and this is just shaken us all up. >> now the pilot of that other plane is still in the hospital tonight recovering from his injuries. and people are still bringing in pieces of those two planes. one broke apart on impact in midair and bruce leshan reports because one pilot worked for the ntsb and the survivor for the faa the canadian transportation board took over the investigation. >> it was in a perfect glider fashion. >> reporter: jim flanagan still shaken by the plane that crash- landed in his cow pasture. >> in on the southeast side of it. and -- if we can kick the field goal, it's right through the uprights. and he left the wings as you can see the white residue. >> reporter: he's shaken as well at what the pilot told him. >> he told me he had hit someone in midair. >> i in part because the -- in part because the pilot of the

pitcher told them -- piper told them he hit something but how and why these two aircraft were in the same place at the same time exactly in the middle of the giant blue sky that's in the center of this investigation. and investigators are going to be looking at these holes in the piper, this distinctive square hole here with red paint around it as well as the jagged tear right here. investigators are also going to be looking at site lines, clearly those two pilots didn't see each other. and both this piper and the beachcraft have wings that are placed down below the cockpit. >> once we ascertain the angle to which they came together then we will start to look at what would be the field of view from the pilot's perspective. >> reporter: the pilot of that beach craft never had a chance. investigators say the tail break e broke off on impact -- broke off on impact and here it is at least a piece of it.

right in jim flanagan's cow pasture without the tail there's no way to fly the aircraft. what's amazing is that the piper pilot could land with this piece of tail. attached to his aircraft. in summer duck, virginia, bruce leshan, 9news now. >> the surviving pilot just got out of the hospital and immediately headed to flanagan's farm to thank him and his wife for helping him after that crash. a veteran culpeper police officer sits in jail tonight charged with murder. a special grand jury indicted officer daniel harmon wright in the death of a woman earlier in year. peggy fox is live in fauquier county. peggy? >> reporter: well, anita about four months since patty cook was shot and killed by a culpeper police officer. now that daniel harmon wright has been charged with murder and is here in the fauquier county jail, many are saying justy is finally served --

justice is finally served. >> his initial reaction was shock and horror. he was on the verge of nausea. >> reporter: dan hawes escorted his client culpeper police officer daniel harmon wright jail after a special grand jury indicted him for murder and three our counts. he is charged in the shooting death of 354-year-old patricia cook in her jeep in a catholic school parking lot february 9th. >> she had been warden, around in the religious school and refused to identify herself. >> reporter: they wound up in a confrontation. he told investigators she caught his arm in the window and was dragging him when he shot her six times. special prosecutor jim fisher says it didn't happen that way. >> the terms trapped and drags were used. these were not descriptors that i would have used. >> and she's being held there. he can't -- he can't free himself. >> reporter: harmon wright's attorney says it's true. he wasn't dragged. he says it was his hand that was caught in the window and that he'd stepped up on to the

jeep's running board as cook started driving away. >> she wasn't armed. was she? >> no. >> then how was its self- defense? >> she hit a light pole or a -- what was it? was it a light pole? telephone pole. now if she had been slightly to the right of that pole and he was still attached to the window he'd have been crushed. >> reporter: his mother, bethany sullivan is also charged relating to forging public documents and an attempt to purge her son's personnel file of negative information. >> i thought -- like hey you know, i can believe it. >> reporter: price wonders if her compliant against harmon wright could have been altered. this is a hospital record showing an injury to her wrist that she says she suffered when harmon wright pushed her in 2008. now daniel harmon wright has been suspended from his job without pay. his first hearing is in culpeper circuit court next friday. reporting live in fauquier

opens the cash register and gives him an unspecified amount of o money. >> reporter: in hill crest heights maryland, scott broom, 9news now. neighborhoods do all sorts of things to get drivers to slow down on the local streets but new traffic calming measures in jones bridge road are upsetting the residents and drivers tonight. according to the examiner at least half a dozen drivers have hit them so hard, they blew out their tires. and neighbors complained the island's not marked and it's hard for drives to see it. montgomery county is looking into the problem. mcduffy is the newest member of the d.c. city council. he was the new council member for ward 5. he won a special election last month to replace harry thomas jr. heading to prison after pleading guilty to embezzling money from the city. new at 6:00 tonight, another thumbs down from dwight

back now with the commuter alert about some major work on the beltway. crews will be repaving the through lanes on the inner loop between the wilson bridge and telegraph road. they're going to start closing the lanes tomorrow night and plan to have them completely shut down by friday night at 8:00. they will reopen monday morning. so local lanes will stay open through the weekend. a supercute 6-year-old is creating quite the buzz at the scripps national spelling bee.

and you can leave your remembrances of chuck brown on facebook. just search r. i. p. godfather of go-go. an ohio man is fighting a littering ticket. he says he got when he tried to give money to a panhandler in the wheelchair and the cash fell to the ground. john davis says he reached out and the money dropped on the ground. police gave him a $344 ticket. here's the deal. cleveland officers say it's illegal to solicit or give money. a woman from ohio is also in trouble. she broke into a home and did some cleaning and left a bill. the family thought a cleanings service sent the wrong person to the wrong address but the woman told them no mistake and you better pay up. >> our jaws just dropped to the ground. i said what happened you know? did you get the wrong house? she said no. she said i do this all the time and i'm like what do you mean?

she goes i just stop and clean your house. >> the woman in question is named sue warren and we're told she does in fact run a cleaning business. so far no charges have been pressed here. but last month, in a separate matter, warren was charged with criminal trespassing. a waiter in houston got quite a shock last weekend when two customers left him a whopping $5,000 tip. the generous payment couldn't have come at a better time. greg rubar's car was destroyed recently in a severe storm and he'd been talking cabs and buses to get to work. a couple of the restaurant regulars heard about the troubles and decided to help in a big way. after finishing their $27 lunch, they handled him an envelope with $5,000 cash. >> he just said here and said you know we're still going to come in and not tip you for a while. he said this is for you and this is enough money to buy you a nice car. >> he will buy a new ride. >> there are good people out there in the world.
