were unable to bet into the apartments quickly to search for the injured. crews rushed several people outside the buildings to the hospital. none with life-threatening injuries. navy investigators declined to speculate on what might have caused the crash but with scores of navy jets flying almost constantly over heavily populated virginia beach, the mayor says this has long been one of his worst nightmares. >> i prayed every day that it doesn't happen, but it has. >> reporter: rescuers say the real miracle here, no one was killed. and doctors have actually released several patients from the hospital. one of the naval aviators is listed in fair condition, the other in good condition. bruce leshan, 9news now. an update now on the howard university athletics program. the student athletes who were declared ineligible to compete have now been reinstated. last friday the university announced it was going to

temporarily withhold the number of student athletes from competition as a self-imposed action, part of an internal investigation of possible ncaa rules violation. as a result of today's decision all spring sports teams will compete as scheduled for the rest of the season. despite today's news howard's internal probe continues. despite a maryland attorney general's opinion that says you do have the right to record police doing their jobs in public, we've got some new evidence tonight that some officers have not yet gotten that message. 9news now has uncovered an encounter with prince george's county police in college park. it happened yesterday when an officer claimed that police rights were being violated by a woman with an iphone. scott broom investigates in a story you will see only on 9. >> my neighbor's house was surrounded by police so i walked out in the street to record what was happening. >> reporter: kim is a retired journal whist took to the street in front of her college park house yesterday. >> yeah, they came with guns drawn.

>> reporter: when police add neighbor in handcuffs. this is the video of the incident kim took with her iphone showing at least eight officers from prince george's county at the scene. we've agreed not to identify the neighbor because he was not charged. it's video as lucy and hear that police objected to. >> i need you to stop recording. >> it's perfectly legal to record. >> reporter: moments later the female prince george's county police officer approaches kim. there is absolutely nothing. >> but you're violating a police officer's right because they asked you. i'm asking you not to record. >> reporter: as kim showed me where she stood she explained why she wanted it on video. >> there was a mistaken police report about him, and he's the sweetist guy on earth and i couldn't imagine that he had done anything that warranted. that they used to say when we were growing up, don't say anything that you don't want to see printed on the front page of the paper. and now it's like, that you don't want 20 million people seeing on youtube.

you just have to be aware. >> reporter: there have been a number of disputes like this because of the state's unique wiretapping law. but attorney general doug gansler has issued an opinion that it is legal for citizens to videotape police in public doing their jobs. and so far, the courts have been agreeing with him. in college park, scott broom, 9news now. >> prince george's county police did release a statement this afternoon, and it said, we recognize and support a citizen's right to landfallly record our officers performing their police duties if there is a reason to believe that that didn't occur we will immediately look into the fact of the case and act accordingly. two people, they fall in love, get married, for some reason things don't work out so they get a divorce. that's usually how it works. but for a same-sex cup paige maryland it is proving to be a lot more difficult than that. in october 2010 jessica port filed for divorce but a prince george's county judge denied it staying marriage wasn't valid in the state. the couple legally married in california and now maryland's

highest court is hearing arguments over whether or not the couple can legally split in maryland. >> i'm a homeowner in maryland, i live in maryland, i pay taxes in maryland, i work in maryland. i have every right to get a divorce in a timely manner like every other couple. >> lawyers for the woman say maryland should recognize gay marriages performed elsewhere even though it doesn't currently allow same-sex weddings. of course, that may well change come 2013 as maryland recently passed a bill legalizing gay marriage. did you know in that d.c. you can get your license revoked for driving just 13 miles over the speed limit? a d.c. woman was caught in virginia going 83 in a 70 miles per hour zone, and she was charged with reckless driving. now she's just four days away from losing her d.c. driver's license. >> i'm kristen fisher in washington where a woman is just four days away from losing her driver's license after she was caught going 83 in a 70 on i-95 in virginia, just 13 miles over the speed limit. there was no at, there was no

her amazing 40-year journey at this station. she's shown us moments that were both bitter and sweet. today what she shared during her noon newscast is very tough to hear and it affect all of us deeply. >> i need to share something that's very personal and private with most people but i want to share it with you because i feel you are my friend and my fans. on wednesday i was diagnosed with breast cancer. and i need you. i need your prayers, i need your support and i need your love. >> you got it, jc. she says her prognosis is good. the cancer was caught easter. one of the first people jc talked to about her diagnosis was her long time friend and our morning ainge company, andrea roane. for decades now andrea has been encouraging women and men, conduct those monthly self- exams. jc says it's so important because that's how she found the lump in her breast. since the announcement our facebook page has been flooded with all the thoughts of hope,

some surprising reaction today from an asian american business owner about council member marion barry's racially charged comments. during his speech he said and we quote, we've got to do something about these asians coming in and opening up businesses and dirty shops. this woman did not want to show her face but she says she understands where the ex-mayor was coming from. she and her husband own sonny's liquor. she says even though the comments were insensitive some asian businesses do have a bad reputation in the african- american community. >> they don't really take care of their business places nice and clean, and they just want to make money. i always tell my employees, we want to treat our customers like our family. i always talk to them, have a consideration with them.

>> and there was a statement issued saying the gsa commissioner got adds 9,000 bonus. off to california where oakland police they have found the gun used in the deadly shooting rampage at the university. officers have been looking for the weapon since the mon day massacre. the suspected shooter, one goh, has confessed to the killing. now he's charged with seven counts of murder and three counts of attempted murder. it is usually the suspect, not the victim, forced behind bars before trial. but that's not the case in sacramento. right new 17-year-old girl would was raped and kidnapped is in custody to make sure she actually shows up for the suspect's trial. the accused man is this fellow, frank william rackly. the victim's attorney says the teenager is very terrified to face him. but the assistance district attorney says the victim has missed two court dates and several meetings with the d.a., forcing the case to be dropped and refiled.
