admit that this is the end of the road legally. people need to wake up. >> this is a huge victory for president obama and the democrats. >> whatever the politics. today's decision was a victory for people all over this country. whose lives will be more security for you because of it this law. >> reporter: but mitt romney, he is already offering it as a rallying cry for the november campaign. >> the o bam ma care was bad policy yesterday and today. it wasn't anthony kennedy as many legal analysts predicted. but they found that the care act is mandated and that everyone will be buying health insurance here or pay a penalty. and they could not be justified here under congress' power to regulate the interstate commerce. but he held that it was

constitutional anyway. congress may have called it a penalty, but the chief justice says that it will be a tax. collected by the irs and well within congress' taxing power. >> the health care is needed. it is constitutional, undeniable and irreversible. >> reporter: they also expand medicaid. offering it to everyone who will be falling under 133% of the poverty line. but the court said that the federal government has no right to cut off all of the state's medicaid funds. if it fails to sign up for the expanded medicaid. and that is the chief justice and what he said was not a gentle none, but he called it an unconstitutional gun to the head. so states, they are all left to decide whether or not to join medicaid expansions, and its huge federal subsidies. the fight was certainly

continuing. >> they needed to place a mandate with the tax. >> i'm so happy as the supreme court that it is the right thing that upheld the constitution. >> reporter: now, the house republican leaders, they have already set a date, just two weeks from today on a vote to repeal the affordable care. if it passes, it is certain to go nowhere in the democratic- lead summit. anita? >> thank you for your coverage. in the meantime, the attorney general, he was one of the first to challenge the affordable care act. and while virginia ended up not being a part of today's case, he still had plenty to say about the ruling. and in fact, he played a part of it. two things happen. first, they declared the explicit outer limits of the federal power under the commerce clause, which has never happened since the new

deal. and that is a win for liberty. in the future, no congressman, no president, no senator will be able to say for any bill, that has the possibility of raising money here that it is not a tax. >> and that will be before the supreme court, the attorney general said that they never doubted that the plan would be upheld. >> we knew it was constitutional. we knew that it would be upheld. so in maryland, we have been going forward progressively, getting ready to implement the affordable care act so we could make ourselves available for all of that. >> and they have passed legislation to set up the health care exchange, to set the standards and set the regulations to run the program, creating a framework for the marketplace for people and businesses here to buy the coverage.

and the district, they have all taken steps to create an exchange. they plan to commit considering the nominees to the board of the health exchange tomorrow. take a look at the numbers. all these people are living in maryland and they are no health insurance right now. that number is nearly 1.1 million. in both places, that's up to 14 to 15% of the population for you across the nation. and more than 30 million people will be uninsured. now as we have said throughout this newscast, they impacted all americans, but they will employee more than 50 full-time workers that will start feeling the changes right away. they will need to provide that for their own employees. we spoke to them and several workers in northern virginia. >> i was shocked, i was absolutely shocked. i did not think that the supreme court would uphold it.

>> reporter: surprise was quickly replaced by uncertainty, over how to handle the rising cost of insuring his 120 employees. >> i don't know yet. i'm not sure yet. reaction was varied. >> i do believe that we need to reassure those people and i think that it will be a real debate. >> i don't think that it should be mandated. i don't think that it is necessary. although, you know, a lot of us struggle to get there. >> this small business needs to take it a little bit more. more responsibilities. but it should be shared. >> reporter: whether or not the costs are sharedded or not, small businesses have until 2014 to comply with the ruling

or face a fine of up to $2,000 for each employee. 9news now. >> not every business owner is opposed to the affordable care act. the group here praised it, saying that they will rain in cost and provide more coverage for entrepreneurs. now, we'll head back to the studios with the other big decisions. >> thanks, anita. >> the justices did strike down the law that will make it a crime to lie about having received the military award. they stand from the california case here in which a former local elected official, they falsely claimed that he was a decorated war hero. and in a 6-3 ruling, they cited that the first amendment for protecting the speech that we tested here as well as that we had embraced it all. well, you can read more about today's rulings at wusa9.com. that's where we have documented for all of the cases.

