man. dick clark productions created thousands of hours of television, particularly award shows, such as the golden globes, the daytime emmy awards and academy of country music awards. he appeared on many of the shows, most famously for years ringing in the new year as a host of dick clark's new year's rocking eve. clark was unable to host in 2004 after suffering a stroke a few weeks before the show. but he made a highly anticipated return in 2005. it was his first television appearance since the stroke. >> getting closer to midnight and everybody is to one spot. >> clark's youthful appearance got him the nickname, america's oldest teenager. >> the minute you grow up and freeze in time, you are old. >> clark felt that rock and roll lasted so long because it has so many forms. he himself survived by embracing each new way,

ensuring the affection of millions of americans. >> a statement from dick clark's statement says the long time tv host died of a massive heart attack earlier today. an out of control car slammed into the building just before the lunchtime rush. and tonight, it is raising new concern about safety issues associated with elderly drivers. in this case, the driver was 91 and police tell 9news now they are examining driver competency as part of its investigation. scott broom is in front of jerry seafood with more on this. >> reporter: started across the street at the bbnt bank where the driver lost control of his car. the car came screaming across the road right to the parking lot here. if it had been me, he might have hit me. and slammed into jerry seafood right there. >> he came and rode right

through our dining room. it's crazy. >> caught on tape inside the restaurant, the impact looked something like an explosion. you can see a waitress leaping out of her seat as the car crashes in. taking tables minutes away from being filled with lunchtime customers. employees rushed outside. >> i told him, put the car in park, turn the vehicle off. he was trying to back out of there. >> police are looking for a cause. >> he was taken to a local hospital to be examined. we don't know if there was a medical condition or not. >> driver competency became a big issue this year, legislators approved extending the license renewal period from 5 to 8 years to save money. for a driver aged 82, that means no renewal test until age 90. >> i don't want them taking my driver's license away. >> the accident here remains under investigation with no

conclusions yet about driver competency, mechanical failure. for the moment, restaurant employees are simply counting this as a close call to remember. and jerry seafood tonight, you can see the cleanup continues. jerry's is a popular restaurant here. probably among the most popular around. they think they'll have this repair done by the weekend. in the meantime, jerry's sister restaurant in bowie is open for business. reporting live, scott broom, 9news now. >> incredible pictures there scott, thank you. breaking news now out of richmond where it appears the budget stalemate is done. less than one-half hour ago, the senate passed a budget and peggy fox is live with more the peggy. >> reporter: well that's right. yes, virginia, you have a budget. at 4:30 today, the senate took a revote and they had the votes they needed this time. specifically they had the vote.

and that vote was from senator charles colgon, a democrat. yesterday he voted against that $85 billion plan. he had been convinced by fellow democrats that they needed to hold out for more money from the state for the dulles rail line. that rail line, the phase two part of it from wheelie avenue to dulles airport and into loudoun county is not funded yet. the state has only agreed to put up $150 million. that's only about 5% of the total cost of that $2.7 billion plan. and the democrats wanted to hold out for $300 million. they thought they had a deal in the works. they thought they had their whole contingency of democrats holding together, but a few hours ago, i spoke with senator chuck colgon and he felt he made a mistake. he said he had gotten a call from the prince william county chairman, corey stewart, who

told them look, we need a budget. we have to make sure our kids are educated. we have to get the budget going so all the localities can have their budgets in place. so that really affected charles colgon and he wanted a do over. he wanted another chance. in fact, he got that chance and they wound up taking a vote at 4:30 today and it was 20-19 and chuck colgon made it pass for the republicans. they have their $85 billion plan. and we'll have more on that. you'll hear from senator colgon coming up at 6:00. i'm peggy fox reporting live in richmond. back to you. >> no government shutdown for virginia. that is the good news. thank you, peggy. a university of maryland student accused of threatening to go on a campus shooting spree has been found competent to stand trial. 19-year-old alexander song was arrested in march. investigators say he had posted online messages saying he would kill enough people to make it to national news. it could be months before the

