river were put on notice to keep watch of what could be a changing situation if more rains come. >> so precautionary measure to notify communities and towns and residents is downstream. the dam has gotten to a specific level over the normal limits. >> the storms dumped 3 inches, workers hurried to close about a dozen flooded roads after streams and creeks flowed over their banks. rushing waters ripped out part of the road when the pipes under ground could handle no more. >> over flows the road and undermind the asphalt and exceed the capacity of the types we had. >> police closed park gate road when a small bridge was deemed unsafe and near the bristow man, it was kettle runs waters. the driver of this pickup truck regretted taking a chance on piper road near the manassas station. he had to be rescued by boat. >> unless you are driving a

tank, i wouldn't even attempt to go across. just find an alternate means to get around. >> a number of school bus routes had to be canceled. hopefully it will all be back to normal tomorrow morning. reporting in manassas, peggy fox, #news now. >> the flood waters may have receded for now, but all it will take is heavy rain. topper. >> here's the deal. most of the showers and storms have been heavy tonight have been well west of us. let me show you live doppler 9,000. we have a few storms trying to develop in the past 20 minutes. this is where the heavy rain was last night. right in that area. if we do see some showers and thunderstorms trying to develop in this area. in fact, these are going to become certainly heavy rainmakers, not going to be severe, but good activity if you are headed out towards chantilly. that's the heaviest activity. that's rain fall rates of a half an inch per hour.

we'll collapse this collapse this for you. it sits on route 50. they sit and sit and sit and that produces the flooding. right now, the heaviest activity is down towards charlottesville and over on the i-81 corridor. we'll watch that for you as we go through the night and keep a close eye on these storms in western fairfax county, because that's close to where the areas got hit last night. >> we'll talk to you later, thanks, top. >> gary giordano has been charged with indecent exposure. he is a gaithersburg man linked to the disappearance of robyn gardner. giordano was arrested last friday in annapolis. this has nothing to do with the aruba stuff. according to a police report, giordano and a woman were naked in the back of giordano's suv. a parking garage manager had called report a possible sexual activity. we spoke with robyn gardner's exboyfriend about what happened. >> this incident at 5:45 in

the afternoon and he had a mattress in the back of his car. it says a whole lot about the guy. >> we did try to reach gary giordano to say what he wanted to say, but he refused to talk to us. d.c. mayor is still out of town tonight and he will not talk about news that his campaign's top money man appears to be headed to prison. thomas gore pled guilty in federal court today to illegally diverting campaign dollars to another candidate, sulaimon brown, so brown would stay in the race and keep on attacking the incumbent. bruce johnson has been on this story right from the beginning. >> today in federal court, thomas gore for mayor gray confessed that he and a second campaign staffer were involved in a scheme to get money to sulaimon brown. sources identified howard brooks to 9news now as that second campaign staffer. gore admitted in court that he diverted money from the gray campaign and gave that money to brooks who used it to purchase

money orders that he in turn delivered to sulaimon brown. >> vincent gray's campaign, specifically mayor vincent gray gave me cash to maintain my campaign for mayor, cover living expenses, and attack then mayor fenty during the 2010 mayoral race. >> i can't imagine engaging in such reprehensible behavior. i know absolutely nothing about any one of miscampaign who did that. >> he kept a record of the payments to sulaimon brown until he learned of the fbi investigation he destroyed the notebook. in total, we're talking about five money orders. some bought here at the safeway across from campaign headquarters. a total of $660. all misdemeanors, but then it kicked up to a felony, obstruction of justice when you consider that gore destroyed the notebook, got caught on tape admitting it, and lied to federal authorities. >> he is facing 12 to 18

months in prison. according to sources, howard brooks has his own deal with federal prosecutors. no word on when he'll appear in court. bruce johnson, 9news now. >> it is official. income taxes are going up on people making six figures. today, governor martin o'malley signed into law the $260 million tax hike that was passed by the general assembly in last week's general session. this would affect households making $150,000 or more. governor o'malley signed into law a plan shifting some teacher pension costs down to the county level. those two bills keep the state from having to cut almost half a billion dollars in spending. meanwhile, maryland's house and senate leaders set a date for another special session. this will consider -- the tentative date, july 9. but that is only if a gaming work group reaching a consensus and poses a bill.

