. the colorado shootings have many of you debating gun control. >> so 9 wants to know why is a local judge making it easier to carry handguns and why now. plus we have new information on this puppy found in a trash bag after being thrown from a car. but first breaking news. we are talking to folks

displaced by a raging fire. this is 9news now. tonight almost six dozen people have to look for another place to sleep. a fire has forced them out of their homes. >> it started around 7:45 in a three story apartment in the block of rochelle avenue. ken molestina is there. he talked to people who were able to escape just in the nick of time. >> reporter: anita, they were flightened after what they saw -- frightened after what they saw here. we're talking about an entire building that burnt. fire crews still on the scene here. we understand firefighters hitting some of the hot spots. miraculously, no one was hurt but a dog that had nowhere to run did burn to death according to witnesses. >> couldn't nobody do nothing for that dog. oh, my god, that dog was screaming and hollering. >> reporter: a dog is, in fact, unaccounted for. the massive blaze burnt through a total of 22 apartments. it was a police officer on

patrol who noticed the fire and called for help. by the time firefighters got here, all four floors of the building were bursting with smoke. >> the flames were just like that. it happened all of a sudden. >> reporter: many residents were inside their apartment building when the commotion broke out. there were people yelling telling them to get out of their apartments fast. she was able to get her cats. >> i was not going to leave her pets and let them get burned. >> reporter: you can still see the heavy haze from the fire. firefighters from all over the country were called out to try and battle this blaze. many of the firefighters were also treated for fatigue and minor smoke inhalation. investigators say the fire originated on a first floor apartment. the smoke and the flames then rose up through the floors above and left the building in jrue ins. >> this fire was -- ruins. >> this fire was well advanced. >> reporter: the red cross is out here tonight assisting these

families who have now been displaced. the actual cause of the fire we're being told is still under investigation. guys. >> well, ken, we just heard that the fire got a jump start. it was ahead of the firefighters when they got there. had consumed four entire floors. what went wrong? >> reporter: well, here is what they believe happened. it started in a first floor unit and smoke, flames and heat, as we know, rises. so they believe the fire went, consumed the second floor, then it took the third floor, and then it rose up to the fourth floor. and it was at that point that the fire was actually visible. so they believe that while the fire burnt through the first floor, second floor and third floor, nobody had seen it until it made it to the very top. that's when the police officer noticed the fire and called for help. they think that's what happened here. exactly what caused it, we are yet to find that out. >> and the call came in very late in the game. all right. thank you. well, maryland tonight is looking at big changes in the way citizens get handguns.

a judge ruled it's unconstitutional demand that the citizens show good and substantial reason before they can get a permit. gary nurenberg is here with that story. gary. >> reporter: well, derek, what it means is the state doesn't get to decide whether the reason you want a handgun is good enough. it means you will no longer have to provide a reason to get your permit. those who favor gun controls are appalled. >> well, is it's an outrageous and reckless ruling. >> today's decision bring more in line with the vast majority of other states in the union. >> reporter: he's glad that good and substantial requirement is going away. >> that does not mean it will be a free-for-all in maryland because we are keeping the vast majority of important standards that the entire rest of the country recognizes. things like background checks. things like ids. things like fingerprints. none of those things are disturbed by the ruling. >> reporter: yes, but. >> as we saw in colorado,

someone might be able to pass a quick check but be extremely disturbed. and the idea that police see someone like him walk into the station are concerned about the danger he poses and yet have no choice but to issue him a license. that's dangerous. that's not what the second amendment means. >> reporter: but what's the danger in requiring a good and substantial reason. >> the danger is to not just second amendment but to the entire constitution. imagine, for instance, gary, if before airing this segment you had to seek the government's permission to exercise your first amendment right. if you had to show a good and substantial reason and you do not want to live in a country where we have to show the government a good and substantial reason to exercise our rights. >> reporter: a federal appeals court could change things in the next two weeks. but if it doesn't, marylanders will no longer have to provide a good and substantial reason to get a permit to carry hidden, loaded guns. anita. >> well, gary, the investigation into the deadly theater shooting in colorado centered on the