case goes to trial. police are investigating what they call a robbery by force at the university of maryland. it happened yesterday near the graduate hills apartments. investigators tell us two female students were out walking when two men approached them and demanded their property. one of the girls was pushed to the ground. neither of them seriously hurt. and police are still searching for the two men tonight. the army is now investigating photos the l.a. times published that appear to show u.s. proof posing with the bodies of afghan suicide bombers. it is the latest in a string of incidents complicating the mission in afghanistan. danielle nottingham has the latest from the white house. >> anita, the head of the pentagon spoke out today and said this incident does not represent what the u.s. military is about. >> top u.s. officials are strongly condemning photos the los angeles times published that appear to show american troops posing with dead

insurgents in afghanistan. >> that behavior that was depicted in those photos absolutely violates both our regulations and more importantly, our core values. >> the two printed photos are among 18 taken in 2010 that an 80 secondary born division soldier wanted the newspaper to make public. the secretary said the pentagon asked the l.a. times not to run the photos. >> not excusing that behavior. but neither do i want these images to bring further injury to our people or to our relationship with the afghan people. >> white house called the pictures reprehensible and said the president wants those responsible held accountable. the obama administration is already dealing with a series of recent incidents that have strained relations with afghanistan. last month, an army sergeant allegedly killed 17 afghan civilians in a shooting

rampage. earlier this year, video surfaced showing marines urinating on afghan corpses and the accidental burning of korans sparked deadly riots. sec secretary paneta apologized. the los angeles times reports the soldier that gave those pictures wants to investigate a breakdown in discipline and leadership in afghanistan. at the white house, danielle nottingham, now back to you, anita. there's also an investigation tonight into the disappearance of a fort bragg soldier, army pfc, kelly bore bordough. an employee at the bar offered

her a ride home. she says quote, kelly is not a solar who would go a wall. a texas woman charged with murder after allegedly shooting a mother to death in order to abduct her newborn child. it happened near houston yesterday evening. the suspect got into an argument with the mother. cala golden and golden was leaving a doctor's office with her baby boy. mcclane shot golden repeatedly, then snatched the baby and drove off. >> based on the totality of this investigation, the interview with the suspect, examination of evidence, we do believe today that she acted alone. >> that three day old baby was found unharmed last night. lesli. >> all right, an extended school year, longer days, possible school closures. tonight, we're taking a closer look at a plan that could affect your child's education. d.c. mayor, vincent gray, and

kia henderson sketched out a plan that will graduate more students. our own bruce johnson was there as this plan was unveiled. so, what do we know about it? >> you know what i think? five years of school reform, a long way to go. >> i'm not satisfied with where we are on test scores. >> after nearly five years of school reform efforts that began with michelle reid, our former boss and mentor. >> we really have to get dcps functioning. >> only 43% of public school students are proficient in reading and math. under a five-year plan unveiled today with mayor gray, they want to increase math and reading proficiency. in the 40 lowest performing schools, the goal is to increase proficiency by 40 points. longer school hours and the longer school year will be tried in some schools. principals are asking for it. >> we could do a lot more if

we had an extended day and school year. we know for sure that in order to move kids who are behind, we need more time with them. >> it would be chaotic to go out and say, well, 123 schools will now go to school until 5:00 every day. i think that's not responsible. so what we're going to focus on is working with a few schools initially. >> under questioning, the mayor and school chancellor conceded that many school buildings will be closed. no specific numbers, no time frame. >> we will be closing schools, yes. there will be some pain, but we'll also open new programs. we'll figure out how to consolidate schools. >> five-year plan gets high marks from herb. he gets scholarship money to give to qualified d.c. graduates. >> what's been missing in the past is understanding where we were trying to go as a school system. at least now she's layed out bold goals that we can now measure on the ground. >> now back to that five-year plan. there are some 220 school

some terrifying moments today for a couple people on board this overturned sailboat in lake michigan. these two were spotted holding on for dear life in choppy, cold waters before they were seen by a tv news helicopter. a chicago police boat was dispatched and the men were helped aboard. they both appeared to be in good condition as they were taken away in ambulances. what a way to boost your retirement. a retired illinois couple comes forward as the last of the big

