a.g. sally yates, who was fired just early on in the trump presidency. david chalian, let me start with you, our political director there. i think we noted the same thing. the fact from the sally yates testimony was that she told the white house that general flynn, nsa at that time was a russian blackmail risk and sean spicer kept referring to that warning as a simple heads-up. what did you make of that? >> yeah. that heads-up expression is what he had said back at the time. so he's trying not to change the characterization i think he used heads-up four or five times in the briefing today. it just is remarkably different than the tone and tenor we heard from sally yates yesterday who was discussing a sense of urgency to get over to the white house counsel, to say your national security adviser here at the white house is likely compromised by the russians. that may be interpreted, it sounds like if you listen to sean spicer, from the white house, as a political opponent or some partisan opponent who came over to give a casual heads-up about michael flynn.

the courts stopped it but, first, it was sally yates, the acting a.g. that stopped it. ban even though the department of justice, office of legal counsel said the ban was legal. so, yesterday, john kennedy, the senator from the great state of louisiana, a republican, asked her a very pointed question on how, look, the rule -- the lawyers at the department of justice said it was legal. and, yet, she said it was unconstitutional. so that led to this conversation between the two of them. >> at what point does the statute or an executive order become unconstitutional? is it some opriore determines? let me tell you what i'm getting at. and i don't mean any disrespect. who appointed you to the united states supreme court? >> i was appointed. >> that determined -- isn't ittn is that decides what's constitutional or not? in fact, aren't most acts of congress presumed to be constitutional? >> they are presumed but they are not always constitutional and no, of course, i was not on the supreme court and, i can tell you, senator, look, we really wrestled over this decision. i perso

sally yates is the deputy a.g., a career prosecutor. goes to the white house and she says, "we are worried that your sitting national security adviser is compromised byitize russia," and president trump immediately fires not general flynn. he fires sally yates. he isn't going to fire general flynn until a few weeks later. the facts of flynn's ties to russia and his lies to the vice president and the f.b.i. come out. and at that point, the trump team is forced to fire general flynn. attorney general session is caught misleading the senate judiciary committee about, of all things, his ties with russia. and then is forced to recuse himself from the investigation into russia, which is probably the most moment out ous investigation the justice department is doing right now. and today, jim comey, yesterday, gets fired as he's in the midst of this investigation. add to that, president trump's letter. the letter, one-pager, signed by president trump, has a very unusual sentence in it that sticks out like a sore thumb, like in such an obvious way
