. this is 9news now. the guns bank. tomorrow members of the national rifle association and representatives of the entertainment industry will meet with vice president joe biden, the vice president has been tasked by the president to come up with new recommendations on how to quell the nation's gun violence. >> we're reaching out to all

parties on whatever side of this debate will call. >> by that reaching out may have limits. >> yes. the vice president raised some eyebrows with another remark today signaling what may be a constitutional fight. that is, if the administration tries to take unilateral action against guns. gary nurenberg is here with that. >> reporter: the administration will likely reveal next week a legislative package to deal with the gun issue, but today the vice president indicated the administration may go around congress and act on its own as well. it came out of a meeting with victims of gun violence and advocates of gun control. >> the president is going to act. executive action can be taken. we haven't decided what that is yet. but we're compiling it all. >> reporter: the right jumped on that executive order line. >> it can only be to take guns away from people. >> reporter: and who knew that an executive order can trump a

constitutional amendment. >> can president obama take our guns? >> no, he cannot. i hope he knows that. >> reporter: lewis fisher is with the constitution project, author of american constitutional law. >> there may be some things he can do. i don't think he can do what he would like to do to do something about the semiautomatic weapons. i don't think he has any authority there. >> reporter: cbs reports the legislative package independent of any executive action is likely to include a plan to reinstate the assault weapon plan and to extend criminal background checks for gun buyers. it might include having more state and federal agencies see the national database. but fisher wonders about that executive authority line and the president's grasp of the constitution. >> i have not seen any great understanding by him as to what the constitution is. i don't see any understanding by him that he has to work jointly. that there is a big disk on

claiming inherent unilateral authority. i don't see that he's supposed to be an expert. he's supposed to have taught constitutional law. i don't see it yet. >> reporter: one scholar's opinion. now, we are not clear on what mr. biden meant by executive orders and actions, but we are clear that the administration will face a legal fight if it acts without firm con -- congregational grounding. some type of administration plan probably next week. >> thank you, gary. wal-mart has changed its mind. it will participate in the meeting with vice president biden's gun task force tomorrow after all. originally they said executives couldn't be there because they had sales meetings and that decision had been widely scrutinized. many questioning how wal-mart could be a part of the discussion without listening to what other parties were saying at the white house. so in response, wal-mart now says its people will be there. here in washington, a fraternity of sorts exists of men who survive gun violence on

dc street. many are wheelchair bound because of their injuries and now as the gun debate rors on, so do their thoughts on the issue. a ken molestina caught up with one of these guys. he's live now with that story. ken. >> reporter: corey davis, the man you're about to meet, has been confined to a wheelchair for about 13 years now. he never thought much about gun control until the day he was shot. as he sits at home in his apartment. >> i can't ever forget that. >> reporter: corey davis reflects on the day that forever changed his life some 13 days ago. >> next thing i tried to smack him with a brick. >> reporter: a street fight, he says, that led to a still unknown person pulling out a gun and shooting him. the bullet went in the left side of his neck and came out of his back. >> went straight for the ground and i couldn't move my arms or legs. >> reporter: he was left paralyzed from the neck down. therapy later helped him regain feeling and control of his arms and chest, but that's about it.

the one thing that wasn't severely damaged were his thoughts on what he has come to describe as a city overrun with illegal guns. >> dirty weapons. that's the problem. dirty weapons. those are the ones that the law enforcement need to get off the street. >> reporter: and although the current gun laws are more cumbersome than neighboring maryland and virginia, he says he knows there are too many guns in the hands of people wanting to cause harm. >> the law enforcement do get some of the guns off the street, but it's hard to get all of the guns off the street. >> reporter: this 33-year-old admits his actions led to him being shot. still, though, he thinks if gun control laws were tougher back then, perhaps he says he would have never been left paralyzed. >> as far as 13 years ago, i think it would have saved me. >> reporter: is as our country moves forward with the debate on gun laws, he offers his thoughts to leaders who will undoubtedly be looking to track up new legislation. >> make it stronger, harder. make it harder for people to

