groundbreaking day. after decades of lawsuits and red tape, crews begin working on a new lifeline for the outer banks. and a local city calls out a candidate for mayor for what he told us! we'll hear from both sides about police officer staffing. first let's begin with that breaking news in california. deputies say a tree on the tracks caused a commuter train to derail last night. firefighters say 9 people were hurt; 4 have serious injuries. the sheriff's office said it was a miracle no one died. the front car of the train fell into a creek below. you can see in this video a train car is under water. crews worked overnight to pull that train car out of the creek. the train was traveling from san jose to stockton. officials said it was raining heavily during the accident. we'll be following that story throughout the morning. now it's time for a check of your weather and traffic. jen lewis is keeping an eye out on any problems

happening today a major milestone on the outer banks - north carolina officials will break ground to replace the crumbling bonner bridge in dare county. crews built the current bridge, crossing the oregon inlet, in 19-63. it was expected to last only 30 years, but budget concerns and legal issues kept

rico bush joins us this morning in the studio with more on the the project 10 on your side has covered for years. rico. after years of fighting with environmental groups over the project, n-c-dot plans to finally move forward on a new span. these are pictures of the bonner bridge being built more than 50 years ago. for years, dare county officials spent millions repairing and maintaining the bridge due to decades of delays on a replacement. environmental groups, worried about the project's impact on wildlife, challenged the state in court and prevented it from moving forward on a new one. the groups eventually reached a settlement, giving the state a green light to structure. c0007 - governor pat future generations, is going to be a great attribute of connecting not only our two states, but the entire atlantic coast. 3340 here's a computer rendering for the new officials say the 3-point- 5 mile bridge,

determine whether or nto additiaonal resources are needed the police cheif...the curretnt police chief should make that case known. norfolk residents will elect their next mayor on may 3. this morning two people are behind bars charged in the murder of a norfolk man. police found a man, shot, in the driver's seat of a minivan on kingston avenue over the weekend. that's in ocean view. 38-year-old robert knight, the third died at the hospital. police charged elisha hernandez and mondozer masters with second degree murder and attempted robbery. despite the arrests, people we talked did not feel better about their neighborhood. after he pleaded guilty to a federal weapons charge. a judge granted his attorney's request to withdraw from the case because of a conflict of interest. according to court documents, federal public defender represents another peron's interests that go against hadsell's. specifically this person could become a potential witness against hadsell if he is prosecuted in with a crime in his adoptive daughter's case. police found aj hadsell's remains last year, after she was missing for a few weeks. the fight between national security and your privacy is developing this morning. the justice department appealed a recent ruling that said apple could not be forced to help the government access a locked i-phone. the appeal is over a routine drug case in new york. the f-b-i says it also needs the company's to open the phone of the suspected san bernardino terrorist. a judge there ordered the company to create software to break into the encrypted phone. apple opposed the government's request. the government's response in that case is due

verizon will have to pay a hefty fine to the fcc for tracking customers' information. verizon must pay $1-point-4 million dollars for a program called supercookie. supercookie is an ad targeting technology that tracks which websites verizon customers visit, then delivers targeted ads to their devices. for a while, the company was implementing tracking technology without customer's knowledge and did not provide the option of opting out. the fcc now requires verzion to secure an explicit yes to opt into the technology going forward. a federal judge in oklahoma sentenced a former missonary 40 years in prison for sexually abusing children at an orphanage in kenya. 21 year old matthew lane durham sexually abusing orphans in nairobi between april and june 2014. the judge called these crimes disgusting and henious. a jury convicted durham in june of seven counts of abuse.

$55 million dollars in her lawsuit against the stalker who secretly recorded her in her hotel room, and the company that owned the hotel. :43-:57 erin andrews - girls... high school, college... they tweet me and they say i want to be erin andrews except for the marriott stalker thing. and i cant control that. after several days of testimony, the jury only took a few hours make their decision. andrews originally sued the nashville marriot hotel and michael barret for $75 million dollars for emotional distress after a video of her undressing in her hotel room went viral 8 years ago. michael barret, andrew's stalker has already served two-and half years in jail for admitting to recording and stalking ocassions. severe weather slammed parts of north texas late last night. in one town, residents think a tornado may have touched down.