that work group will consider adding table games and whether or not to build more casinos, including one at the national harbor in prince georges. a federal appeals court has rejected an arlington dog groomer's attempt. we told you about kim back in december of 2010. that is when the arlington county told her to cover up that mural because it violated county advertising rules. it violated her first amendment rights to pree speech. but today, the circuit of appeals disagreeded. a scary moment for a woman in montgomery county. she called 911 only to hear the sound of snoring from a dispatcher asleep on the other end of the line. >> i'm anny hong in montgomery county where a woman calls from this residential building in rockville. she called 911 on april 4 just after midnight concerned that her husband was having trouble breathing. >> hello?

hello? >> the 911 call taker transferred the call it a dispatcher, but soon realized something wasn't right. >> hold on one second, let me get them on the line again. >> what you're hearing in the background is snoring from a sleeping dispatcher. another dispatcher got on the call to help. montgomery county assistant fire chief says the dispatcher snoozing on the job was 17 hours into a 24 hour shift. >> the employee was immediately taken from the floor, maced on paid administrative leave pending the outcome of the inquiry. >> the woman's husband was taken to the hospital and released without any life threatening injuries. in rockville, anny hong, 9news now. smoke, fire, and explosion and people trapped inside a tunnel. what would you do? for a couple of u.s. capital police officers, there was no

hesitation. even though inhaling that smoke sent them to the hospital. bruce leshan got the opportunity to speak with those officers who helped commuters stuck in dc's third street tunnel yesterday when a bus burst into flames. the officers, michael wait and andy mabo. >> we just saw the dense smoke coming. it was so dense that you couldn't see the light. >> we are obviously yelling at each other the whole time, making sure we had sight of each other. it was very easy to get disoriented. >> except for some hacking and coughing and tightness under the chest, both men feel fantastic and it's right back to work with the u.s. capital police. they say they are ready to do it all over again if they have to. still to come, one year after the town was ravaged by the deadliest u.s. tornado in six decades, joplin, missouri, marks a major milestone in the effort to make a comeback. but first, a local woman launches a movement to create an annual tribute to the late

august 22 chuck brown day. that would be the d.c. music legend's birthday. so far, more than 2500 people have signed up. the woman hopes to get 5,000 signatures before mailing it to the mayor. a mother in texas has doled out unusual punishment for her daughter. that girl posted a picture of herself on the website, instagram. she was with an unopened bottle of vodka saying, i wish i could drink this. she made the girl post a picture of this. the sign reads since i want to post pictures of myself with liquor, i am not old enough. >> i love that woman. the mom says her daughter was mortified at first, but came to accept and appreciate the punishment. don't be fooled, a little sunshine this afternoon is

permanently grounded, space x is one of several private companies competing for nasa contracts to carry cargo and eventually astronauts into space. the space capsule is carrying a thousand pounds of mostly food ask clothing. if all goes well, it will reach the space station in a few days. a 58-foot robotic arm will latch on to the capsule and guide it into the space station on friday. >> if things are moving in the right direction. there's lots of activities that will occur that will stretch the space x team and also stretch the nasa team. >> nasa is now focusing on trips further into space to visit planets like mars. dick brennan for cbs news, kennedy space center. >> what do you think? does using private companies make up for the fact that the shuttles are grounded and sure, they got the stuff up into orbit, does any private company have enough company to get to mars? nasa in the backseat, your

marking the anniversary with a day of unity. people in joplin spent the whole last year rebuilding. businesses reopening, homes rebuilt, and today, the city gathered to break ground on a new elementary school. that's one of three new buildings that will replace the schools destroyed one year ago. it's a new beginning for joplin and the school district, they worked so hard to get to this point and this is just, it's an incredible feet what we have come through. >> human spirit on full display. more than 130,000 volunteers from all over the place shown up this week to help them get it all done. later in the day, they join survivors and first responders for what they called a unity walk. followed the exact path of that terrible tornado. a half mile wide, top? they don't usually come that wide, do they? >> that's a big one. we had over 1600 tornadoes in 2011 and the aver raj is about a thousand. >> it was a bad year.