three megamillions jackpot winners which was $656 million. anny hong has more on the couple. >> they are a darling couple retired from illinois. we're talking no office pool or a bunch of tickets, just one. retired couple said they bought a $3 quick pick ticket in their hometown. a small southern illinois town. illinois lottery officials introduced meryl and patricia butler at a ceremony in their hometown. that's where they bought the winning ticket for the historic march 30 drawing. now this retired analyst chose to accept the prize as a lump sum payment of $111 million after taxes. butler says he was watching the 10:00 news when he realized he held a winning ticket. >> i turned to my wife who was right there with me and i says, we won. and she kind of looked at me

son. generally speaking, we have rain south and north of town. it's drying out south of town. 54 downtown. kind of april showers and march temperatures, really. winds northwest at 8. pressure steady at 30.19 inches of mercury. and we're looking at clouds going to hang tough tonight. the rain and showers will dispate. here's a wide look at the rain. hagerstown, west of charlottesville. this is all training up to the north and to the east. a little less to get over towards fredericksburg and southern maryland. less rain fall. all right, live doppler 9,000. we'll pinpoint some of the activity. going up 270, it's going to be a wet commute. thankfully nothing is heavy, but wet roads up 270. out 97 towards alany. out connecticut avenue. you're going to have wet roads heading north of town. also some rain towards leesburg. and also over toward ashburn. but again, nothing is heavy.

so that's the good news. temperatures are cool. 50 in rockville. 48 in gaithersburg. 50 in bethesda. only low 50s in great falls and reston and sterling is 51. looking at 52 down in manassas. even down in fort bellvoir. 50 in beltsville. so, here's the deal. we are going to have a nice finish to the week. as dreary as it is right now, it will be nice friday. milder on thursday, warmer on friday. and then rain for the weekend. here's a hint, trying to schedule a tee time, schedule it on saturday in the morning. tonight, mostly cloudy, chilly, light rain and showers, especially north and west of town. light winds, at least thankfully, unlike last wednesday when it was blustery, no winds to deal with. returning partly cloudy and cool. grab your sunglasses. 40s and 50s with light winds and by afternoon, beautiful day. partly cloudy, milder, about

average. sometimes it pays to be average. high 65 to 70 and winds will be light once again. that's good news indeed. so, let's break it down for you. 46 to 52 to start in the morning. a little chilly and cool by noon. temperatures in the 60s. mild by evening. under partly cloudy skies. a good idea. the next three days, temperatures go up even more friday and saturday. gorgeous on friday, 75. warm on saturday, 74. we do have some showers and maybe a thunderstorm late in the day. i think the bulk of the day will be dry on the front end and that will be the better of weekend days. why? well, here's the seven-day. looks like a good soaking rain on sunday. looks like a nor'easter. temperatures around 60 with rain and showers and maybe some thunderstorms, although if the storm hugs the coast, we'll have some rain. the bulls eye may end up being the dell morva. eastern shores are the hardest hit by the drought.

sky 9 was over a school bus crash that injuried two people in anne arundel county. it happened earlier this morning. investigators say the bus collided with a car. you can see it right there in the intersection. no children were on the bus at the time. a 25-year-old man was taken to the hospital with unfortunately, life threatening injuries. the identity of the second

victim unclear. a ten-year-old was being bullied is facing charges for allegedly bringing a bb gun to school. the child was bullied because he wears ankle bracelets. and the ten-year-old brought the bb gun to school to intimidate his classmates. he got the gun from his mom. the man who confessed says there are only two options. the death penalty or an acquittal. the right wing said in court today that the maximum prison term in norway of 21 years is pathetic. the key question now is, by the same, because that determines whether or not he goes to prison or a mental institution. >> the family of osama bin laden is expected to be deported to saudi arabia today. this almost a year after u.s. navy seals killed the chief in pakistan. bin laden's three widows and nine children were detained after the raid on may 2. the family has been in custody

since then. the relatives were eventually charged and convicted of living in pakistan illegally. now to an amazing story of survival out of india. a man trapped under the wreckage of a building that collapsed for two days has been rescued. it happened in india's northern state. rescue crews used bulldozers to try to save people trapped in the rubble of a blanket factory that collapsed on sunday. nine workers were killed. 61 others had been rescued. okay, why did this man bare it all at an airport security check point? >> out with its 100 most influential people in the world. one of those people lived right here in bethesda. i'm sur ray chin. i'll tell you what it is coming up.

