had followed johnson from west 33rd street alerted two uniformed police officers who were on post in front of the empire state building. >> reporter: police say when the officers confronted johnson, he reached for his gun. that's when the officers fired at him. >> i heard approximately five to eight gunshots. >> reporter: when the bullets stopped, nine people were shot. it's not clear whether the gunman or police shot the bystanders. >> while confronting the suspect and fatally shooting him unfortunately there may have been other victims as well. >> i saw a woman sitting up against the building with her foot who had been shot and then i looked halfway down at the doors where you enter the empire state building and the supposed shooter was on the ground and he had been shot. >> reporter: all of the bystanders are expected to survive. new york mayor michael bloomberg says they are investigating how the bystanders were shot. it may be that the gunman himself never fired a shot at police. that's the latest from

manhattan. manuel gallegos, back to you, anita. >> thank you. to winchester, virginia, tonight where a mother and stepfather are grieving after losing their two small children in a fire. it happened around 9:30 last night in the 200 block of summit avenue. that's where we find our surae chinn live in front of the house where tall happened. so sad. -- where it all happened, so sad. >> reporter: this community and neighborhood is in mourning after the loss of these two little boys. the children were up in the second floor bedroom. the youngest would have turned 5 next week. the family desperately tried to save them, but it was too late. >> god, don't let your kids go to bed without hugging them tonight, please. >> reporter: a message from a grieving grandfather of 4-year- old braden and 6-year-old landon. >> you can lose them so quick and it's just not worth. it. >> reporter: family friends say the boys' step grandfather was woken up by the hallway

smoke detector around 9:30 last night. he's pictured here in the winchester star. >> the mom was screaming trying to get them out and the boys were unresponsive. they had no idea what was going on until -- they were trying to get them out, but never could. >> reporter: alan berg said the stepfather burned his hands so badly trying to get to the boys he was taken to the burn unit at washington burn center. >> he's in the hospital now fighting to save his hands. >> i feel so sorry. very six grandchildren. i don't know what i would do if i'd lose them. >> it's a loss they'll never get back. >> reporter: jason music is a close family friend. he says little braden had special needs, but both were bright kids who loved to play. >> he brings sunshine to your face because he's such a happy little boy. he's always running around play having a good time and i think that's what i'll miss the most is just the smile. >> reporter: friends have been leaving messages on the family truck. one writes we love you landon and braden rip, little friends.

there was a working smoke detector, but it's unclear if there was one in the room. >> you need a smoke detector in every room just for situations like this. when the children go to bed and the door is closed behind them, there's no smoke detector in there, then this is what happens. >> you just don't know what they're not going to -- when they're not going to be here. >> reporter: the fire marshal is still investigating the cause of the fire, but there's nothing suspicious they say and also talking with the family they rented this home and they also say if there is no smoke detector in each room, the fire marshal says leave the kids' bedroom door open at nht. a really tough tragic lesson tonight. back to you. >> you only wish they had known this before this all happened. there is breaking news tonight. the case is closed. montgomery county state's attorney john mccarthy is announcing a self-admitted carjacker now admitted a guilty plea. it was all caught on camera.

now 23-year-old taron white is looking at 40 years in prison, the video of that chase and the dramatic ending. >> reporter: he pled guilty to two counts of kidnapping in in video we'll show you. taron white's run from the law comes to an end in dramatic fashion. look at this video. that carjacking and kidnapping victim is seen jumping from the car with her 20-month-old baby in her arms. shortly after white surrenders to police and he's taken down by maryland state troopers. officials say this all happened on july 13th last year. it began at a baltimore gas station where white robbed the victim's car. investigators say the woman begged him not to because her baby was inside. instead he kidnapped both of them and led them through a four county chase that ended in montgomery county. the state's attorney john mccarthy says once this procedure is taken care of here in montgomery county, he will

