we start off with an arrest on the murder of a southeast d.c. mom. phillips' body was found in a creek on august 1. ken molestina is live at headquarters with the latest on this. ken. >> this was one of those investigations that kept police with their hands full. the case is closed. they arrested this man. let's show them your picture. this is joseph jones of capital heights. this is the man that police say is behind the murder of 22-year- old shavon phillips. it was in late july that phillips had gone missing. phillips was later found dead inside a bag, inside of a creek in fort washington. we learned today that the cause of death was asphyxiation and the two were somehow related,

some kind of acquaintances. they also released a motive behind all of this. police suspect this all had to do with some kind of a robbery. they say that phillips was carrying something upwards of $3500 in cash. they believe that was the motive behind this brutal crime. once again, jones, the suspect, right now in custody. prince georges county police continue to talk to him and they are charging him with two counts of murder related to this case. we'll have more tonight at 11:00. back to you. >> thank you. he was in handcuffs and tried to run from police. that's when investigators say a district heights officer shot a man in the back. it happened yesterday at the intersection of county road and foster street. as surae chinn explains, some people are questioning the officer's actions. >> this shooting happened in front of this daycare at a time when parents were picking up their children. around 5:30 last night. police say they stopped the 26- year-old man because he was on

a stolen motorcycle. what happened next? this neighborhood is wondering why. >> got out, grabbed by the hair, and stormed out on the ground, handcuffed him. >> this woman did not want to show her face. she watched the whole incident from the window. the 26-year-old man police identified as calvin kyle, was sitting handcuffed in the front passenger seat of the police car. she saw kyle get out and run from police. >> he told her to stop and shot him three times, hit him twice. >> prince georges county police say sergeant john riley, an eight-year veteran shot kyle in the back. >> shot him, he got past the tree and fell. that's when i must have hit him because he was down to the ground face down. >> this man says the details are reminiscent of another incident. >> reminds me when they shot this, handcuffed behind his back. >> it was twenty years ago,

officers shot a 24-year-old man to death, also handcuffed and seated in the front seat of the cruiser. a few blocks from yesterday's shooting. the officers were never indicted in that case. yesterday's shooting brings brings questions to the neighborhood. >> we are trying to calm them down and make sure they are okay. >> sergeant riley is on paid administrative leave. both prince georges county and district heights police departments refused to go on camera today to talk about the case. in district heights, surae chinn, 9news now. >> no remorse today from michael gardner. the falls church man was sentenced to 22 years after being convicted in may of sexually abusing two young girls. the abuse happened at his daughter's slumber party last year. barring an appeal, gardner won't be out of prison until he is 70 years old and as peggy fox reports, the victims and their families say that's a

good thing. >> in reality, we got one less child molester off the streets. >> when dan picked up his 10- year-old daughter from a friend's slumber party, she told him that michael gardner had molested her in the middle of the night. >> this is crucial that you believe your kids. the moment they speak up. >> that child and the other girl who was molested by gardner that night also spoke up quickly. police were able to collect their pajamas and underpants for dna testing. >> children are often not believed having that dna to back it up was crucial. >> convinced the jury michael gardner was guilty. >> a strong, powerful, convincing evidence. >> he had no apology. he told the judge he was falsely accused and wrongly convicted. his wife and former falls church mayor believes him. >> there's no doubt in my mind that my husband did not commit the crime he has been found

guilty of. >> defense attorney, peter, asked the judge to consider that michael gardner's criminal behavior was an aberration of who he is. and gardner told the judge he was innocent. but the judge looked at gardner and said, the jury didn't believe you and sentenced him to 22 years. >> dan rice says he never expects michael gardner to apologize. >> anybody that knows him, knows he has a huge ego. i don't think he has the ability within himself to admit what he truly is. >> peggy fox, 9news now. >> 9news usually does not identify the parents of children who have been abused, but dan rice wanted to speak on camera and get his message out. maryland's number one ranked high school football team takes the field tonight under a cloud of scandal. five players from catholic and hyattsville snuck prostitutes into their hotel. they withdrawn or face

disciplinary hearings. bruce leshan has more. >> reporter: one of the top high school athletic programs in the country now struggling to explain how five football players could sneak three prostitutes into their hotel room without chaperons noticing. >> the school community is saddened and hurt by the actions of these few who do not reflect the character of the community. >> dematha crushed 55-14 last friday night. after the game, the players allegedly went on the internet and found three prostitutes who allegedly arrived at the hotel sometime after the last 4:30 a.m. hallway check. it is still unclear how school officials found out. >> we come from a faith tradition that emphasizes that we tell the truth and support one another. i cannot either legally or morally speak to any disciplinary matters. thank you so much. >> the all boys school bills

