good morning. >> reporter: good morning again, aaron. well, this case does indeed carry a second degree murder charge. that could carry from five to 40 years in jail for officer torres. he was let go from theers forc the 31st and in the interim the charges were brought by the special grand jury. it stems from the incident in august of 2013. there was a domestic call at john geer's home and it turned into a standoff of sorts with geer standing in his doorway. hands above his head for most of the time. a police negotiator had begun to talk to geer and about 40 seconds -- 40 minutes in to that exchange is when the gunshot was fired. officer torres said he saw geer make a move toward his waist band, but others had testified that geer's hands were indeed above his head. now a grand jury found that there was enough there to bring the second degree murder charge. now fairfax county has already agreed to pay $2.9 million to geer's daughters in a settlement of a wrongful death suit brought earlier. live outside fairfax county police headquarter,
