nigerian military escorts had trouble finding the road to get there. this is where the 12-member american team and 13 nigerian soldiers stopped to get supplies. villager adamou bubaker told us he saw three or four armed men on motorcycles approach the u.s. convoy. he was so nervous he walked 25 miles to speak to us at another location. "we thought it was just a few terrorists the soldiers can kill them easily," he said, "but we didn't know there were so many more of them waiting nearby. it was a trap." once the isis fighters managed to lure the troops away from the village, their numbers multiplied and suddenly they were under attack. you can still see the bullet cases left over from the intense shooting. the burnt-out shell of a school, blood-stained bush, an empty boxes of ammunition are all that's left now. bubaker told us there were at least 60 attackers armed

rocket-propelled grenades. the fighting lasted over two hours. when it was over, he said he saw the bodies of three american soldiers slumped near their vehicle, all three were stripped of their uniforms. but it would be two days before children from the village discovered the forth body of sergeant la david johnson about half a mile away. it's still not clear how johnson got separated from the rest. this soldier would only talk if we concealed his identity. "he had been stripped of his uniform," he told us. "his hands were tied and they shot him in the head." the pentagon would not comment. there is still some confusion over why this american team had their mission extended and what exactly their assignment was, but either way, it meant that they camped out overnight in dangerous territory, and that, anthony, might have alerted the extremists to where they were.

>> mason: debora patta with some remarkable reporting tonight. nigerian forces were is concerned about security in that village they would only allow debora to stay there for 15 minutes. we have breaking news tonight. sources tell cbs news new york city police have brought prosecutors new rape allegations against hollywood mogul harvey weinstein. jericka duncan has the latest. >> reporter: actress paz de la huerta says in october 2010, harvey weinstein offered to give de la huerta a ride home to her new york city apartment after party because the two lived in the same neighborhood. she says weinstein insisted they have drinks. the pair eventually ended up inside her apartment. that's when she alleges weinstein took off her dress and forced himself on her. i spoke to her by phone. >> he pushed me on the bed, unzipped his pants and it happened all very suddenly. >> reporter: more than a month later she claims she confronted weinstein at f

weinstein kept calling her. on december 23rd of the same year, she says weinstein showed up in the lobby of her apartment. they went upstairs, and de la huerta alleges he raped her a second time. de la huerta has been in numerous films and starred in hbo's "boardwalk empire." >> i want to see what it looks like on her. >> reporter: the accusations follow more than 50 allegations made against weinstein. the police have assigned a senior sex investigate to watch this case. weinstein had denied allegations of non-consensual sex. de la huerta says at the time of the alleged second rape she had been drinking and was in no shape to have consensual sex. >> mason: jericka duncan, thanks. house republicans rolled out

they say it will cut taxes for middle-income earners, but democrats say, no, some will get a tax increase. chief congressional correspondent nancy cordes now on what is in the plan. >> it's what they promised, and it's a great product. >> reporter: g.o.p. lawmakers were jubilant today. >> it's extraordinary. >> extraordinary? >> extraordinary. >> reporter: after party leaders unveiled an ambitious set of tax cuts worth $1.5 trillion or more. >> the typical family of four will save $1,182 a year on their taxes. >> reporter: the plan would slash the number of individual tax brackets from 7 to 4. the top rate would remain at 39.6%, but it would only apply to households making $1 million or more. the median household making $60,000 a year would see its rate drop from 15% to 12%. >> we are giving them a big,

beautiful christmas present in the form of a tremendous tax cut. >> reporter: and republicans say there is more. they want to double the standard deduction to $12,000 for individuals and $24,000 for married couples. they also want to expand the child tax credit from $1,000 a year to $1,600 and repeal the alternative minimum tax. but democrats noted that the g.o.p. proposal would also eliminate deductions for student loans and medical expenses and it would slice the mortgage deduction cap for new homes in half, from $1 million to $500,000. >> what they give you with one hand they take away with the other. >> reporter: 401(k) contribution limbs and charitable giving deductions would remain unchanged. the most lucrative cuts would go to u.s. businesses, including a permanent reduction in the corporate tax rate from 35% to 20%. >> we are focused on increasing

