he is charged with allegedly kidnapping a 12-year-old girl. is he a hero or a criminal? his lawyer says he's a victim of bizarre circumstances that unfolded when he let the alleged victim out of his car in front of her home. >> no temporary restraint, no force, no nothing, and he lets her off right at her house. there is not one element of kidnapping. it is, if anything, the opposite of kidnapping. >> police seized a ski mask, flex cuffs, and a gun. he met the girl online, believed she was 20 years old, not 12, never had sex with her, and let her out of his car at her request. prosecutors say it is simply another reason parents need to be vigilant online. >> there are individuals in the community that would do harm to your children. please monitor your child's use of the internet.

be intrusive if you have to and they are at risk when those activities are not monitored. >> all right, that's montgomery county state's attorney, john mccarthy. his lawyer on his side said it's portnoy who is the victim of online circumstances. he says the girl in this case presented herself as an adult. and he explained the cuffs and gun saying he just finished military police school and is a legal owner of the weapons. a lot of facts to sort out. the judge reduced his bail from $1 million to $300,000. a small victory for him. there's a chance he'll get out of jail before court hearings get underway. very bizarre case, scott broom, 9news now. >> you're right about that. we are hoping they can sort all the facts out. >> a stormy holiday weekend spilling into this short workweek and topper is in the

weather center to tell us if we could expect another round of rain. >> we are in a tropical air mass. in part, courtesy of isaac. we aren't going to change that air mass any time soon. let's start with radar. we have showers and storms. we have been tracking a few in the afternoon. mainly south of town. we had some storms in charles county, southern prince georges county and calvert and southern anne arundel county. now we have lighter activity. if you are going up 270, some lighter showers, nothing crazy heavy. there's no reds or yellows and more showers trying to develop toward culpeper. we'll watch those for you. most of us will have a dry commute home. temperature wise, you'll look at it, it looks comfortable. 85 downtown. 84 in gaithersburg. and 88 in fredericksburg. it's so humid, it feels a lot hotter. so for tonight, partly to mostly cloudy, a few storms possible.

those that develop could be hefty. lows between 70 and 75. we'll come back and talk about the effect of those storms on the nats game and look ahead through the week and the weekend. >> all right, thank you, top. one of the key figures in that d.c. corruption probe was back in court today. thomas is the former deputy treasurer for the vince gray campaign has pled guilty to felony charges for steering money to fringe sulaimon brown, and then trying to cover up those payments. bruce johnson has been looking into where the federal probe stands now. bruce. >> this much we do know, the federal probe is not over. in fact, a number of people feel it will pick up in public view now that summer vacation is over. thomas gore, deputy treasurer in the vincent campaign was sent home from u.s. district court today. his attorney seemed to be hoping for a sentencing date. even though gore is expected to get probation, prosecutors feel he knows more than he has been willing to say about illegal

payments to fringe candidate for mayor, sulaimon brown. they held a press conference only after they get convictions, but according to sources, prosecutors are asking a will the of questions about illegal payments to sulaimon brown, still asking a lot of questionabout the shadow campaign that helped get vincent gray elected mayor. secly, what role did vincent gray have in all of this? >> staffers have now pleaded guilty to felonies. at least two prom that night attorneys who talked with us today say more charges are certain to follow. >> i wouldn't get away with the lack of activity. if anything, quite frankly, that may mean a storm is brewing. >> in your mind, is there any doubt the prosecutors are looking at the mayor? >> i think so, until we hear otherwise. >> our second criminal attorney who talked on backgrounds says that d.c. mayor gray helped launch a

