intent to kill while armed. shooting victim leonardo johnson is recovering in the hospital. perkins says he is hailed across the world as a hero for wrestling the gun away from corkins. >> still kind of groggy and he said this hero business is hard work. >> reporter: corkins so far faces neither hate crimes charges nor terrorism charges, but if he is convicted, he could spend nearly a half century in prison, but first psychiatrists are going to have to certify that he is mentally competent to stand trial. >> bruce leshan reporting from northwest, thanks. >> let's go to more on that employee today described as a building operations manager who is being hailed as a hero after the shooting at the family research council. scott broom has spent time with leonardo johnson phelps today. he's live in southeast d.c. from -- johnson's family today. he's live in southeast d.c. from their home with that part of the story. >> reporter: his mother and

grandmother say they are extremely proud of him and if they needed any confirmation that everybody else thinks he's a hero, police chief cathy lanier dropped by today to let them know what she thinks. chief cathy lanier visiting with virginia johnson, the mother of 46-year-old building operations manager leonardo johnson to, talk about how he's doing. >> i think what he did yesterday probably saved a lot of lives. >> he just told me ma, i've been shot. don't worry about me. i'm okay. >> reporter: johnson's mother says she's recovering from the shock that her son took on a gunman at the family research council and survived a wound to his arm and she is thankful for his actions. >> i know he saved a whole lot of lives yesterday and i'm very proud of him. i couldn't be no prouder than i am. i thank god for everything. i thank god for him, too because so many people could have been gone away from here today. >> reporter: johnson's 102- year-old grandmother also calls him a hero. johnson is 46 and worked at the

family research council 11 years. his mother said he told her his attention was drawn to the accused gunman who emed to be lingering uncomfortably in the lobby. >> he said he was walking around to see what he's doing. he was just looking all around at different things and he asked him a couple questions and it got into an altercation or something. then he pulled a gun out on him and then they got to tussling and that was. it. >> reporter: the fbi's washington field office agent in charge also visited with the family. >> interviews have been conducted for the most part. we conducted two searches -- three searches actually overnight. we had one in virginia, a car that he drove left at a metro station in virginia as well as the crime scene itself. >> if he hadn't been there, a whole lot of people would have got killed. >> reporter: according to his family, johnson is doing well after surgery to his arm last night. police chief cathy lanier also visited with him in the hospital. she said he's got a sense of humor and he is not quite

the investigation at our website www.wusa9.com. we have an update to a story from may, a maryland man accused of both murder and cannibalism has been ruled incompetent to stand trial. alexander kanua admitted to killing a man and eating his heart and parts of his brain. doctors at clifford t. perkins hospital will continue to assess his mental status while they treat him. in june kanua was indicted for first degree murder and a weapons charge. two sheriff's deputies killed, two others injured in an early morning shootout near new orleans. tonight five suspects are behind bars. an off-duty deputy was working traffic detail when he was approached and shot several times, the officer rushed to the hospital and is expected to be okay. deputies tracked the suspect to a trailer park. they were interviewing two people when they were caught off guard. >> as we were interviewing the two subjects, another person exited that trailer with an

assault weapon and ambushed my two officers. >> the sheriff says five people in all ended up under arrest including two who were wounded in that shootout. both injured officers underwent surgery today. the two former penn state officials accused of covering up the school sex abuse scandal are now trying to have the charges against their clients dropped. tim curly and gary schultz are accused of lying to a grand jury which was investigating the claims against former coach jerry sandusky. manuel gallegos has the details of the court hearing from harrisburg, pennsylvania. >> reporter: the two former penn state officials are charged with not reporting suspected child abuse as required by law and also about lying to a grand jury about what they may have known about jerry sandusky. lawyers for former penn state athletic director tim curley and vice president gary schultz are trying to clear their

clients in the sex abuse scandal that stunned the university. >> we're confident we're going to win this case. >> reporter: the men are charged with perjury, accused of not telling a grand jury that they knew jerry sandusky may have been sexually abusing a child on the campus in 2001. they're also charged with failing to report to authorities what then grad student mike mcqueary told them about seeing sandusky in a shower with a boy. curley's attorney says it's a matter of interpretation. >> i think that it is clear from mr. curley's grand jury statement that he told the truth. >> reporter: the judge made no decision about dropping the charges and it's unclear if the case could get settled before it goes to a full trial. a penn state trustee was in court concerned about continued negative publicity for the school. >> if the judge rules that this is going to go to trial, then this is going to continue to stay in the news and that will