scene of the crime today. investigators returning to the theater to help build their case. federal agents were seen processing and loading up evidence from inside the theater where the shooting happened. investigators and lawyers for the defense are requesting to be let in as well. they also want access to the suspected gunman's james holmes apartment. as for the victims, 15 still in the hospital. five in critical condition. and the first funeral for those who died will begin later this week. we're also hearing even more amazing stories of survival and heroics inside the theater. including that of michael white. going to midnight movies was a tradition for michael and his dad and this time they took his girlfriend. they both were hit and that's when the father jumped into action to shield her. >> i held her. >> so you're literally holding her intestines in? >> yes. i could not let him get both of

us. so i said if he's going to shoot me, let him get me instead of her. >> she is still in the icu in the hospital in critical condition. a bullet went into michael's back and shattered his shoulder blade, but he is now out of the hospital. among all of this is born a little boy. hugo jackson medley delivered today. his mother was not hurt. the newborn child's father was shot and cit wally wounded. -- critically wounded. tonight baby and mom are in the same hospital as the father. the fact that holmes purchased all of his weapons legally is leading to a new argument over gun control on capitol hill, and it got started today with a moment of silence on the house floor honoring the victims of the shooting. and then a new push by democrats

by what they call common sense law. this time banning the high capacity gun magazines, but they argue stricter laws will not prevent these tragedies. >> nobody is proposing taking people's guns away. we're talking about magazine clips, limitations, that kind of thing. >> somebody who is that unbalanced will find some way to do harm. and we have many areas of the country that have very strict gun control laws, and it seems not to have any impact. >> top democratic leaders say they know gun control is a non-starter. they don't have the votes or they don't suspect the political will for change. matt jablow tells us tonight a 9-month-old puppy is now on amends after being terribly abused by his owner. >> thank you. >> reporter: you would never know from his sweet face. >> he is very, very sweet.

>> reporter: and apparently gentle disposition that this puppy was the victim of an abusive owner. >> he was found on the roadside. >> reporter: but he was according to the vet who is now nursing him back to help at his clinic. it all began a few days ago in prince george's county. >> his initial owner was driving down the road, through him out inside a garbage bag on top of the road. this good samaritan was coming by, saw hershey trying to get out of the bag with a leg sticking out of it. >> reporter: the doctor said the puppy issued only a few injuries and he came to gaithersburg in montgomery county because prince george's county animal control does not take pit bull. >> pit bulls, overall, i don't think should be called dangerous dogs. >> reporter: the next step is finding a permanent home for hershey which should not be hard. pit bull mixes like hershey would likely have an extremely difficult time getting adopted if a ruling by maryland's highest court that pit bulls are

inherently dangerous dogs is not overturned on appeal. >> it could affect caring for them. it could affect ownership. it's going to affect a lot of things going across the board for not just the pits but a lot of dogs that are similar to pits. >> reporter: if you have any information about the person who tossed hershey out of the car last week, you're asked to call the prince george's county animal management division at 301-780-7241. the humane society is now offering a $2,500 reward for information leading to an arrest and conviction in the case. anita. >> let's hope that comes about too. thank you, matt. a relative finds two people dead in an apartment bedroom. tonight police say it looks like a murder-suicide. the scene, the park shirlington apartment building. the young man and woman were in a relationship. this is the first homicide there

in more than two years. he allowed monsters to destroy the souls of children. that statement today from a judge who handed down a sentence to the first u.s. church official ever convicted of covering up sex abuse crimes by catholic priests. he is monday senior william james and the judge gave him 3-6 years behind bars. >> he locked in a vault the name of men who had abused children. he now will be locked away. >> from 1992 to 2004, he handled priest assignments and child sex assault complains at the archdiocese of philadelphia. he was convicted last week for covering up priests he supervised. new developments today at penn state. first, they took down the statue of joe paterno. now they demolished the statue where it once stood.

they removed the entire area. katherine harris was a little shocked by it all. >> i think it's been all done really quite fast. it's probably helping some people and not helping others. >> some penn staters say joe paterno was with the school for decades and his legacy will live on whether or not there is a piece of bronze there representing him. we're now learning more about the financial repercussions from the jerry sandusky sex abuse scandal. insurance company state farm is pulling all of the sponsorship of the football program. that includes ads at beaver stadium and during game broadcast. general motors may follow suit. it says it's now reconsidering the deal with the school, and that's not all. moody investor service says it may cut sponsorship. we have cooler air coming this way. a break from the humidity. so tomorrow after waking up, lots of sunshine. we're going to feel the