$653,000 shadow campaign with businessman, jeffrey thompson, providing the funding. the attorney says the prosecutors believe the mayor okayed the payments to sulaimon brown. the same attorney, though, is not convinced the prosecutors have the proof at this point. that attorney says -- >> i think he's in some political trouble. someone described it a political mess. that remains to be seen. >> mayor vincent gray, denied any wrong doing. right now he's in charlotte, north carolina. he paid his own way. no staff or security detail. he led in a rally calling for budget rights and statehood for the districts. they are in the democratic platform. statehood is surprised it's not. >> there's a big difference between what prosecutors believe and what they could prove. any indications that any of the

witnesses turned over on the mayor. >> what i'm told, the short answer, no. if some of them say the mayor did this, did that, it's his word versus their word. where is the proof? >> that's the question everybody is asking. thank you, bruce. anita. >> summer is over for students across northern virginia. some of the region's biggest district head back to school today. fairfax county. our kristin fisher spent the morning with students at the south county middle school in lorton. >> good morning. >> it's a day full of firsts at south county middle school. it's the first year that this school has been open. first day of school. how are you feeling? >> very nervous. don't want to get lost. >> i'm feeling anxious for her. >> kind of scared maybe. >> i'm so anxious. i'm so excited for my daughter, but you know, she's growing up so fast. >> but no one is more nervous than this seventh grade boy

from south korea. >> this is your first day going to school in the u.s., how are you feeling? >> not good. my son is very nervous. >> at least everyone is a new student at this school. they have come armed with color coded maps to find their classrooms in this $22 million sprawling school that has been years in the making. >> i think it's great. i mean, we have been waiting for it. >> this is one of two new schools opening in fairfax county this year. the other is mason crest elementary. these new schools were built to help accommodate the new students entering the school system this year. >> we have grown about 15,000 kids over the last five years. we are dealing with growth, growth, growth. >> for dr. jack dale, head of fairfax county public schools, today is his last first day of school as superintendent. he's moving on at the end of the school year and no doubt what the biggest challenge will be for his successor. >> we're running out of space. it will be a challenge.

>> kristin fisher, 9news now. >> major growth there. the first day of school was met with anger from parents of arlington county school students. the school district canceled bus service at 12 stops. we caught up with parents who now have to walk with their kids to campbell elementary school. they are not pleased with the decision to cancel the buses. >> it is a very big safety concern. the route is long and this is a difficult street to walk along. especially when you are talking about little children. >> school officials insist the new streamline bus service is more efficient and safer for students. >> pentagon is now thinking about taking legal action against a former navy seal who wrote his account of the osama bin laden raid and put it out in the book. there's word the entire command of the seal team that carried out that raid has been ordered to temporarily stand down. the book is called no easy day and hit the bookstore shelves

today. that author spoke with 60 minutes. now he went by the pen name, mark owen to conceal his identity. he spoke on live tv. the book was originally set for september 11. the author insists his book is not aimed at influencing the election. >> my worry from the beginning is a political season. this book is not political whatsoever. it doesn't bad mouth either party and we specifically chose september 11 to keep it out of the politics. >> military officials insist the real impact of this book is that the author's broke the code of silence among military operatives. >> coming up, firefighters continue to try to get a handle on a wild fire that disrupted holiday hiking and camping for thousands of people. also ahead, it was nearly one year ago, tropical storm lee washed out more than a dozen bridges and roads in fairfax county. we'll explore whether the

firefighters say the flames in the forest could keep burning for a week. that burned 3600 acres so far. two people hurt. campers aren't allowed to stay at the campgrounds. people living in a nearby trailer park were ordered to leave. some decided to take their chances. around here, virginia's wine harvest is coming early this year. wine makers in central virginia say the dry summer has been great for grapes, but plenty of wet weather forecast, the vineyards in charlottesville decided to take early this year. >> it is to the east a little bit. the flavors aren't as concentrated. sugar is an important factor when determining when to pick. >> other wine makers are

roads and bridges. will those bridges hold up if another storm comes our way? >> reporter: there was no bridge here last year, washed away by tropical storm lee. in its place, these rocks, a temporary fix. a year later, like so many bridges, washed away that day, there's the no permanent fix. >> i remember the bridge getting swept out and how horrible that was for us. >> charlotte edwards had to take the long way around just to do her errands. >> it was 2 1/2 miles out of the way. >> it took two months for vdot to fix it. >> it was a long time. all the roads that were going up to route 7 were washed out. and we used to joke, we live on a cul-de-sac. >> wiped out bridges across fairfax county, creating sink holes that cars fell into. >> we'll always have the