impact the students at penn state. that will impact the alumni at penn state and that will impact penn state community. >> reporter: sandusky is in solitaire confinement not far from the campus and is said to be a model inmate. he'll be sentenced next month convicted of abusing 10 boys and he's reportedly writing another book with the help of his wife. penn state is still paying the legal bills of spanier, curley and schultz and the university is holding a child sexual abuse summit this fall. that's the latest from harrisburg pennsylvania. i'm manuel gallegos. derek, back to you. >> penn state announced it will host a national child sex abuse conference this fall. featured speakers include boxing champ sugar ray leonard and former kidnapping victim elizabeth smart both of whom have suffered sexual abuse. we just got new information about our top story, the alleged family research council gunman floyd corkins. surae chinn is live from his parents' home in herndon, virginia, to fill us in.

prepare a couple of fbi agents just left the home -- >> reporter: a couple of fib agents left the home about 15 minutes ago. -- fbi agents left the home about 15 minutes ago. other than that it's been fairly quiet here. there is a no solicitation sign in front of the house and a handwritten no trespassing sign, a clear indication that media has been stopping by and for now their lives have been thrown into the spotlight. we are getting a better picture of who floyd corkins, ii is, the alleged frc shooter. corkins graduated six years ago from gmu. he holds a teaching license in physical education. he was involved in gay lesbian bisexual transgender groups on campus and he volunteers at the d.c. center for glbt. his facebook page had no picture. it indicate he has 12 friends -- indicates he has 12 friends and likes men. corkins' parents informed fbi agents that their son has strong opinions with respect to those he believes do not treat

homosexuals in a fair manner. his parents told the fbi their son left the home at 9 a.m. yesterday, presumably he went to a chick-fil-a before getting on metro. one employee i talked to says she remembers a man ordering 15 sandwiches yesterday morning, but when she told him it would take 15 minutes, the man said he didn't want to wait and left. the restaurant chain was recently embroiled in controversy involving a senior exec. he opposed same sex marriage and in a statement they released in this incident it says chick-fil-a has not been contacted by the authorities in relation to the incident at family research council headquarters yesterday because it say police matter and we do not yet know the -- it is a police mart and we do not yeten the facts. we -- matter and we do not yet know the facts. we prefer not to speculate on the issue. our thoughts and prayers are with his family." that is the very latest here in

your home. lows will be 63 to 73 degrees, winds southwest and light tonight. tomorrow you'll nt to bring sunglasses for the morning commute and don't forget your umbrellas because we could see strong to severe thunderstorms, especially tomorrow afternoon and tomorrow evening. we'll break down that forecast for you, also look at a much cooler weekend that could impact your weekend plans. back to you. a manassas driver is charged with dui-related manslaughter after a deadly crash in alexandria. it happened in the middle of the night on i-395, the southbound ramp to route 236. investigators say an audi ran off the road, spun around and slammed into a tree. a back seat passenger was killed. the driver faces charges in the case and police say speed and alcohol were factors. a police cruiser in

alexandria, fairfax county investigators are looking for a pair of good samaritans who helped an officer out of that wrecked cruiser. the crash happened monday morning on franconia road. the driver of an infiniti veered into oncoming traffic and crashed head on into the cruiser. that driver was killed instantly and the officer became trapped. police say the two good samaritans then pulled the officer out to safety. they are asking for help locating them to simply say thank you. still to come pepco has filed its request to charge customers for part of that outage from the derecho and 9 wants to know just how much they want to get from us. >> plus a fish tale in massachusetts you've got to see to believe. >> but first -- >> reporter: the wikileaks founder found asylum, that story coming up.

julian assange remains holed up inside ecuador's embassy in london as a diplomatic standoff. britain and ecuador are having a tough time here. we have all the details from london. >> reporter: supporters of julian assange celebrated outside ecuador's london embassy. the south american nation granted political asylum to the wikileaks founder, but he's not a free man. british officials say he will not be allowed free passage to ecuador. >> it should not be used for the purposes of escaping the regular processes of the courts and in this case that is clearly what is happening. >> reporter: assange is wanted in sweden to answer questions about sex abuse allegations, but the 41-year-old believes sweden will hand him over to the u.s. to face spy charges. assange's wikileaks website leaked thousands of classified

