5:00 tonight. just an hour before the deadline the appeals court granted a temporary stop to his release. moments later we caught up with the family at his attorney's office. >> anyone chat with us for a moment? >> no, we can't. we got to talk to lawyers. >> reporter: their hopes dashed justin wolfe's mother terri steinberg and the family did not feel like talking after hearing the news they dreaded. with only an hour left to the deadline the 4th circuit court of appeals granted a stay in the case. it means justin wolfe who spent 11 years on death row won't be getting out of jail tonight or any time soon. attorney kimberly irving had to break the news to his family. >> how disappointing is this for the family? >> the family is disappointed, but it was not wholly unexpected. >> reporter: what does it mean? >> it is really just slowing it down. the court of appeals has issued the stay, but they've asked for an expedited hearing on it. so it should be heard in their

oral arguments schedule sometime by late january, early february. >> reporter: the family was very hopeful. i imagine they still have hope. >> they do. they do. judge jackson's order and our opinion is the correct order and we believe when everything is flushed out that, should remain. >> reporter: now the commonwealth's attorney has just a few weeks to file briefs explaining why federal judge raymond jackson's order for release should be overturned. at this point the attorney general's office tells us justin wolfe remains behind bars on retrial for murder for hire. i'm peggy fox reporting live in manassas. back to you. a mack truck smashed into a car and there are five teenage boys inside this afternoon. police say the teens were pulling out of the parking lot of the mount hebron high school in ellicott city. one of the teenagers is in critical condition. the other four are expected to

be okay. i had to have somebody take me to show me where the cafeteria was to get some coffee. it's a little odd being a 54- year-old freshman. >> nearly 100 new members of congress sworn in today, this group of lawmakers the most diverse in history with a record number of women and minorities taking the oath. among the new lawmakers virginia senator tim kaine and maryland congressman john delaney. the 113th congress has a lot of work to do. in the first few months lawmakers face a looming government shutdown and a battle over the debt ceiling and automatic spending cuts. >> what just happened with the debt and deficit and taxes, that doesn't go away. >> this is the reason that i ran for congress, so while it's daunting this is what i'm ready for. i'm here to work. >> the first major vote will come friday when the house takes up part of the superstorm sandy relief package. also today the house voted to retain john boehner as speaker

of the house. critics call grover norquist the single biggest impediment to a budget deal. you might think he'd be lying low as some of his allies passed a $666 billion tax increase, but bruce leshan reports norquist is keeping anything but quiet. >> no. i'm disappointed that we weren't able to continue all of the 2001, 2003 tax cuts. >> reporter: grover norquist's days are filled with media interviews and he's putting his best spin on the first republican vote to raise taxes in 22 years. >> they were scheduled to go higher if congress hadn't acted. they were scheduled to go higher on everybody. >> reporter: 238 members of the house and 41 senators have signed norquist's pledge never to raise tax rates on anyone and he insists the new year's day vote did not break that

promise. >> so on december 31st they would have broken the pledge. at the stroke of midnight they're no longer breaking the pledge. >> no. there was no vote they could cast that would stop. it so the republicans are livid, unhappy, grumpy about that and i think we'll spend the next two years focused on the obama white house and the fight on spending. >> reporter: norquist says it is one, two, three. the sequester, the budget and then the debt ceiling, all ground that plays to the gop. >> the president says he will not negotiate over the debt ceiling. this is money that congress has already spent. pay your bills. is the gop really willing to shoot america's credit rating in the head to extract some spending cuts? >> well, you have to ask the president is he willing to damage our credit rating to keep spending money that he doesn't have? >> reporter: it is a fight that has been going on since before reagan's presidency.

>> the obama tax hike. >> reporter: and norquist plans to keep fighting. bruce leshan, 9 news now. homicides here in washington d.c. down 58% from just five years ago. that's a big headline from a news conference held today by mayor vince gray and police chief cathy lanier and matt jablow joins us now from mpd headquarters. lanier is saying they're not satisfied yet. >> reporter: last time there were this few murders john f. kennedy was president and police chief cathy lanier wasn't even alive. a lot has been accomplished, but a lot of work remains. that was the message today from d.c. mayor vincent gray and police chief cathy lanier. >> every corner matters. >> reporter: who proudly announced a 19% decline in homicides last year from 108 in 2011 to 88 in 2012. >> our goal is to get that down to zero. >> reporter: the fewest number

of homicide says since 1961 and 391 murders less than 1991 when there were 479 murder victims in the city. >> most places homicide numbers are about 87 to 95% fire apartment related and we've kind of been -- firearm related and we've kind of been able to drive that down by targeting illegal firearms here. >> reporter: in addition to focusing on illegal guns and breaking up gangs, the chief says the steady decline could largely be contributed to the increasing use of technology by the police department. >> we use every means of technology available to us, the text list serves, facebook, twitter, youtube. >> reporter: having said that chief lanier and the mayor both pointed out that not all the crime numbers are heading the right direction. after several years of steep declines overall violent crime was up 3% last year and assaults with a deadly weapon were up 6%. >> there's so many factors that go into changes in crime rates.