then have to face similar charges in every other county where he ran from police including baltimore county, prince george's county and howard county. he is scheduled to be sentenced for his guilty plea here in montgomery county in late november. those other charges, we'll just have to wait and see what happens at that point. missouri, the second step turned himself in in that chase that killed a 23-year-old police officer. police took kevon neal to jail after he surrendered around midnight. a reporter asked him if he felt responsible for the death of officer adrian morris during a chase that hit speeds up to 100 miles an hour. >> reporter: you're being blamed for his death. should you be? >> no. >> if you think you're going to terrorize the people of this community, we will go after you and bring you to justice and that is what this police department has done. >> neal and his alleged accomplice kenneth mitchell are

so far charged only with felony theft of an automobile, but prince george's state's attorney angela alsobrooks says if the investigation determines they caused the crash, she'll charge them with vehicular homicide in the death of officer morris. prince george's county police continue to look for the intruder who shot a 17-year-old honor student in her bedroom. amber stanley was killed when a man broke into her largo home wednesday night, went to her upstairs bedroom and shot her several times. several other people were in the house and got out. stanley was a student at charles flowers high school. police have no suspect or motive. the man accused of shooting a building manager working security at the family research council pleaded not guilty today. that suspect floyd corkins was found competent to stand trial. corkins is accused of shooting leo johnson at the headquarters of the conservative group. johnson is out of the hospital now. corkins is charged with assault with intent to kill while

armed. he could be decades in prison if convicted. a man on a bicycle wanted in a series of sexual assaults around dupont circle is in jail tonight. police have linked 30-year-old oscar pena of northwest washington to four assaults in the area this month. two of them happened in the 1200 block of connecticut avenue, 1 in the 1900 block of q street and the other at 16th and u. police say the man would approach the women, touch them and run off. overnight lance armstrong lost more than a decade's worth of cling titles and today the u.s. anti-doping agency erased 14 years of his career including his seven consecutive tour de france wins because they say he used performance enhancing drugs. anti-doping officials say lance armstrong can no longer call himself tour de france champion. the u.s. anti-doping agency stripped him of those seven titles along with 14 years of other wins after he stopped

challenging the charges against him. enough is enough armstrong wrote on his website. i refuse to participate in a process that is so one-sided and unfair. usada ceo travis tygart says armstrong used performance enhancing drugs to win and reportedly had 10 former teammates prepared to testify. >> given that he's chosen not to contest, it's a legal fact that he's now disqualified and has a permanent ban from sport competition. >> the anti-doping agency expects the international cycling union and the tour de france organization to go along with its decision, but both groups have yet to make an announcement. the retired cyclist denies ever taking performance enhancing drugs, but last year former teammate tyler hamilton told 60 minutes he watched armstrong use illegal blood boosters. >> you saw lance armstrong inject epo? >> yeah. like we all did. >> armstrong could have entered arbitration to fight those charges and his decision to

quit surprises former teammates and competitors. >> i definitely would have expected lance to fight all the way to the grave to clear his name. >> for his part armstrong says he will no longer drats issue regardless of the circumstance. -- address the issue regardless of the circumstance. armstrong could lose his bronze medal from the 2000 olympic games in sydney. there has been no announcement on that one from the international olympic committee. the tour de france had no comment. kevin black stone from sports journalism at university of maryland and a long time nationals sports columnist, thanks for joining us. >> sure. >> any doubt in your mind that lance armstrong used performance enhancing drugs? >> there's no doubt in my mind there is a plethora around circumstance cal evidence were the fact -- circumstantial evidence around the fact that he may have used performance enhancing drugs. there was plenty of smoke all around him, but clearly he's

passed hundreds of drug tests. >> which he will waste no time in telling you. >> absolutely. >> now at this point, however, the shock is that a guy who is as competitive as lance armstrong decided you know what? i can't do this anymore. what do you think of that? >> i think he saw the writing on the wall. he didn't quite like his chances going up against an arbitrator. he couldn't get the court where he had filed the suit to rule in his favor and let him take his case to it and so i think he just decided to fold up his cards. >> what's your take on the process? he says it's unfair. is it? >> well, it's the system we have set up in this country and around the world through the wado and usada is clearly set up by this government to investigate doping in our sports and this is what they do. >> but i got to ask why go after armstrong now? he hasn't won a tour de france in years. the sport has moved on.