u.s. documents. ecuador said it took action because assange faces a serious threat of unjust prosecution at the hands of american officials. the embassy sits in a posh neighborhood of london. once a fairly lone building is drawing plenty of curiosity. >> the only way he can get out is by helicopter. >> reporter: the theories are endless. some suggest assange could be smuggled out of the country in an oversized diplomatic bag. others think the australian will stay in the embassy for months. supporters say they'll camp outside the embassy to ensure british police don't take assange into custody. >> wikileaks' twitter feed now says that assange will give a statement outside the ecuadoran embassy sunday afternoon. the virginia firefighters are helping to contain those wildfires that are burning out there in four western states. the state department of foresty said it's deployed employees and a wildland firefighting

crew this week and they're joining up with other crews fighting wildfires in idaho, arizona, california and nevada. their duties range from helping wildfire hand crews in the mountains to working as dispatchers. right now at least 70 wildfires are burning west of the mississippi charring tens of thousands of acres. >> the drought is such a big part of that story. >> it just keeps getting worse. on the west coast a lot of folks need the rain, but they aren't going to get it the next couple days. in our area humidity is lower, so it feels much more comfortable, but we see changes coming this way tomorrow. we're talking about a cold front approaching. friday will start out really beautiful. then we'll see changes come by the afternoon and increasing cloudiness and storms that could impact us, especially for your friday evening commute, but tonight is really nice, perfect for that evening jog or stroll or bike ride. live doppler 9000, it is quiet out there, a few clouds, a live

check it out. that is an rv emblazoned with the words who's your daddy. it's stirring up a storm of controversy in new york. that's because this rv offers paternity tests, men questioning if they are the father of their children can get a dna test on the rv. here's what one customer had to say. >> you have a child and you're not sure if it's yours? >> i'm not sure. i'm paying child support anyway and i will continue doing it. >> reporter: you just want to know. >> yes. >> the dna testing costs between 300 and $575, results available in a couple days. a 10-year-old boy from massachusetts has quite a fish tale to tell. he and his dad were tuna fishing on cape cod bay when they spotted something big, something very big in the water.

9 wants to know has obtained new documents showing how pepco is accounting for how much it couldn't bill customers for during the summer's big derecho storm. turns out it's over a million buck and this provides the first clue as to just how much they'll be billing customers for their losses. our own russ ptacek uncovered the documents and has more on the story. >> this is it, the filing with

the maryland public service commission, about $1.2 million being what pepco told state officials overnight that it lost because it couldn't bill customers during the storm and that's in addition to the losses during that first 24 hours, which is what maryland customers will be billed for in the end gain. we asked montgomery county consumer protection director eric friedman to analyze the filings and he told us the paperwork is so complicated his experts are still trying to figure it out. pepco account ising the losses because it can't -- accounting the losses because it can't charge customers. friedman says frustration is mounting because although the new filing puts losses over a million dollars, after that first 24 hours, there's still no answer of what pepco plans to charge for their losses under the billing stabilization adjustment or

bsa. >> we're totally frustrated about everything. now when people find out about it, they're outraged. >> we asked officials at the maryland public service commission to help explain this. we also reached out to the maryland people's council. neither of those state offices returned their calls. pepco says the official office for the 24 hour period, the one maryland customers will be expected to%, won't be released until next week. bge which is in a similar filing says the same seven-day period cost them off a million dollars is now estimating the 24 hour window will be about $600,000 that it couldn't charge, but it will be charging customers breaking down to something under 50 cents a customer in an extra bill to the bge folks, but for pepco -- >> we're still waiting. >> just wait a little longer. >> i'm sure you'll be on it when the information is available. >> i hope your air conditioning is on and your lights are working. d.c. mayor vincent gray has a task force looking into

burying power lines. it will hold its first meeting next thursday. on this task force city leaders, pepco executives and community leaders from wards that typically see the highest outages. gray created the task force last month in response to the june derecho. the goal is to create long remember it plans to reduce the impact of severe weather on -- term plans to reduce the impact of severe weather on the city's power grid. the check should be in the mail soon for thousands of d.c. workers furloughed last year. the d.c. government says the workers will receive back pay for those days starting tuesday. the city decided to pay the workers after announcing a $240 million surplus. about 22,000 workers will get that money. there is a push for an outside agency to investigate complaints against the laurel police department. the washington times reports the naacp is behind the move. the push comes after a 27-year- old man claimed he was beaten up by an officer after being