>> reporter: congressman kevin brady of texas is the bill's chief author. >> the bush tax cuts didn't lead to growth or higher wages or more jobs. in fact, quite the opposite. so why are you so sure this will be different. >> reporter: a complete redesign of the code. that's not just putting higher octane fuel in an old clunker of a tax car. we from posed to drive a newer tax car that can compete and win against any country in the world. >> reporter: handful of republicans are already raising objections tonight to changes to the mortgage deduction and to the elimination of a deduction for state and local income taxes. g.o.p. leaders, anthony, may have no choice but to negotiate, because they're going to need near unanimity in their party in order to get this through the house and senate. >> mason: nancy cordes at the capitol. thank you, nancy. new york city began putting up concrete barriers today to prevent cars from entering the

in a truck mowed down pedestrians and cyclists. eight people were killed, a dozen injured. michelle miller has new video of the arrest. >> reporter: this is the moment terror suspect sayfullo saipov was captured by new york police. the newly released cell phone video begins right after saipov was shot by 28-year-old officer ryan nash as he tried to flee after using a rented truck to drive down a west side bike path. he drove for a mile, killing eight, before crashing into a school bus. >> oh, my god. >> reporter: police found fives and notes praising isis inside the truck, and according to court documents recovered two cell phones. a law enforcement source tells cbs news authorities tracked the numbers on the phone and have linked them to sympathizers of a radical cause who were already on new york police radar. the source

calls to some of those numbers the day of the attack. >> there's no point thinking about the what ifs. >> reporter: five days before the attack, london-based graphic designer damian erskine and his girlfriend were inside saipov's uber car for an hour. he picked them up at newark airport. >> obviously you don't get to know someone in an hour, but you get a vibe from someone, and there was nothing that would give you any sense obviously of what was to come. >> reporter: sources close to the investigation say an associate of saipov who they were looking for, mukhammadzoir kadirov, has now retained a lawyer and is set to be questioned by authorities tomorrow. anthony? >> mason: michelle miller, thanks. president trump put himself right in the middle of the saipov case and may have made things more difficult for federal prosecutors. here's chief white house correspondent major garrett. >> reporter: two days after the new york terrorist attack, president trump made clear he is ready to sentence the

suspect. "should move fast. death penalty," mr. trump wrote on twitter. "should get death penalty." this was the president yesterday. >> we need strong justice, much quicker and much stronger than we have right now. because what we have right now is a joke and it's a laughingstock. >> reporter: tweeting about the death penalty this early in the case could complicate matters for justice department prosecutors. >> does the president have any sentencing authority? >> no, he does not. >> reporter: john wood is a former u.s. attorney. >> it gives the defense attorneys an argument that the jury pool has been tainted and their client can't get a fair trial. the second way it can complicate things is you could have somebody on the jury who is anti-trump, and so it could have the opposite effect of what he intended. >> are you going to pardon paul manafort? >> thank you. >> reporter: the president also faces another potential legal pitfall, robert mueller's investigation of his campaign's dealings with russia. today his former

deputy campaign manager rick gates appeared again in federal court, both under indictment for must be -- money lawntering and making false statements. allies of the president say mr. trump is bothered by the publicity around the investigation but does not fear being charged himself or being it peached. the president maintains there was in collusion between his campaign and russia. sam clovis, the trump campaign cochairman implicated in the russia investigation, today withdrew his nomination to a top science post at the agriculture department. also mr. trump's son-in-law, jared kushner, has turned over to the special council's office documents related to his role in the firing of f.b.i. director james comey. anthony. >> mason: major garrett at the white house tonight. thanks, major. tripadvisor, one of the most popular travel web sites, is accused of deleting customer reviews that raise red flags about potential dangers. tony dokoupil now has looked into this. >> he

and i pushed him off with the other arm, and i was thrown in the bushes. >> reporter: kristi love was on a beach getaway when she says she was raped by a security guard at the highly rateddive berostar paraiso maya in mention we's yucatan peninsula. >> i was hysterical. >> reporter: when she reached the lobby, love says the staff refused to call police, something iberostar dispute. a few days later the hotel said they would help her pursue justice. she says when they didn't... >> my next greatest weapon was tripadvisor. >> reporter: but love's review was rejected as not family friendly. >> it was deleted within a couple hours every time i posted. >> reporter: trip adviser is now apologizing seven years after the incident. finally reposting love's review last month. but finding her review is not easy.

"reare horrified," a tripadvisor spokesperson told cbs this week, and other travelers should be aware of this incident. love's comment came too late for 34-year-old jamie valeri, who says she was sexually assaulted at the same resort two years ago. she also tried to warn others but says her post was rejected by trip adviser. >> every time i posted it would come down. i would get a generic e-mail back saying i didn't meet their requirements for posting. >> . >> reporter: more then a dozen other travelers say trip adviser scrubbed their crime-related review, too. trip adviser told us crime, such as robbery, theft, and rape, are being published. but a search of the site suggests the rules may be unevenly applied. kristi love wonders how many other horror stories are out there. >> i have gotten such a response of people, it's just opened their eyes. >> reporter: trip adviser makes most of its revenue from commissions on hotel bookings
