slash e-mails tonight, asking for contributions to keep the battle going through the fall and the elections for congress and president. even the affordable care act's harshest opponents admit that it will be the end of the road legally. >> now, the only option left to us is a political solution. so people will need to wake up. we have to replace the president of the united states. >> reporter: this was a huge victory for president obama and the democrats. >> whenever the politics, today's decision was a victory for people here all over the country. whose lives will be more secure for you because of the law. >> reporter: but mitt romney is already offering it as a rallying cry for the november campaign. >> reporter: it was bad policy yesterday. it is bad policy for today. the obama care was bad law yesterday and today. >> now, it was the chief justice john roberts who offered up the swing vote.

not anthony kennedy as many experts predicted. but the chief justice found that the mandate here for everyone should buy health insurance or pay a penalty, that it could not be under the power to regulate the commerce, but they held that it was constitutional anyway. and congress, they may have called it a penalty. but the chief justice, he says that it will be really a tax. it was all collected by the irs and well within congress' taxing powers. >> the health care was moved here. undeniable and irreversible. >> reporter: and they also expand the medicaid. offering it to everyone who will fall under 133% of the poverty line. but the court said that the federal government, they have no right to cut off all of the state's medicaid funds. that's if it fails to sign up for the expanded medicaid. and that, the chief justice said was not a gentle nudge,

calling it an unconstitutional gun to the head. so the states, they are all left to decide whether or not to join medicaid expansions, and the huge federal subsidies. the fite was all, but certain to continue. >> they will place the mandate with the tax. >> i'm so happy as the supreme court, doing the right thing to uphold the constitution. >> reporter: now, one big question is what this is now going to do to the supreme court's reputation with the public, you know, before the vote. they were suggesting that the supreme court had gotten just way too political and was making big decisions, based on politicians. today it was the republicans that were absolutely furious at the chief justice john roberts. >> it must have been a fascinating day to be in the courtroom. thank you so much. the local politicians are also weighing in on today's landmark decision in heavily

democratic maryland. they said they chose to protect the laws of millions of americans, including the residence. >> the important message is that it is now time for the democrats and the republicans to move forward with health care. >> people don't consider that fab. that's what the president was saying. i think that he was absolutely correct. people need to take the responsibility so that the rest of us are not paying for them. that's the bottom line that the bill we passed to provide theaffordable quality of the health care to all americans is constitutional. he says that it will create a costly system that will hinder

economic recovery. but the attorney general who was one of the first to challenge the law actually praised a part of today's ruling. i'm peggy fox in richmond, where he was first to file the state health care law. and that it was very pleased. they said that was a penalty for them for not having coverage was really a tax. >> in the future, no congress, no senator, no president will be able to say that for any bill. that they will have the possibility of the act. >> reporter: they are not allowing the federal government, to expand for the coverage. two things happened.

and that will be under the commerce clause. that has never happened since the new deem >> he is running for governor, telling us that they don't think that the affordable care act would happen. >> they have not seen it yet. they will decide the formula for how medical care is rationed. >> reporter: in richmond, peggy fox, 9news now. >> and where does the nation go from here? is the fight really over? i'm joined by kathleen stall, the deputy executive director for family u.s.a. and the national organization. dedicated to providing affordable health care. they both supported the law. and the vice president of legal affairs for the catoe institute. they are opposed to the idea here of universal health care. the bottom line, we'll start with kathleen, is this good or bad for america? what will the impact be on our can economy? >> they really came down on this side of the consumers, not

on the side of the insurance companies. for the first time, the consumers with the pre-existing conditions, they will lose a job, perhaps in this recession and they will be able to have a guarantee of the quality affordable insurance coverage. and they will now give those people and their families, the peace of mind, they will give them a sense of security that they will not be bankrupt, because they cannot afford insurance to pay the health care bills, roger? >> this came down on the side of the consumers here in the immediate context. it's just a matter of time before the crosses here will start coming home. and then those consumers are going to complain. because this is the unaffordable care act for the troops. but that's the thing that will strike me that this decision to make, it is from the absolute chaos matter. the court said, at least john roberts said, that the commerce

clause does not justify the individual mandate. and that is something that a number of us would argue in a hong -- for a long time. then he went on to say that you can do the same thing under the taxing power. not even the governor argued against that. now what you have is a very restrained chief justice who calls for the judicial modesty, essentially making up the law as he goes along, doing it in the medicaid part of the bill as well. >> reporter: moments ago you call the decision appalling, kathleen? >> reporter: well, you know, first of all it will be interesting for you and that is the conservative republican appointee. they found it constitutional. now we can move forward. we can move forward to make sure that in 2014, you know, the middle class working families, they get the robust subsidies to help them purchase the insurance in the private insurance markets. giving them the kind of help that they will need to meet their family needs.