we now have breaking news in the investigation of the secret service scandal out of columbia. scott pelley has more. >> one secret service member said he would be fired. and a third has decided to resign. eight other members of the secret service are still under investigation. part of the team, but going to columbia to secure president obama to the summit of the americas. an investigation has shown that 21 americans, 11 from the secret service and 10 from the department of defense hired prostitutes and brought them back to their hotel. all became public when one of the secret service agents got into an argument with one of the women over payment.

the demating process that will soon begin at dulles. kristin fisher joins us live with more on that part of the story. kristen, as we were saying yet, demating was a new thing for us. >> it's slightly unusual term, but when you look at the shuttle, you can see why it's called that. now all day long, people, space nerds, nasa geeks, they have been coming up here where i am now, which is the roof of the parking garage right here at dulles airport. and they have been coming here hoping to catch a glimpse of this demating process, which was supposed to start today. but if we take a look all the way out on the tarmac, you can see shuttle discovery and her shuttle carrier aircraft, that 747 are still mated together one on top of the other and the problem, the delay has been this weather. high winds, rain, some lightning, that has all prevented the nasa crews from

beginning this process. so now it's going to be taking place overnight starting at 8:00 p.m. until 8:00 tomorrow morning. then the shuttle will be towed over to the udvar-hazy center for that big welcome ceremony which will take place tomorrow morning at 11:00 rain or shine. so if you still can't get enough of space shuttle discovery. get up here to the rooftop of the parking garage at dulles starting at 8:00. you should see some pretty spectacular demating, as they call it, as the shuttle separated from that 747. back to you. >> all right, we'll wait to see it all happen. thank you, kristen. >> from fly by to drive by. an elderly woman crashes into a florida grocery store. now this surveillance video just looks crazy. the car is driven by a 76-year- old woman crashing into a store, striking a baby stroller and injurying ten people. yeah, i got distracted watching that. the car appeared to be going 50

miles an hour when it crashed through the supermarket. they found a problem with the brakes. the driver now charged with fearless driving. the dramatic takedown . officers used stop sticks to slow down the suv. the driver swerves and comes to a stop. that's when a police dog would not let go of the man. officers had to cut through his shorts to get the dog to release him. the suspect was treated for dog bites and taken to jail. don't mess with the dog. now to a story of a man who gave travelers a bit of an eye full. >> police say john brennan stripped naked during a security check last night. he refused to put the clothes back on. brennan was protesting all the extra security measures he was being put through. brennan told officers he felt the tsa agents were harassing them. police charged him with

indecent exposure. they say he was not under the influence of drugs or alcohol. wow. nor is he shy. >> rescuers came to the aid of a gray whale entangled in a fishing line off the california coast. the 40-foot whale is towing 50 to 100 feet of line on one of its fins and in its mouth. the crews attached the boys to the whale to help track it as they got into position. >> counting down to the games, a look at what london is doing. >> first, a closer look at the link between gum disease and your heart and what the real risk may be.

