uniform, in many cases putting your life on the line and raped or sexually assaulted when doing it. the pentagon says it happened to nearly 3,000 service members last year and congress is thinking about taking the military out of the loop when it comes to investigating and punishment. >> gary nurenberg is here to explain. >> many of the victims believe the military doesn't do enough to protect them and to punish those responsible. so congress is pondering a bill that would take the issues of sexual assault and its aftermath out of the military chain of command. lieutenantlieutenant survived iraq but at the marine barracks. >> in my case it was a gang rape, so my word against two of the perpetrators, two against one. >> the secretary of defense got an earful on capitol hill about how the military deals with the issue of sexual assault. >> our men and women in uniform should not fear their fellow

service members. >> but lieutenant clay says her superior officer. >> threatened me with death and performed sexual acts on me that were as he said to humiliate me. he felt that he could get away with this, because he was in a protected system. >> panetta admitted monday. >> sometimes these matters are put aside and not followed up with. >> the newest report on sexual abuse in the military counts her rapist as among those punished. >> he only spent 45 days in the bringing, and for adultery and indecent language. that is nothing. >> panetta issued new orders to ensure the cases are taken more seriously, insisting the pentagon understands sexual assault. >> it is a violation of everything that the u.s. military stands for. >> secretary panetta said tonight he is fundamentally changing the way sexual assaults are handled, 4 hour

reporting hotline, a special court-martial level system to deal with them. no more putting the cases aside and then he repeated i will change the way they are handled. congress is watching, and may still take steps to take it out of military hands. anita? >> thanks you, gary. well, new at 11:00, was it justice denied? officials at the justice department have known for years that some evidence used to convict people has been flawed. and despite that knowledge, the washington post reports prosecutors did not notify defendants or their lawyers even when they knew the cases were flawed. now, the problems arose in the 1990's when some criminal cases came under review and work done by the fbi crime lab was called into question. information about affected cases was made known only to prosecutors. crooks in montgomery county using a scary method to rob unsuspecting drivers. the first incident happened on april 3rd at 11:30 on jones lane near turkey foot road in north potomac.

the female driver was struck from behind. she called police and the person who hit her took off. on april 15th at 12:20 in the morning, on jones lane near carrie back drive, this happened again but this time the driver struck got out of the car and two masked men in the other vehicle approached with a gun and a knife. they attacked the victim, stuffed him in the trunk and drove him to several atm's and made him take out cash before finally letting him go. in both cases the suspect vehicle was a white or light- colored truck with maryland tags. call montgomery police if you have information. investigators say if you are involved in a minor collision, call the police, then drive to a public, well-lilt area and wait for the police to get there possible criminal charges and more officials under fire as the gsa scandal widens. tonight for the first time boththe acting and ousted gsa chiefs testified at a congressional hearing. we have the outrage and new

details. >> reporter: the official in charge of that las vegas outing refused to answer questions. >> did you attend the 2010 western regional conference in las vegas? >> mr. chairman, on the advice of my counsel, i decline to answer based on my fifth amendment constitutional privilege. >> did you approve the funding for the 2010 western regional conference. >> i respectfully decline to answer based upon my fifth amendment constitutional privilege. >> reporter: former gsa administrator martha johnson did talk, showing these pictures where gsa vip's staled during the agency's $820,000 convention. videos mocked the easy spending policies in convention videos. >> i am extremely aggrieved by the gall of a handful of people

to misuse federal tax dollars, twist contracting rules and defile the great name of the general services administration. >> reporter: johnson said the white house did not ask her to quit, but she resigned on her own to symbolize the need for new leadership. >> i will mourn for the rest of my life the loss of my appointment. >> thank god this time what happened in vegas didn't stay in vegas. >> reporter: members of congress expressed outrage and asked why the official who refused to testify today and planned the conference received a $9,000 bonus. the inspector general who uncovered the las vegas spending spree testified he's handed the case over to the justice department. >> we recommended criminal charges. >> reporter: the inspector general says he's now handed the entire gsa case over to the justice department. he says he's uncovered bribery and possible kickbacks. i'm investigative reporter russ, 9 news now. >> the agents on the

prostitution scandal in columbia, the agency revoked the high clearances for all 11 agents accused of hiring hookers and other misconduct. while some are suggesting it's part of a larger problem, secret service officials call it an abnormality. president obama holds a 9 point lead over presumptive gop lead mitt romney. here's a look at the latest numbers. 52% of those asked said if the election were today they would vote for president obama. 43% would choose romney. women voters back obama over romney 55 to 39%. the poll was taken from friday through sunday. senate republicans today blocked the so-called buffet rule named after billionaire investor warren buffer feet. it would have raised the tax rate for the super rich. gop lawmakers called it a political gamut. democrats say it's all about being fair.