itself as a community of gentleman and scholars, but reaction to the scandal is mixed. >> they are boys, they are football players. i'm not saying it's right, but to throw them out of school, that ain't cool. they paid all this money to go to school. >> i'm shocked because i never knew, you know, the guys in dematha did stuff like that. it's an awesome school academically wise, it's great. >> that was bruce leshan. none of the five players were starters for the football team. a weaker than expected jobs report from the labor department. u.s. employers added 96,000 jobs in august, 30,000 fewer than expected. the unemployment rate dropped from 8.3% to 8.1, but analysts say that's because more people have stopped looking for work. they have given up. on the campaign trail, mitt romney hammered president obama on those job numbers. speaking in iowa, romney told supporters that mr. obama would

bring four more years just like the last four. president obama acknowledged we need to create more jobs and do it faster, but he told supporters congress can get people back to work if members pass his jobs bill when they return to washington next week. mitt romney's wife, ann, was greeted with wild cheers at a women for mitt rally. she says riding helped her battle multiple sclerosis. in a one on one interview, she told me what that diagnosis was like. >> the symptoms were very standard. for most people, numbness in my leg and then increasing numbness and weakness and then, the real kicker was enormous fatigue and that overcame me to the point where i was completely debilitated. >> tonight at 11:00, more from my in depth interview as she appeals to undecided women

voters. what would she champion as first lady? more tonight on 9news at 11:00. nice today for most of the day. tomorrow is expected to be a severe weather alert day. anny hong right now with the details. anny. >> yeah, things are really nice tonight. still muggy out there. it will be muggy once again tomorrow. we are concerned about tomorrow afternoon and tomorrow evening. that's why we declared a severe weather alert day for saturday. here's a look at our conditions today. we are looking at just some spotty isolated thunderstorms out to the north and west of us. really out toward winchester. we had a little one in hagerstown. very spotty in nature and we're looking at a couple lightning strikes. but overall, most of us should be dry tonight. heat index, it feels like 89. 90s in leesburg. all right, so the storms right now that we're going to see tomorrow are out to the west and to the upper midwest and ohio valley. causing severe thunderstorms. tonight, partly cloudy and mild, lows in the mid 60s to lower 70s by tomorrow morning.

new dash board video tonight of a maryland state trooper being hit by a tractor trailer. it happened back in june as trooper david avila stood along interstate 70. avila suffered back, leg, and shoulder injuries from that. he is recovering. the agency released the video to publicize a state law. drivers need to give stopped emergency vehicles an extra lane of space when passing by. take a live look outside right now on this friday night. anny hong will be here in a few

and there are a lot of people who think it's not nearly enough. that's because william fitts admitted to killing his neighbor. and even had pictures of him hanging on her wall. today, her family spoke publicly for the first time and scott broom was with them. >> we learned today here at the prince georges county courthouse that 92-year-old thelma steel loved and trusted the teenage boy across the street. the boy who eventually admitted to murdering her with his pocket knife. thelma steel still independent, vibrant, and loving at age 92 and william roger fitts, here only 15 years old, under arrest for her murder in july of 2011. fitts went on to admit it using her credit cards to buy mock marijuana online and going in and out of her house for four days before her body was discovered. >> my grandmother trusted him. >> her granddaughter said after an earlier break in, she

insisted she wanted to stay. >> she indicated to us that she felt completely safe as long as the fitts let her cross the street. >> it was a fatal misjudgment. >> she had pictures of him on her wall. >> they reacted after the adopted son of a family who sent him to a church run boarding school got 60 years. though steel's family wanted life. >> you need some evidence of premeditation and we just didn't have it. >> she could give him grandma's early advice. >> steel's family say they accept the legal realties for 60 years. they just wish they knew why. fitts at such a young age turned to murder and today when he had his chance to talk in court, he stayed silent. at the prince georges county courthouse, scott broom, 9news

prediction area. the main threat being damaging winds. areas north of us, that's moderate risk where even tornadoes are possible. our 9 future cast again, tonight things are pretty quiet. still muggy out there. overnight it will be quiet. tomorrow morning, looking at partly sunny conditions and then we see a loin of storms with a strong cold front coming through that will come through in the afternoon through the evening hours, dropping in rain, maybe some hail, but the main threat being damaging wind gusts. we'll head over to the east toward the shore and also toward the eastern shore and also to the beaches by 7:00 tomorrow night. behind it, though, dryer and cooler air comes after 10:00. all of us should start to dry out. here's your forecast for tonight. partly cloudy. lows in the lower 70s. mid 60s for leesburg. tomorrow morning, a nice start overall. plenty of sunshine, but temperatures will be getting up