arrested. the naacp says it's been contacted for advice in at least 20 cases. the organization says all those cases involve allegations against police officers in laurel. in tonight's health alert we have another case of west nile right here in our area. the maryland department of health confirms the second person in the state contracted this virus. this latest case is a 70-year- old person in the d.c. metro area, but health officials aren't saying exactly where. maryland normally sees one or two cases this time of year, but across the nation the numbers are spiking. the cdc says there have been at least 693 cases of west nile in 32 states. 28 people have died. a university of maryland professor of entomology, that is an expert on insects, says the increase is likely due to the weather. >> to get west nile off the ground you have to have three things in place, birds that are

carrying the virus, good populations of mosquitoes and with the recent rainfall and the elevated temperatures this means mosquitoes can basically complete twice the number of life cycles and you've got a susceptible population. >> some states including texas, new york and massachusetts are trying to keep the mosquito population down by using airplanes to spray insecticides. also tonight a new technology that gets its name from the insect world, firefly. surgeons at medstar georgetown university hospital are adding it to their robotic operating system to better illuminate tumors inside the kidney. as is the case with many patients, jean carter's kid -- gene carter's kidney case was discovered by accident. his lungs were clear, but a spot on his kidney raised an alarm. >> i sort of thought at 70 this is not likely to go away. nobody could say how slowly it

would grow and so the question is are you going to be in better condition if you live to have surgery later or to do it now? >> reporter: surgeon keith kovalcuk suggested surgery now using a laproscope and a robotic guided tool. they go in through smaller incisions, so it's easier for the patient, but what isn't easy is for the surgeon to see. >> when tumors are very high up on the kidney, it's often very difficult to operate because it's so far up. sometimes they're inside the kidney and it's very difficult to find. >> reporter: that's where firefly comes. in a tracer is injected into the bloodstream. then intrared images is use and the arteries are lit up a fluorescent green including the inside the kidney. the cancerous tissue does not reflect the light. >> with the firefly it doesn't light up and it helps guide me to where i should be cutting inside the kidney. i think it's a game changer in that it makes the procedure easier.

caught on tape in china, look at this, a young boy stuck in a very tight spot. apparently he forced his head through the hole on a concrete railing and the boy could pull his head only so far back through. so rescue crews had to bring in hydraulic spreading pliers to help free the child. the ordeal drew a big crowd and several tv stations. a hug from his grandma helped him get over the embarrassment and all the people, too. >> why do little kids like to

stick body parts in things like that? >> i think they're just curious and sometimes curiosity will trap you in the balcony. everybody knows dog is man's best friend, but in this story the question becomes which man because a group of eight people found an injured german shepherd abandoned near mount berstadt at 13,000 feet. >> it had been up there for eight days. after a nine hour rescue they took the dog to the vet. when the word got out about the dog's return, the owner showed up to get his dog, but the rescuer said hold up, wait a minute. >> absolutely not. absolutely not. >> eight days passed, that's a lot of time. it's kind of hard to get your head around. >> the owner said he left the dog up there because he was unable to bring him down himself. an attorney said this may be an animal welfare case more than an animal legal case or property case. she also adds it may come down to what's in this dog's best interests.

we kick off tonight's consumer alert with a recall. chrysler is calling back more than 1,400 done durangos. some of the 2013 models may have pen built with the wrong air bag -- been built with the wrong air bag control module and the bags may not inflate correctly if the suv is crashed from behind the second row seat. chrysler will notify you about the free repair. you might have to toss something in your kitchen tonight. wegmans issued a soup alert because there could be bits of plastic in certain containers. so here's what you don't want to seat, 16-ounce cups of chicken and -- eat, 16-ounce cups of chicken and dumpling soup with a use by date of september 24th and 16-ounce cups of italian wedding style soup with meatballs, tomato basil and caribbean black bean and lobster, all with a use by date of september 3rd.

a shooting at an anti-gay marriage lobbying group downtown has activists on both sides hurling charges that the other has been inciting the violence. the head of the family research council today accused a long time anti-hate group of giving the shooter license to open fire. bruce leshan is live outside frc headquarters downtown to break this all down for us. >> reporter: amazing that one day after the shooting this could evolve into charges and countercharges between activists. a federal judge today ordered floyd corkins to undergo a psychiatric evaluation, but the head of the frc says corkins was egged on by civil rights activists who have labeled this organization, the frc, a hate group, for its stance on gays. >> how many unhinged individuals walk around with 15 chick-fil-a sandwiches and 50 rounds of ammunition? >> reporter: tony perkins, to cable channels
