year away. we have the latest developments from aurora, colorado. >> reporter: law enforcement officials have been seen entering the theater where a dozen people were killed and 58 others injured during a midnight showing of the new batman movie. investigators and lawyers for the defense may be allowed inside today. james holmes' dense attorney asked the judge for ak to the theater as -- access to the theater as well as his apartment. the public defender is now expected to request a mental health examination for holmes before he's formally charged. a makeshift memorial outside the theater finishes to grow. people have been leaving flowers and notes for the victim. >> i can't help but cry. >> reporter: plans for the first funeral from this tragedy are already under way but stories of those who survived are helping this community heal. katie escaped the rampage without injuries and is now in the maternity ward giving birth to her first child. her husband who was shot in the eye is being treated in the same hospital. >> he's making some

improvements, some small steps. but he is -- he's not anywhere near out of the woods. >> reporter: christina was shot in the knee during the attack. her good friend was killed. several members of the denver broncos visited her in the hospital. >> any moment people take out of their day to spend with me means something. >> reporter: 15 victims are still hospitalized, five of them in critical condition. teresa garcia, cbs news, aurora, colorado. >> colorado gun stores report a big jump in demand for firearms since last friday's massacre. in light of the movie massacre, new york city mayor is once again calling for gun control measures, specifically michael bloomberg is taking issue with armor piercing bullets, bullets he says are designed for one thing only: killing police officers. >> police officers want to go home to their families. and we're doing everything we can to make their job more

difficult but more importantly more dangerous by leaving guns in the hands of people who shouldn't have them and letting people who have those guns buy things like armor, piercing -- armor piercing bullets. the only reason of an armor piercing bullet is to go through a bullet resistant vests. the only people who wear resistant vepses are our -- vests are our police officers. >> maryland lieutenant governor anthony brown will join us later live in the newscast to talk more about gun control issues. we are under a code yellow alert. that means we could be in for some tough weather later today. howard bernstein, he has the details. howard, what should we expect? >> we could be seeing some strong thunderstorms in spots. other areas are seeing showers. it looks like the worst of it will stay well west of us. you may be reading stuff online

and people saying another derecho. if there is one, it will be well west of us. i'm watching this area in kentucky. it may get into parts of virginia and southwest virginia but i think this would be the most damaging stuff. locally we're watching a severe thunderstorm. they've put a tornado warning out on it. this is in mineral -- when i say they, the national weather service. watching the storm which is now coming through kaiser headed toward romney. this is doppler indicated. storms got some rotation but i want you to take this seriously. again till 12:30 for grant and mineral counties here. this is route 50. we've got route 220 coming into 50. this is coming out of garrett county in that direction moving southeast at 25 to 30 miles per hour. tornado warning till 12:30 and locally on live doppler 9000 hd, some light to maybe a moderate shower coming through the metro right now. temperatures have climbed into the upper 80s, even 90s south. so the energy is there for us to see strong thunderstorms.

south of town fredricksburg is now 95. but with the showers gaithersburg is 82 degrees. winchester is 86. we're going to get back into some sunshine. we'll be somewhere anywhere from the mid-80s north to the mid-90s south. we'll have to watch this for the rest of the afternoon because some storms will be pushing through and damaging wind gusts are going to be the primary threat from these storms for the afternoon. but there's a payoff here. once the storms of the front pass, you'll like tonight and tomorrow. i'll be back in a few minutes with the full forecast. >> thanks, howard. a woman in her 30s is being treated for injuries after her suv hit a freight train near edmondson, maryland. this collision happened in an industrial area around 10:00 a.m. at 4505 deindicate our -- decatur street. the train originated in florida and was on its way to new jersey. it's still on the scene while police investigate this accident. home prices may finally be bouncing back. an industry report says home values rose two-tenths of a percent from 2011 during the

