relief from the heat. finally a break from oppressive heat as cooler temperatures move from the midwest to the east coast. kofi annan -- great white get away. kayakers on both coasts survive close encounters with great kayakers on both coasts survive close encounters with great white sharks. captioning funded by cbs this is the cbs morning news for monday, july 9, 2012. good morning everybody. good to be with you. i'm terrell brown. finally, the deadly record breaking take your breath away heat wave that scorched much of the country for days is starting to break this morning. the blistering temperatures are blamed for at least 46 deaths across the country.

more normal temperatures are forecast for today from the midwest to the east coast. the cooler air and the storms it triggered began to arrive yesterday. drew levinson has our report. a storm sent trees and power lines smashing into homes and cars in free hold, new jersey. >> the wind went through. it was incredible. looked like a tornado going through. will fernandez and his son ben spent sunday cleaning up their yard where a tree barely missed their house. there's no electricity and with temperatures still hovering around 90 in this neighborhood, fernandez says it's tough staying inside. >> how uncomfortable has it been for you? >> very uncomfortable. no power. so it's been sweating profusely. >> jersey central power and light says more than 85,000 customers lost electricity saturday. crews have been working around the clock to restore the power. storms are ushering in relief in the form of cooler weather. but it was still sizzling in washington, d.c. on sunday where it hit triple digits for the

fourth day in a row. it was 102 in the nation's capitol. a record high for july 8th. >> a lot of people are sick of it and want it over. >> as people continue to try to cool down from the heat wave and clean up from the damaging storms, forecasters are promising lower temperatures ahead. drew levinson, cbs news, free hold, new jersey. president obama is expected to announce today that he'll call for a one-year extension of tax cuts for the middle class. "the new york times" reports the president will ask for tax cuts for people making $250,000. house republicans plan to vote this month to extend permanently all the bush era tax cuts for middle and upper income people. to the supreme court now and president obama's health care law. we're learning more about chief justice john roberts' decision to uphold the affordable care act. conservatives feel betrayed including roberts fellow justices. jan crawford says conservative justices were infuriated that

roberts switched his position late in the game. >> the conservatives refuse to even engage with roberts on joining his opinion to uphold the law and they sat out writing their own opinion. they wrote it really to look like a majority decision, my sources say, because they hoped that roberts would rejoin them to strike down that mandate. >> crawford says there's a tension and bitterness on the court not seen in nearly 70 years. overseas this morning, the taliban claimed responsibility for a roadside bomb that killed six american soldiers yesterday in eastern afghanistan. roadside bombs and insurgent attacks killed a total of 29 people yesterday in afghanistan. so far this year, more than 225 nato service members have been killed in that country. u.n. special envoy kofi annan is in damascus frying to revive the peace plan he say has failed. assad says annan's plan is good and should not be allowed to fail. according to one human rights

group more than 30 people were killed yesterday. susan mcginnis has more this morning. susan, good morning to you. >> terrell, good morning. an estimated 14,000 people are now dead in this conflict that's about 16 months old now. kofi annan heads back to ka mass cuss to try again. kofi annan's convoy pulled into a secured hotel in damascus. he will meet with bashar al assad today to try to revive the failed peace plan he first brokered. >> the government of syria and all parties on the ground must recommit to the 6 point plan in its entirety. >> the annan plan called for a cease-fire and for the government to withdraw its troops from populated areas. but in the three months since the plan was agreed to, the fighting has only worsened. >> a violation of human rights continue to take place. >> assad blames the u.s. >> they give -- they offer the

umbrella to. >> the obama administration is coming under sharp criticism from some on capitol hill who say the u.s. isn't doing enough to remove assad from power. >> my question is to the secretary of state and the president of the united states is how many more have to die & before we take action to help these people? >> secretary of state hillary clinton says assad will be gone soon enough. >> the future to me should be abundantly clear to those who support the assad regime. the days are numbered. >> but assad said he isn't going anywhere. >> >> he says he'll stay in power until the end. now, the west is said to be reluctant to intervene because of how quickly the crisis in

today, inflation fell to the lowest level since 2010. that was cup md with increases in food prices. a disruption could have a negative impact on u.s. and european markets. on friday, chien released the second quarter gdp. that news put a chill on markets. the nikkei dropped 1.5% and the hang seng lost 2%. earnings season begins on wall street this week. we'll get the first report from chase since the multibillion dollar loss. friday's weak jobs report led to a down day for stocks. the dow lost 124 points while the nasdaq fell 38. after falling steadily since april, gas prices ticked up last