challenge. there will be storms that are in excess of a design capacity. they can't afford to design the bridge to meet the ultimate rainstorm. >> they should spend the money to do it right and build a bridge down here. stop. this has been going on for thirty years. >> fairfax county supervisor says they are in the works for making a stronger structure to withstand lots of rain. vdot crews were out today making notes for the new concrete bridge. >> if something happens, we'll be ready to respond. >> not much you can do about mother nature. >> it will cost roughly $1 to $1.5 million to replace each bridge. we're a year to two years away from completion. for now, we have to watch and hope another storm doesn't wash them away. in fairfax county, surae chinn, 9news now. >> juves in just the past three years, five tropical systems affected. lee last year, ida in '09.

the invitations are finally out. apple sent e-mails to members of the media inviting them to a september 12 event. all of the buzz is that the company will introduce the iphone 5 next wednesday. rumor has it, an updated version features a slightly larger screen, a smaller connector and some technology that will allow you to use payments through the mobile device. it's expected that apple will unveil a smaller ipad tablet come october. >> and you may want to savor those last days of summer, but retailers are gearing up for the holiday shopping season,

believe it or not, and toys r us are getting a head start by offering free lay away. it seems the toy store wants to compete with target and wal- mart. it has become popular lately as the economy has been uncertain and credit card debt has become a bad thing. girl power pushed up lego sales all thanks to a new line designed especially for girls. the toy maker's friends sets are apparently being swooped up by the shoppers. profits for the family business increased by 35% in just the first half of this year. now critics complain that these toys played gender stereotypes and concern that the lego sets for girls cost more. our consumer team contacted the company and assistant brand relations says it's not true. she says it's the number of pieces in the box that determines the price of all

lego products and not what gender it may be aimed at. anita. we have a head's up for anyone driving in downtown bethesda. part of woodmont avenue will be closed this week. between miller and leeland street. it's going to stay closed for 20 months. here's why. workers are building two residential buildings and shops on two parking lots. an underground garage is also being built. the capital crescent trail will remain open during the construction. a plan to transform a small chevy chase shopping center into an urban town center is causing a storm of controversy. the plan calls to turn chevy chase lake on connecticut avenue just inside the beltway into mixed use apartment buildings. some up to 8 stories high. there would be a park and outdoor playground. critics say it would overwelm schools. >> some changes are in the works. in the name of safety. the maryland state highway

administration plans to triple the amount of truck parking spaces in savage. officials say that is because many truck drivers can't find a place to pull over when they need it. officials are worried about sleep deprived drivers on 95. the funding comes from a $2.5 million grant from the transportation department. still ahead, a spectacular crash at a weekend air show all caught on tape. but up next, only on 9, a former life guard learns a lesson he has been teaching for years, but he learns the hard way.

the 2012 democratic national convention is officially underway. in fact, this is a live picture from the convention site in charlotte. that's maryland's governor, martin o'malley who is speaking out right now live even as we look at him. later on tonight, there will be michelle obama reintroducing her husband to the nation. san antonio's mayor, julian castro will deliver the keynote address. only on 9, if it can happen to him, it can happen to anybody. a former life guard makes a mistake that he has warned others about for years. peggy fox is here with a story she shot while on vacation in the outer banks last week. >> i caught up with an old friend who i have known since i was a child. he used to life guard with my older brother. he recently had a horrific accident and he wanted to tell

his story. all i had with me for a camera was my iphone, but i think you'll find it did a good job capturing the message. >> they call this a halo, though it looks more devilish than angelic. it is bolted to the head to keep the spine straight. >> eight total screws in my head and they are screwed into the skull. >> bill has had the halo since july 4. that's when he made a split second mistake while on a friend's boat on the sound near nags head. >> i decided to take a swim and did not know the water was shallow. >> he says the depth gauge showed they were in six feet of water, but the boat had drifted. they were on a sand bar in two feet of water. >> bounced off the boat into the sand bar head first, and my neck got pretty well damaged. i popped up and the people on the boat, thank god they were experienced paramedics.

