system to communicate with one another. >> reporter: the coast guard documentation for the glenn has expired. that has the fire chief especially upset. >> it appears the certification for the boat should have been applied for back in august. the date was missed. >> reporter: this was already a used boat when the d.c. fire department got t. they're estimating the cost of repairs about $700,000. what is the status of that fund something. >> we're still looking for it. >> reporter: it was nearly four years ago when a gust of wind helped push the spirit of washington into an f.b.i. boat, a d.c. police boat and finally the john glenn. the 50-year-old glenn ended up with a 15-foot long gash in its hole peeling its back like a can opener. at issue today is whether to continue trying to get grants for repairs to the glenn or start lobbying capitol hill for funds to buy a new state of the art rescue boat. >> there are some challenges internally that the members have figured out how to work around but we need to get the boat in order. >> reporter: bruce johnson,

9news now. in other d.c. news, today the former d.c. council chair kwame brown is scheduled to be sentenced in federal court. in june brown pleaded guilty to bank fraud. he admitted to lying on two separate bank loans valued at more than 200,000. he could face a maximum of six months in jail. prosecutors have asked the judge in the case to sentence brown to six days plus three years probation. president obama is trying to gain support for his plan to avoid the fiscal cliff. today he'll meet with labor leaders. tomorrow he hopes to earn the support of business leaders. friday he'll talk to congressional leaders. the fiscal cliff is a series of tax increases and across the board spending cuts which many economists say could push our country into another recession. congress is also going to be working on the fiscal cliff when it comes back to work today. the house and senate have been in recess since september when legislators took a break for elections. both democratic and republican

leaders say they do believe some kind of deal can be worked out before the end ever the year. newly elected senators from both sides will get a chance to meet their new colleagues. the department of defense is investigating america's top military official in afghanistan. >> the investigation is linked to david petraeus, the former head of the c.i.a. >> reporter: general john allen, the man who succeeded david petraeus as head of the international forces in afghanistan is now linked to the f.b.i. investigation involving his predecessor. >> i want to thank you all so much for being here this morning. >> reporter: secretary of defense leon panetta confirms the department of defense is investigating allen and a senior u.s. defense official says the inquiry centers around potentially inappropriate e- mails with jill kelley, the florida woman who sparked an investigation that led to petraeus's resignation as head of the c.i.a. >> if you know my sister, like i said, she's a dedicated mother and dedicated wife. >> reporter: she first went to the f.b.i. when she left threatening e-

mails from an anonymous source. the e-mails were allegedly linked to paula broadwell. broadwell was having an affair with petraeus and reportedly believed kelley was a romantic rival. the agency would not say what it was looking for, only that broadwell agreed to a search ahead of time. petraeus resigned friday when word of the affair became public. >> it's a tragic turn of events for someone who had contributed so much to this country. >> reporter: general allen is in washington, d.c. for senate confirmation hearings for his new job as head of the u.s. european command. however, president obama has now agreed to put the general's confirmation for that post on hold. secretary panetta issued a statement saying while this matter is under investigation and before the facts are determined, general allen will remain commander of the isaf. general allen denies he's done

anything wrong. tara mergener for cbs news, washington. >> secretary panetta has already named general allen's replacement for afghanistan. the secretary would like the senate to confirm as quickly as possible. closing arguments are set to begin today in the preliminary hearing for army staff sergeant robert bales accused of killing 16 afghanis during the night. several wounded children testified via a military link. after closing arguments, the military will decide whether to move forward with a court marshal. a conviction could lead to the death penalty. new york governor andrew cuomo is expected to request $30 billion in federal aid to rebuild after super storm sandy. governor cuomo says the money will be used to repair infrastructure and pay for emergency costs related to the storm. the new york city council is going to vote on a plan today

to use half a billion dollars to repair public schools and hospitals. 23 schools and two city-owned hospitals are still closed now two weeks after the storm. in boilers, new electrical systems, roof repairs are on the long list of repairs that need to be fixed. also in new jersey they are going to end the gasoline rationing there. it will remain in place in new york city and long island. they expect to have power restored to 99% of customers by tonight. here's a look at some other things making news at 4:35. the deaths of three children, their uncle and grandmother inside a toledo home appear to abmurder-suicide. the woman's husband called police after he shundz suspicion -- he found suspicious notes in the house. they found a truck running with hoses leading to a car in the

garage. investigators believe the grandmother was upset about possibly losing custody of her grandchildren. the awards just keep rolling in for the washington nationals. bryce harper named the national league rookie of the year on monday. he's the first national to get the award since the franchise came to d.c. he's the second youngest player ever to win the award. a former capital isn't doing too badly in the awards category. adam oetes has been inducted -- oates has been inducted into the hall of fame. he went from being an undrafted player to one of the league's elite setup men. oates ranked sixth on the all time league assists list. just about 4:37. coming up morning rain is going to give way to a cool, breezy day. a little sunshine, too. howard is back in two minutes with your forecast. >> more americans are paying their mortgages on time.

behind on their payments fell 5.4%. that's down nearly 8% from the same time last year. also the lowest point since the first quarter of 2009. the rate still above the his tore cal average which is -- historical average which is an indication that many homeowners are still struggling to make their payments. toystoys 'r' us is scheduled to open at 8:00 p.m. on thanksgiving day. they join a crowd of retailers that are opening their doors to shoppers earlier than ever. but more than 150,000 people have signed a target petition calling on the retailer to save thanksgiving and stick to a friday opening time. meantime the traditional thanksgiving dinner is going to cost a little bit more this year. the american farm bureau says shoppers can expect to pay $49.48 to feed ten people. that's an increase of 28 cents from last year. high demand for turkey being blamed for the price increase. if you go to grandma's house,

births dropped from 12.8% in 2006 to 11.7% last year. the improvement comes after a national campaign urged doctors not to schedule deliveries early unless there was a medical reason to do so. a new study finds graphic warning labels on cigarettes are effective. the labels are used in foreign countries and huge on packs of cigarettes. doctors at the medical university of south carolina tested them on thousands of american smokers and most smokers said the pictures made them think about quitting more than print warnings. the fda plan to use the labels in this country but a federal court blocked the warnings saying they wanted more evidence they worked. 3-d technology is making it easier for doctors to detect breast cancer. a new study in the journal of radiology finds it's more effective. it's accurate 91% of the time compared 207% for the standard