>> almost double. we're looking at most of the activity south and west of town, but there are a couple showers and storms beginning to pop up. a great picture of a rainbow. first things first, let's start with a live look outside. see the rain drops hitting the camera. this is brought to you by michael and son. our live weather cam. temperatures 76. high was 80. winds are still out of the southeast. we cannot get rid of that southeasterly component of the wind. pressure is rising, 29.82 inches of mercury. all right, look at the rainbow. this is really pretty nice. this is sent to us by our own greg. this is i-66. you're looking east and there is the rainbow, which means the sun is behind you and it's raining in front of you. we appreciate that. very nice. and right now, a little around manassas, where all the rain occurred and unfortunately, we have showers and thunderstorms beginning to develop. we'll take you out here to front royal first. they have been around i-81.

the problem is, they don't move much. they produce very, very heavy rains and this is more than likely hail and it is essentially on the west side of i-81. pretty heavy rains there. rain fall rates in red, 1 to 2 inches per hour. now going out route 50. this hasn't moved at all in the last 20 minutes. so this is rain fall rates of an inch, inch and a half per hour and that's sitting on top. back the radar out a little bit and we'll put this into motion as to what's going to happen in the next hour. and the storms really don't move much at all. i mean, this drifts across i- 81. this storm drifts across 66. and weakens a little bit. we'll keep an eye on those storms because they will have the potential of producing heavy rains and some flash flooding. temperatures, 77 in great falls. 74 in arlington. looking at 79 in rockville and 78 in college park. so, unsettled and humid for a while. some thunderstorms tonight. more sun tomorrow, but showers

and thunderstorms tomorrow as well and thursday, more of the same. more showers and storms. for tonight, mostly cloudy and mild with showers and storms. low temperatures in the 60s. winds will be light. after midnight, we may see some fog develop as well in the wake of those storms. next seven days, we'll hover around 80 tomorrow and thursday and then mid to upper 80s on frizz. decreasing chance of showers, and the weekend is going to feel like july 4. close to memorial day. 90 on saturday. 91 on sunday. low 90s on monday. a few storms are possible, but it's not going to be that bad of a weekend. >> unless you don't like heat. >> you are correct. we'll be right back. send your e-mails to mcginty's mail bag. the address, mailbag@wusa9.com. 9news now will be right back.

in the mail bag tonight, there is disagreement over the sentencing of former rutgers student who got 30 days in prison after he video taped his gay roommate making out with another guy and said roommate killed himself. michelle in hyattsville just can't believe it. that sentence is an aberration of justice. what is appalling is the guy that did that act didn't even apologize. how disgusting. they should take that judge's law license away. first of all, can we get away

with this idea that we don't like this idea? plus, not everybody agrees that the sentence was off target. listen to harold in germantown, for example. robbie was convicted of violating tyler clemente's privacy. he was not convicted of murder or contributing to the suicide of tyler. it's a shame that tyler took his own life, but people should look at what the charges were and they would see the judge's decision was just and fair. thanks for that, harold. robbie's actions were unspeakably cruel. frankly i don't understand the lack of a sincere apology. however, if we take the suicide out of the equation, which has been pointed out, he was not charged with, does the 30 day sentence still appear so grossly unfair? and then there was this on the decision to back gay marriage, even though polls show a majority of black folks disagree. brad says good job. the naacp got it right. the ones out of touch with the