it means that people on medicare may no longer need to get that in the medicare program. >> reporter: now talk about this being for consumers. they found that 55% of the americans opposed the law. i also saw the immediate estimates that the administration believed that 1 million americans would rather pay the penalty than purchase insurance. that means more taxes, robust properties. we're faced in a situation that we are borrowing 40% of the money that we spend. our debt is approaching $16 trillion. it is good to have all these things that she talks about,

on capitol hill today, something that has never happened before. the house voted to hold the country's attorney general in contempt of congress. voting with largely along the party lines. the republicans voted for the contempt citations. the democrats voted against it. it all stems from the dispute over the documents that the house wants to review the documents that eric holder refuses to turn over. and the documents, they all relate to the botched gun tracking operation, along the u.s. mexican border known as fast and furious. the operation ended up putting the guns of the hands to the mexican drug organizations. coming up next, we know some americans, they will feel the effect of today's ruling in some way, but now will it affect your insurance? and the story is right after this.

so what if something happens to your insurance plan? ryan young is the senior director of the federal government affairs for the independent insurance agents. he serves as the spokesperson. thanks for being with us. >> thanks for having me. >> the bottom line, is this going to make my rates go up or down? >> i would say that they would go up without a doubt. it is full of the drivers here.

the things that were all added in, the taxes that will be handed down from the insurance companies to the small businesses. and really, the only piece of the bill that looks at the cost of insurance at all are some transparency issues. that's if the rates will go up over 10% in any given year and these rates, they need to be posted on the website, which is pretty much the extent of how they control the prices. >> now, you know that you're a republican. but this is a major victory for president obama. however, i also read a law that this will be galvanizing the gop base. what's your take on that? >> that will be a huge victory for president obama. it will be a devastating blow for you if it was struck down. on the other hand, it will give the governor something to run on. and this is a huge plank in their reason to run. and if that was taken away, it would have been a wit of a blow to the campaign. and that will be for all

republicans across the country. do you have any kind of estimation as to how much the rates will go up? >> it is hard to tell at this point, i believe that, you the next few years, from excluding anyone to have the insurance coverage and the mandate to keep it from the ground perspective for the guys, the rates will be going up. >> it will be a big challenge for the days to come. just and what they are doing today. and the senior director at the government affairs for the independent insurance agents. and the brokage of america. thank you so much for being here with us. >> yes, thank you. now, turning back to

bethesda, the excitement is getting going to the at&t nationals. so is the heat. topper is out at the congressional, braving it with bad news about the temperatures here for the people coming out to watch the tournament, topper? had >> reporter: yeah, andrea, i mean really, the temperatures today, they were hot, but they were not dangerously hot, probably on saturday and sunday. the temperature at nationals with the dew points and the humidity under control. that will change overnight. let's start with the temperatures. some folks, they are already in the upper 80s. and 90 in manassas, 92 downtown. and only 82 in oakland. it feels like it is 92 downtown. that's the same in the temperature. that's good news. the trouble is that the heat index, they will boost up the temperatures anywhere from 5 to 10 degrees. but here's the deal. the thunderstorms are possible tomorrow. that will be on friday, 101 for the high. some records are going to fall tomorrow.

saturday, we'll drop it down to 99. a couple thunderstorms are possible for you as well. the frontal system, they will kind of play cat and mouse with us all weekend, but they won't be doing too much to relieve the heat. here is the deal. wear the light colored clothing. get out of the sun. and when possible, especially if you feel dizzy. eat the light meals. better eating light meals as opposed to one or two big meals. they are in the bag. that should go away. set back in 1991. the record highs downtown, and 105 at baltimore. now it will be tough for you. we'll see, we'll be flirting with it downtown no doubt. and so tonight, it looks like this. partly cloudy, muggy, the thunderstorm is still possible. lows in the 70s. the winds are southwest at 10 to 15 and tomorrow morning, an isolated thunderstorm for you. mid-90s by noon. that will be comfortable. then by the afternoon, a thunderstorm is possible for you again. and any storm that will develop, it could be hefty, it could be severe. we'll keep you posted. and we miss the code yellows for tomorrow, saturday, and also sunday. the high temperatures are
