department documents while serving in iraq. manning's attorneys today asked the judge to dismiss all charges against their client. a ruling on that is expected sometime tomorrow. >> this sentence sends a mess sole message that the lives of our three children are virtually meaningless. >> sample of the anger you witnessed here live friday evening from the parents of three young people killed in a montgomery county drunk driving accident. it happened after a three judge panel cut the 20 year sentence, given the driver, kevin coffee, in half. we have a transcript of the judge's decision that sparked so much anger and grief from those parents. scott broom was here to walk us through it in the judge's own words. scott. >> there's no audio or video recording in maryland courts. when this transcript became available, we wanted to get ahold of it to go through it word for word so you could decide for yourself whether this was an outrageous

sentencing or not. what the judge did and the way he did it was so cruel to us, the families of these victims. >> it was hard for all of us to watch the anguish and anger of these parents. after the sentence for kevin coffee was reduced from 20 years to 8. >> the lives of our three children virtually meaningless. >> coffee was driving drunk when he went off the road may 16 last year, killing three high school companions and fleeing the scene on foot. so why did the three judge panel reviewing his sentence reduce it? in the transcripts released today, the judge reading from a unanimous opinion, acknowledged the grief of the families. but he went on to point out that the three victims were drunk, too, and said quote, their ability to make good decisions was compromised. when it came to getting in coffee's car after attending two underage parties. then he layed some blame on a

culture of under age drinking. quote, kevin, an immature 20- year-old didn't produce this culture, isn't responsible for it, and shouldn't bare the burden of remedying it. why should he pay a big price for a malady, which was in existence long before may 15, 2011 in mcbegan went on to say, we will not place blame at kevin's feet for creating the reckless climate, which allows, tolerates, and sometimes encourages excessive drinking. >> the judge should be punished because it's exactly what he's done. he has put the stamp of approval on the kevin coffees of this world. >> a lot of very angry victim parents after this. it took the judge 10 or 15 minutes to go through his entire opinion. a lot of words there, but it all boiled down to three words for the families. this opinion boils down to an advertisement, drunk drivers welcome here. that's what they said. live in the newsroom, scott

broom, 9news now. thank you, scott. well, it looks like maryland could have two special legislative sessions in the coming months. one, to deal with the state's money problems and the second to focus on expanding gambling for the national harbor. now, if the legislature does not pass a new budget by july, the so-called doomsday budget, which includes half a billion dollars in cuts will take effect. d.c. councilman, marion barry, has some explaning to do tonight. this after his remarks about nurses who work in d.c. hospitals. during a recent council hearing, barry said quote, it is so bad that if you go to the hospital now, you find a number of immigrants who are nurses, particularly from the philippines. the former mayor added quote, no offense, but let's grow our own teachers, let's grow our own nurses so we don't have to be scrounging around having to hire people from somewhere else. last month, barry was forced to explain remarks he made about asian business owners. we asked barry for an interview

today, we were told he was unavailable. tomorrow, the u.s. supreme court will hear arguments about arizona's law designed to crack down on illegal immigration. it requires police to check people's immigration status when they are stopped for traffic violations. it makes it a crime for illegal immigrants not to have some proof of immigration or try to solicit work. several other areas including prince william county, virginia, enacted similar measures based on that arizona law. today, a senate subcommittee held a hearing on the constitutionality of state and local government enforcing immigration law. >> i will submit to you that any evidence to justify profiling, harassment, or repression of anyone is un- american, illegal, and unconstitutional. >> i believe it's too damaging to our economy and too dangerous to our democracy to have our states do 50 different

tonight. they'll have to spend 40 minutes extra in class. reduce transportation costs by merging some bus routes. and a school in southeast d.c., one of just eight chosen from all across the country to take part in a new white house program. it is part of the turn around arts initiative and it's a two- year program aimed at transforming into what the white house calls a creative, engaging, and high performing learning environment. >> virginia's governor is pushing the limits to tuition hikes at virginia state university. major increases would deter qualified students from getting a college education. speaking on wtop radio, mcdonnell said the idea is simply unacceptable. >> i said this 10% increase every year can't do it anymore. it was 9.7% last year. i kept my end of the bargain.