according to harry reid, 7,000 millionaires didn't pay a dime in taxes last year. a benefit tonight at george washington university to raise money. >> the justice project was founded last year to raise awareness about a massive black log of unprocessed rape kits which contain the dna evidence from victims of sexual assaults. the investigation founded was by a rape victim in new york city back in the '90s. ten years later, her rape kit was finally processed and her attacker arrested and convicted. >> individuals that commit sexual assault, the recidivism rate, the rate at which they recommit other crimes is very high. this isn't a one-shot deal, so if we're not putting these individuals behind bars and processing these kits, our streets aren't safe. >> now, according to her, there could be as many as 400,000 unprocessed rape kits throughout the country. part of the problem is money. it can cost as much as $1,200

to process a single kit to be. it was a slow day in court as the roger clemens retrial gets underway. at the end of the day only 13 potential jurors were screened. two of them questioned the government's use of time and money in the case. clemens is accused of lying back in 2008. game three in the books and pats fans went home disappointed. >> at verizon center where the caps trail in their series with the bruins. >> it was not the way the caps fans wanted to go. before the game, i rode up the elevator to the press box with the general manager. i said, how are you feeling? he's like i'm really nervous. so he definitely had a lot to be nervous about tonight, but they were hoping the home crowd could get them going. this was a back and forth dual tonight. both teams putting up seven goal totals, more than their first two games combined. you can also see the tension

that a crazed gunman went on a deadly shooting on the virginia tech campus. >> 32 people died in the worst mass shooting in modern history. we went to a moving tribute to the victims a short time ago. good evening, peggy. >> reporter: the virginia tech memorial is just as beautiful at nighttime as it is during the daytime. the candles are still lit from the vigil earlier tonight. right now, it is quiet here, but two hours ago, the drill field was jam-packed with students coming to remember the lives lost here. ♪ [ music ] >> reporter: instead of cursing the darkness, they shined a light. that's what governor bob mcdonnell told the massive crowd of students who lit up the darkness one candle at a time. >> but what we do know is some things with great certainty.

and that is the incredible love, compassion, and concern of the virginia tech community. >> reporter: five years ago today, a deranged student killed 27 students and five teachers and injured 16 others. >> the passage of five years has done nothing to diminish our great sorrow. >> reporter: the most of the current students were not here then, they came by the thousands to pay tribute to the victims and learn about the horrific tragedy from those who lived through it. >> in the midst of our darkest day, we refuse to be defined by an act of violence. >> reporter: after hearing a short life story on each victim, the students were moved. >> speeches about them at the end, it was very moving, to hear all the things about them. it made it more real. >> all of them, it's like every single one of them led like a more extraordinary life than i could even imagine. lawsuits, people suing their bosses for the o.t. last year the labor department won $225 million in back pay for employees, up 30% from the year before. tonight, actor ryan o'neal is thanking fans for their prayer and support as he battles prostate cancer. he said it was detected early and doctors expect him to make a full recovery. he was diagnosed with leukemia in 1998 and he beat it. his longtime partner, farrah fawcett died of cancer three years ago. tomorrow morning a chance to see a space shuttle flying low over the heart of our capitol. it's the discovery heading for its retirement home. discovery will piggyback a boeing 747 and make a special washington flyover on its way to dulles. sometime during the 10:00 hour. on thursday, crews will tow it to the smithsonian where the shuttle will be on permanent display. it will fly over and land

woodward spent the day picking up the pieces left behind. residents say the tornado moved very fast and there were no sirens. lightning apparently knocked out the town's warning system as the storm hit. >> usually this is a wet time of year, and it's dry. >> and where is the water? that's what farmers along maryland's eastern shore have been asking again and again. it's now so dry many of them stopped planting their all- important corn crop. meanwhile, well drillers are punching holes into the ground looking for water to irrigate a farm in preston that ideally needs 1,000 gallons a minute. the entire eastern shore is under a drought watch except for cecil county. >> not good. >> no, and this early. >> that's the thing. i went to the shore a couple of weeks ago and they were irrigating the crops. that's okay in july but not in april. let's talk about the rain and lack of rainfall here in the metro area. the immediate metro area, we're abnormally dry. not technically into a drought.

but we're looking at rainfall averaging around four inches. three inches at dulles. and one inch -- 1.2 inches on average. we're well below average, 4-5 inches below average. the drought mount monitor, we are abnormally dry, but you get to the eastern shore and you're either in a moderate drought if you're right along the bay, and you're right smack in a severe drought right where they're trying to grow all that. they're going to hold off on that for a while. fires still going in the shenandoah and page county. please be careful of cigarette butts. wisconsin avenue, very nice, summer outside. 78degrees. the winds out of the south/southwest at 13. the frontal system is still to the west and will go through in a couple of hours and turn winds more northwestly at 10- 20. overnight partly cloudy, breezy and mild. isolated shower possible. had to keep it in.

this was a back and forth duel. lots of excitement, lots of fighting. let's get to the game and show you the highlights. making a playoff debut at home. game scoreless until four minutes to go. a rocket to put the caps on the board first. second period, rich scores for boston, but 13 seconds later, alex ovechkin into the glove, caps up 2-1. the bruins get two more past hopi. they like putting the move on thomas. caps tied up at 3. two minutes left. charra gets one to go. bruins take the game 4-3. that would be your game winner. >> it's hard work. it's not that we're not doing it. it's just we know as a group that we can be successful. >> we played great and their
