new at 11:00, in our restaurant report, tense moments when our cameras find critical health violations. plus, a surprise vice presidential candidate. the antisarah palin. but first, only on 9. exclusive new information on mayor vincent gray. who paid for his luxury suv? >> this is 9news now. >> and we begin tonight with that new information in the federal probe of d.c. mayor,

vincent gray's campaign. sources confirmed that mayor gray and recent convicted felon, jean clark, met as early as january of this year to discuss that shadow campaign that spent hundreds of thousands to help gray get elected. those same sources tell bruce johnson that he balked to hide those contributions. what happened at that meeting? >> these are people coming from the mayor's side. mayor gray said his attorneys won't let him talk about the case. but government sources tell us that mayor gray did meet with harris this year. the mayor's account goes this way. she has invoices from what is clearly a shadow campaign. an off the books illegal campaign, dollar spent, lots of salaries, yard signs, t-shirts, vehicle rentals, you name it. harris wants the may your to get the invoices on to the books of the officials, vincent

gray for mayor campaign. in other words, to cover up the campaign, illegal activity. gray told associates he was surprised and it's the very first time he had gotten wind of the shadow campaign. the amount of those invoices nearly $600,000, according to sources. harris left the mayor's office and gray is telling sources he notified his attorney about the meeting with harris. mayor gray is instructed to get harris to return with the invoices so that the mayor can turn them over to bennett. the fbi retrieved those invoices later. only after and that's this year, only after they rated jeanny's home and the offices of jeffrey thompson. her boss who funded that shadow campaign. anita. >> it sounds like in such large amounts that the campaign had to chris cross with the vehicles in all of that. >> in one case, we found out today that the mayor's driver and suv that was transporting the mayor around was paid for

not from official campaign dollars, but from invoices and checks from jeff thompson. >> when are we going to know who knew with what and at what point? >> absolutely. the fbi is the only one that can sort this out. the mayor says he didn't do anything wrong. others aren't so sure. the mayor isn't going to resign because three council members are asking him to. the mayor will step down if and when the u.s. attorney calls the man and tells him he is about to be indicted and they present a case. we're not at this point. >> and your sources say he's not going to change his mind. >> the name we have been hesitant. our sources confirmed the fbi and federal prosecutors want to talk to vernon hawkins. he is the guy who allegedly was the field general for that shadow campaign. they haven't been able to talk to him. they have been talking to his attorney and the two are trying to work out when they meet with the feds. >> the scope and complexity of this is immense.

bruce johnson, thanks for coming in. now bruce, the mayor made that clear when he talked to gary earlier this evening. he has said he will not resign. gary is here with more on that. >> anita, we wanted to ask to respond to that call that he quit. >> reserve, protect, and defend. >> gray presided at the swearing in of a new ethics board whose members understand. >> we are at a time where district residents have reason to be skeptical about the district's government's ability to enforce its own ethics rules. >> to begin. >> focus first on the highest levels of government because if there is a solid head, then the rest will fall into line. >> it's the head of d.c.'s government, mayor gray, who was at the center of a legal and ethical storm because of an illegal under the table 2010 mayoral campaign. three members of the city council are calling on him to

resign. >> i'm not going to be resigning. i think that there are nine members who didn't. they have indicated they wouldn't be doing that. i'm not resigning. >> how could $650,000 be spent on your behalf without you knowing? >> i have indicated many times that there's an on going pending investigation and we would like to have the investigation, you know, be completed and then, you know, all the facts will come out then. >> can you tell us if miss harris talked to you earlier this year that you were made aware in a january meeting with miss harris? did she tell you? >> i'm going to repeat. >> that hand on his back belongs to city attorney general, irve nathan, sending a message of support. phil mendelson embraced the mayor during the ceremony. an indication of the personal affection which the mayor inspires in colleagues. councilman, jim graham says -- >> i think there's an urgent

need for him to make a full statement. but i think the city is really crying out for that kind of clearing of the air. it should be a press conference. should speak to the residents of the district of columbia. >> mendelson is not asking for gray to resign. >> it is premature at this point. the one piece i would add right now, you think of the metaphor. >> an easy thing to do in calm waters. harder to do in choppy waters. harder in a tsunami caused by an earthquake of the revelations tuesday of a secret illegal campaign that violated numerous federal and d.c. laws. anita. >> gary, thank you. we move on to breaking news out of new york. right now, a bomb squad is checking out a suspicious device found aboard a plane that was set to fly from kennedy airport to madrid, spain. delta flight 126. passengers have been taken off that plane. we're going to get more information and as soon as we

