system to communicate with one another. >> reporter: the coast guard documentation for the glenn has expired. that has the fire chief especially upset. >> it appears the certification for the boat should have been applied for back in august. the date was missed. >> reporter: this was already a used boat when the d.c. fire department got t. they're estimating the cost of repairs about $700,000. what is the status of that fund something. >> we're still looking for it. >> reporter: it was nearly four years ago when a gust of wind helped push the spirit of washington into an f.b.i. boat, a d.c. police boat and finally the john glenn. the 50-year-old glenn ended up with a 15-foot long gash in its hole peeling its back like a can opener. at issue today is whether to continue trying to get grants for repairs to the glenn or start lobbying capitol hill for funds to buy a new state of the art rescue boat. >> there are some challenges internally that the members have figured out how to work around but we need to get the boat in order. >> reporter: bruce johnson,

9news now. in other d.c. news, today the former d.c. council chair kwame brown is scheduled to be sentenced in federal court. in june brown pleaded guilty to bank fraud. he admitted to lying on two separate bank loans valued at more than 200,000. he could face a maximum of six months in jail. prosecutors have asked the judge in the case to sentence brown to six days plus three years probation. president obama is trying to gain support for his plan to avoid the fiscal cliff. today he'll meet with labor leaders. tomorrow he hopes to earn the support of business leaders. friday he'll talk to congressional leaders. the fiscal cliff is a series of tax increases and across the board spending cuts which many economists say could push our country into another recession. congress is also going to be working on the fiscal cliff when it comes back to work today. the house and senate have been in recess since september when legislators took a break for elections. both democratic and republican

leaders say they do believe some kind of deal can be worked out before the end ever the year. newly elected senators from both sides will get a chance to meet their new colleagues. the department of defense is investigating america's top military official in afghanistan. >> the investigation is linked to david petraeus, the former head of the c.i.a. >> reporter: general john allen, the man who succeeded david petraeus as head of the international forces in afghanistan is now linked to the f.b.i. investigation involving his predecessor. >> i want to thank you all so much for being here this morning. >> reporter: secretary of defense leon panetta confirms the department of defense is investigating allen and a senior u.s. defense official says the inquiry centers around potentially inappropriate e- mails with jill kelley, the florida woman who sparked an investigation that led to petraeus's resignation as head of the c.i.a. >> if you know my sister, like i said, she's a dedicated mother and dedicated wife. >> reporter: she first went to the f.b.i. when she left threatening e-

mails from an anonymous source. the e-mails were allegedly linked to paula broadwell. broadwell was having an affair with petraeus and reportedly believed kelley was a romantic rival. the agency would not say what it was looking for, only that broadwell agreed to a search ahead of time. petraeus resigned friday when word of the affair became public. >> it's a tragic turn of events for someone who had contributed so much to this country. >> reporter: general allen is in washington, d.c. for senate confirmation hearings for his new job as head of the u.s. european command. however, president obama has now agreed to put the general's confirmation for that post on hold. secretary panetta issued a statement saying while this matter is under investigation and before the facts are determined, general allen will remain commander of the isaf. general allen denies he's done

anything wrong. tara mergener for cbs news, washington. >> secretary panetta has already named general allen's replacement for afghanistan. the secretary would like the senate to confirm as quickly as possible. closing arguments are set to begin today in the preliminary hearing for army staff sergeant robert bales accused of killing 16 afghanis during the night. several wounded children testified via a military link. after closing arguments, the military will decide whether to move forward with a court marshal. a conviction could lead to the death penalty. new york governor andrew cuomo is expected to request $30 billion in federal aid to rebuild after super storm sandy. governor cuomo says the money will be used to repair infrastructure and pay for emergency costs related to the storm. the new york city council is going to vote on a plan today

to use half a billion dollars to repair public schools and hospitals. 23 schools and two city-owned hospitals are still closed now two weeks after the storm. in boilers, new electrical systems, roof repairs are on the long list of repairs that need to be fixed. also in new jersey they are going to end the gasoline rationing there. it will remain in place in new york city and long island. they expect to have power restored to 99% of customers by tonight. here's a look at some other things making news at 4:35. the deaths of three children, their uncle and grandmother inside a toledo home appear to abmurder-suicide. the woman's husband called police after he shundz suspicion -- he found suspicious notes in the house. they found a truck running with hoses leading to a car in the

garage. investigators believe the grandmother was upset about possibly losing custody of her grandchildren. the awards just keep rolling in for the washington nationals. bryce harper named the national league rookie of the year on monday. he's the first national to get the award since the franchise came to d.c. he's the second youngest player ever to win the award. a former capital isn't doing too badly in the awards category. adam oetes has been inducted -- oates has been inducted into the hall of fame. he went from being an undrafted player to one of the league's elite setup men. oates ranked sixth on the all time league assists list. just about 4:37. coming up morning rain is going to give way to a cool, breezy day. a little sunshine, too. howard is back in two minutes with your forecast. >> more americans are paying their mortgages on time.

