are kind of confusing and there's nothing in the rule books right now about when to graduate to the front seat. now some maryland legislators and child advocates want to change that. >> each year more than 5,000 children and adolescents die in

motor vehicle collisions and hundreds of times more than that are injured. >> reporter: hearings on a bill today that would mandate that kids up to age 13 would have to ride in the back with exceptions if the seat wasn't available due to a full vehicle or car pool. >> we're just trying to keep it simple, trying to cover the majority. >> reporter: safety advocate emily crown from montgomery county explains the current maryland child safety law is based on height and weight and age and doesn't address graduating to the front seat. >> the back is the safest for children. children are 40% less likely to be killed or injured in the back seat. if you have a back seat available, you want the children in the back. >> it's largely related to air bag safety. >> reporter: one big issue here is front seat air bags and testimony from doctors today that even a sturdy 12-year-old could be injured much worse than a similar sized adult in a crash. >> kids and adults are not the same in their architecture. >> reporter: keeping kids up to age 13 in the back seat is a

longstanding recommendation of both federal experts and the american academy of pediatrics. if this bill passes here in maryland, this will be the first state to make those recommendations law. in annapolis, scott broom, 9news now. >> right now maryland requires the use of safety or booster seats for kids who are 7 or younger unless the child is 4 feet 9 inches or taller or weighs more than 65 pounds. as many as 20% of antibiotic prescriptions are for treating sinus infections but there's serious doubt as to whether or not they work. a study published found that antibiotics do not clear up a sinus infection any better than a placebo does. researchers suggest treating the symptoms instead and allowing the patients to get better on their own. people who have trouble sleeping could face memory problems later in life. researchers in st. louis looked at sleep patterns of 100 people and those who woke the most during the night were more