get it on these new developments, we will pass it along to you. >> a d.c. police officer has been assigned to quote, other duties after making a threat against first lady, michelle obama. according to the washington post, the officer worked as a motorcycle escort for white house officials. the cop in question was overheard making the threat against mrs. obama and even showed a picture on his phone of the firearm he intended to use. however, the report in the post shows mrs. obama was never in any real danger. in campaign 2012 news tonight, is mitt romney getting ready to shock the nation with his pick for vp? the report claims that former secretary of state, condoleezza rice is at the top of a short list of contenders. in a recent e-mail, rice calls the upcoming election the most important in her lifetime. an announcement will be made in the coming weeks. we reached out to miss rice via phone and have not heard back with a comment. another gorgeous day out

cloudy, 74 to 82. we have some showers on radar. we'll tell you where they are headed and look ahead to our weekend forecast coming up. new at 11:00, two men, one spare tire, and no making sense of what happened. prince georges county police tell us two acquaintances got into an argument over the spare tire. one pulled out a gun and shot the other dead. it happened late today at a home along cross road trail in brandy wine, maryland. police have taken the alleged shooter into custody. now to capital heights. a nail salon that allegedly did a lot of business that had nothing to do with manicures. police ran a sting operation at star nails. they arrested five nail technicians, all charged with theft. police say the women were buying stolen goods and selling them overseas. things like shampoo and tide detergent. loved ones of a local marine killed in action are left with heavy hearts tonight. 23-year-old lance corporal, neil cody sears grew up in the

district and layed to rest earlier today at arlington national cemetery. ken molestina spoke to some of his loved ones tonight and is live with their story. ken. >> reporter: yeah, his family and friends say the 23-year-old was full of zest and patriotism for his country. he joined the marines because in his heart, he felt it was the right thing to do. >> he sacrificed his life for us to be doing what we do every day. >> his stepsister along with friends and family gathered for an informal ceremony. they came to remember 23-year- old marine lance corporal, nile cody sears, their friend and their hero. >> an amazing person inside and out. beautiful soul, so much energy. and the kindness person anyone could have ever known. >> earlier in the day, the mood was a lot more somber.

[ trumpet sounding ] >> the 23-year-old was layed to rest in arlington national cemetery. he died last month after stepping on an explosive during a dangerous operation in afghanistan. hundreds of those who knew him came to say their good-byes and pay tribute to a young life cut short by war. >> the power of seeing so many people behind us while we were walking behind the casket drew me out and realize just how much he touched me as an individual. >> deep roots in the area, living at the district and arlington. he went to wilson high school and took piano lessons since he was six years old. >> we all love him so much and we're going to miss him dearly. and he will never be forgotten. >> lance corporal, cody sears family says he was supposed to return from war last october. he received the news during his birthday weekend when many of his friends and family gathered to celebrate the occasion at the home where he lived. anita. >> look at all those people. thank you so much x ken. we know about the crime.

now we know about the alleged coverup. details coming from an independent investigation into the child sex abuse scandal at penn state university. it falls the late football coach, joe paterno and top administrators for doing nothing for more than a decade, to stop jerry sandusky from victimizing more young boys. recently found guilty of his crimes. former fbi director led that independent review. >> our most saddening and sobering finding is the total disregard for the safety and welfare of sandusky's child victims. >> free also said he discovered evidence that penn state's president, athletic director, and paterno back in 1998. sandusky was under investigation for sexual misconduct. the late coach also did nothing in 2001 when former coach, mike mcquery reported seeing sandusky abusing a boy in a campus shower.

in washington, on southern avenue southeast, inspectors sited china southern, sited chicken wings were held at unsafe temperatures. >> soda. >> did you sell any food during that time? >> no. >> so all this food that was at the improper temperature, you planned to throw it away? >> throw it away. >> inspectors sited the restaurant for ten violations total, including mice. on the waterfront, inspectors sited jenny's for 22 food violations reporting no employees seen washing hands between tasks and mice droppings. >> very serious. >> terrible. >> right. very serious. >> okay. >> we won't be eating here. >> were you about to go in. >> yeah, we were about to go in. >> district only made for two of the five area restaurants. reports show shutdown for vermin. tyson's buffet on randolph

road. and best way snacks in landover. in arlington on columbia pike, inspectors reported suspending this wendy's for a sewage backup. >> the manager disputes the report saying she recognized the sewage was out of control and closed the restaurant voluntarily. in georgetown, inspectors suspended cafe romeos siting a gross unsanitary violation that could endanger public health. operating without electricity closed house of chang. east on indian head highway. panda cafe. the grocery on annapolis road in new carollton. super chicken market and all in wheaten. in the district, inspectors sited the west wing cafe on the new jersey avenue northwest were 16 violations, including selling food out of a freezer
