so imagine the surprise of guests who wanted a dip in the pool this weekend when they saw this sign saying the pool is currently closed for unforseen maintenance, but according to documents obtained by 9 wants to know under the freedom of information act, the closure was actually ordered by the d.c. health department alleging staff was unable to provide certification of lifeguarding and cpr training, that the water system was in disrepair and conditions created a hazard to the public. marriott wardman park was also cited for ignoring the citation and reopening despite the closure order. marriott declined an on camera interview saying in a statement, "we take matters of safety and security very seriously. we contract with an outside pool management. the pool is closed until further notice as we look into this situation." at noon today we tried to ask the district health department how often this sort of thing happens, how often does a pool ignore a closure order? they said it would take them until noon tomorrow to answer

any of our questions about this particular closure situation or closure rules in particular. a pool safety consultant tells me it's a very big deal that puts the public at risk and could make a hotel really liable if there was an accident. >> so why is this consultant saying that this could be a vulnerable situation? >> well, the one thing which obviously we were talking about earlier that is if these pool workers weren't certified to do cpr and lifeguarding, that could be an immediate risk. the other thing, if you're ever sued, you want say you didn't know about any potential risk. in this case those health inspectors clearly said an imminent health hazard and ordered a closure. nobody was hurt today when a u.s. navy drone crashed on maryland's eastern shore. it went down in a marshy area about 20 miles west of salisbury. that unmanned drone went down during a routine training flight. the coastguards blocked off the crash site to recreational boat

traffic while they investigate what happened. questions about what the culpeper police department did and didn't do in the months before one of its officers shot and killed a woman. >> reporter: i'm peggy fox in culpeper where the police department may soon face a civil lawsuit because of the officer charged with murder and their alleged failure to rein him in. just four months before culpeper police officer daniel harmon-wright shot and killed unarmed housewife patricia cook, he used excessive force against the wilson family. >> it was terrifying. it was a little scary. >> reporter: their mother says officer harmon-wright pounded on her door waking her up on the morning of october 10th. with his gun drawn he demanded to search her home for her son. were you afraid? >> i was scared. i had just woken up, not even wiped my eyes, came out of my room and i had his gun in my face. >> reporter: the civil lawsuit patricia cook's husband filed against harmon-wright maybe expanded to include the police department. his attorney greg webb says, "the more i learn about what

occurred over the last six years and his history with the police department, it's mind boggling to me that his career was allowed to culminate in this horrific shooting." peggy fox, 9 news now. here in d.c. police are hoping you can find a convict who just walked way from a work crew this morning. conrad thames was serving 10 years for manslaughter and handgun violations. police say he was part of a crew working along route 197 in prince george's county. he was last seen wearing a fluorescent road crew cover with a white t-shirt and jeans. you see conrad, please call 911. the man accused of ramming his suv covered in gasoline into a connecticut avenue office building made his first appearance in court today. >> reporter: i'm andrea mccarren at d.c. superior court where the man who plowed a jeep into a downtown office building has been charged with assault with the intent to kill while armed and arson. 32-year-old charles morrell ball told police his family was in danger and the frederick

county authorities wouldn't do anything to help. after plowing through the glass of this office building at 1050 connecticut avenue northwest ball told the metropolitan police officers on the scene, "i want to speak to the fbi. i did this to get their attention." charging documents reveal that ball had doused the stolen jeep and himself with gasoline before reaching into his pocket for a lighter. as he flicked the lighter, police snatched it away before he could ignite anything. when police contacted the owner of the stolen jeep, she told them ball had left a voicemail message saying i was going to make people pay for -- he was going to make people pay for their actions and said there will be bloodshed. andrea mccarren, 9 news now. inside a county courthouse in pennsylvania disturbing stories of child sex abuse and the big question, of course, are those stories true? testimony now underway in the trial of jerry sandusky, the

former assistant football coach at penn state. sandusky is charged with abusing 10 boys and prosecutors today called on one of the alleged victims on the stand, a man who is in his 20s now. that man testified he took showers with sandusky after exercising and those showers led to sex acts. defense attorneys maintained the victims are just out for money. no pitches today for roger clemens. his defense team rested without calling him to the stand. the former major league pitcher has been on trial in d.c. for nearly nine weeks, but closing arguments are set for tomorrow. then the case goes to the jury. clemens is charged with lying to congress when he denied ever using performance enhancing drugs. attorney general eric holder could face contempt charges related to a botched sting operation called fast and furious. today a house committee leaninged holder is not giving lawmakers -- alleged holder is not giving lawmakers all the information they've requested

about the operation. fast and furious allowed illegally purchased guns to get into mexico. the plan misfired when the guns ended up in the hands of mexican drug cartels. a medical condition may be behind two car beings involving the secretary of commerce over -- car accidents involving the secretary of commerce over the weekend. >> reporter: a government spokesperson says commerce secretary john bryson suffered a seizure at the wheel of his car when he allegedly caused two separate crashes near los angeles saturday. bryson spent a night in the hospital for observation and returned to washington. white house spokesman jay carney says the president's chief of staff jack lew spoke to bryson this morning. >> we're obviously concerned about the incident and concerned about secretary bryson's health-related issues that played a role in this incident. >> reporter: police say bryson crashed his lexus into another carsoned waiting for a train. they say he spoke -- car stopped waiting for a train too

pass. they say he spoke to the -- to pass. they say he spoke to the three men inside and hit their car as he passed. minutes later bryson allegedly hit another car in the neighboring city of rose meade and was found unconscious. he was given seizure medication and hospitalized. nobody was seriously hurt in either accident. bryson was cited for felony hit and run but has not been charged. bigad shaban, cbs news, san gabriel, california. >> secretary bryson voluntarily took a breathalyzer test after the accident. the los angeles county sheriff's department said drugs and which were not factors in either crash. a spokesperson for egypt's interior ministry says former president hosni mubarak has slimmed into a coma. the 84-year-old -- slipped into a coma. the 84-year-old's health has been deteriorating since he was sentenced to prison a week and a half ago for killing uprisers in last year's protest.