carry these weapons on the street. >> reporter: davis did tell me he doesn't have a problem with legal gun ownership for those that can justify having the guns. it's the so-called duty guns he's worried about. anita. >> absolutely, ken. thank you. a georgia woman and her kids might not be alive today if she doesn't have a gun. at least she thinks so. the woman was home with her 9-year-old twins when a man broke into their home. she grabbed the kids, her handgun and they hid in an attic crawl space. the 32-year-old man found them. all this time she's on the phone with her husband who is talking to 911 dispatchers. listen. >> she shot him. she's shooting him. she's shooting him. shoot him again. shoot him. oh, no. >> okay. the man was shot five times but survived. he's under arrest and facing

lots of surgery. oh; boy. a colorado judge will decide by friday if james holmeses will go on the -- holmes will go on trial for the massacre inside of a movie theater. today they showed the photos holmes took on his iphone. he had orange hair, black contact lenses and i wild grin as he flashes a glock pistol. another shows holmes sticking out his tongue. there were photos taken inside and outside the theater including an exit door which he propered open the night of the attack -- propped open the night of the attack. there were guns and armor laid out on his bed. holmes seemed to smile when he saw the photos come up in court. >> he was delighted to see himself on the screen. we were all sitting there trying to hold our emotions. and he was very excited to see himself. >> he was smiling. having a hard time controlling

himself. >> holmes attorney presented no evidence. he said a preliminary hearing is not the place to "put on a show" and present a partial defense. if the judge decides to air rain holmes -- a rain holmes -- arraign holmes, cameras will be allowed in the courtroom. rj iii had surgery today. >> they repaired his acl and performed what he called a redo of the original acl repair griffin got done in 2009. dr. andrews said the surgery will give griffin the best opportunity of a long professional career. aside from the successful surgery, the good news is the recovery time is less than originally expected. andrew says about 6-8 months until griffin can return to the field. andrews released a statement shortly after surgery today saying in part we expect a full recovery and it is everybody's hope and belief that due to his

high motivation he will be ready for the 2013 season. now, of course, we've seen how motivated griffin is and what kind of work ethic he has. so return of the 2013 season definitely not out of the question. let's just hope it's the right decision. anita. >> thanks, kristin. now, the information i got today on recovery and rehabilitation after the surgery for most people in the 8-12-month range. orthopedic surgeons have a lot of experience to go on. there are about 250,000 acl tears in the country every year. and there are cool new devices and therapies to help people heal. today at the hospital, i met 14-year-old carly dorsty of alleghany. she needed surgery after landing on someone else's foot in a volleyball game. how is things going after the surgery? >> good. the recovery is great. my knee is coming along and i should be back to playing any time soon. >> reporter: and on that note, you are on one of the coolest treadmills i have ever seen.

coming into the picture, we have her physical therapist revving this thing up for us. what does this thing do? >> pretty much the machine has differential air pressure technology. >> reporter: it's blowing up air. >> there is specific sensors around the treadmill that we can pretty much use to calibrate for what body weight we want her in. >> reporter: this is actually countering her body weight and countering gravity. >> yes. taking the pressure off the tissues. >> reporter: so what can she do because it's doing that? >> this allows us to get them running and getting range of motion and getting all of those muscles back in a lot earlier. >> reporter: carly, can you demonstrate for us? >> sure. so we're putting it down to 75% body weight and then gradually increasing the speed. >> reporter: and with that she starts walking and even can run. and is it safe for her to do it in here? >> definitely. especially during the early stages of rehab. you don't want to be putting a

whole lot of impact on the healing tissue. >> reporter: so right now she would not be out running without this thing? >> definitely. correct. >> reporter: pretty cool. thank you so much. >> thank you so much. >> reporter: carly, you rock. >> thank you. >> reporter: and whether you're a pro or a regular athlete, acl begins with stretching, strengthening, walking and finally running. new at 11, dc police arrest one of their own. and the child, child sex abuse in the first degree. the officer, wendel palmar. he had been on the force for 22 years and now he is on leave pending the outcome of the case. and things were shaking in virginia tonight. an earthquake that measured 2.0 on the richter scale hit around 6:30. i'm sure many of you will not remember there has been a first time there's been a quake down there. this was also the epicenter of the huge quake we all felt back

