arizona's immigration law. >> we don't need people coming in here illegally. >> people have a right to come into cross borders to help their families. >> reporter: inside justices listened to arguments about one of the most controversial parts of the law. it would require police officers to perform roadside immigration checks of people they've stopped or detained if police believe the person may be in the country illegally. >> it became clear today during the argument that there is no federal system that would readily clear united states citizens who are stopped during a traffic violation. >> reporter: some fear the law could lead to mass arrests of illegal immigrants in arizona. >> if they're breaking the law, there's that possibility i would assume. >> reporter: the justices appeared skeptical about the obama administration's argument that the government not states should enforce immigration law. >> the burden, of course, on the federal government in this case is to show that there's a conflict between what the federal government has done in its congressional approach and

what arizona has done in its own approach. >> reporter: justice elena kagan is not taking part in the case because she worked on the issue while at the justice department. the remaining eight justices could reach a tie. that means the lower court decision would stand. this law would not take effect. the court is expected to issue its ruling at the end of june. danielle nottingham, cbs news. >> today's proceeding sure does give us an impression that the justices may be poised to overturn other laws. we have some help here to break down what happened. donald, your impressions of the arguments today? >> i couldn't believe how hard the justices were making it for the solicitor general. they really came down hard especially where part of the arizona law where if they're a reasonable stop, can you check to see a person's status?

it was almost beetling of them. >> so in -- belittling of them. >> so in other words, you believe there's an impression that part of the law may stand? >> i do. this what's going on in many parts of the country. you see somebody with a reasonable stop. it depends how far you go, what's reasonable, not reasonable, but you're just reporting on to the federal authorities. >> what parts of the law could be under fire where states are overstepping what the federal government does? >> arizona in this law makes it a crime to look for work, makes it a crime basically to be an overstay or to come in unlawfully. there's no crime under the u.s. law for this. it's not a criminal matter. it is an administrative wrong. so arizona i think the supreme court will say overstepped creating a law the federal government or congress did not create. >> only eight knights of the supreme court will be deciding this. elena kagan had input on this case and has recused herself. how does that affect the ruling? >> it means if we're looking at

liberals and conservatives, the liberal side is down one. if you're looking at the conservatives being at four, liberals being at three, justice kennedy being the balance, maybe at best we'd see a 4-4, but i think we might see lopsided decisions on both sides of this. >> the fact is the lower courts have thrown out a good deal of this law. if there is a tie, the law is still thrown out, correct? >> well, the law is thrown out but just in the 9th circuit. it won't be precedent throughout the rest of the country. >> polls show more than 2/3 of americans do like this law, 68% according to quinnipiac. does that have any bearing on what the court does, in other words the politics? >> i think the perception of the law, people haven't delved into deeply to what the law actually says, but i think if we start seeing the racial profiling that liberals believe may happen as a result of this, i think that perception may change a bit, but the sense and disquiet about what do we do about people who overstay or come across the border without going through normal channels,

there's a lot of disquiet in this country. what do we do? >> we appreciate your time, thank you. even before arizona prince william county, virginia, passed one of the country's toughest laws involving people here illegally. that county law makes it mandatory to check legal status after arrest, but it gives an officer discretion to check legal status before a person is taken in. lisa johnson who has been practicing immigration law over a decade believes the prince william county law will stand no matter what the u.s. supreme court decides. >> to make it in a post arrest situation only, not mandate that the police question someone in a prearrest situation, so i still don't believe that prince williams law will likely be impacted. >> but johnson first believes if the court rules in favor of that arizona law, more states, counties and cities will begin to adopt such laws. day three of the child molestation trial of michael gardner produces some of the

prosecution's strongest testimony yet. it came from an 11-year-old girl who took the stand against falls church community activist and businessman that she says molested her. >> reporter: peggy fox at arlington county courthouse covering the michael gardner trial. three little girls accuse him of molesting them. one of those girls took the stand today and a courtroom observer found her extremely believable. >> i thought she was very arctic hate and bright and credible. -- articulate and bright and credible. >> reporter: the 11-year-old girl that took the stand today was at the gardner family's slumber party and said she woke up because someone was messing with my sleeping bag. >> who was it? >> i saw his face explaining there was light shining in from the basement windows. the girl said mr. gardner then went upstairs but that he came back downstairs and started touching me on my vagina. she said gardner went upstairs and came back again and touched her again on her vagina.