the hovel space telescope started orbiting earth. the space shuttle discovery, heard a lot about that, released the telescope 381 miles above the surface. since then, it has given us glimpses into space that are ten times clearer than anything you can see on a telescope on earth, and asteroids circling our solar system. and speaking of as trades, there's a focus on a new mission. >> a group of scientists and tycoons announced their plans to mine the space rock as they move toward earth. you get everything from water to precious metals out of these hunks of rock that are out there for the taking. >> this company is not about paper studies. this company is not about thinking and dreaming about asteroid mining. this company is about creating a space economy beyond the earth. >> yeah, except the outside experts are skeptical. they say the folks may never, ever get off the ground. they worry the project requires

witnesses begin taking the stand today in the child molestation case against the husband of the former mayor of falls church. the first witness against michael gardner, a ten-year-old child who was on the stand for more than 3 1/2 hours. peggy fox has been covering the story and brings us the latest. >> it was a grueling four hours on the witness stand for one of three girls who accused their former friend's father, michael gardner, of sexually abusing them. the alleged incidents happened over two nights at a sleep over and then a slumber party at the gardner's home last june. the ten-year-old witness said she had fallen asleep watching movies. she said, i heard someone opening my sleeping bag. though it was dark, she said i saw mr. gardner. she said he held up the waistband of her underwear and put his hand inside. she said he touched my girl

parts. he just like felt around. she said i wasn't sure what to do, so i acted like i was asleep. she said he left and went to someone else, but came back and did the same thing again. commonwealth attorney asked the girl why she didn't say anything and she said, i didn't know what he would do if he saw i was awake. on cross-examination, the defense attorney tried to discredit the girl's attorney. the girl could not remember and denied statements she made to detectives and seemed unsure about whether she had seen michael gardner that night or not. >> our thanks to peggy fox. matt, the husband of 9news now reporter, jessica doyle, was called as a witness by the prosecution today. he testified that he was a guest in the house the night of the alleged attack, but he didn't see anything. tonight, we are learning a bit more about why the city commissioners in sanford, florida, rejected their police

chief's resignation. we told you about the vote to keep the chief, bill lee, on the job, but on paid leave. lee stepped aside last month at the height of the call for charges in the trayvon martin shooting, but at least two commissioners say they did not want lee to lose his job until a special investigation to this case is completed. investigators in alabama want to know if a man was beaten within an inch of his life as a result of the martin case. this happened saturday night. investigators say matthew owens was attacked by a mob of people after complaining about some children playing basketball in front of his house. police are still trying to sort out all the details. >> the victim had approached some kids that were playing basketball on the street and fussed at them about playing basketball. after they left, what is believed to be a number of adults came back and assaulted our victim with pipes, paint cans, and chairs. >> the victim's sister says she heard one of the attackers say the beating was justice for

trayvon martin. home prices dip to a new low in february. according to the index, home values in 20 cities declined 3.5% from a year ago. atlanta, charlotte, and new york were included in the nine markets that were the hardest hit. phoenix and miami saw an increase in home prices. the rate around washington, d.c. remained unchanged. those high bank and debit card fees have people taken to the streets last year and some banks cave to pressure, but that still hasn't slowed all of them down. they are still raking in billions with a b of dollars in overdraft fees. sharon signed up for overdraft protection on her checking account. she thought it would protect her from those penalty fees. >> i got hit with the bank charge for the transfer and the bank charge for the overdraft and because i had written a

check, i got charged the return check fee. >> consumer reports said government rules that went into effect in 2010 were supposed to help curb abusive bank fees. it hasn't worked that way. >> now your bank must get you to sign up for overdraft protection, then it will cover you if you spend more money than you have in your account. >> for instance, if your account is overdrawn, you're able to use your debit card to buy a magazine or a pack of gum, but for each transaction, you can be charged as much as $35 a pop. banks rake in more than $31 billion a year in overdraft fees and sharon says overdraft protection is a sham. >> don't say that i'm protecting myself by signing up for this program when there's still going to be this charge. >> so here's how to get real protection. first, decline your bank's offer to opt in for that overdraft protection. if you are signed up, opt out. >> you won't be able to use

your debit card if you have enough money, but you can be charged overdraft fees for a bounced check or automatic withdrawals if there isn't the money to cover them. >> another good idea, we file alerts. we have alerts that e-mail us or text us when our account is under a certain amount that we set. >> so sharon will not get hit with unexpected charges. you can also minimize fees by linking your savings and your checking accounts so that you'll have that much more money to draw on if your balance gets low. you might be charged a transfer fee, but that is certainly much lower than those $35 overdraft fees. all right, now we need to tell you about a bank in our area being singled out for doing something good. virginia commerce bank corps made the forbes list of america's 100 most trustworthy companies. it was saluted for being transparent, having integrity, and not playing games with its revenue expenses and assets.