disgraced former cycling champ met with the ceo of the doping agency to talk about the possibility of some kind of grand public confession. usa today sports writer and wusa9 kristine brennan says sources are saying that armstrong is seriously talking about coming clean about his alleged use of performance-enhancing drugs. but tonight, brennan told me it's likely too little too late. >> it was two months after he was basically kicked out of the sport and he's already trying to angle his way back in. >> usa today sports reporter kristine brennan on why she thinks lance armstrong met with the u.s. doping agency last month to hint at a possible confession after having his seven tour de france wins snapped away and a ban for competition for alleged doping. >> and he thought the world anti-doping agency and to think that he already requested and had a meeting with those people to see if he could apologize, it's mind boggling. >> armstrong apparently walked

away from the meeting with no deal in hand. but brennan wrote the story just as we learned that armstrong will be joining oprah next thursday for a 90-minute no holds barred interview. >> he wants to be able to have a quick apology with oprah and then come right back to doing his triathlons and his marathons venl the reality is -- the reality is he's banned for life. and even if he comes clean and gives all of the information about everyone else cheating, it's still an eight year ban. >> armstrong has become a cultural icon. his work on behalf of people with cancer was perhaps even more legendary than his athletic powers. but brennan believes much of the sympathy is now swayeded and he did what he had to do where so many others were cheating as well. >> he was one of many to do it. he did it worse and longer and in a more ruthless fashion than

anyone else. now to a health alert that offers up a word of caution about sipping too much soda. a new study links artificially sweetened drinks to depression. those that drank more than four cups of diet soda a day were more likely to develop depression. what's odd here is coffee seems to have the opposite effect. people that drank more than four cups a day were less likely to have depression. well, president obama will have an all star musical line up when he is sworn in. beyonce sings the national anthem. kelly clarkson sings my country 'tis of thee. the white house had a hand in picking the singers. here is something you probably didn't want to know about your fellow neighbors in dc. they're watching a porn. and i do mean a lot.

according to the website, washington dc residents watch more porn than anyone else. in fact, they watch an average of 14 videos per year. behind dc, hawaii. they watch 7.5 videos a year. christmas they say was a pretty quiet day over at old point hub, but two days later they had their busiest day of the year. go figure. >> what are you watching? what are you watching? talk about some serious things like insect. flu. that sort of thing. so check it out. let's start with our live weather cam. michael and son weather cam. again, 50 was the high. our average is 42. it's still 47. this is still a bargain day, believe me. winds have finally turned now. the trouble is it is slow to clear. winds northwest at 8. the pressure recovering. mere is the storm we're tracking -- here is the storm we're tracking. it looks like april. thunderstorms back into the texas panhandle. big time thunderstorms in louisiana headed into arkansas. actually some local flooding going on right there. and we're looking at this storm moving almost due north which is almost, again, like an april track. not like a january track. but the good news is it's going to move so far west and north it's going to pull up a lot of warm air. especially over the weekend. in the meantime, we can't get rid of the clouds. tomorrow morning we may see some lingering clouds in southern maryland. i think you folks gaithersburg and loudoun county and west will

be clear. maybe some residual clouds early in the morning. grab a jacket either way. it's mild, but it is still january. grab your sunglasses as well. a little cooler tomorrow. we're kind of slicing hairs at this point. showers for friday but not a washout by any means. you can still get some stuff done. now, let's talk about overnight. i thought we would be clear by now, but we're not. a one blanket night. lows 32-40. now, by morning mostly sunny and chilly. you still need a light coat. 30s and 40s. kids too. winds out of the notre west at 10. -- northwest at 10. partly cloudy and cooler. that will keep temperatures near 50 and drive some clouds in here late in the day. for the most part if we tell you back in july that january 10th is going to be partly cloudy and cooler, highs near 50, we would take that. a few clouds late. a few showers.

good news robert griffin's knee surgery was a success. he's expected back within 6-8 months. sooner than thought. but now moving forward, things will change. hopefully. they have to change with if the skins -- change if the skins plan to keep their quarterback. and whether you decide to keep him in the game, one thing is for sure. a mistake was made on sunday. earlier today i talked with kristine brennan and darrell green. they both agree someone needs to own up to the mistake. >> rgiii is a young man who we care very much about. he's also the franchise. and you cannot make that kind of mistake. >> i agree with that. in retrospect, he blew it. and i would wish he would say i blew it. i would love that. >> i made a mistake. >> but with what he did, i agree with i just like the retrospect out of it. >> they're talking about mike shanahan there. now, as griffin starts his recovery, another dc star returning from his own injury. john wall returned to practice