you're taking down a guy who has done so much for the sport and for people who have cancer. >> because he is famous. he's one of the most famous athletes on the planet. a lot of people have suspected him of wrong doing for a very long time. a number of his former teammates have gone down because of doping scandals. his former coach wasn't even at the tour this year because of allegations and investigations surrounding doping scandals. so that's why. this is who they believe is the kingpin. >> i got to ask you this. if we concede that cycling had a serious doping era in the '80s, '90s, is it over? >> not at all. i think cycling is the dirtiest sport i've ever covered. i still think it's dirty of we just saw -- >> dirtier than sprinting and everything else? >> we just saw tyler hamilton have his medals taken away for doping and the person taking his place is a former lance armstrong rider. who knows where it's going to

isaac still strengthening in the caribbean and tonight some forecasters are predicting that storm could dump up to 12 inches of rain on haiti and the dominican republic. >> that could cause life threatening flash floods and mudslides. >> for about 400,000 people still living at camps following the 2010 earthquake in haiti, the results could be catastrophic. >> topper is tracking isaac in the weather center. where is it going now, top? >> bad news, but as expected headed toward the southern coast of haiti. we talked about this yesterday, the winds not the huge problem with this storm.

maximum winds are now 65 miles per hour, but the big news will be the rainfall, 10 to 20 inches possible across southern sections of haiti. let me show you the satellite picture and radar combined. right now it's located about 100 miles south, southeast of port-au-prince, movement west at 14. it's a pretty massive storm, too taking up a good chunk of the caribbean. danielle nottingham is live in tampa where there are concerns isaac could be an in unis righted guest for the upcoming -- an uninvited guest for the upcoming national republican convention. what's the latest? >> reporter: florida's governor said the state is open for business and the republican national convention is going as planned now. workers are setting up the stage and the areas around convention center, but officials are still keeping a close eye on this storm. they're concerned about the residents and the tens of thousands of people expected to attend this convention next week. tropical storm isaac is bringing wind and rain to the

dominican republic as it moves towards the gulf of mexico. >> it has strengthened since yesterday. >> reporter: forecasters expect isaac to strengthen into a hurricane, but say it's still too early to predict exactly where the storm will strike the u.s. that's causing headaches in tampa where the republican national convention starts monday. rnc and state officials met friday to discuss emergency plans. florida governor rick scott says he's optimistic the gop will be able to keep its schedule. >> we'll have a great convention. they're going to see a little bit of rain and wind. >> reporter: delegates are already arriving in tampa for the four-day convention. officials are putting something extra in their welcome packets, information on storm preparedness. right now the storm is tracking west of tampa, but even if it does not make a direct hit, low lying areas could see flooding. >> what you really worry about here is tidal surge and that's

where you get the loss of property and a potential loss of life. >> reporter: the florida keys may see isaac first and tourists there are already packing up. forecasters are warning residents all along the gulf coast to get ready. >> the threat is out there and preparation is key. >> reporter: florida officials say they are prepared and as of now, the gop party will kick off as planned. florida's governor also said he has briefed republican nominee mitt romney about the state's preparation for this storm. now there is talk that the republican national convention will officially nominate romney monday instead of wednesday if they find that isaac poses a threat to tampa and disrupts the convention. now back to you, topper. >> thank you. i think the biggest threat in terms of isaac will be rainfall and that includes haiti and also much of florida.