. he played one of tv's most memorable characters. george jefferson. and tonight hollywood is mourning his death. he passed away today. >> he portrayed george jefferson in all in the family and then later on in a spinoff the jeffersons. edward lawrence takes a look back at his life and his career ♪ we're moving on up >> reporter: the man made most famous for moving on up to a

deluxe apartment. they found him passed away in his house. the actor first rose to fame in 1971 playing george jefferson in all of the family. two years later he starred in a spinoff called the jeffersons. >> i'll just have to go over the boss's head. [ laughing ] >> it will be a short trip. a [ laughing ] . >> reporter: mr. jefferson would then be quick with a return dig. he played on broadway. he sang. danced. even released a single in 1989 called ain't that a kick in the head. in retirement, he still made appearances on television and walked the red carpet for big cbs events. >> i went to the movies before i got into the business. >> reporter: born in philadelphia, he had no children or wife. edward lawrence for cbs news. >> hensley earned emmies for his portrayal of george jefferson. the aids conference is here in dc and there were 13 arrests

today. the activists said they wanted to send a message to the white house and the world. the aids pandemic can be brought to an end. time to keep fighting. the human rights of people living with hiv and aids must be protected. the protest was sponsored by the group we can stop aids. police arrested the activists for demonstrating without a permit. the man believed to be the first ever man cured of the aids virus came to the conference today to announce skepticism about the cure. tame thee ray brown was known as -- timothy ray brown was known as the berlin patient. he was treated for leukemia in 2006, almost died until he got a unique stem cell treatment. it came from a donor whose blood cells had a mutation that made them immune to hiv. he has been off antiretroviral drugs ever sense, and the disease has not made a resurgence. >> my history is proof in

concept that hiv can be cured. >> brown has allowed researchers around the world access to tissue samples and some scientists presented new evidence that there is still traces of hiv in his body. brown insists those cells are dead and not replicating and that he know longer has the disease. a fishing boat called the queen bee has crossed the ocean and had one heck of an adventure. too bad there was nobody on board. scott douglas and his brother went fishing off the coast of nantucket. a big storm came up, and they were tossed overboard. they managed to swim back to shore and they thought they would never see the queen bee ever again, but somehow she found her way back to the coast of spain. the boat merely drifted up towards canada and swept across the atlantic to spain. the company that made the boat is very proud of what they've done. >> we always knew we built a good boat. but to go through what this boat

has gone through in the atlantic for three and a half years is just unbelievable. >> there are barnacles and things. . >> the queen bee is out in baltimore. she'll be appearing in boat shows all across the boat shows. >> 3,000 miles. wow. >> with no crew. >> some power there. >> flying dutch men. >> it does remind you of that. how about the storms tonight. >> we saw a couple in montgomery county and frederick, but they weakened the pretty quickly. so most of us dodging the big storms for tonight. that's good news. because we don't want to deal with anymore power outages, do we? all right. now, what we have next coming this way is the dryer air. right now you can see on the radar things are pretty quiet really, except we know way out in west virginia where we do have a couple showers. they've been actually weakening. but otherwise we're looking at skies clearing out. 82 degrees. still mostly cloudy in downtown. winds are northwest at 10 miles per hour. and dew points are in the 60s.

right now we are in the 70s in gaithersburg. 79 in manassas. 73 in winchester. fredericksburg in the mid 70s. dew points, it's still muggy out there. i was just out on the weather terrace. you can still feel upper 60s and 70s. but you look up north, lower 60s in haeger town. so the -- hagerstown. so the dryer air is making its way south overnight and through tomorrow and we'll see dew points drop in the 50s and you will notice a difference tomorrow. our satellite radar picture showing us we're going to see skies clearing out making its way for sunshine tomorrow. get ready for the dryer air to move in overnight. less humid for your wednesday. it's going to be really nice. but it won't last long. very hot and muggy, once again, for thursday. and we're hot again for friday. so you have to enjoy tomorrow if you can. here is a look at your overnight forecast as you're sleeping. clearing skies. only a slight chance for a shower or thunderstorm. lows will be 64-72 degrees.