witnesses say they saw the man abandon the car. police say they nought they were responding to a car crash, but instead they found the eight month old baby girl in the backseat. police add that akoanor is related to the child. >> as officers approached, they located an 8 month old baby girl in the backseat, still strapped into her child harness. the child appeared okay. didn't seem to be injured in any way. >> the baby was left alone in the -- for 15 to 20 minutes. police say she was not hurt and is with the family tonight. >> at least 42 people are dead after a bus crash near one of morocco's top tourist spots. it ran off the road and smashed

into the ravine. it happened in the middle of night. it is the deadliest crash ever. >> a murder case that made headlines across the country is coming to a close. closing arguments are taking place today in the drew peterson case. the former illinois police officer is accused of killing his third wife, kathleen sabio. she was found dead in a bathtub in 2004. prosecutors say circumstantial evidence points to peterson. there's physical evidence that is not there. sabio's death was originally treated as an accident. that is until peterson's fourth wife disappeared three years later. it is official. it will now be live with kelly and michael. former nfl star, michael str ahan was introduced today. he replaces regis philbin who retired last november. 59 guest cohosts tried out for the job. strayhan is currently host of

the 2012 democratic national convention now underway down in charlotte, north carolina. in fact, you are looking live right now at the convention site where maryland congress member and minority whip is speaking, or at least he will be getting up there very soon. he just spoke and he walked away. and now someone else is walking up who is not quite as local and well known here in town as danny was. >> they are going through all the rehearsals. >> exactly. >> meantime, a deadly crash at a weekend air show is caught on tape. this is home video from the air show in davenport, iowa. three planes flying in formation when one -- creating a huge fire ball. look at that. the air show was temporarily halted. the caws of the crash is under investigation. a traffic cop in south korea made sure a suspected criminal did not get away. now video of that daring arrest

has gone viral. >> indeed, you may want to check this one out. the 34-year-old officer hung on to the car's windshield for 25 minutes. like something out of a movie. the driver trying to shake him off by weaving through the back streets for miles. >> for the first ten minutes, i thought i was going to die. but then as he kept zigzagging the car did an illegal u turn and other cars to get rid of me, i was determined to survive and capture him. >> apparently that's exactly what he did. the car stopped, the officer jumped off the windshield, chased the car. he suddenly drove off, that's how the whole thing got started. it was the same guy wanted on drug charges. >> probably why he tried to get away. >> a deer made quite a splash in colorado springs. scott captured this video going for a swim after hearing

commotion coming from his backyard pool on one sunday morning. >> my dogs were barking like crazy and i couldn't get them to knock it off and i got up on the top of my deck and i looked down and there was an 8 point buck in the middle of my swimming pool. >> he quickly realized the animal was struggling to get out. he called 911 for help. he built a ramp out of plywood. after ten minutes of coaxing, the deer walked out of the pool, but not before it did $2500 in damage. 8 point buck. >> yeah. they'll have to drain that pool. a news crew interviewing an elderly couple about storm damage captured a man emerging from the woods, buck naked. there he is just chilling next and he walked on down the street. what the heck is going on? the cops want to know, they show up. and he was arrested. the charge, indecent exposure. >> you don't say?

in tonight's health alert, another potential culprit in causing high blood pressure and it has to do with the body's biggest artery. the aorta is the largest blood vessel. as we get older, the aorta's wall becomes stiff. heart failure and heart attacks. >> it increases the pressure isolations each time the heartbeats. and in addition, pressure waves move more rapidly through the arterial system. >> but does high blood pressure cause this stiffness or is it the other way around? >> this is someone with a stiff aorta. means the waves are traveling quickly down the aorta. >> they test blood pressure and three measures of blood vessel stiffness. sensors were placed against the skin over an artery and

repeated over two seven year cycles. >> we were able to conclude that arterial stiffness contributes to the development of high blood pressure. it is not a consequence of high blood pressure, but is a cause of high blood pressure. >> what does this mean for patients and the doctors who treat them? this study in the journal of the american association say blood pressure patients need to focus more on keeping the aorta from becoming stiff in the first place. >> now one thing proven to have effect is a person's weight. a higher bmi is tied to greater hardening of the aorta. keeping the pounds down as we age, always good. not easy, but good. >> there you go. >> heard that. top. >> tropical air mass, we are affected by isaac. remnants are still running around. that's giving us a tropical air mass and threat for storms. heavy rain with these storms. those that develop will produce