let's go to the graphics. i want to show you the track. there are some computer models today that are actually bringing it to the east side of florida. so we've seen some shift a little bit, but the national hurricane center is pretty much staying where they had it yesterday across eastern sections of cuba and then notice some of the models now take it on this side of florida. i think we'll still see a track more through key west and off the west coast of florida, but it's still only friday. here's the official track. you can see it going south of puerto rico cutting across haiti and eastern cuba as we get into saturday. sunday it goes back just to the keys and monday and tuesday back to the gulf of mexico. the only good news about this track, highest winds are 85 miles per hour. the bad news about the previous graphic, if there's a little shift to the east, we're talking anywhere from 5 to 15 inches of rain is possible for places like tampa and the west side of florida. so not so much a windstorm, but it could end up being a big

next three days at noon we'll keep it on yellow, code yellow saturday and sunday, because some of the storms could disrupt your plans, 79 saturday, 83 sunday, nice monday, maybe a thunderstorm, but temperatures go back into the upper 80s. we'll be hard pressed to make 80 tomorrow. if you're going to the redskin game, prepare for showers and temperatures in the 70s. tuesday we're near 90 again, isolated storm possible. wednesday we're throwing some clouds there. those clouds actually would be what's left of isaac. i think it will slide south of us which is too bad. we need the rainfall. then thursday we're back in the upper 80s. friday there's signs of getting hot again in the mid-90s. so again isaac could end up being more of rain problem for tampa than wind and if you're going to the redskin game, put a poncho on. >> it sounds like we got isaac jr. for the weekend. >> not quite. >> it just keeps getting worse, though. up next some startling new video of a ride on bus crashing into a silver spring home.

massacre. court records now show that james holmes told a classmate he wanted to kill people four months before the shooting. there is also word tonight holmes failed a key exam pat the university of colorado just -- at the university of colorado just six weeks before the shootings. holmes is charged with killing a dozen people and wounded 58 others during the showing of the dark knight returns. that norwegian man who killed 77 people at a summer youth camp received the maximum sentence for his crime, 21 years in prison. still anders breivik smiled because it also declared he was sane. the norwegian extremist said the attacks were meant to draw attention to his right wing ideology and he said he'd appeal any insanity ruling before the ruling came down. today's sentence can be extended under norwegian law as long as the inmate is still considered dangerous. imagine driving down the highwaand out of nowhere a

called to a bank robbery? it happened in georgetown today. >> there was concern about some structural damage after at least one burglar managed to punch through the walls overnight to get the cash. scott broom reports it was all caught on camera. >> reporter: a bowl burglar caught on camera at 2 -- bold burglar caught on camera at 2 a.m. today after breaking through walls in a failed attempt to get to an atm machine. the damage left behind at the m&t bank at 1420 wisconsin in georgetown so bad firefighters were called in to ensure safety during the investigation today. >> this is the third incident of this similar m.o. >> reporter: fbi agent jacqueline mcguire says it may be the same suspect or suspects who have done it before. here's a burglar in a similar suit on video after breaking through a wall from an adjacent business and again cameras caught two suspects in the same

hospital after this bus slammed into a house right near new hampshire avenue. all the victims are going to be okay and no one inside the house was hurt. the cause of the crash is still under investigation. watch your speed especially if you're coming up to a school. the speed camera program is being expanded in montgomery county just in time for the beginning of a new school year. yesterday a 15-year-old girl riding a bicycle was hit in gaithersburg after crossing against the light. she is in serious condition. >> they can appear out of nowhere and we need to be very defensive in our driving and take those precautions that will enable us to keep our kids safe. >> speed cameras will be deployed around many new montgomery school zones starting monday including damascus high and cedar grove elementary in germantown. more parents than ever are buying school supplies online, but the stores don't want to lose their foot traffic. so this season some of them are coming up with new ways to lure

caught on tape a woman takes a frightening fall on the subway tracks while holding her little boy in boston wednesday. it shows the two suddenly plummeting onto the tracks. the woman said she saw the outbound train, thought it was hers and just walked over the edge, momentarily lapse. fortunately a man jumped down and helped pull them to safety. >> i was just rushing thinking that oh, that's the train i'm boarding, but that train was on the other platform. it was not on this platform and i just stepped boom on the tracks. they were right there. they just didn't care like if trains were coming or. what we fell and they jumped behind us. i got a new life as of yesterday. we just are saved. it's a miracle. >> wow. she and her son were not seriously hurt, but she is still shaken because she knows it could have ended up so much terribly worse. here's some dashcam video