virginia commerce is also the only bank headquartered in virginia to make the list. d.c. mayor is out to make this city in his words, the greenest, healthiest, and most livable city in the country. earlier today, he cut the ribbon on a brand-new bridge that is part of the river walk trail. this bridge provides a link between bening road and the title basin. gray also released his 20 year stainability plan. >> there frankly is no reason why we should not be the greenest, healthiest, most livable city in the nation. and i need your help to make this a sustainable city a reality to all of us. >> now, under the mayor's plan, most people would opt out of using cars in two decades from now. and a will the of homes and apartment buildings would have their own compost pile. >> a new york kidney donor wants her organ back. she donated her kidney so her boss could move up on an organ

donation list. now her employer at atlantic automotive repaid her by firing her. stevens talked about what went through her mind. >> you hate me so much, i'm so dispickable, then give me my kidney back. give me my kidney back. >> her work might have suffered during her recovery from that surgery, but she says in the end she feels betrayed. the new york post reports it would take four operations for steven to get her organ back because it was one of those domino effect donations. clearly that's not happening. breaking news right now. we learned that three more secret service agents involved in that prostitution scandal in columbia have now been forced out of their jobs. two more agents have been cleared. congress member peter king says a top secret service official says five other agents and officers are still being investigated for their conduct just ahead of president obama's visit to columbia a few weeks ago. in all, a dozen people were implicated in the scandal.

a mixed up hodgepodge of garbage. those are the words of roger clemens lawyer today describing evidence collected by his chief accuser, former trainer. the government's key witness says he injected the seven-time psi young winner with human growth hormones. clemens is accused of lying to congress when he denied using those drugs. a former aid is sharing intimate details about john edwards affair and the coverup of it during the 2008 campaign. the former presidential candidate is accused of illegally using campaign funds. >> the prosecution star witness, andrew young, came to court and zeroed in on the

heart of the case against john edwards. that the former presidential candidate used illegal campaign contributions to cover up his affair with rielle hunter. the former campaign aide said they insist they talk in code about payments because quote, he couldn't know about this in case he had to be sworn in as attorney general. a reference to edward's hopes for a cabinet post. >> this claim that john edwards would be speaking in code in order to have an attorney general, it suggested he might have known these contributions were illegal. that's a key part of the case. >> young testified that when edwards heard hunter was pregnant, he made a derogatory comment, saying there was only a quote, one in three chance it was his child. young testified that hunter threatened to go public so they used $1 million in donations from wealthy contributors in order to support hunter's lavish lifestyle. edwards edwards communicated with her and for a time, hunter

temperatures later tonight. right now, we'll show you the big picture. showers in much of new york state with a few showers mixed in and down into pennsylvania and some of the showers into western maryland. most of the showers confined west of i-81 inbetween cumberland and hagerstown. if you go far enough north, you could see a sprinkle or a shower. temperatures, 59 in bethesda. 58 in arlington. 61 in rockville. you go further up 270, it's only 57 in gaithersburg. looking at 60 in great falls. 59 in reston. 62 to the west of us in sterling and 59 in leesburg. 62 in college park. now it's not going to be crystal clear tonight, but some folks had a real treat last night with the northern lights. we had that big solar flair earlier. check this out. this is near minnesota. that is incredible. i have never seen anything like

it. it rarely comes this far south. that is just absolutely spectacular and that is electromagnetic particle jumping up and down as they interact with the particles sent to the sun. it's a pretty cool sight. all right, back to reality for us. temperatures running about 10 degrees below average. if you are headed out, grab a jacket. you will be warming up gradually, but you'll need a jacket for the kids tomorrow at the bus stop. milder on wednesday and then warmer on thursday with some showers and maybe some thunderstorms. all right tonight, partly cloudy, cold. a one blanket night. 36 to 46. winds westerly. we may have to dial these down a little bit. we will keep you posted on that. there are freeze warnings to the west of us. partly cloudy tomorrow morning, a cold start. you'll need a jacket and shades. 30s and 40s. and then by afternoon, pretty nice day. partly cloudy, milder. light jacket not a bad idea.