she said, "i didn't know what to do. i was nervous and scared." a dna expert has been on the stand this evening talking about michael gardner's dna on the girl's clothing. the defense takes the case tomorrow. in arlington peggy fox, 9 news now. the jury is debating the fate of five men accused in a series of shootings in d.c. in march of 2010. prosecutors say the men went on an eight-day rampage that killed five people and injured nine. the defendants face life in prison if convicted on the most serious of the charges. homeland security secretary janet napolitano says there was no threat to president obama's safety as a result of the secret service prostitution scandal. still during a hearing on capitol hill today she said the situation did pose a risk and that's why it's being investigated so forcefully. >> the first question i posed to the director was was there any breach to the president's security in this instance and the answer was no. >> but there was a risk of

breach along those lines if those connections existed, correct? >> there may be a risk and that's why this behavior cannot be tolerated. >> napolitano called the behavior of those involved in the scandal inexcusable and so far at least a dozen people have been caught up in the matter. still to come he is the talk of the town and the redskins haven't even drafted him. hear what robert griffin, iii's parents think about the pandemonium surrounding their son. >> but first governor salahi? the infamous white house gate crasher starts the process that could make that phrase a reality. we'll talk about it next.

just one day after mitt romney pulled off the sweep of five republican presidential primaries, anotherred can may be bowing out. two advisors -- another candidate may be bowing out. two advisors to newt gingrich say he may formally end his campaign next tuesday. the former speaker was in north carolina today, but after yesterday he says he knows romney will win the nomination and is calling for republicans to unite around him. >> i am committed to this party and defeating obama. we will find ways to be helpful. i do think it's pretty clear that governor romney will be the nominee and we'll do everything we can to make sure he is, in fact, effective. >> in all gingrich won two primaries, south carolina and georgia. hoped to pull off delaware, didn't happen, though. his advisors expect him to

endorse romney once he drops out next week. while one republican is getting out of the race for president another one is getting into the race for virginia governor, tareq salahi. that's the man who became famous after he and his wife crashed the white house steak dinner. now he's filed a declaration of candidacy and plans to run as a republican. his candidacy is not official. the virginia board of elections cannot accept the declaration of candidacy until the start of the election year for the race. that's january 1st next year. a new poll shows the race in virginia this year for the u.s. senate now a dead heat. according to rasmussen, republican george allen leads democrat tim kaine by one percentage point. that's 46-45, a huge drop from two months ago when the polls showed allen had an eight-point lead. both still have to win their party's nomination in the june primary. the two former governors will face off in the first of four debates saturday. get ready to break out the

griffin, iii with the no. 2 pick in the 2012 nfl draft, but today was a little bit of fun. the heisman trophy winning quarterback joined other top prospects to give back to the game. the college stars were teaching football and fitness skills to 600 kids at the nfl's play 60 draft celebration and rg3 says while tomorrow is a dream come true, it means even more to his family. >> it's more important to my family, my mom and my dad, my friends, everybody involved is cheering and it's a celebration of what i was able to do and what they helped me do in my past. so i'm going to save it and when i get -- savor it and when i get drafted, i'm going to fly to d.c. >> for rg3's parents, their moment comes tomorrow night when their son's name is called inside radio city music hall. our dave owens caught up with the griffins in new york city. >> reporter: i'm here with the parents of robert griffin, iii, what a week, what a month. jacqueline, i'll start with

in the mailbag tonight the reaction harsh indeed to a school in a town known as converse, texas, that will not let a couple kids wear t-shirts dedicated to an organization that's helping their dad who is badly hurt serving the military in afghanistan. the school says those t-shirts violate the dress code even though a shirt with a college name on it would be okay. karen just doesn't get that. since when is a t-shirt with a college name on it not an advertisement? this district needs to be consistent. and ulysses writes please, i have seen kids with all kinds of different sayings and slogans and you you want to stand firm?

i think we want to show what this country stands for and behind our troops. i'd say consistency is a good thing, but as emerson once said foolish consistency is the hobgoblin of small minds. in other word, you find yourself in a hole, you might want to stop digging and on that vicious dog attack days ago greta says we missed an important average the on the story. i am disappointed after seeing those terrified dogs beat back by those neighborhood family men that no one, not even mcginty dared to call them heroes. these men without thought put their lives in jeopardy to spare those kids. if the first menman had not intervened, those -- first man had not beer conveniented, those kid would have been dead and if the second man hadn't intervened, the first man would have been dead. okay. those actions took a lot of courage. they deserve to be honored. heros is the right word. write us any time. the address is mailbag at wusa9.com.