capturing police coming to the rescue of a woman whose accelerator got stuck while she drove on the missouri interstate. lori ooglestad called 911 when she couldn't slow down her kia sorento. missouri highway state troopers surrounded her car to protect her and other drivers. they reached speeds of 110 miles an hour. they travel nearly 60 minutes and just 30 minutes going in and out of traffic veering off on the side of the highway to avoid a collision. eventually lori was able to slow down enough for a trooper to climb into the car and put it into park. no one miraculously was hurt. >> what a story. caught on tape tonight, i think this is our favorite, a thief with an appetite for dried flavored meat. >> this is cops in albuquerque. they have a guy they call the beef jerky burglar. check out slim. he runs up, throws a brick through the front window of mike's beef jerky, then squeezes through the broken

about it. >> reporter: she acknowledges district 2 was operating without a current license but disputes health department records citing employees unable to keep hands clean due to no hot water, refrigerators as warm as 78 degrees and a food safety manager without proper paperwork. in montgomery county el tiana was one of three restaurants suspended for violations during an inspection. sewage backing up onto the kitchen floor and trouble with insect animal controls were cited. more sewage problems and a citation at brothers chinese at amherst and wheaton for defying a closure order and continuing to operate after inspectors ordered it shuttered because the take-out was discharging sewage into an already grease clogged manhole. montgomery county records indicate the backup was so severe sewage was spewing from this manhole cover. they had to close wren's ramen

next-door but the manager there said the sewage never backed up into his store. at this office building inspectors cited no food safety manager, food not date marked and riy temperatures. we found sundry's deli still closed and roaches across from tyson's galleria? it happened here at saigon deli. the health department cited the restaurant because it did not have a food safety manager on duty. that's the person responsible to keep roaches away from food, the person who has to maintain a communicable disease policy for the staff and who has to keep food at safe temperatures. the health department cited this restaurant for violating those policies, too. >> i ordered the ravioli. >> really, i'm sorry to hear. that. >> reporter: how was your lunch? >> it was fine. i didn't know about it. >> reporter: the owner of the taste of saigon restaurant and patio in the same building says it did not close and if is

and the concerns of some local coaches. take a look. >> control your body. >> reporter: local high school football coaches have a difficult balancing act in 2012, how to prepare student athletes for a season while keeping them safe in one of the hottest summers on record. a new maryland law is providing guidance, new heat guidelines say two-a-days can't begin until the sixth day of training. >> the idea of a two a day practice as we knew it heretofor is almost obsolete. >> reporter: so says william beatty, athletic director of montgomery county schools. >> it's a gradual indoctrination to the heat. >> reporter: that's understandable, but the rules impact schools differently. the first official day of practi was august 11th meaning the first day coffees could conduct two-a-days was -- coaches could conduct two-a- days was six days later, august 17th. in prince george's county school began august 20th which allowed just one day for double practices while montgomery county starts a week later.

that's six additional practices. ed shields coaches at suitland. he says the new rules make sense but -- >> we don't get as much time to deal with the kids in the technique area. >> reporter: it's a viable concern. joshua lewis, a jv football player at northwestern high school in hyattsville, was paralyzed in 2003 during a game. he was tackling with his head down witnesses say. shields says two-a-days are a critical time to teach do's and don't's of football. >> your knee, head, neck placement, keeping your head up. >> reporter: he and his coaches will have to deal with the fact he'll have less time to prepare than some of his proponents. he and some of his fellow coaches are hoping the state will change regulations next season to allow teams like his to get more practice time. >> we'll see what happens, dave. coming up on 9news at 6:00, a family tragedy. we'll hear from the friends of a virginia family that lost two