second quarter. it's the first annual increase since 2007. nationwide the median price of a house now stands at $149,300. despite the gain, overall home prices still down almost 24% since april of 2007. philadelphia monsignor william lynn could be sentenced up to seven years in prison today. a jury found him guilty of child endangerment. it's the first time prosecutors didn't just charge the abusive priest but also church leaders for failing to stop them. his defense team arked he repeatedly told higher ups about the abuse allegations but was under strict orders from the city's cardinal and had no authority to remove priests from the ministry. joe paterno's legacy in shreds. penn state's football program crippled after the ncaa dealt the university a harsh set of saptions. the sanctions include -- sanctions. the sanctions include a $60 million, a four-year ban on

post-season bowls and the loss of up to 80 scholarships between now and 2015. on cbs this morning, ncaa president mark emmert discussed the severity of this move. >>it's about an institution that had a severe systemic loss of integrity. it failed to maintain control over its athletic programs. there were multiple violations of any sense of ethical conduct. those are the things that surround and build up the culture inside an athletic department. we simply can't abide that. >> the ncaa is permitting penn state athletes to transfer out of the football program without penalties. investigators are now trying to determine what caused a house explosion that killed a 12-year-old girl and injured four people in western new york. it happened early this morning in the town of wilson outside of buffalo. police say four survivors were found outside of the home. they were rushed to area hospitals. the 12-year-old girl was found buried beneath rubble in the

two-story house. the d.c. police department's gay and lesbian unit -- or lesbian liaison unit will be investigating the beatings of two men. they were attacked sunday night in northeast. police say three suspects began yelling homophobic slurs at the two then and then assaulted them. one man was taken to the hospital for his injuries. a court marshal trial stemming from the suicide death of a u.s. soldier in afghanistan gets under way today. eight soldiers are accused of hazing danny chen before he took his life. a military report found he endured weeks of emotional and physical abuse. a sergeant from ohio -- [ inaudible ] some wowngdzed warriors are on -- wounded warriors are on the last leg of a journey of a lifetime. they left monday on the final stretch of a bicycle trip across america.

welcome back. new york city health officials are holding hearings today on mayor michael bloomberg's controversial ban to ban sales of large sugary drinks. he wants to prevent sales of soft drinks over 16 ounces in size. supporters say the move will help reduce obesity. that's a problem they say costs the city billions of dollars a year in health care costs. critics say the measure is misguided and an unfair limit on consumers' choices. the new york city board of health will take a final vote on the plan in september. turning to campaign 2012 now. following the colorado movie massacre, the tone on the campaign trail is shifting. mitt romney is challenging president obama's foreign

talk about this issue that so many people are debating yet again in maryland. -- in america. maryland's gun control regulations, the law of the land has been essentially if you want to buy a gun, you need to justify what you're going to do with that. but that's being challenged. bring us up to speed on where that lies. >> i want to express my condolences to the victims and families of the massacre in colorado. my heart goes out to them. this of course is an opportunity i think that every state and the federal government ought to take to look, relook at gun laws to make sure they're adequate in filtering out knows individuals who simply -- those individuals who simply should not be in possession of firearms. while it's probably impossible to prevent everyone who might do harm with a firearm against another individual from possessing it, we certainly ought to take this opportunity to make sure we're doing everything we can. in maryland our law requires that someone who wants a gun

show good and substantial cause for owning that gun. that provision is actually being challenged in the courts. and a court ruled against maryland saying that it's too restrictive. we think it's a good standard in maryland. it gives us an opportunity to do criminal background checks which are required in maryland, gives us an opportunity to do mental health evaluations. it also gives us the opportunity in maryland to require training for everyone who seeks to own a gun. so those are some of the things we're doing in maryland. it is under challenge but we're going to defend that law and it's our goal to keep that standard in maryland. >> when you look at the spectrum of gun control regulations across america, maryland is on the more restrictive side of the major states that are advocates for gun control regulations. you hear people after these events like virginia tech shooting, like the sniper shooting and they say, yes, we knew this person in our life was on the edge, we knew this

