selection to begin in tracie hunters 2nd criminal trial, but what they got was a surprise announcement from the special prosecutor. scott---it is our duty seek justice here. to prosecute the remaining charges serves no useful purpose. we believe that the interest of justice has been served in this matter and we have decided to dismiss the remaining charges. scott croswell says he believes hunter would have been found guilty, but he says prosecuting her would be expensive and cause further conflict in the community, but say dismissal of the surprise since the first district court of appeals upheld hunter's conviction on having an in a public mike-----that gave the prosecutor what he needed to make sure that the so it would have been perhaps overkill at this point and too much of a fiscal burden proceed. like bishop bobby charges shouldn't the first place. the charges were

we believe judge hunter is simply not guilty of any charges and the one that they're holding on we believe she's innocent of that charge also. hunter's attorney's say they plan to appeal her conviction to the ohio supreme court, but judge norbert nadel, who presided over hunter's first trial, says that's a long shot. norbert----at least 90-percent of the cases that are appealed to the ohio supreme court don't get in so you can take the odds right there. close-----tracie hunter is expected to be back in this courtroom friday to learn if she'll have to begin serving her six month sentence immediately or if that sentence will be delayed once again. at the hamilton county courthouse i'm gordon graham fox19 now. she was convicted of killing her lawyer boyfriend after he was set to go on a date with a beauty contestant. but she says she deserves a new trial. we'll explain the reason why next. today marks

murderer shayna in court in august.. to get a new trial. hubers' attorneys are calling for a mis-trial after one of the jurors convicted felon! last year hubers was found guilty of killing her on- again-off-again boyfriend ryan poston, arguing self defense throughout the trial. today, the poston family issued a statement saying they stand by the original prosecution. the u-s marshals have arrested a man accused of raping a mentally disabled adult. you're looking at 35-year old diondre brandy who's charged with rape, felonious assault and gross imposition for an incident on wilder avenue in east price hill. brandy is now being held at the county justice center, and is due in court tomorrow morning. the chairman of the hamilton county g-o-p is calling for colerain township trustee greg insco to resign... for allegedly faking an endorsement! you're looking at

insco's twitter page. he's being accused of sending out these fake sample ballots that called him an officially endorsed republican. insco ended up winning the seat, but the party says they never endorsed him... leading to more than a dozen complaints from colerain township voters. we caught up with both sides to get their take on the claims. "you can clearly see on the ballot it doesn't say i'm endorsed. these guys have been threatening me for years and really it just comes down to i don't owe them any favors."