>> reporter: nancy levine is the director of the justice policy center at the irvin institute in washington. she said even though the police department should ab lauded for its role in significantly reduce-- should be applauded for its role in significantly reducing violent crime, the city's changing demographics have played an important parole as well. >> absolutely. i think that does come into play with the homicide drop in d.c. >> reporter: though we're just three days into the new year, 2013 is continuing the positive trend. so far this year nobody has been murdered here in the district. >> we'll hope that trend keeps going a while. right now family and friends are gathering to remember officer chris yung, the prince william county officer who died in a crash while responding to a call new year's day. tonight's wake at the hilton memorial chapel runs through 9 p.m. and his funeral will come tomorrow morning at the same location. classes, recess and homework are now part of the

healing process for the kids from connecticut sandy hook elementary school. students returned to class for the first time since that nightmare shooting three weeks ago when adam lanza killed 21st graders, six educators, then himself. that school is still a crime scene. so students are using a refurbished school a few miles away. >> they were happy. they were happy to see each other, hugs and kisses and the teachers are happy to be back with their students and finding part of the healing process to be together again. >> the new school has been renamed sandy hook elementary. coming up tonight in your only local 7:00 news, d.c. delegate eleanor holmes norton will join me to talk about the upcoming inauguration and there is a startling new study out there about the number of people who get behind the wheel who are feeling a little sleepy. we'll talk about that at 7:00. still healed this half hour of 9 news some amazing -- still

a judge sentenced a man to jail for making fun of his name. bill bailey lives next-door to a little girl with cerebral palsy in canton, ohio. 10-year-old hope needs two crutches to move around. well, bailey was caught walking on camera with a limp near the family's home and the two families have had a long standing feud, but bailey claims the limp was the result of a work injury. bailey was charged with menacing and sentenced to 29 days in jail. that's crazy. are you tired of those annoying robocalls? i am just done with them. we're not the only ones. >> no. the federal trade commission hates them as well and they want your help to get rid of the robocalls. they're asking for suggestions.

hundreds of cars and trucks, even some police cruisers all shot at with bb guns. who is doing it? arlington county police believe they've captured the culprit. under arrest are alexander chase, william romero and ricardo reynoso jr. all of arlington. police believe these three shot out hundreds of car windows over the past several months across the area. some four-legged friends will proudly march in the inaugural parade. a group of trained assistance dogs will represent canine companions for independence, the nation's biggest nonprofit that provides free canine helpers to people with disabilities. imagine's best friend vastly improves quality of life for his or her owner. >> he's very nice. >> reporter: sagin is a service dog for 19-year-old caroline elkins who lives with

her family in middleburg, virginia. sagin was trained by canine companions for innocence or cci. the mother learned about the group when her daughter got surgery for cerebral palsy. sagin is a highly trained skilled companion for caroline provided for free by cci. >> she used to be very shy because she had a little speech impediment and sagin has given her amazing confidence. >> reporter: speaking through ipad technology caroline is overjoyed to be able to be in the inaugural parade with her dog. >> i'm really excited about being in the inaugural parade. >> reporter: like all cci dogs sagin was prepped and trained from the moment of birth. after the puppies are weaned they're assigned to a volunteer puppy raiser, people like gail griffith who teaches basic commands. >> i started out wanting to be with a dog after i met all of the cci people and the graduates that i was doing something that made a real difference to somebody else's

life. >> reporter: all cci dogs are black labs, golden retrievers or a mix of the two. >> this class allows us to practice our commands. >> reporter: at age 1 1/2 the dogs leave their volunteers and they head to long island where they get more formal training learning more than 60 commands. only 40% of the canines pass this stage of training and those are then placed into service. >> sagin has been the best thing that we've done for our family. >> today is sagin's birthday. canine companions for independence says training each dog costs about $45,000. cci is looking for more volunteer puppy raisers. go to our website for more information and look under our inauguration button. >> you just made it. >> what do you mean? i've been here for five minutes. >> really? >> yes. hanging on every word. >> we should show people the video. >> we have no video.