conditions this morning. i'll be back with more coming up at 4:47. andrea and mike? >> thanks, monika. it's 4:40. time for your first money segment ever the morning gl. here's jessica doyle. >> good morning to both of you. let's hope for a better day than yesterday. wall street looking ahead today to some new economic news. earnings reports from the likes of cisco systems and home depot. stocks finished mixed in light trading. the bond market was closed for veterans day. there were no economic reports. checking the numbers the dow and nasdaq each fell less than a point. really slow day. the s&p 500 was up fractionally. shares of apple will be ones to watch. they slipped yesterday and down 22% from their september high. apple hasn't been able to keep up with demand for the latest versions of its iphone which account for about two-thirds of apple's profits. american homeowners are doing a better joive keeping their mortgages -- job of keeping their mortgages up to date. the percentage of mortgage holders who are two months

behind on their payments fell 5.4%. that's down nearly 8% from the same time last year. also the lowest point since the first quarter of 2009. the rate still above the his tore cal average which is -- historical average which is an indication that many homeowners are still struggling to make their payments. toystoys 'r' us is scheduled to open at 8:00 p.m. on thanksgiving day. they join a crowd of retailers that are opening their doors to shoppers earlier than ever. but more than 150,000 people have signed a target petition calling on the retailer to save thanksgiving and stick to a friday opening time. meantime the traditional thanksgiving dinner is going to cost a little bit more this year. the american farm bureau says shoppers can expect to pay $49.48 to feed ten people. that's an increase of 28 cents from last year. high demand for turkey being blamed for the price increase. if you go to grandma's house,

probably through mid-morning. temps in the 40s. some windchills now down in the 30s. this is after being in the up ir60s and low 70s -- upper 60s and low 70s the last couple of days. we've got the rain around. 8:00 48. by noon we should be partly to mostly cloudy. in fact some sunshine, especially west of d.c. still in the upper 40s with a brisk north wind. 10 to 15 miles an hour for the afternoon. gusting 20, 25. in fact this morning it's gusting close to 30. 50 at 4:00. i think we get enough sun, we could peak up to 52. back in the mid-40s by 8:00. 30s tonight in town. 20s north and west. the front came through. probably heard the heavy rain late last night hitting the windows. behind the front we have the rain. there's been a touch of snow in the mountains on the back edge of this. seeing light to moderate showers in d.c. we've got some breaks to our east right now but more showers are on the way. north and west of town, moderate showers from frederick up toward thurmont,

emmittsburg, hagerstown, smithsburg back into martinsburg. this goes into southern loudoun county, culpeper and out 66 toward strasburg and areas like front royal are seeing some of the moderate rain showers. southern maryland st. mary's, calvert, not much going on. down in st. mary's this is drifting toward the eastern shore and down around reedville and the northern neck we have the showers. everything is moving northeast this morning. temperatures south and east of town still holding on to about 50 but the farther north and west you go, the colder it gets. 42 hagerstown. the upper 20s in garrett county. outside on our michael & son weather camera, good visibility. in fact, just cloudy skies at the moment at reagan national but more showers on the wind. winds north at 16 gusting 28 last check. that's pushing our windchill down to 42 even though our air

temp is 48. here's the big picture. you can see the front coming through now with the rain and showers. a little bit of snow on the very back side of this before it ends in a few spots but in western pennsylvania and west virginia, clearing already taking place. that's what i anticipate us for as we head toward later this morning into the afternoon. we are going to see the rain showers scoot off to the east. in fact, by noon if anyone has seen any leftover showers, down toward maybe the northern neck, the lower eastern shore, north and west of town, maybe into d.c., we're going to start to see the sunshine late this morning into the noon hour. by the afternoon we may see a few clouds lingering southern maryland, lower eastern shore. the rest of us should be partly to mostly sunny, chilly, breezy, upper 40s to low 50s. tonight down in the 20s and 30s. very chilly wednesday morning. wednesday looks to be a sunny but brisk day. again high temperatures upper 40s to low 50s. by thursday perhaps just a few more clouds coming into thursday morning. so thursday partly sunny but not much change in this air

the express lanes open up but you're going to need an ez pass. if you commute with three or more people on board, you can ride for free as long as you have a flex pass. anyone who has an ez pass or smart tag can use the new express lanes which run in both directions from springfield to the dulles access road. >> i think it's great. >> reporter: there are new glance and exit ramps exclusively for the express lanes. two go in and out of busy tysons corner. the tolls will vary. the more crowded, the more expensive in order to keep traffic flowing on the express lanes at or above 45 miles per hour. the tolls pay be as high as $10 each way unless you'll be carpooling or on a bus. >> flex, i think i can use the same one, right? >> reporter: no. you'll need a flex pass if you'll be hoving with three on board. then it's free. peggy fox, 9news now. >> turning our attention to health news, fewer babies are being born premature. the march of dimes found early

births dropped from 12.8% in 2006 to 11.7% last year. the improvement comes after a national campaign urged doctors not to schedule deliveries early unless there was a medical reason to do so. a new study finds graphic warning labels on cigarettes are effective. the labels are used in foreign countries and huge on packs of cigarettes. doctors at the medical university of south carolina tested them on thousands of american smokers and most smokers said the pictures made them think about quitting more than print warnings. the fda plan to use the labels in this country but a federal court blocked the warnings saying they wanted more evidence they worked. 3-d technology is making it easier for doctors to detect breast cancer. a new study in the journal of radiology finds it's more effective. it's accurate 91% of the time compared 207% for the standard
