charges against the former chairman of the d.c. city council. he resigned amid accusations he lied on financial applications for a home equity loan. bruce johnson has been following the story from the very beginning and joins us now from the wilson building with more information. what are you hearing, bruce? >> reporter: jc, yesterday was the big charge, a felony, bank fraud. today it's a misdemeanor, one count, one charge, unlawful cash campaign expenditure aiding and abetting. to summarize what we v they're charging kwame brown allowed his brother to set up and outside account. jay brown had no official standing with the campaign but allowed him to set up an outside account and then to make expenditures from that account. that's illegal. one misdemeanor count kwame brown has agreed to plead guilty to that. that will be decided in d.c. supreme court, not federal court. back in january specifically on
12:02 pm
our set i asked kwame brown how the federal investigation into his 2008 campaign would turn out. here's would he said. >> when you say it's going to be a positive outcome, does that mean there's going to be nothing in kwame brown's doing how he handles his campaign that will have you standing before a judge or something like that? you're totally innocent of any wrongdoing, other members of your campaign totally have done nothing wrong? >> i have done absolutely nothing wrong, bruce. >> reporter: so obviously either that wasn't correct, that wasn't true, or he has been made to realize he had done something wrong and is going to plead guilty to that one misdemeanor. our sources also say his brother sls likely to face -- is also likely to face charges from prosecutors. kwame brown resigned yesterday. he's due in court tomorrow for arraignment. leenter the guilty plea. he's expected to be released on
12:03 pm
his own recognizance. i might mention that kwame brown's staff is in there right now. they officially were terminated last night when kwame brown's regular nation was accepted by the council secretary. they're looking for new jobs or waiting to find out if the next chairman will keep them on board. back to you. >> bruce, in this plea deal, we're assuming that mr. brown is going to have to serve time. how much do you think? >> reporter: well, it might come as a surprise you to. i don't think he's going to serve any time. i've been talking to a lot of people close to this case. with the federal guidelines, he's looking at perhaps zero to six months but my sources say that it might even be part of the plea agreement that chairman kwame brown serves no time. it might be enough. it might have been enough for prosecutors just to get him out of office. we've noun seen they've done -- we've now seen they've done that.
12:04 pm
>> bruce johnson is continuing to follow the story. we'll have the latest information beginning on 9news now at 5:00 and our website wusa9.com. thank you, bruce. well, d.c. residents have seen a lot of political corruption this year. former council member harry thomas, jr. stepped down from office in january. and then he pleaded guilty to charges that he sold money -- he stole money from the city. earlier this month, 2010 campaign aides to mayor vincent gray pleaded guilty to corruption charges. howard brooks and thomas gore were both involved in giving money to former mayoral candidate sulaimon brown and both could spend some time in prison. the kwame brown story has a lot of people talking. you can join in that conversation by going to our facebook timeline. that's at facebook.com/wusa9.
