new this morning... shayna hubers is asking a judge to set aside her conviction, declare a mistrial or order a new trial....after a mistake with the jury. huber is currently serving 40 years in prison for shooting her boyfriend in 2012. but a juror in the case says he mistakenly answered the jury questionaire wrong. the 53 year old bellevue man pleaded guilty in 1992 of falling behind in child support...which is a felony in kentucky. however, he says he had no idea that was a felony...and therefore filled out the form incorrectly. hubers lawyer says she deserves a mistrial, since felons are not allowed to serve

kara hplaz police are expected to begin their questioning today of the three california imates who escaped jail...but are now back in custody. new video this morning shows two of the escapees being brought back to jail. jonathan tieu two and hossein nayeri knee-air-ee were on the run for eight days before they were recaptured in san francisco. the third escapee- 43-year-old bac bach-do-ong turned himself in a day before...and confession helped police find the other men. the hunt came to a close when a tipster recognized the escapees van. a citizen saw someone, saw something suspicious, notified and officer and that notification ultimately led to the apprehension of two armed and dangerous suspects wanted - who escaped from jail. this failed escape attempt is unlikely to significantly affect the charges for the three men...since all were facing life in prison before the escape. developing now

investigating a major data breach of police officer's personal information. the national fraternal order of police says hackers got access to thousands of names and home addresses, of police officers. since becoming aware of the breach, the f-o-p say they've notified the department of justice cyber crime division. the f-o-p website and system has been taken down... and outside consultants are now working with internal personnel to get both safely back online. the f-o-p says it's not aware of any threats to officers or their families. happening today.. federal investigators are expected to release new evidence about an amtrak derailment in pennsylvania. the release of the evidence comes 8 months after the deadly incident. the national transportation safety board says this will be the first major development ... since it pinpointed excessive speed as a key factor. hospitals around the country are implement new surgery, after a bizarre incident in california. california state

coming together to help keep a retired police officer with his k-9 officer companion. the marietta police officer is retiring...but his k-9 partner isn't. and the dog will now go up for auction. the problem is...the dog is going for thousands of dollars. so the whole town is raising money, to purchase it for the officer.