as you probably heard, the number of people diagnosed with alzheimer's disease is growing. by 2030, 80 million seniors could have the disease. researchers think they found a better way. dick brennan reports. >> don and carol are doing their daily chores, but they may also be reducing their risk of o alzheimer's disease. the couple is taking part in a study that uses this wrist monitor to follow their every move. the device tracks their level of activity 24 hours a day. >> i always feel better if i'm

moving around. i don't want to stay put for very long. >> exercise can reduce the risk of alzheimer's, but every day physical activities like cooking, cleaning, and washing dishes can make a big difference. >> overall activity during the day seems to have benefit, even more than exercise. >> dr. rog and researchers at the rush university medical center in chicago use the activity monitor on 700 seniors. they found the least active people were more than twice as likely to develop alzheimer's. doctors call it the fijit factor. just moving, even fijiting can make a difference in the long run. >> it doesn't matter what activity you do, as long as you are doing activity. >> for don, it's personal. both his mother and grandmother had symptoms of dementia. he believes it pays to be active mentally and physically. >> your body is the card given

to you. if you don't take care of it in both ways, you can be in trouble. >> and doctors say keeping all the parts moving is a fine first step. cbs news, new york. >> doctors say a healthy diet that includes fish oil and antioxidants can also reduce the risk of alzheimer's and dementia. we have more in our health alert. for decades, doctors linked heart disease for gum disease. there's no proof one causes the other. they looked at hundreds of studies and researchers for the american heart association determined that treating heart disease does not seem to reduce the risk of cardiovascular problems. the new report from the heart association is published in today's statement in the journal circulation. now we are talking about gum disease and mouth health, now here's something that is interesting. there is some evidence that using floss may protect against health problems. the university of pennsylvania's penn dental medicine center suggests flossing at night instead of

the morning. and try not to saw back and forth when you floss. start at the top and slide down. then remove it and move on. well, if you want pictures of all the babies delivered at holy cross hospital, you better have a will lot of photo albums handy. holy cross helped to deliver 100,000 babies and that's just since the year 2,000. to celebrate, holy cross brought together the moms, doctors, and nurses and little ones who made it happen. >> better schools, safer streets, thriving businesses, healthier citizens. all of those are goals of a new neighborhood initiative. county executive outlined the project during a trip to glass manner elementary in oxen hill. he said it's going to involve everything from filling potholes to boosting police paroles to replacing empty store fronts with new

businesses. we have to be more efficient and more effective in how we deliver services to our citizens and our residents of this county. >> and the initiative is going to focus on six neighborhoods. the east river dale area, glass manner, the hill crest heights, marlow heights area, langly park and the coral hills neighborhood. >> that's good. that's my platform, no potholes. you know what else? everybody gets bacon. like bacon wednesdays or something. >> what if you don't eat bacon? >> then you don't enjoy the treat. >> you won't be voting for top. >> the third thing would be smart, traffic lights. you don't waste gas. that's my platform. >> let's get to the forecast. temperatures today more like march. and the showers more like april. finally we have april showers. looking at temperatures, still in the mid to low 50s. some of the suburbs in the

lower 40s. winds out of the north, northwest at 8. 54 at the airport. and the pressure is steady. 30.19 inches of mercury. and looking at winds light. winds not really a factor today. they sure were this time last week. here's all the rain and showers pushing northeastward and moving north and west. so you are drying out in southern montgomery county. still going to have a wet commute up 270 and also out route 7 in virginia. live doppler 9,000, you get south of gaithersburg, not so bad. it's generally dry. but the bulk of the steadier, light rain out toward leesburg and everything toward charlestown is moving away up to the north and to the east. temperatures if you are headed out, grab a jacket. it's chilly. 48 in gaithersburg. 51 in great falls and in reston, 51 in arlington. only 53. 53 in college park. 55 out towards annapolis. so, here's the deal. a nice finish to the week.

there is scheduled for 2013. we begin tonight with breaking news as it appears, the fourth time was the charm for a budget in virginia. and now that the battle is over, a final bill is heading to the governor's desk. i'm peggy fox in richmond where late this evening, the senate took a revote and this time approved an $85 billion two- year budget. they did it with one democrat siding with republicans. >> i made a mistake. >> the senator wanted a do over after he felt he made a mistake by voting against the budget on tuesday. after supporting the budget in a conference committee, he was convinced by fellow democrats in the evenly divided senate to vote against the plan to hold out for more money for the dulles rail project. >> the state has done practically nothing for dulles rail and it's being supported right now by the local governments and by the commuters. >> state has only committed