week. according to aaa, the average price of a gallon of regular is $3.38. that's about eight cents higher than a week ago. and thousands of computers may not be able to connect to the internet this morning. at midnight, the fbi shut down temporary servers that were set up to keep computers infected with malware online. the fbi estimates more than 40,000 computers in the u.s. will be affected. if you think your computer is one of them, you're asked to call your internet service provider. i sure hope you don't have malware. >> that's the virus you have on the weekend that makes you spend. >> ashley morrison in new york. appreciate it. coming up on the morning news, fins up. a shark sighting off cape cod gives a kayaker a big fright setting off a furious paddle. also a frightening misstep for a tightrope walker in china. this is the morning news. he also made it. on sunday a chinese acrobat was trying to cross a tightrope suspended more than 600 feet in the air. it didn't help that he was blindfolded and walking backwards when he suddenly lost his balance. lucky for him, though, he was near the end and fell into the side of valley. i give him six months. he'll be right back up there. he was not badly hurt. in chicago another death-defying act. it's their job. they were on top of the willis tower. 1700 feet in the air. loosening the bolton an antenna. a helicopter took the monstrosity away. a new digital antenna will be installed in the next few weeks. break out the theme music to jaws. do we have that? no. in massachusetts and california, beaches were closed after great white sharks got a little too close for comfort. as the report says, they're not after humans. they're stalking a much tastier

prey. >> every kayakers' worst fear. you see this man looking over his shoulder in panic. ten feet away the dorsal fin of a great white shark. >> surprised it hasn't happened sooner. we know they're out there. >> the same day in santa cruz, california, a great white took a bite out of this kayak. the man inside thrown into the water but survived. >> sharks in the area at all times. people need to be aware of that and just be careful. >> they're the latest in great white encounters. the hot temperatures bringing them earlier but it's not the people they're after. it's the exploding seal populations that have moved closer to shore. >> sharks are going to go where their food is. >> seals are their food. shark expert ralph collier says seals are protected species so the population has exploded with about a quarter million gray seals on the eastern seaboard alone.

sharks, collier says, are not interested in hunting people. >> white sharks specifically are very curious apex predators. when they bite an individual, it's usually a test and the last thing to find out if this is anything of interest is it will take a little nibble. >> but a great white's nibble can be a deadly chomp for a human which is why this san diego area beach was shut down. >> we were just looking at the shore and you could see the black fin. we saw at least one. >> two. >> it seemed like it was two. it seemed like there was two. either that or they move fast. >> the sight of a dorsal fin this summer shuttering beaches from coast to coast. karen brown, cbs news, new york. >> i would have had a heart attack and died in the ocean. free food. coming up, in sport, tears and the hope of a nation crushed during the men's wimbledon finals. grilled chicken fajitas, h-size with sauteed onions and peppers,

sunny across new york to new england. in sports, roger federer won his seventh wimbledon. andy murray is the first britt to reach the finals. started off hot taking the first set. after a rain delay, federer came back. 6-3, 6-4 for a 17th major. it was clearly a very emotional loss for murray. >> everybody always talks about the pressure of playing at wimbledon, how tough it is. but it's not the people watching. they make it so much easier to play. the support has been incredible. so thank you. [ applause ] >> along with a few tears, federer is now ranked number one for the first time in more than two years. to baseball now. the new york yankees are heading into the allstar break on a hot streak. in the fifth a-rod tripled to center. sweeney goes for the diving catch, misses it and slams into

the wall. he's okay. stays in the game. nova strikes out 10. the yankees beat the red sox to take three of four at fenway. thought he was under attack. >> folks running. players duck for cover after a loud thunder clap during the twins/rangers game in texas. one player tweeted, it was so loud he thought jesus was coming. he must not be living right. after a rain delay, the game went 13 innings, but the rangers beating minnesota 4-3. pittsburgh floods their way to the first place in the national central division. racked up 17 hits against san francisco including three home run. the pirates left the giants 13-2. left the break winning 10 of the last 12 games. heads up. this foul ball is coming right at you. minor leaguer will myers fauld this back in the game in kansas city. as you can see, the ball completely shattered the -- that made me duck in the studio.