the other story we're keeping a close eye on tonight. it is the heat and topper is out in the middle of it all at the congressional country club tonight. topper, it is only 95 degrees, right? >> yes, that's true. it will just get worse. that's the little heat here to speak. so the course, you know, they are yielding some birdies. and let's talk about the temperatures. yeah, downtown, really, we're in the mid-90s. but in the burbs, temperatures are in the low to mid-90s, which is not too bad. the thunderstorm is possible in the morning and on saturday we'll dial it back. won't that feel refreshing? primarily in the afternoon. here's what you can do, the kinds of stuff that you cannot do. no pictures, no radios, no tvs, no food or drink or coolers,

eric holder is voting largely along the party lines to the republicans voting for the citations and the democrats were all voting against it. now, it all stands from a dispute over the documents that the house would like to review

and that ericed holder, he has refused to turn over. but the documents, they will relate to a botched gun tracking operation along the u.s. mexican border known here as the fast and furious. the operation ended up putting guns into the hands of the mexican drug organizations. and just moments after today's vote, the attorney general, he had this to say. >> it's clear that they were not interested in bringing the end to the dispute, or even obtaining the review that they all wanted. but hopefully their goal was the goal that with the help of the special interest, they now, you know, have engineered it. >> reporter: in the coming days, the house is expected to confer that charge to the u.s. attorney for the district of columbia, who will then need to decide whether or not to press the criminal charges against holder. and his own boss. well, golfers, they hit the links in round one of this year on the at&t national today. our own have great seats over on the 18th green.

encourage you to drink a lot of water, wear your sunscreens, bring the hat. whatever you could do to mitigate the heat and keep yourself cool as possible. >> yeah. l topper said it here. it will be a while before you see the downside of 90. >> yes. [ laughter ] >> a listen while, but that's the good news. we'll see the downside of the triple digits by monday or tuesday. so tomorrow will be the hottest day of the next three. no doubt about that. >> shorts, shorts. [ laughter ] >> yes. we'll start with the forecast here now and for tomorrow and saturday. that will be at at&t. right now we're looking at temperatures. 94 downtown and leesburg. so now advance here. and watch carefully as it will go to the heat index. it doesn't change too much in terms of the humidity. it still stays 94 downtown and gaithersburg. that will tell us that the humidity level will be 28% or so. it's not adding any discomfort to the heat right now. but that will change tomorrow as they get a little more humid. okay, here is the deal for you. tomorrow, now, 101. and you could see a thunderstorm the in the morning and you could see one in the

afternoon. ironically that will drop us to 99 on saturday once again, any storm that develops and we're around 100, it could be heavy or severe. get out of the sun if possible and eat light meals. you don't want to eat one or two big meals and start moving around the gulf course. that's a recipe for disaster, believe me. dulles will fall, that's 95. record high here. 101 in d.c. and that is a big shot of that and 105 it in baltimore on the outside here. both of those records, they were set back in 1934. >> all right. now, let's talk about the forecast here for you. for tonight, well, partly cloudy, muggy. a thunderstorm is possible by dawn. not too bad right now. lows in the 70s. and now tomorrow morning, well, we're looking at the chance of a thunderstorm. you might have a wet commute in the morning. temperatures, 75 to 95 by lunchtime. >> yes. >> by the afternoon, partly cloudy with the thunderstorms

that are possible. some could be be heavy and severe with the higher temperatures that will be around 100. more likely 101. all right? and the winds are northwest 10 to 15 with a front going on through. but it will not lower temperatures. it will go back to the north here as we get into saturday. the next three days, nine weather alerts. we're going to color coat everything now. we've got the heat and the thunderstorms, 101 on saturday. and 95 on sunday. the temperatures are going down, gentlemen, i can point that out. and on the 70s, they will go down further. by tuesday and wednesday, we're in the lower 90s as we took the thunderstorm off the july 1 forecast. that's good. 95 here on thursday. and the temperatures are in the mid-90s. welcome back. we are live at the

congressional country club. round one of the nationals wrapping up here as it is a close bunch at the top of the leader boards. they remained here at the u.s. open finishing 1-even par. tiger woods here and an up and down day for the tournament and the host. a good birdie here. that's a difficult par 5. that got him to even par on the front nine. but there's the bad. at the very top 11 hole. if you miss this right off the tee, it will be trouble and that's what tiger did here. looking on with the big concern for you here as the ball will be going right into the rocky, avoiding the bogey. to the leaders, walker at the ninth. looking at a long birdie put to get a four-under par. rolling right to the hole. he would bogey that 18 hole to finish here with 3 under 68, one shot off the lead. he's trailing this guy.

and that is both sets here for them. >> and that's what i wanted, but it will be in fine shape this year. that will be high for you here and it is a tough test. >> a pretty good grind out there. not a lot of scores here, especially this afternoon. it was tough, you know, it was baked out. the ball was springy and it is hard to believe that, you know, they needed to lead it. >> it does not seem to bother me. i mean, you know, they will have a good track record of playing in the heat to keep it up. >> so here is a look at your leader boards. it is on the top here. they all tied here in third place. the local guy, the third, who you just heard from is tied from fifth at 2-under. tiger is five shots off the lead here at 1-over par. the nationals were having a rocky finish against colorado to start. jackson is giving up a touchdown in the first two innings of the game. and then they would come back