we have a chance of a thunderstorm in, but the odds are with us tonight. it's going to be humid. no doubt about that. 86 right now in rockville. 85 in great falls. 83 in fairfax. again, you look at temperatures. you think comfortable, but it's humid. 84 in arlington. 87 in college park. 84 also over in bowie. so here's the deal. still humid and unsettled. a few thunderstorms tonight. bring the umbrella. that will help chase away the rain. more thunderstorms tomorrow and then a very hot finish to the week. tonight, partly cloudy, muggy, a few thunderstorms possible. some could be heavy. primarily heavy rain fall. lows between 70 and 75. tomorrow morning, partly sunny and warm. shower possible. 70s and 80s. we should get through the commute tomorrow without any rain. and then by afternoon, partly sunny, hot and humid, shower or storm possible. some could be hefty. high temperatures near 90. winds southwest at 10. so because of the heat, humidity, and the threat of storms, we're going to go code yellow for our system.

some storms on wednesday, 89. hot on thursday and friday with afternoon storms. 91 both thursday and friday. next seven days. it stays unsettled. it really does. afternoon storms on saturday, 89. so not a washout. but then a lot of showers and storms sunday and monday and morning and afternoon storms. cooler, 81 sunday. 80 on monday. even a left over storm on tuesday and temperatures only in the upper 70s. so, the temperature is going in the right direction, but the showers and thunderstorms, not so much. >> i guess i should give up on getting that car washed. >> all right, the nationals, they are sitting atop their division and that win over the cubs last night extended their lead over the braves. >> they can widen that gap with a win tonight. kristen berset is live at nats park with more. exciting times. >> it is. that win last night not only extended their lead, like you said, but clinched them their first winning season in nine years here at the nationals.

the first for d.c. baseball fans since 1965. it's a great time, but of course lots of baseball still to play. a lot of the success has been attributed to those top three guys in the nats pitching rotation. you have detwiler. their third starter has been solid as of late as well. he struck out ten in eight innings when the cardinals were here without giving up an earned run. tonight we get the chance to get his own win, loss record back to .500. and jackson's teammates have total confidence he can get it done. >> he's a true pro and you know, he's an asset to the pitching staff and the team. i mean, i would say he is probably the quiet leader of the starting rotation and part of the team, too. >> he's dependable. he goes out there and pitches a lot of innings. he is a workhorse out there. >> joining me now live here at nats park, nationals reporter from masnsports.com.

we were just talking about edwin jackson. a lot of talk about stephen strasburg. he had the talk about getting shut down. when these nats go to the post season, if they fall early, is that shutdown going to leave a bad taste in fans mouth? >> it might. that's the easy explanation for fans if the nats lose because this is a team that has had the best record in the national league. the best record in baseball. a lot of that might fall on stephen strasburg. he's one pitcher and one guy on this roster. they feel, without him, have all the talent to win the world series and none of them would blame stephen strasburg for not being with them. >> johnson said his final game september 12, next week. we'll be looking out for that. we saw the team falter on the road. they had the five-game losing streak. was that a blip on the radar? because we have seen them bounce back against the world

champs. >> resilient club. over the course of a season, you'll have some losing streaks. and you know, the nats dropped 5 in a row. they weren't playing great baseball. you look at what they have done, they come back and won five of their last six games. and davey talked about how that losing streak and that road trip might have gotten his guys reenergized for the stretch run. they come into september knowing they are running out of games. they need to maximize every one of them. >> you talk about that stretch. bryce harper out of the lineup today. but not injure related, right? >> just a day off. davey doesn't want to run the kid into the ground. even though he is 19 years old, just a day off. jason worth will get a day off tomorrow. got to get these guys some rest. just taking care of them. >> need them for the long haul. thank you so much. we'll have more on the nationals big game, big series
