from the courtroom during the trial: set to begin march 21. sources say rankin has witnesses who say he had no choice but to shoot 18 year old william chapman the second saying chapman was the agressor outside the frederick boulevard walmart last year. with the rankin trial in mind, the new portsmouth police chief, tonya chapman, says-- transparency will be a top priority at the department. chapman was sworn in this morning. she is the first african-american woman to be police chief there, and she says she wants to build trust with the community. "transparency and accountability leads to legitimacy so that is extremely important to me and it has been important in my career to up hold the highest ethical standards and to hold others accountable as well so i will be as transparent as possible" just before new chief took her oath, william chapman's family gathered to peacefully walk to city hall. they say they support the new chief, but want her to know they're watching.

tell her this morning that the time for justice is always right now" william chapman's mother sally met chief chapman after the ceremony. they say they are going to sit down soon and talk. lawyers want to revisit the scene of a deadly police shooting in norfolk. they were arguing the motion today in the case of michael edington junior. the nofolk police officer faces manslaughter charges in the death of david latham from 20-14. police say latham threatened them with a knife before edington opened fire on west 30th street. latham's family says he suffered from mental illness. a veteran virginia beach police officer is in jail tonight -- accused of driving under the influence. fellow officers pulled sergeant margaret hobbs over last night. jail records show she had a child in the car with her. 10 on your side's liz palka joins us from newsroom.

nicole - the people we have spoken to within the department are stunned. she's been with virginia beach police for 17 years and is highly respected. they also say hobbs got into some sort of accident right before she was arrested. a virginia beach police sergeant arrested for driving under the influence. virginia court records show sgt. margie hobbs' blood alcohol concentration was more than twice the legal limit. and that she had a child in the vehicle with her. c50 1:03 - the crook isn't going to place a device on there for permanent purposes. they're going to come back and get it. 10 on your side file video from 2011 shows hobbs when she served as officer. a police spokesman says she now works in the investigative division and has been with the department for 17 years. master police officer jimmy cason released few details on hobbs' arrest - other than it happened on sunday in the early evening. however, police sources tell us some sort of accident happened near the oceana nas dam

and that hobbs did have a child in the vehicle with her. c84 :43 - our officers coordinated with norfolk's swat team and homicide squad. sources tell ten on your side they're shocked by the charge. they say, when hobbs decided to become a sergeant she was at the top of the department's list. adding, they wouldn't expect this from her. hobbs is currently being held in the virginia beach city jail. she will have a bond hearing early tomorrow morning. i'm liz palka, 10 on your side. tonight two people are locked up -- after virginia beach police say they robbed a woman at knifepoint and abducted her. 22-year-old ronnie anderson is also accused of sexually assaulting the victim. police couldn't show us the second suspect because he's underage. 10 on your side's erin kelly has been working to learn more from nearby businesses off northampton boulevard. erin? most of the surrounding businesses would have been closed at the time this is alleged to have occurred. but there may be surveillance video -- and

what that could show. virginia beach police say it started here -- at the wingate by wyndham hotel on burton station road. around 12:30 am sunday -- officers say a woman was about to get out of her car -- when 22-year-old ronnie lesha anderson came up to her with a knife and demanded something she had. then, police say an underaged male who also had a knife, took the woman's purse. when that didn't turn up anything of value, police say anderson forced his way into the woman's car -- and sexually assaulted her. staff at the wingate tell 10 on your side they're not aware of anything happening on their property, but they're looking at surveillance video. after the alleged assault, police say the suspects forced the woman to drive to an a-t-m at this 7-eleven on northampton boulevard and baker road. it's there -- that police say the woman was able to escape and get help inside the building -- while the suspects ran off. employees there tell 10 on your side they do not know what happened. police say later sunday morning -- officers with

wind: ese 15-25mph g.35. local cities may be passing up a money- making opportunity. there's a law saying they can collect reimbursement -- for expenses related to d-u-i cases. investigative reporter chris horne is looking into why some cities are leaving money on the table, by failing to fine. take sot pkg eight years ago, ronald mcclenny had an idea. sergeant wanted d-u-i offenders to reimburse the city for services connected to their crime -- fire and rescue, tow truck, and repair work to public property. c 1 00:49 ronald mcclenny retired police officer -- i knew this was money that could be collected and it wouldn't take much effort to collect it the city passed the law and mcclenny even won an award for his idea. a few years later he wanted to see how the dui ordinance was helping the city's balance sheet. c 1 - and found the same thing - the fee is on the books but