11-year-old chance leo has plenty of hair to go around and that's a good thing since he's growing his hair to give others a chance. when he was 9, he heard oprah talk about helping kid with

cancer by donating to wigs for kids or locks for love and he told his mom he wanted to help and despite being teased at school, he's been growing his hair ever since. >> them getting teased, the kids for cancer who have no hair and very so much hair i'm getting teased, when you put it together and think about it, they're getting my hair so they won't get teased and when i get my hair cut to give to them, i won't get teased. so it's a win/win for both of us. >> chance says his parents and sister helped him stay motivated through all the teasing and now he knows who his true friends are. he says his hair is about a foot long right now and he plans to get it cut soon. the museum of the confederacy in virginia is asking for some help. the museum discovered photos of two little girls on civil war battlefields and near trying to identify them. the richmond museum wants to find out the story behind these photos. if you have any information, contact the museum.

breaking news out of new jersey where a boat apparently exploded off the coast. these are the waters here and if you follow the camera, it will take you over to the emergency equipment hopefully still in the water. this is the picture from monmouth where crews are waiting for the victims to be brought back to the shore. about 21 people were aboard a yacht named blind date when some sort of explosion occurred. now the boat sank, but we hear everyone was able to make it to life rafts. at least seven people are injured. it's not clear at this point the extent of those injuries. we will watch this story and bring you more information when we get it into our newsroom. now to a commuter alert about some work that starts on the beltway tonight. crews will shut down three of the four lanes of the outer

loop between georgetown pike and the oak street overpass. this work is part of the express lanes project and it's expected to last every night this week. those lanes will be opening up by 5 a.m. mitt romney is hitting the road for a six-day bus tour in campaign 2012. the republican presidentialed can will start in new hampshire friday. over the next five days he'll visit pennsylvania, ohio, wisconsin, iowa and michigan. romney plans to meet with small business owners hurt by the recession to portray the president as out of touch. the polls open at 6 a.m. for virginia's primary tomorrow. voters will cast ballots for u.s. senate, u.s. house and alexandria city council races. we have a complete voters guide for you at www.wusa9.com. we'll also have the results for you tomorrow night on 9 news now at 11:00. just 12 people are voting on a replacement for the now convicted felon kwame brown and a majority may already have

decided on phil mendelson. the low key at large council member would only become the second ever white chairman of the d.c. council. bruce leshan reports vincent orange is still lobbying for the job. >> reporter: what do you think will happen wednesday? >> i think the council will meet. >> reporter: phil mendelson is no showboat, but his mild mannered no frills persona may be what most of his colleagues are looking for do. you have anything you could tell us? >> reporter: after scandals that have driven two other council members from office. >> the council is hurting. we've betrayed the public trust. we need to rebuilt the public trust. >> reporter: vincent orange is still trying to convince his colleagues that he is the stronger leader. >> if you look at my record and look at the record of mr. mendelson, you'll see the majority of the time he's on the losing side of a 10-2 vote or 12-1 vote. >> reporter: ward 7 council member yvette alexander says some of her constituents are worried about race, but she suspects mendelson already has

a majority of seven strong votes wrapped up. >> it's always an issue to be quite frank, but i think in this instance it's who has been in the community. >> reporter: and phil mendelson for you has been in the community? >> he has been. >> reporter: if phil mendelson wins, he would become only the 2nd white chairman in the history of the d.c. -- second white chairman in the history of the d.c. council and there is the potential that he could become the first ever white mayor since the start of home rule in 1973. does it matter in the majority black city that you're white? >> it shouldn't, but yes, it's still an issue for many people. >> reporter: the council chair would become mayor should a long running federal investigation force vincent gray from office. mendelsohn is ambitious, but he says he does not want to climb the ladder with another scandal. >> i truly hope that that doesn't happen. this government doesn't need

of harward and charlottesville getting more of the downpours out there. still sticky out there, wind south 15 miles per hour, lower 80s in hagerstown, cumberland 77 degrees lark plate a 85 degrees and degrees, la plata 85 degrees and annapolis 84. the satellite and radar is showing us a chance for showers basically tonight and overnight. west of town better chance and then tomorrow morning we'll probably see some scattered showers to impact part of that morning commute. so unsettled and cooler, but for tonight isolated thunderstorm and shower possible, otherwise showers ands to remember likely tuesday. flash flooding is a possibility especially tomorrow with those storms. then we've got drier air moving in for wednesday here's a look at the 9 futurecast. tomorrow morning again some scattered showers for that morning commute, not widespread, but in the afternoon we can see a lot of us in the green for that light

rain. the yellow and the orange northeast of us toward baltimore is the more moderate to heavy rainfall. tomorrow night for the evening commute expect wet roads and then we'll all probably see 1 to 2 inches of rain locally higher amounts depending where those thunderstorms are and how heavy that rain is. tonight cloudy, mild and muggy, maybe a shower or storm to the west, lows upper 60s to lower 70s in, downtown 72, leesburg in the upper 60s. so here is our next three days. tomorrow the yellow weather alert day because the showers, highs low 80s, wednesday breezy, partly sunny, in the lower 80s. here's a look at your next seven days, flag day cooler, upper 70s, maybe a shower. friday is also in the lower 80s, plenty of sunshine and heading into father's day weekend it looks pretty good. saturday 80, plenty of sun, father's day on sunday, a chance for a little shower, otherwise outside plans should not be affected if you want to take dad for golfing or brunch,