person was in danger of picking up a weapon. what more can be done from a lawmaker's standpoint in terms of helping people to come forward when people in their lives are starting to fray? what more can be done to flag these people who might be at jeopardy or putting others in jeopardy? >> it's probably less from a standpoint of what a lawmaker can do but what we as a community, as neighbors, as family members can do. and when those who are our loved ones, our friends, our colleagues at work are displaying or exhibiting what we consider the unusual behavior, we ought to raise that issue, raise it with the supervisor, raise it with -- if you're in a school setting, raise it with an administrator at the school or even a professor. but what ought to be done is not to be silent on that and just hope that there's not a problem with someone but to raise that up asen issue so that -- as an issue so that help can be given and provided and at least we can reach out to those individuals to see what may be going on in their

garrett county coming into west virginia. lots of activity to the west. we'll have to watch that as well. but this is of a immediate concern, a doppler indicated tornado. the storm is showing rotation, likely has hail with it as well as it moves southeast out of garrett county. the tornado warning is for eastern -- excuse me, southwestern mineral and northeastern grant until 12:30. you can see this is moving southeast. want to switch over to live doppler 9000 hd because this storm, especially south of kaiser, we're seeing some -- keyser, we're seeing this purple color, that's most likely hail. this thing is going to track toward romney and purgitsville. you want to take cover and get into the lower levels. we have new severe thunderstorm warnings being issued as the storm moves east. i'll try to get you an expiration time by the end of the broadcast. but treat this storm seriously. there could be winds even if there's no tornado gusting 50, 60 miles per hour or more and a

little hail. as we look at the day planner for the afternoon, temperatures at least in town are in the upper 80s now. we have a few showers and clouds. we'll break out into some sunshine but still a threat for some thunderstorms here and there for the afternoon. 93 at 3:00. 91 at 5:00. there's plenty of heat and humidity around. winds shifting to the northeast with a cold front coming through that's also helping to fire off these storms. we'll have even a couple of storms still through 7:00. by 9:00 i think most of this has moved well south and east of us. we'll be in the middle 80s and drier air will be moving in for tonight and tomorrow. right now you can see we got up to 91 here as of noon. 94 at pax river. they were 95 but where it's been raining like in oakland 64. petersburg 87. so plenty of heat and humidity there. 81 leesburg and gairtersburg. s with -- gieters -- gaithersburg. you see the clouds that have moved in toward d.c. light sprinkles, 91. but it's a sticky 91 with humidity at 53%. big picture, got a ridge in the middle of the country. tremendous dome of heat and high pressure.

tennis fans will soon be headed in droves to the fitzgerald tennis center at 16th and kennedy. that's because the city open starts saturday. the tournament's chair and co- founder donald dell is here with a preview. thanks so much for coming in. this is a great tournament. a lot of people know it as the legg mason but this year it has a different name. >> thety is the new sponsor. legg mason was a wonderful sponsor for 18 years. we're story to lose it but their contract ended last year and they wanted to give it a rest. we started february 15, the city decided to come in. one of the prerequisites which is exciting, they wanted a women's event as well as the men's. for the first time ever since 1969 we have a women's wta

tournament which is on the world calendar for the women. and of course the men's tournament. they will be played this sunday to sunday, eight days, and we'll have a lot of matches out there. >> what are some of the key events that people are going to be looking forward to? who are some of the names we could look forward to? >> first of all, we've done three things that are very dramatic. we built a new stadium court so we have three stadium courts. we put in new lighting and put in five new practice courts. so when people come out, they'll see a different facility. as far as the top names, we're going against the olympics so that's going to be a tough situation for us. marty fish will be here as our number one seed. sam query, another good american, tommy haas who won the turnment. james blake won the tournament a few years ago. they'll all be back. on the women's side we'll have a slone stevens who is annual attractive 19-year-old -- an attractive 19-year-old african- american. she can beat everybody. our cutoff was 84 which means the entry would be very strong.