here's a look at the forecast in some cities. in d.c., stray thunderstorms, 85. afternoon thunderstorms in atlanta, 92. stray thunderstorms in st. louis, 88. thunderstorms as well in denver, 74. mostly sunny skies in seattle, 80 degrees. relief operations under way in russia after flash floods killed more than 170 people in less than 24 hours from friday into saturday. more than a foot of water came crashing down in southern russia. thousands of homes have been destroyed. residents say a 16-foot wall of

water went through the town. most of the dead were reportedly sleeping when the deluge hit. officially over today after more than two months of rain fell in one day. the devastating floods left hundreds homeless. forecasters say the worst is over but no sunny weather for ten days. one of hollywood's most endearing actors died. ernest borgnine's career spanned 60 years. he won an oscar playing a lovesick butcher and had a recurring role on spongebob squarepan squarepants. he was 95. manuel gallegus looks at his career. >> from baby boomers to his stint in mchale's navy. his career took off when he was cast as another military man, sergeant judson in 1953's from here to eternity. >> anybody steps in here, i give it to them first. >> numerous supporters roles as heavies in a steady string of dramas and werns.

coming into work. >> mr. bernstein, about morning. >> good morning. we need the rain. it's also a sign things have changed. no more hundreds in the forecast. we'll be 15 degrees cooler today and that sounds really, really good. we start you off with a look at -- let me back it up here and show you what's happening. that's our camera lens. a little wet with the raindrops on it. the temperature 79 with the light rain at reagan national. we could have showers and storms even going on for a few more hours. by midday other than a lingering shower, i think we're partly to mostly cloudy and a little son this afternoon that will push -- little sun this afternoon. that will push temperatures into the mid 80s. yesterday was a record setter at 1023. there are the -- 102. there are the showers and thunderstorms. you can see everything as it's moving to the east. maybe drifting slightly south of east. up to the north we've seen the heavier showers and storms, especially coming through montgomery county and howard counties here in the last half- hour or so. that's -- got some other storms coming out of the harrissonburg

area headed toward orange. light to moderate rain in and around d.c. it's up north. this is -- these are the thunderstorms that were leaving clarksburg through damascus headed toward howard county. there's more toward lovettsville and northern loudoun county. could be a little loud at times for a little while. temps this morning 81 still in annapolis but the rest of us thankfully in the 70s. no more super heat. not sorry about that. monika, it is wet this morning. maybe not slowing things down now but i'm shower it will. wet roadways and monday, that combination is never good. no problems as cow in from the west right now. on 66s are the dulles toll road we're looking good as well. i-59 in virginia, we'll go live there right now on the northbound side. here's what it looks like in dumfries. wet road conditions as you head up 395 and the 14th street bridge. you still might want to give yourself a little extra time if you're heading out the door

early this morning. one thing you do want to be aware of, on the eastbound side of route 50 right here as you approach route 197, the road has buckled. you're getting by. only single file to the right as you head eastbound on route a and the northbound route 197 ramp to route 50 eastbound is blocked off as well. so be aware of that. we'll take a live look over at 270 on the southbound side again just wet roads. right now volumes are light at father hurley boulevard. we'll be back in a few minutes with more traffic at 4:39. >> thank you, monika. police in fairfax county are investigating a police involved shooting in mount vernon. authorities say around 11:20 last night, two officers approached two men they say were acting suspiciously near frye road and route one. >> one of the men ran off. the officer pursued the suspect. he allegedly pulled out a gun and fired at itself officers. the officers returned fire and hit the suspect. he was taken to the hospital where he was pronounced dead. police have not released any information about the case.

when we get more information, we'll pass it along. the weekend and the day's top story is the hit weave which has taken over -- hit wave which has taken over much of the east coast has claimed 45 deaths. >> the relief also brought severe storms over the weekend. one system yesterday knocked down trees and power lines along the east coast. 85,000 customers in new jersey are now in the dark because of this. many of our neighbors who were already recovering from a life without power are once again living without electricity. the hardest hit region? northern virginia. at the height of sunday's storms, 30,000 dominion power customers in northern virginia were without power. at last check dominion power has less than 5,000 customers in our region without power. pepco has about 1700 outages. most of those are in prince george's county. storms in spotsylvania county destroyed two buildings and injured several people. this is along route 1. one
